If a utility can remain in the highway right-of-way and there is not a conflict, we can also use an agreement that NDOT calls “Consent To Common Use”. This agreement identifies the company’s land right and replacement/relocation rights should it be needed for a future highway project. The company’s deed or other documentation that establishes the land right and a map or plan sheet that depicts the easement area is attached to the agreement as an exhibit. By State Statue we cannot acquire the easement for them. It has been proposed the DOT purchase the replacement easement on behalf of the utility during the DOT acquisition. This would eliminate the landowner being approached multiple times by the DOT and then utility companies. This may be considered during our legislative session.
