Article 1-Recognition
Section 1.0. Exclusive Bargaining Representative
Local 860 is the sole and exclusive representative of all Tier I and Tier II Assistant
School Building Custodians and Tier I Assistant Custodian Quadrant Rovers.
Section 1.1. Classified and Coded Printout of Bargaining - Unit Employee
Information
The Union will be provided two (2) computer printouts with bargaining unit employee
information twice a year.
Section 1.7. New Job Classifications
Whenever possible, work will be assigned to employees in job classifications in
existence when the work is to be performed.
Article 2 – Union Security
Section 2.0. Fair Share Fees
Section 2.1. Fair Share Fee to the Union
Section 2.2. Discharge for Failure to Pay Fair Share Fee to Union
Sections 2.0. through 2.2. provide for payment of a fair share fee.
Every employee which the Union represents is required to either be a member of the
Union or pay a fair share fee.
Section 2.3. Checkoff and Remittance
Authorized deductions will be deducted from pay monthly.
Section 2.4. Exclusive Checkoff
Union has exclusive right to have dues withheld.
Section 2.5. Indemnification
Union indemnifies the District from any action arising from deductions.

Article 3 – Right of the Union
Section 3.0. Right to Inspect and Audit the District’s Books
Upon reasonable request and during business hours, the Union has right to audit
District’s books to determine accuracy.
Section 3.1. Designation of Stewards/Release Time
Not more than three (3) stewards may be designated to be released from duty as need
arises for problems related to Assistant Custodians with permission from
Administration and notification to Custodian. Steward meetings may be conducted
during hours of employment upon request and approval of Facilities manager or higher.
Stewards on duty may attend without loss of pay.
Section 3.2. Leave For Conducting Union Business
Paid leaves of absence may be authorized for Union members elected or selected as an
Officer or Delegate.
Section 3.3. Use of District Facilities
Union business other than membership meetings may be conducted on school property
during working hours as long as there is no interference with scheduled work.
Permits shall be issued for Union meetings.
The District will be reimbursed for any additional wages/benefits incurred as a result of
such meetings.
Section 3.4. Use of Mails
The Union is authorized to use school mail for Union matters.
The Union is not authorized to use District computers for Union business other than to
distribute monthly newsletter.
Section 3.5. Use of Bulletin Boards
Person in charge at the work site may post notices concerning official Union business
on bulletin boards in District buildings.

Section 3.6. Full Time Union President
The Union President may be full-time released while maintaining full status as an
employee and all that that entails.
The Union will fully compensate the District for the Union President’s salary, overtime
and benefits if he/she is released.
Section 3.7. Participation On School Closing Committee
If a formal school closing committee is formed a union representative will have the
opportunity to serve on the committee and be given releases time if during work day.
Section 3.8. List of Newly Hired Assistants Provided to the Union
A list of new bargaining unit members hired during the previous month shall be given
to the Union on the first of each month.
Section 3.9. Seniority List
The Assistant Custodian/Assistant Custodian Quadrant Rover seniority list as of June
30, 2013, is attached to Appendix C for Article 7, Seniority and Job Bidding, purposes.
The list will be modified by agreement during the term of the contract.
Article 4 - Rights of Management
Except as specified otherwise in the Agreement, the District has the right and
responsibility to do the following:
1. Determine matters of inherent managerial policy which include, but are not
limited to areas of discretion or policy such as the functions and programs of the
school district, standards of services, its overall budget, utilization of technology,
and organizational structure;
2. Direct, supervise, evaluate, or hire employees;
3. Maintain and improve the efficiency and effectiveness of governmental
operations;
4. Determine the overall methods, process, means, or personnel by which
governmental operations are to be conducted;
5. Suspend, discipline, demote, or discharge for just cause, or lay off, transfer,
assign, schedule, promote, or retain employees;
6. Determine the adequacy of the work force;

7. Determine the overall mission of the school district as a unit of government;
8. Effectively manage the work force;
9. Take actions to carry out the mission of the school district as a governmental
unit.
The District has no obligation to bargain collectively with respect to the exercise of any
rights reserved to and retained by it in this Article, unless the exercise of such a
management right impacts upon the wages, hours or other terms and conditions of
employment of employees in this bargaining unit and bargaining is requested by the
Union.
