1. Gold Coast Labradoodles, Ltd. Transfers title, rights, privileges and responsibilities associated with the above-mentioned puppy as of _______________
2. Gold Coast Labradoodles, Ltd. Shall provide accurate and complete health record of puppy. This shall include record of all vaccinations, deworming and any other pertinent health information and conditions.
3. Buyer agrees to have a licensed veterinarian examine the puppy within 72 hours of taking the puppy home. If pursuant to the terms herein, the puppy is determined to have a chronic or serious health problem, he/she is to be returned to us immediately for either a refund of the purchase price of the puppy or a replacement puppy from the next available litter (Breeder’s discretion).
4. If a pre-existing minor condition (i.e. worms, ear mites, etc.) is found in the initial (first) exam, then Breeder will reimburse the amount charged by the veterinarian for the medications only. A detailed veterinarian’s receipt and proof of payment must be submitted to Breeder for reimbursement. Upon receipt the buyer will be reimbursed for paid medications only. Because of (false) positive results with the ELISA test a “positive” result will not be honored. Please ask your veterinarian to use another lab test.
5. Due to contagious illnesses, until all vaccinations have been administered the puppy should not be exposed to other animals and/or brought to any public places, including but not limited to pet stores or parks. During veterinarian visits, puppy should be carried into the office, and not placed on the waiting room floor or seats.
This warranty will be void if this condition is not met.
6. The Breeder guarantees the above-described puppy shall, for up to two years of age, remain free of life threatening inherited disease. In case that such disease should be diagnosed, written verification by two qualified veterinarians must be submitted to Breeder. If the dog is determined by The Orthopedic Foundation for Animals
(OFA) to have a hip score of moderately or severely dysplastic the Buyer must submit a copy of both x-ray and report to the breeder. OFA shall be the sole judge regarding hip score. The Canine Eye Registration Foundation
(CERF) shall be the sole judge regarding eye disease.
Buyer may return the puppy for a full refund (excluding deposit and shipping) or replacement when one comes available. Buyer understands that shipping expenses are Buyers responsibility.
Buyer may keep puppy and Breeder will reimburse veterinarian expenses up to purchase price of $3,000 less deposit. Veterinarian receipts must be submitted to breeder for reimbursement.
Breeder is not responsible for negative reaction to vaccination(s).
7. Buyer agrees that should the situation arise that Buyer must place the dog in a new home, Breeder will assist family in re-homing the dog in 1 of 2 ways: 1) website post, various doodle sites including rescue. Buyer will select the adoptive family and settle on a monetary exchange, if any. 2) If Breeder is able to board the dog during the rehome process buyer agrees to allow breeder to make the decision of both adoptive family and monetary exchange. A minimum of $300.00 will be deducted from proceeds to cover vet care and boarding. Buyer understands Breeder will use best efforts to obtain a reasonable price for the dog, but that Breeder does not guarantee obtaining the same price paid originally by the purchaser. Buyer understands that re-home dog most often sell for much less than a new puppy.
8. Under no circumstances shall the Breeder be liable to the Buyer or to any third party for a puppy/dog that has been subjected to abuse, accident, negligence or misuses. Buyer shall indemnify and hold Breeder harmless for injury to anyone or damage to any property, which may be caused directly or indirectly by the puppy/dog.
9. The guarantees set forth here shall be null and void upon any evidence of trauma, abuse or neglect to puppy. If dog is more than 25% overweight hips will not be warrantied. To exercise rights under the guarantees,
Purchaser must provide written proof that the puppy has received reasonable veterinary care and in some cases, reasonable training.
10. This guarantee applies to original buyer only. Upon transfer of ownership, this guarantee shall be come null and void.
1. Buyer agrees to provide puppy with adequate exercise and a safe environment. Buyer agrees that this puppy will not be an “outside dog” (living entirely outdoors).
2. Buyer agrees to provide a high quality food. Please read labels. You will be amazed at what you find by comparing dog foods.
3. Buyer agrees to provide human companionship. The Australian Labradoodle is a “people” dog who will want to be with you as much as possible.
4. Buyer agrees to provide adequate training and mental stimulation.
5. Buyer agrees to crate train for “training” purposes, but will not subject puppy to excess hours of confinement.
6. Buyer agrees to maintain this puppy/dog in good health, provide routine preventative health care. Veterinary
records must be provided to Breeder if requested.
7. Buyer has the right to return the puppy to the breeder during the first seven days after possession for credit in the amount of the purchase price toward the acquisition of another puppy from the breeder or for a refund of the purchase price less deposit and shipping.
8. Buyer agrees to provide an environment that is conducive to the avoidance of environmental causes of Hip
Dysphasia such as:
Not allowing your puppy to excessively use stairs until they are 1 year of age
Keep weight within normal limits
Avoid strenuous exercise such as jogging, long distance walking, agility training, or prolonged activities where your puppy has to jump to catch a ball or other toys until your puppy is a minimum of 1 year of age
1. Buyer agrees that the laws of the State of New York shall govern in the event of any dispute and/or litigation arising as a result of this agreement and/or the purchase of the puppy/dog.
2. In the event of any dispute and/or litigation arising as a result of this agreement and/or the purchase of the puppy/dog, Buyer agrees to venue/jurisdiction in the Supreme Court of the State of New York, County of Nassau.
Buyer waives any right to venue/jurisdiction of any other Court.
3. In the event of any dispute and/or litigation arising as a result of this agreement and/or the purchase of the puppy/dog, Breeder may, at its sole discretion, determine to remove the matter from litigation and proceed to arbitration or alternative dispute resolution with an arbitration/alternative dispute resolution company of its choosing.
4. In the event of any dispute and/or litigation arising as result of this agreement and/or the purchase of the puppy/dog, damages shall be capped at the purchase price less deposit.
5. This agreement remains in force and effect even if there are conflicts contained within its provision.
We the undersigned have read, understood, and agree with the terms of this contract.
