Subject:-
Revised Provisional Seniority List of Executive Engineer (Civil) in the General Wing of MCD in the pay Scale of Rs. 10000-15200/-
A final seniority list of EE(C) in the General Wing of MCD in the pay scale of Rs 3000-4500/-(Pre revised) was issued vide Circular No. F.8(38)/CED(II)/88/37/17111-56 dated
14.07.1995. In which the name of EE(C) appointed upto 12.08.1994 were mentioned upto seniority No. 42.
Thereafter, a final seniority list of Executive Engineer (C) in the General Wing of MCD in the pay scale of Rs.10,000-15,200/- was circulated vide Circular
No.F.8(38)/CED(II)/8/Pt.III/108/RK dated 02.06.2000 in accordance with the principle as laid down by the Hon’ble Supreme Court in the case of Ajit Singh Vs. State of Punjab & Others (IA
No. 1-3) in Civil appeal No. 3792-3794/1989.
Whileupon, the Govt. of India has amended Article 16(4A) of the constitution, right form the date of its inclusion in the Constitution i.e. 17.06.1995 with a view to allow the Govt.
servants belonging to SC/ST to retain the seniority in the case of Promotion by virtue of rule of reservation and O.M. NO. 20011/1/2001-Estt.(D) dated 21.01.2002 has been issued with the
direction that the seniority of Govt. servants determined in the light of OM dated 30.01.1997 shall be revised as if that OM was never issued. In the light of the aforesaid OM, the final
seniority list of Executive Engineer (Civil) issued vide Circular No. F.8(38)/CED(II)/8/Pt.III/108/RK dated 02.06.2000 was amended and a revised provisional seniority list of Executive
Engineer (Civil) in the pay scale of Rs.10,000-15,200/- was circulated vide Circular No. F.8(38)/CED(II)/88/Pt.III/RK-17 dated 14.03.2002.
Thereafter, UPSC convened a review DPC on 07.01.2008 of the Original DPC held in December-1996 and forwarded the revised panel of the Post of EE(C) vide their letter No.
F.1/30(9)/2007-AP-1 dated 09.01.2008. Accordingly, the order of seniority of certain officers has changed due to aforesaid review DPC.
Further, in compliance of judgment dated 22.03.2007 of Hon’ble High Court of Delhi in Contempt Petition No. 489/2007 in WP(C) No. 12134/2006 , titled as Anil Tyagi Vs. MCD &
Ors. and on the recommendations of Union Public Service Commission as contained in their letter No. F./30(7)/2007-AP-1 dated 22.08.2008, officiating promotion to the post of Executive
Engineer (Civil) has been granted to 20 Asstt. Engineers (C), on probation for a period of two years, subject to outcome of Court Case(s)/stay pending in the Court of law, notified vide
CED’s Office Order No. F.8(8)/CED-III/87/Pt.VI/2008/15/18191 dated 08.09.2008.
Now, therefore, in continuation of Revised Final Seniority List of EE(Civil) circulated vide Circular No. F.8(38)/CED(II)/88/37/17111-56 dated 14.07.1995, a provisional Seniority List
of Executive Engineer (Civil) appointed upto 08.09.2008 on regular basis is hereby circulated for information of the officers concerned. This seniority list is subject to outcome of the Court
Case(s)/stay, pending in the various Courts and/or any other court case(s), if any. Objections, if any, in this respect may be sent to the undersigned within 10 days from the date of issue,
failing which it will be presumed that there is no objection, and the seniority list so circulated herewith will be made final.
This issues with the approval of the Competent Authority.

Final Seniority List of Chief Engineer (Civil) in the General Wing of MCD in the pay Scale of Rs. 18400-22400/- & its
revised Rs. 37400-67000 + Grade Pay Rs. 10000/-.
The Provisional Seniority List of Chief Engineer (Civil) in the pay scale of Rs. 18,400-22400/- on regular basis was circulated vide Circular No.
F.8(28)/CED(II)/87/14/RK-36 dated 05.09.2008, for information of the officers concerned for inviting objections within 15 days from the date of issue, failing which
the same will be finalized as per rule.
After considering the objection(s), the abovesaid provisional seniority list of Chief Engineer (Civil), circulated on 05.09.2008, is hereby finalised and circulated
herewith for information of all concerned, subject to outcome of the Court Case(s), and/or any other Court Case(s)/Stay, pending in the various Courts.
Further, this seniority list is in continuation of the earlier seniority list of Chief Engineer (Civil) issued vide Circular No. F. 8(28)/CED(II)/87/12/4508-20 dated
16.02.1987.
This issues with the approval of the Competent Authority.
