Hold Harmless Agreement
Participation Tennis Lessons
This agreement entered into by and between the Cress Creek Commons Homeowners Association of
Naperville, Illinois (hereinafter referred to as the “Association”), and
, of
, Illinois, (herein after referred to as the “Tennis Instructor” and/or “Tennis
Student”) with respects to participation in a tennis lesson to be conducted within or upon Association
property in the vicinity of the Association’s Bathe and Racquet Club.
The parties hereto specifically acknowledge that the participation in the athletic organized event of
tennis lessons, as contemplated herein, either as an instructor or a student, is purely on a voluntary basis
and that the Association, by allowing the tennis lesson within the Association’s common areas, is not
assuming any liability for injuries sustained by the instructor or student while on the premises and/or
participating in the tennis lessons.
The undersigned expressly acknowledges that he/she will not be afforded insurance coverage/protection
by or through the Association, specifically as it may relate to personal or property damage liability,
under the provisions of any insurance policy owned/or applicable to the Association.
Further, the undersigned covenants not to sue and hereby agrees to indemnify and hold the Association
harmless from any and all claims, losses, damages and expenses, including court costs and attorney fees,
arising out of or in any way related to his or her participation in the organized athletic event of tennis
lessons.
