CONTRACT ST. JACOB HOMECOMING ASSOCIATION I, (Hereby referred to as VENDOR) DO HEREBY ENTER INTO A CONTRACT WITH THE ST. JACOB HOMECOMING ASSOCIATION (Hereby referred to as ASSOCIATION) TO PROVIDE FOOD SERVICES FOR THE 2010 HOMECOMING TO BE HELD ON FRIDAY, JULY 16 AND SATURDAY JULY 17, 2010. TERMS AND CONDITIONS ARTICLE 1 Payments 1.1 In exchange for the privilege of operating said concession stand during the designated time at the St. Jacob Homecoming, the VENDOR agrees to pay a $100.00 nonrefundable application fee to reserve a location. The St Jacob Homecoming will provide two standard 110 volt plugs. Additional plugs will be provided at a cost of $25.00 per night per plug. 1.2 The VENDOR also agrees to pay 20% (twenty percent) of the gross sales to the ASSOCIATION. 1.3 At the beginning of the Operating Time as stated in Article 4.1, a representative from the ASSOCIATION will count with a representative from the VENDOR the amount of start up cash at the VENDOR stand. Throughout the Operating Time a representative of the ASSOCIATION will collect excess cash over the start up amount and count this cash with a representative of the VENDOR and store this cash in the Treasurer’s Office of the ASSOCIATION. The VENDOR and ASSOCIATION will receive receipts at each collection time. At the close of Operating Time each evening, a representative of the VENDOR will report to the ASSOCIATION treasurer office and collect 80% of the funds received over the start up cash. Receipts between the VENDOR and the ASSOCIATION will be given at each exchange of cash. ARTICLE II Stand Requirements 2.1 VENDOR is responsible for the set up and tear down of his stand. Unless VENDOR’s booth is self-contained, all stands shall be confined to a 14 foot by 14 foot area, unless otherwise specified in Article VI. 2.2 The ASSOCIATION reserves the right to locate any and all stands, booths and trailers on the ASSOCIATION property. 2.3 The VENDOR is responsible for the erection of his stand. Any type of construction is permitted as long as it falls within the aforementioned space allocation. The VENDOR MUST supply his own materials. ST. JACOB HOMECOMING ASSOCIATION --- FOOD VENDOR CONTRACT – PAGE 1 OF 3 2.4 Stands may be erected any time, after the streets are closed off in the Homecoming Location, on Thursday, July 15 after 5:00 p.m. through Friday July 16 before 2:00 pm. ARTICLE III Clean Up 3.1 All stands shall be torn down by the VENDOR at the close of the St. Jacob Homecoming Saturday Night, Midnight, July 17. The Village of St. Jacob requests that the streets be open for traffic on Sunday morning. There will be a $100.00 per day fee for any stand, trailer, or storage facility that is not torn down and removed from the site by 10:00 a.m. Sunday. 3.2 All refuse will be placed in the provided dumpster(s) and the assigned site free of all debris. ARTICLE IV Operating Time 4.1 Stands will be open and operating from 5:00 pm to 12:00 am on Friday, July 16 and from 4:00 pm to 12:00 am on Saturday, July 17. The stand must be properly manned at all times. ARTICLE V Indemnification 5.1 To the fullest extent permitted by law, the VENDOR shall hold the ASSOCIATION and all of its members, harmless for any and all claims, damages and losses, expenses arising out of the St. Jacob Homecoming. 5.2 VENDOR also agrees to abide by the rules of the ASSOCIATION and the laws and local ordinances of the Village of St. Jacob, County of Madison and the State of Illinois. It is the responsibility of the VENDOR to obtain all Madison County Department of Health Licenses. 5.3 VENDOR also agrees to provide a certificate of insurance naming the St. Jacob Homecoming Association as the additional insured.
