(June 2008) GUIDELINES FOR POLICY 710.01: LIVE WORK: GENERAL 1. Guidelines a. Colleges must publish Live Work Policies. b. Colleges must recover all costs associated with live work. c. The total charges (cost plus a service charge) for live work will be cost plus 10 percent or cost plus 20 percent; in no case shall the total charge be less than $5.00 per project. d. The President shall have the option to charge either cost plus 10 percent for all work performed at the institution, cost plus 20 percent for all work performed at the institution, or the combination of cost plus 10 percent for internal work (work performed for students, faculty, and staff of the institution) and cost plus 20 percent for external work (work performed for those persons not connected directly with the institution). e. When a licensed training program such as cosmetology or barbering is operated, services may be provided to the public using a schedule of charges established by the President. f. In exceptional cases such as the construction of a public building or a charitable project, a reduced service charge for the indirect expense of live work projects may be applied provided the Chancellor or a designee concurs in writing. g. Colleges must establish and publish a timeframe for payment and pick up of completed live work projects. Any projects not paid for and picked up within the designated timeframe will become property of the college and normal surplus property procedures will apply. h. Each President will submit a report to the Chancellor’s office by September 30, documenting all live work projects performed during the prior academic year. Documentation will include: the specific project, duration of project, cost of the project, and person requesting the project. See Appendix A for form. i. Heavy equipment usage fee guidelines are provided so the institution may recover the operating costs normally associated with the operation of heavy equipment in construction live work projects. The usage fee charged to the customer helps pay operation and repair costs of heavy equipment. All other requirements for live work projects in Board Policies 710.01 through 710.03 also apply. 1. The heavy equipment usage fee requires: 1.1. The customer to (1) provide the heavy equipment for students’ use in the construction live work project or (2) pay an hourly usage fee for the use of (June 2008) institutional heavy equipment. The established hourly usage fee for each piece of institutional equipment is based on accepted accounting practices. 1.2. A standard written agreement for live work projects that includes who will provide each piece of heavy equipment and the hourly usage fee for each piece of institutional heavy equipment. 2. The heavy equipment usage fee is applied to recover heavy equipment costs for construction live work projects when the project: 2.1. Provides for the use of the heavy equipment by students. 2.2. Does not compete and does not have the appearance of competing with local construction companies. This condition is usually met when live work is performed for public, governmental, and nonprofit organizations. 3. The heavy equipment usage fee will include, but is not limited to an hourly usage fee rate for each piece of heavy equipment used in a project (for example, bulldozers, road graders, pans, etc.), any charge to the customer for the transport of students to and from the work site, and any charge for, on an actual cost basis, all fuel and fluids (engine oil, hydraulic oil, etc.) used directly for the project.
