LAW 163-3 OF THE REPUBLIC OF BELARUS of 20 July 2006 on amending and supplementing the Law of the Republic of Belarus „On ensuring the uniformity of measurements” Adopted by the Chamber of Representatives on 23 June 2006 Endorsed by the National Council on 30 June 2006 Article 1. To amend and supplement the Law of the Republic of Belarus of 5 September 1995 “On ensuring the uniformity of measurements” (Official Journal of the Supreme Council of the Republic of Belarus No 32, 1995, p. 420) as follows: „LAW OF THE REPUBLIC OF BELARUS on ensuring the uniformity of measurements The purpose of the present Law is to specify legal and organizational basis for ensuring the uniformity of measurements in the Republic of Belarus and protect the rights and legal interests of both citizens and the State from the effect due to wrong and incorrectly performed measurements. CHAPTER 1 GENERAL PROVISIONS Article 1. Basic terms and definitions For the purposes of this Law, the following basic terms and definitions apply: State metrological surveillance actions to verify the compliance of organisations, individual proprietors and individuals other than proprietors with the Belarusian legal metrological requirements; State register of national measurement standards of the Republic of Belarus information on national measurement standards provided by the State Committee for Standardization of the Republic of Belarus; State register of measuring instruments of the Republic of Belarus information on measuring instruments subject to type approval and issued type approvals provided by the State Committee for Standardization of the Republic of Belarus; Unit of measurement 1 particular quantity, defined and adopted by convention, with which other quantities of the same kind are compared in order to express their magnitudes relative to that quantity; Uniformity of measurements situation when measurement results are expressed in terms of units authorized in the Republic of Belarus and measurement accuracy is inside the prescribed limits with appropriate level of confidence; Measurement set of operations having the object of determining a value of quantity; Calibration part of metrological control which includes set of operations to determine metrological performance of measuring instruments by establishing, under specified conditions, the relationship between values of quantities indicated by a measuring instrument, and the corresponding values realized by standards; Method of measurement set of rules and procedures of performance of measurements which ensure that the accuracy of measurements is inside the prescribed limits with appropriate level of confidence; Metrological certification of measuring instruments part of metrological control which includes a set of operations to determine metrological performance of measuring instruments; Metrological service group of bodies and their parts linked from organizational and/or functional point of view or part of a body which shall ensure the uniformity of measurements; Metrological control set of operations to determine or verify metrological and technical performance of measuring instruments, to assess the conformity of measuring instruments and measurement methods with the legal metrological requirements of the Republic of Belarus and to determine the suitability of measurement methods for a stated use; Metrological validation of measurement methods part of metrological control which includes a set of operations to assess the conformity of measurement methods with the legal metrological requirements of the Republic of Belarus and to determine their suitability for a stated use; 2 National Metrological Institute body which is responsible to the State Committee for Standardization of the Republic of Belarus and assigned with the task to carry out fundamental and applied research studies in the field of metrology, to maintain and use national measurement standards as a means of ensuring traceability of measurements to the International System of Units, adopted by the General Conference on Weights and Measures and recommended by the International Organization of Legal Metrology (hereinafter referred to as the International System of Units) and to perform other tasks according to this Law; National measurement standard measurement standard approved to be used as the national measurement standard by the decision of the State Committee for Standardization of the Republic of Belarus; Ensuring the uniformity of measurements activities in order to establish and ensure the uniformity of measurements in accordance with the legal metrological requirements of the Republic of Belarus; Verification officer person employed by an organisation or individual proprietor or individual proprietor having sufficient competence to perform verification in accordance with the legal conformity assessment requirements of the Republic of Belarus; Verification part of metrological control which includes a set of operations to verify metrological performance and to assess the conformity of a measuring instrument with the legal metrological requirements of the Republic of Belarus; System for ensuring the uniformity of measurements in the Republic of Belarus set of activities including public regulation and administration, state metrological surveillance and metrological control which are performed by the state authorities, organisations, individual proprietors and individuals other than proprietors in order to ensure the uniformity of measurements; Measuring instrument device that is intended to be used for measurements, to reproduce and/or store a measurement unit and its multiples or subdivisions and maintains metrological performance which is assumed to be stable during a specified period of time; Scope of legal metrology 3 fields specified in this Law and other laws of the Republic of Belarus where the state regulation and administration or state metrological surveillance is required in order to ensure the uniformity of measurements; Type approval of measuring instruments part of metrological control which includes a set of operations where a measuring instrument is subjected to state testing in order to determine its metrological and technical performance, to assess conformity with the legal metrological requirements of the Republic of Belarus and to decide on its type approval; Pre-packaged goods consumer goods packed and enclosed without the buyer being present into pre-package of any kind in such a way that the content of product cannot be altered without the packing material either being opened or damaged; Measurement standard measuring instrument approved to be used as the measurement standard in accordance with the rules of the State Committee for Standardization of the Republic of Belarus; Article 2. Legislation of the Republic of Belarus on ensuring the uniformity of measurements The legislation of the Republic of Belarus on ensuring the uniformity of measurements is based on the Constitution of the Republic of Belarus and includes this Law, Decrees of the President of the Republic of Belarus and other relevant laws of the Republic of Belarus. If any international agreement applicable for the Republic of Belarus specifies provisions which are different from the corresponding provisions of this Law, the provisions of the international agreement shall prevail. Article 3. Basic principles of ensuring the uniformity of measurements Basic principles of ensuring the uniformity of measurements are as follows: - - predominant application of the International System of Units; use of national measurement standards; traceability of measurements to the International System of Units realized by national and/or international measurement standards; accessibility and availability of information in relation to the ensuring the uniformity of measurements with the exception of information which is considered to be confidential; harmonization of national and international requirements for ensuring the uniformity of measurements. Article 4. International cooperation in the field of ensuring the uniformity of measurements 4 The international cooperation in the field of ensuring the uniformity of measurements shall be realized in accordance with the legislation of the Republic of Belarus. The Republic of Belarus is properly represented in the international metrological community through the State Committee for Standardization acting as the National Metrological Body of the Republic of Belarus. CHAPTER 2 AUTHORITIES RESPONSIBLE FOR THE PUBLIC REGULATION AND ADMINISTRATION IN THE FIELD OF ENSURING THE UNIFORMITY OF MEASUREMENTS AND THEIR COMPETENCE Article 5. Authorities responsible for the public regulation and administration in the field of ensuring the uniformity of measurements Public regulation and administration in the field of ensuring the uniformity of measurements shall be managed by the President of the Republic of Belarus, Ministerial Council of the Republic of Belarus, State Committee for Standardization of the Republic of Belarus and other state authorities. Article 6. Responsibilities of the President of the Republic of Belarus in the field of ensuring the uniformity of measurements The President of the Republic of Belarus will define a uniform state policy and manage public regulation and administration of any other kind in accordance with the Constitution of the Republic of Belarus, this Law and other laws of the Republic of Belarus. Article 7. Responsibilities of the Ministerial Council of the Republic of Belarus in the field of ensuring the uniformity of measurements The Ministerial Council of the Republic of Belarus will: - - ensure the implementation of the uniform state policy; authorizes the measurement units in the Republic of Belarus; specify name, designation, ratio, notation and application of the measurement units as well as their multiples and subdivisions authorized in the Republic of Belarus; fulfil responsibilities of any other kind in accordance with the Constitution of the Republic of Belarus, Decrees of the President of the Republic of Belarus, this Law and other relevant laws of the Republic of Belarus. . Article 8. Responsibilities of the State Committee for Standardization of the Republic of Belarus in the field of ensuring the uniformity of measurements The State Committee for Standardization of the Republic of Belarus will: - implement the uniform state policy; 5 - - coordinate the realization of activities in the field of ensuring the uniformity of measurements of the Republic of Belarus; ensure the establishment and maintenance of the system of ensuring the uniformity of measurements of the Republic of Belarus; ensure the establishment and maintenance of the state metrological service; submit to the Ministerial Council of the Republic of Belarus proposals for authorization of measurement units in the Republic of Belarus; appoint one of the bodies under its authority which will act as the National Metrological Institute; establish requirements for national measurement standards and measurement standards and rules of their development, approval, maintaining and use; approve the national measurement standards and issue approval certificates for organisations that will maintain and use these measurement standards; maintain the state register of national measurement standards and state register of measuring instruments of the Republic of Belarus; organize and perform the state metrological surveillance; perform appropriate accreditation of bodies responsible for the state testing, metrological certification, verification and calibration; decide on the type approval of measuring instruments and issue type approvals for organisations and individual proprietors; define applications in legal metrology where measuring instruments are subject to verification by the state metrological service and endorse the list of these applications (hereinafter referred to as the List of applications in legal metrology); specify rules and procedures of application of type approval mark, verification mark and prepackaged product mark; ensure the recognition of national measurement standards by other countries; fulfil responsibilities of any other kind in accordance with this Law and other relevant laws of the Republic of Belarus. Article 9. Responsibilities of other state authorities in the field of ensuring the uniformity of measurements Whenever applicable, the other state authorities will: - contribute to the implementation of a uniform state policy; participate in the establishment and maintenance of the system of ensuring the uniformity of measurements of the Republic of Belarus; establish metrological services and endorse their regulations, if necessary; ensure the uniformity of measurements; arrange the development of measurement standards, measuring instruments and methods of measurement; specify appropriate range of measuring instruments used by the bodies under their authority; fulfil responsibilities of any other kind in accordance with the legislation of the Republic of Belarus. . CHAPTER 3 BASIS OF ENSURING THE UNIFORMITY OF MEASUREMENTS 6 Article 10. Measurement units In the Republic of Belarus the units of International System of Units and miscellaneous units authorized in the Republic of Belarus will apply. In international trade it may be possible to express characteristics and parameters of the exported goods in terms of units specified in the contract. Article 11. National measurement standards The national measurement standards provide a basis for establishing the values of measurement standards and realization of units and enable traceability of measurements to the International System of Units. In order to verify their metrological performance, the national measurement standards shall participate in comparisons with the international measurement standards or national measurement standards of the other countries. The national measurement standards are developed within the framework of State scientific and technical programs. The national measurement standards are maintained and used by the National Metrological Institute or by any other body in cases specified by the State Committee for Standardization of Republic of Belarus. The national measurement standards are registered in the State register of the Republic of Belarus. Article 12. Measurement standards Measurement standards provide a basis for establishing the values of other measurement standards and measuring instruments through verification or calibration and enable traceability of measurements to the national measurement standards. The measurement standards are maintained and used by organisations or individuals. Measurement standards used for verification of measuring instruments are subject to verification. Measurement standards used for calibration of measuring instruments are subject to calibration. Classification of measurement standards is specified by the State Committee for Standardization of the Republic of Belarus. Article 13. Measuring instruments Measuring instruments shall be calibrated in units authorized in the Republic of Belarus and shall enable traceability to the measurement standards. 7 The measuring instruments intended for use in legal metrology are subject to the type approval or metrological certification. The measuring instruments intended for use in legal metrology und type-approved are subject to verification or calibration. The measuring instruments intended for use in legal metrology und certified are subject to calibration. The measuring instruments intended for use in legal metrology and verified can be used for measurements specified in the List of applications in legal metrology. For measurements not specified therein, the measuring instruments can be used which are intended for use in legal metrology and passed verification or calibration. The measuring instruments intended for use in legal metrology cannot be offered for sale, used, released or hired unless verified or calibrated. For measurements outside of legal metrology the measuring instruments can be used which are intended for use outside or inside of legal metrology. The uniformity of measurements produced by the measuring instruments outside of legal metrology can be assured through verification or calibration or by any other means specified by the organisation, individual proprietor or individual user of the measuring instrument in question. Article 14. Measurements and measurement results The measurements are performed using measuring instruments. The measurements shall be performed using measuring instruments and measurement methods, if specified by the metrological legislation of the Republic of Belarus. The measurement results shall be expressed in units authorized in the Republic of Belarus. Article 15. Measurement methods Requirements for measurement methods in legal metrology and rules of development of such measurement methods are specified by the State Committee for Standardization of the Republic of Belarus. Measurement methods in legal metrology are subject to metrological validation. For measurements outside of legal metrology either validated methods or methods of any other kind can be used. Article 16. Scope of legal metrology The scope of legal metrology will apply to the measurements as follows: 8 - measurements performed in trade and transactions between buyer and seller; measurements performed for tax purposes; measurements performed for customs and banking purposes; measurements performed for life security purposes and health measurements state inspection and condition diagnostics of vehicles; safety of hazardous industrial locations, fire safety and radiation safety; measurements performed for geodesic and map-making purposes; hydrometeorological measurements; measurements involved in providing postal and telecommunication services; testing and monitoring of conformity of products and raw materials with the legal requirements of the Republic of Belarus; expert examinations; defence and public security; environmental protection; occupational safety; state metrological surveillance; metrological control; inspection of prepackages; veterinary measurements performed for laboratory and diagnostic purposes; manufacture and use of gaming and gambling machines; measurements of achievement in international and national sport events The scope of legal metrology can apply to other measurements if specified by the legislation of the Republic of Belarus. CHAPTER 4 METROLOGICAL SERVICES. MULTI-INDUSTRY COMMISSIONS IN THE FIELD OF ENSURING THE UNIFORMITY OF MEASUREMENTS Article 17. Types of metrological service In order to ensure the uniformity of measurements the state metrological service is established in the Republic of Belarus. The metrological services under the authority of governmental administration bodies, local bodies or specific organisations shall be established in cases specified by this Law. Article 18. State metrological service The state metrological service shall perform metrological control. The state metrological service is established by the State Committee for Standardization of the Republic of Belarus and includes the National Metrological Institute and other bodies which are responsible to the State Committee for Standardization of the Republic of Belarus and authorized to perform legal control in accordance with the present Law and other relevant laws of the Republic of Belarus. The regulations of the state metrological service shall be endorsed by the State Committee for Standardization of the Republic of Belarus. 9 Article 19. Multi-industry Commissions in the field of ensuring the uniformity of measurements The fields where the Multi-industry Commissions are established in the Republic of Belarus are as follows: - time, frequency and Earth rotation parameters; certified reference materials; referenced data on physical constants and properties of substances and materials. The Multi-industry Commissions shall coordinate the activities relating to issues which fall under their competence and, if necessary, elaborate proposals for these issues for the Ministerial Council of the Republic of Belarus. The regulations and membership of Multi-industry Commissions shall be endorsed by the Ministerial Council of the Republic of Belarus. CHAPTER 5 STATE METROLOGICAL SURVEILLANCE Article 20. Elements and procedure of the state metrological surveillance The state metrological surveillance shall be performed in legal metrology and apply to: - measurement units; measuring instruments; measurement methods; manufacture, repair, sale, release and hire of measuring instruments by organisations and individuals; state testing, metrological certification, verification and calibration of measuring instruments and metrological validation of measurement methods; quantity of product sold to the buyer packing and distribution of prepackaged goods other elements specified by the laws of the Republic of Belarus The state metrological surveillance is performed by the State Committee for Standardization of the Republic of Belarus. The responsibility for performing the state metrological surveillance is delegated to the authorized officials of the State Committee for Standardization of the Republic of Belarus acting as the state inspectors The Chairman of the State Committee for Standardization of the Republic of Belarus acts as the chief state inspector. The state metrological surveillance shall be performed in accordance with the procedure established by the Ministerial Council of the Republic of Belarus. 10 Article 21. Powers and responsibilities of the state inspectors in relation to the state metrological surveillance The state inspectors performing the state metrological surveillance are empowered to: - - - - monitor the compliance of organisations, individual proprietors and individuals other than proprietors with the legal metrological requirements of the Republic of Belarus; have free access to commercial premises and industrial establishments of organisations and individuals upon presentation of their credentials and in order to perform the state metrological surveillance; issue orders obliging organisations and individuals to eliminate any non-fulfilment of metrological legal requirements of the Republic of Belarus and removal orders with respect to any non-conforming measuring instrument; record the offences as required by the law of the Republic of Belarus. The chief state inspector of the Republic of Belarus in addition to the powers mentioned in the first paragraph of the present Article is empowered to issue orders banning companies and individuals from: - - running business in case of failure to make the commercial premises and industrial establishments accessible for the state inspectors or to show any documents, records, measuring instruments or pre-packaged goods when performing the state metrological surveillance; selling, releasing or hiring the measuring instruments in case of failure to comply with the legal metrological requirements of the Republic of Belarus; selling, pre-packaged goods in case of failure to comply with the requirements for quantity and/or labelling of the pre-packaged goods The chief state inspector of the Republic of Belarus and state inspectors in charge of performing the State metrological surveillance have further powers specified by the relevant laws of the Republic of Belarus. The state inspectors performing the state metrological surveillance shall comply with the legal requirements of the Republic of Belarus and shall have sufficient credentials and measuring instruments suitable for the surveillance purposes. The state inspectors in the discharge of their official duties act on behalf and are under protection of the government. CHAPTER 6 METROLOGICAL CONTROL Article 22. Structure and procedure of the metrological control The metrological control includes the following: Type approval of measuring instruments; Metrological certification of measuring instruments; 11 - Verification; Calibration; Validation of measurement methods. The procedure of the metrological control is specified by the State Committee for Standardization of the Republic of Belarus. Article 23. Type approval of measuring instruments The type approval procedure will apply to the measuring instruments which are intended for use in legal metrology and not type-approved. The measuring instruments mentioned in the first paragraph of the present Article shall be subjected to the state testing in order to determine their metrological and technical performance and assess conformity with the legal metrological requirements of the Republic of Belarus. The state tests of measuring instruments shall be performed under the contract by the body as part of the state metrological service and the results of state tests shall be given in a report. The results of the state tests provide a basis for the decision-making on type-approval. The decision on type-approval shall be made by the State Committee for Standardization of the Republic of Belarus and supported by issuing a type approval certificate. The measuring instruments which passed type-approval procedure shall be registered in the state register of the measuring instruments of the Republic of Belarus. The registered measuring instruments and/or operating instructions thereof shall bear a type approval mark. The information on type approvals shall be disseminated through the official publications of the State Committee for Standardization of the Republic of Belarus. Article 24. Metrological certification of measuring instruments The metrological certification will apply to the measuring instruments intended for use in legal metrology, made in or individually imported to the Republic of Belarus and will be further applicable for the cases specified by the President of the Republic of Belarus. Metrological certification shall be performed under the contract by the body as part of the state metrological service. The results of metrological certification shall be given in the corresponding certificate. Article 25. Verification The verification will apply to the new measuring instruments and measuring instruments which have undergone a repair, are in-service or imported to the Republic of Belarus. 12 The verification of measuring instruments intended for use or used for purposes specified in the List of applications in legal metrology shall be performed under the contract by the body as part of the state metrological service. The verification of measuring instruments intended for use or used for purposes not specified in the List of applications in legal metrology shall be performed under the contract by the body mentioned in the second paragraph of the present Article or by the body other than that mentioned above having sufficient accreditation. The time intervals between verifications of measuring instruments used in legal metrology shall be specified by the State Committee for Standardization of the Republic of Belarus. The verification of type-approved measuring instruments which are used outside of legal metrology shall be performed either by organisation or individual involved in manufacture, repair, sale, use, release or hire of measuring instruments or under the contract by organisation or individual other than that mentioned above. The time intervals between verifications of measuring instruments used outside of legal metrology shall be specified by organisation, individual proprietor or individual user of the measuring instrument in question. The verification shall be performed by verification officers. The verification officer shall certify the conformity of metrological performance with that established during the typeapproval procedure and specified in the state register of measuring instruments of the Republic of Belarus as well as conformity with the legal metrological requirements of the Republic of Belarus by affixing a verification mark on the measuring instrument and/or on the operating instructions thereof. The results of verification shall be given in the corresponding certificate. The measuring instruments subjected to verification and found to be non-conforming in relation to the metrological performance established during the type-approval procedure and specified in the state register of measuring instruments of the Republic of Belarus shall be rejected. The rejection statement shall be recorded. The use of non-conforming measuring instruments can be renewed after repair or subsequent verification or calibration. Article 26. Calibration The calibration will apply to the new measuring instruments and measuring instruments which have undergone a repair, are in-service or imported to the Republic of Belarus. The calibration of measuring instruments intended for use or used in legal metrology shall be performed under the contract by the body as part of the state metrological service or by the body other than that mentioned above having sufficient accreditation. The time intervals between calibrations of measuring instruments used in legal metrology shall be specified by the State Committee for Standardization of the Republic of Belarus. 13 The calibration of measuring instruments used outside of legal metrology shall be performed either by organisation or individual involved in manufacture, repair, sale, use, release or hire of measuring instruments or under the contract by organisation or individual other than that mentioned above. The time intervals between calibrations of measuring instruments used outside of legal metrology shall be specified by organisation, individual owner or individual user of the measuring instrument in question. The results of calibration shall be given in the corresponding calibration certificate. Article 27. Metrological validation of measurement methods Metrological validation of measurement methods shall be based on examination which may involve measurements. The purpose of examination is to establish if the scope of methods is appropriate for particular measurement requirements so as to confirm the fit-for-purpose of the methods. Methods for measurements intended for use in legal metrology shall be validated under the contract by organisation as part of the state metrological service. Methods for measurements used outside of legal metrology shall be validated either by organisation or individual user of the methods or under the contract by organisation or individual other than that mentioned above. The results of metrological validation shall be given in the certificate or statement regarding fit-for-purpose of the methods. CHAPTER 7 POWERS AND RESPONSIBILITIES OF ORGANISATIONS, INDIVIDUAL PROPRIETORS AND INDIVIDUALS OTHER THAN PROPRIETORS IN THE FIELD OF ENSURING THE UNIFORMITY OF MEASUREMENTS Article 28. Powers and responsibilities of bodies as part of the state metrological service The National Metrological institute is empowered to: - carry out fundamental and applied research studies; develop national measurement standards; ensure the comparison of national measurement standards with the international measurement standards or national measurement standards of other countries; ensure the recognition of national measurement standards by other countries; develop criteria for classification of devices as measuring instruments; perform contractual state testing, metrological certification, verification and calibration of measuring instruments and metrological validation of measurement methods and issue corresponding certificates, statements or reports; 14 - develop measurement methods; obtain the information relating to ensuring the uniformity of measurements as specified by the law of the Republic of Belarus, appeal against action of the state inspectors as specified by the law of the Republic of Belarus; perform any other activities in accordance with the relevant laws of the Republic of Belarus; The National Metrological institute is responsible to: - - - maintain and use national measurement standards; comply with the requirements of the metrological laws of the Republic of Belarus; seek for accreditation to perform the state testing, metrological certification, verification and calibration of measuring instruments; ensure the reliability of the results of state testing, metrological certification, verification and calibration of measuring instruments and metrological validation of measurement methods; provide access to the commercial premises and industrial establishments for state inspectors in the discharge of their duties, show documents, records and measuring instruments to the state inspectors performing the state metrological surveillance and enforce the prescriptions of the chief state inspector and state inspectors of the Republic of Belarus; fulfil responsibilities of any other kind in accordance with the relevant laws of the Republic of Belarus; The bodies other that mentioned above which are responsible to the State Committee for Standardization of the Republic of Belarus and assigned with the task to perform the metrological control in accordance with the present Law and other relevant metrological laws of the Republic of Belarus shall: - - have powers mentioned in the indentions from seventh to tenth of the first paragraph of the present Article and further powers in accordance with the relevant laws of the Republic of Belarus; fulfil responsibilities in the indentions from third to sixth of the second paragraph of the present Article and further responsibilities in accordance with the relevant laws of the Republic of Belarus; Article 29. Powers and responsibilities of other bodies in the field of ensuring the uniformity of measurements The other bodies shall have in addition to powers mentioned in the indentions from eighth to tenth of the first paragraph of the Article 28 of the present Law the powers to: - establish metrological services in order to ensure the uniformity of measurements and endorse their regulations; conclude contracts for state testing, metrological certification, verification and calibration of measuring instruments and metrological validation of methods with organisations and individuals authorized to perform the above activities according to the present Law; 15 - seek for accreditation to perform verification and/or calibration; perform verification, calibration, metrological validation of methods and issue corresponding certificates, statements or reports in cases specified by the present Law. The other bodies shall have in addition to responsibilities mentioned in the indention three and six of the second paragraph of the Article 28 of the present Law the responsibilities to: - ensure the uniformity of measurements used for manufacture of products, execution of work and providing of services; maintain a register of measuring instruments in use; ensure the reliability of results of verification, calibration and metrological validation of measurement methods; show pre-packaged goods to the state inspectors when performing the state metrological surveillance. The other bodies may have further powers and responsibilities in the field of ensuring the uniformity of measurements in accordance with the relevant laws of the Republic of Belarus. Article 30. Powers and responsibilities of individual proprietors and individuals other than proprietors in the field of ensuring the uniformity of measurements The individual proprietors shall have the powers mentioned in the indentions from eighth to tenth of the first paragraph of Article 28 and in the indentions three and five of the first paragraph of Article 29 of the present Law. The individual proprietors shall have the responsibilities mentioned in the indentions three and six of the second paragraph of Article 28 and in the indentions from two to five of the second paragraph of Article 29 of the present Law. The individual proprietors may have further powers and responsibilities in accordance with the relevant laws of the Republic of Belarus. The individuals other than proprietors shall be empowered to purchase, lease or hire verified or calibrated measuring instruments intended for use in legal metrology. The individuals other than proprietors shall use measuring instruments intended for legal metrology purposes in accordance with the legal metrological requirements of the Republic of Belarus. 16 CHAPTER 8 FINANCING OF ACTIVITES IN THE FIELD OF ENSURING THE UNIFORMITY OF MEASUREMENTS. PAYMENT OF THE METROLOGICAL CONTROL COSTS. Article 31. Financing of activities in the field of ensuring the uniformity of measurements The activities in the field of ensuring the uniformity of measurements are financed by public funding or by other funds not forbidden by the legislation of the Republic of Belarus. The activities relating to the development, purchase, maintenance, use and/or verification of national measurement standards and the state metrological surveillance activities shall be financed by public funding. Article 32. Payment of the metrological control costs Costs associated with the metrological control shall be paid under the contract by organisations, individual proprietors or individuals other than proprietors. The price of metrological control shall be set in accordance with the legislation of the Republic of Belarus and mentioned in the contract. “. Article 2. This Law comes into force eight months after its official publication with the exception of the present Article and Article 3 of this Law which will come into force from the date of official publication of this Law. If not otherwise specified by the Constitution the legislation of the Republic of Belarus shall be applied as far as it is in line with this Law until harmonized.
