Both parties subscribe to this educational cooperation agreement regulated by Royal Decree 1845/94, in which the student Mr/Ms ______________________, holder of Fiscal Identity nº ________, enrolled on the degree course __________________ at the Faculty mentioned above and resident at _______________________________, nº. _______, post code _________, telephone nº _______________. BACKGROUND 1. The Spanish Universities Act 6/2001 establishes in articles 2.2.d, 33.1 and 34.3 that the universities, in exercising their autonomy, may impart courses of their own design. 2. The Statutes of the University of Barcelona, approved by the Decree 113/1997, of 13 May, establish in articles 106 and 107 the possibility of imparting other courses, such as specific courses of social interest. 3. Royal Decree 1497/1981, of 19 June, modified by Royal Decree 1845/94, establishes the characteristics of educational cooperation agreements between universities and companies or institutions for in-company placement involving students enrolled at these universities. 4. The regulations for student placements in companies and institutions, approved by the Governing Board of the University of Barcelona on 16 July 2002. 5. Royal Decree 1497/1987, of 27 November, modified by Royal Decree 1267/1994, of 10 June, concerning the common general guidelines for the study plans of the official degree qualifications valid throughout Spain. Article 6.3 establishes that the study plans approved by the universities must specify the practical teaching involved. 6. The University of Barcelona expresses its wish to encourage first and second cycle students on any course taught by the university or by one of its affiliated centres to complete their education by participating in a placement program in a professional environment. 7. The aforementioned company/institution similarly recognizes the need for students to complete part of their education in a working environment of this kind. 8. Given the circumstances outlined above, we consider mutual cooperation to be of interest to both parties. TERMS OF AGREEMENT 1. The collaboration will take the form of a student placement program previously approved by the Study Council of the area of teaching party to this agreement. 2. The number of hours to be dedicated by each student to the company or institution is ______ hours (up to a maximum of 500 hours and five hours per day), to be completed between _______ and _________ and with the following timetable:___________. 3. The Study Council as appointed Mr/Ms _____________________________ as tutor of the student participating in this agreement. 4. The company or institution has appointed Mr/Ms _____________________________ as tutor of the student for the duration of the program in the company or institution, who shall be responsible for their training, induction, health and safety and also for the appropriate management of the educational activity provided for hereunder. 5. The company or institution will pay the student signing this agreement the sum of ____________, paid in the instalments it considers appropriate and in any case not after the end of the placement. In the sum to be paid the appropriate tax deductions for payments of this kind will be made. 6. In addition, the company or institution will pay __________€ to the University of Barcelona for its cooperation in the amortization of the placement program, in accordance with article 5, section 2 of the regulations. This amount will be billed by the University of Barcelona once the agreement is signed and will include VAT at the current rate. 7. All matters relating to the strictly academic evaluation of the students on the placement programs shall be the exclusive concern of the University. 8. The undertaking of the student placement program, once completed, shall not give rise to any obligations other than those agreed to hereunder and under no circumstances will it give rise to any obligations characteristic of a work contract between the students and the company or institution. 9. In the event of accident, the latter shall be covered by the terms of the compulsory educational insurance policy. Students must take out insurance if they have not done so on signing this present agreement. The insurance regulations provided for by labour law shall not apply given that this is not a work contract. 10. On completion of the program, the student may request a certificate from the company or institution attesting to the placement program undertaken with them. 11. This agreement shall terminate on completion of the student’s placement period. 12. Prior to this date, the agreement may be rescinded by either party on presentation of a written statement of termination. In pursuance thereof, the interested parties hereby sign this placement agreement, at the place and on the date stated below.
