when you go away on a long holiday or
work/study in a different city.
When subletting it’s important that you always have permission to do so
from your landlord or condominium association.
Your landlord can not deny you permission if you have a justifiable reason,
such as:
- Temporary studies or work in a different city
- Moving in with a partner during a trial period
- Military service
- Long hospital stay or other rehabilitation
If the apartment is a condominium you may also sublet for other reasons such
as buying an apartment to move into when you are retired.
The rent must be reasonable.
You are still ultimately responsible for the property during the lease.
The property must have a normal standard i.e. be habitable. It must also be
properly clean when your tenant moves in, as well as moving out.
If you are subletting your apartment for more than two years to the same
tenant you should fill in the form “Relinquishing the right of possession”.
When subletting a house or a condominium apartment where you are the
owner, there is no longer any right of possession unless you are renting out
several properties simultaneously. As such you don’t have to fill in the form for
relinquishing the right of possession for single leases of an owned property.
The property you sublet can be furnished or unfurnished and the leasing
period can vary from a month to several years.
