Restraint / Seclusion Updates & Reminders Fall, 2013 What is Restraint? • ‘Physical restraint’ means the restriction of a student's movement by one or more persons holding the student or applying physical pressure upon the student. ‘Physical restraint’ does not include the touching or holding of a student without the use of force for the purpose of directing the student or assisting the student in completing a task or activity; • ‘Seclusion’ means the involuntary confinement of a student alone in a room from which the student is physically prevented from leaving. ‘Seclusion’ does not include: The removal of a student for a short period of time to provide the student with an opportunity to regain self-control if the student is in a setting from which the student is not physically prevented from leaving. Use of Restraint Previous Regs • As part of a behavior support plan when other less restrictive interventions would not be effective and the student’s behavior poses a threat of imminent, serious, physical harm to the student or others. • The emergency use of reasonable physical force by a school administrator, teacher, school employee, or volunteer “as necessary to maintain order or to prevent a student from harming him/herself, other students, and school staff or property.” New Regs • When the student's behavior imposes a reasonable threat of imminent, serious bodily injury to the student or others; and, less restrictive interventions would not be effective. Reporting to Parents • Notify parents same day • For any restraint / seclusion lasting more than 30 mins, must attempt to notify parents immediately. • Invite parents to the debriefing meeting • Provide copy of the notes of the debriefing • Report the training status of staff who participated in the restraint Debriefing • • • • Must occur within 2 days of the incidents Invite parents Copy of notes provided to parents Required attendees; – All staff who were involved must attend – Administrator 30-minutes • Attempt to contact parents • Offer water and bathroom • Administrator must give written authorization to continue Forms • Use current forms only. • Third page only necessary for restraints lasting 30-mins or more. • One incident per form. • Copy to Cathy Jensen at DO. Training • • • • OIS 16 hours for the initial certification 8 hours for recertification every two years Review training at least once a year Troubleshooting • Belt-shirt: 10 seconds • Escorts: – To the nearest safe location (clear area, wall) – No further than about twenty feet – Never use stairs Planning • After 2 incidents, contact behavior team and review BSP. • After 5 incidents, review the IEP • BSP – based on an FBA – progress data – threshold for review • Parents provided a copy of the board policy.
