Evolution of Local-self Government in India 1. Municipal Bodies have a long history in India 2. First Municipal Corporation was constituted for Madras city in the year 1688 3. Later on, Municipal Corporations of Bombay and Calcutta were constituted in the year 1726 5 3. Constitution of Municipalities i. The Constitution of India (through 74th Amendment) provides for three types of municipalities with constitutional status a. A Nagar Panchayat for a transitional area, that is to say, an area in transition from rural to urban b. A Municipal Council for a smaller urban area c. A Municipal Corporation for a larger urban area 6 6 4. Composition of ULBs Criteria for fixation of strength : Population Strength of ULBs Nagar Panchayats / Municipalities :21 to 45 members Municipal Corporations :50 to 150 members MPs, MLAs, MLCs are Ex-officio members 10 8. Division of Nagarpanchayats & Municipalities into wards • Municipality / Nagarpanchayat divided into as many single member wards as the number of elected members. • Electoral Rolls: The electoral Roll for Assembly Constituency shall be adopted as Electoral Roll for the Municipality. 12 10. Election of Ward Members i. Voters in each ward elect a member ii. There is a provision of reservation a. SCs and STs: As per the proportion of the population of SCs and STs to the total population b. BCs: One-third of the total members. c. Women: one half of the total members including one half of the reserved for SCs, STs and BCs iii. Reservation is by rotation 13 11. Election of Chairperson i. All ward members elect one of its elected members as Chairperson. ii. Ex-officio members also participate. iii. There is provision for reservation. a. SCs and STs: As per the proportion of the population of SCs and STs in all municipalities to the total population in all municipalities b. BCs: One-third of the total number of Chairpersons in the State. c. Women: One half of the total number of Chairpersons including one half of the reserved for SCs, STs and BCs iv. Rotation in reservation. 14 12. Conduct of Elections i. State Election Commission supervises the conduct of municipal elections. ii. Commissioner & Director of Municipal Administration is the Election Authority (appointed by SEC). iii. District Collector is the District Election Authority (appointed by SEC). 15 13. Term of the Council Chairperson and Elected Councilors : Five years from the date of first meeting of the Council. 16 14. Elections on party basis The election to the office of Chairperson and ward members shall be conducted on party basis 17 15. Meetings of Municipal Council i. Council shall meet atleast once in every month ii. Agenda for the meeting shall be prepared by the Commissioner in consultation with Chairperson. iii. Minutes of the proceedings at each meeting shall be entered in minutes book and signed by the Chairperson. 18 16. Functions of Municipalities 1. Responsible to inspect places of entertainment to ensure that various statutory provisions are complied. 5. Chairperson, the Commissioner and not less than three and not more than seven Members chosen in this behalf by the Council – To settle tenders whose value Range from Rs.5,000 to Rs.75,000/- according to the Grade of the Municipality. 58 36. Government’s powers to Cancel or Suspend Council Resolution in the following Cases i. Not passed in accordance with law ii. In excess of the powers conferred under the Act. iii. Likely to cause financial loss to Municipality, danger to human life, health or safety iv. Likely to lead to riot or breach of peace v. Against public interest 59 37. Government’s Powers to remove Chairperson or Vice-Chairperson i. Willfully omits or refuses to carryout or disobeys the provisions of the Act.or any rules issued there under ii. Abuses his position or the powers vested in him Suspension of Chairperson or Member iii. Misbehavior, or manhandling any other Member or officer or employee of the Council or iv. Destruction of the property of Council v. Use of un-parliamentary language vi. Abuse of Position 60 38. Government’s Powers to dissolve the Council i. Council is persistently making default in performing the duties. ii. Council has abused its powers iii. A situation exists in which Municipal Administration can not be carried in accordance with the provisions of the Act. 61 39. Power to give Directions The Government are competent to give directions to the Municipalities for carrying out the provisions of the Act. 62 40. Role of District Collector in Municipal Administration i. Competent to suspend a resolution, order, licence, permission or act of Municipal authorities. ii. Competent to call for any document from Municipal Commissioner. iii. Powers of inspection of any work or immovable property. iv. In cases of emergency direct the execution of any work necessary for the safety of the public. 63 42. Responsibilities of Commissioner as per manual 1. Responsible for the due fulfillment of the purpose of A.P. Municipalities Act, 1965 2. To undertake outdoor inspection daily for a minimum period of 3 hours in the forenoon. 3. To carry into effect all the resolutions of the council. 4. Responsible for assessment of property tax and disposal of revision petitions filed for reduction of property tax. 64 Contd.. 5. To exercise all powers in relation to collection of taxes and fees, the licenses and the removal of encroachments 6. To be in charge of the municipality and ensure the municipal records are properly protected. 7. Supervision over maintenance of urban services. 8. Supervision over implementation of urban development schemes, urban poverty alleviation programmes, plan schemes etc. 65 Contd.. 9. Supervision and regular review of the activities of all sections. 10. To attend the meetings of the council, and where he is required to do so by the chairperson, of any of its committees. 11. Responsible for placing the budget before the municipal council before 15th November, of every year for approval. 12. The agenda for the meeting of the municipal council shall be prepared by the Commissioner in consultation with the Chairperson. 19. To inspect places of entertainment for the purpose of verification of the sale of tickets and to ensure that various statutory provisions are complied. 20. Powers relating to Finances & Loans 1. Competent to borrow from the Central or State Government. 2. Borrow from any person with the sanction of the Government. 8 9. Powers relating to Budget 1.
