West Virginia Military Authority (WVMA) NASMRM Break-out B Human Resource Position Compensation NASMRM Break-out B Human Resource Position Compensation WVMA • West Virginia Code §15-1J-1 “The West Virginia Military Authority Act.” • Preamble: “The Legislature finds that the West Virginia National Guard is a unique entity that has a duel mission for both West Virginia and the United States.” • “In this duel capacity, the West Virginia National Guard receives funds to administer programs, including the hiring of employees, which the federal government, including DOD, provides to the guard in support of specific activities for various federal agencies for national security and homeland security purposes.” NASMRM Break-out B Human Resource Position Compensation WVMA • WVMA was a legislative act which allowed the WV National Guard to create a new type of public employee – “Military Authority Employee”. • “Military Authority Employee” – Employees which are federally-reimbursed, either in part or whole, who work in and manage various National Guard and Homeland Security Programs, such as BASOPs, SRM, Challenge, Environmental, Physical Security, etc. NASMRM Break-out B Human Resource Position Compensation WVMA • Allowed the Adjutant General’s State Military Dept to overcome limitations placed on them at the State level for hiring new “State” employees to operate and maintain new programs. • Allowed the hiring of new employees without increasing the size of “State” government. Under the new State Code, the WVMA was established to administer national security, homeland security and “other militaryrelated programs.” – Payroll, Retirement and all applicable Benefits Carryover • At first, the WVMA was to be treated as a quasi-governmental agency, such as commission or board and would not be apart of the State accounting and payroll systems. • But after review, it was determined that the WVMA was not a quasigovernmental agency and could continue using that State systems. NASMRM Break-out B Human Resource Position Compensation WVMA • State Agency Hurdles: – Develop Agency Personnel Policies and Procedures Manual – Develop New Agency Positions and Job Descriptions • Permitted development of new job classifications that were closer in-line to each program’s position descriptions funded through NGB. • Permitted the TAG Personnel Director, whose mission it was to work with each Program Director who manages federally reimbursed employees, to create these new job classifications.
