“Skrill €1000 Question” Promotion Terms and Conditions (“Promotion Terms and Conditions”)
1. Introduction
1.1 PLEASE READ THESE PROMOTION TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING IN THE PROMOTION. BY PARTICIPATING IN THE
PROMOTION YOU WILL BE DEEMED TO HAVE ACCEPTED AND AGREED TO THESE PROMOTION TERMS AND CONDITIONS. AMONG OTHER THINGS, THESE
PROMOTION TERMS AND CONDITIONS INCLUDE LIMITATIONS OF YOUR RIGHTS AND REMEDIES.
1.2 If you are resident outside of the European Economic Area, this promotion (the “Promotion”) is brought to you (“you” or the “Participant”) by Skrill Limited,
a company registered in England, with company number 04260907, whose registered office is at 1st floor, 2 Gresham Street, London, EC2V 7AD, United
Kingdom authorised and regulated by the Financial Conduct Authority (FCA) under the Electronic Money Regulations 2011 for the issuing of electronic money.
1.3 If you are resident in the European Economic Area, this Promotion is brought to you by Paysafe Payment Solutions Limited, a company duly registered
under the laws of Ireland, under company number 626665, with its registered office at 3rd Floor, Kilmore House, Spencer Dock, Dublin 1 D01 YE64, Ireland.
Paysafe Payment Solutions Limited is authorised by the Central Bank of Ireland (“CBI”) as an electronic money institution under the European Communities
(Electronic Money) Regulations 2011.
1.4 For the purposes of these Promotion Terms and Conditions, Skrill Limited and Paysafe Payment Solutions Limited are both referred to as “Skrill”, “we” or
“us”. (Skrill is trading as Paysafe, NETELLER, Rapid Transfer, NETELLER Money Transfer and Skrill Money Transfer).
1.5 Except as otherwise expressly set forth herein, these Promotion Terms and Conditions shall be read together and interpreted in conjunction with the Skrill
Account Terms of Use. In the event of any conflict or inconsistency, these Promotion Terms and Conditions shall prevail (only to the extent of the conflict or
inconsistency).
1.6 Capitalised terms used but not defined in these Promotion Terms and Conditions shall have the meaning given in the Skrill Account Terms of Use.
2. The Promotion
2.1. From 1st March 2024 up until 25th March 2024, 23:59 GMT (the “Participation Period”) Skrill shall invite all Qualifying Participant via an invitation email
(“Invitation Email") sent to the primary email address registered to their Skrill Account to participate in the Promotion by completing a form (“Participation
Form”) in accordance with Clause 3 below where the Participating Customers shall have the opportunity to win the Prize as stipulated in Clause 4 below.
During a Prize Draw (“Prize Draw”) organised in accordance with Clause 6 below we shall randomly select the winning Participating Customer, as stipulated
in Clause 3 below.
3. How it Works
3.1. Qualifying Participants who wish to participate in the Promotion must complete the Participation Form during the Participation Period. Qualifying
Participants who have successfully completed the Participation Form shall be regarded as Participating Customers and Skrill shall give such Participating
Customer one (1) ticket (“Entry Ticket”) that would allow them to participate in the Prize Draw for the chance to win the Prize. Participating Customers
shall also have the opportunity to increase their chances to win the Prize by acquiring additional Entry Tickets. Participating Customers who wish to acquire
additional Entry Tickets must successfully complete Eligible Transactions. For each successfully completed Eligible Transactions` Skrill shall give the
Participating Customer one (1) additional Entry Ticket. Participating Customers are eligible to receive up to a maximum amount of ten (10) additional Entry
Tickets for a grand total of eleven (11) Entry Tickets during the Participation Period. For the avoidance of doubt, completion of Eligible Transactions after a
Participating Customer has already collected all eleven Entry Tickets shall not be considered. Further, submissions of the Participation Form and the
completion of Eligible Transactions after the expiration of the Participation Period shall not be considered as well. All Entry Tickets shall be included in the
Prize Pool as per Clause 3.2. below.
3.2. Skrill shall include all Participating Customers’ Tickets in a pool (“Prize Pool”) from which Skrill shall randomly select one (1) winning Participating
Customer during the Prize Draw in accordance with Clause 7 below.
4. The Prize
The Prize is a cash reward in the amount of EUR 1000 (payable in accordance with Clause 8 below);
5. Eligibility Criteria
5.1. This Promotion is available to Qualifying Participants and in accordance with the eligibility criteria set out below in this Clause 5.
In order to participate in the Promotion you must:
a)
have a registered account with Skrill in accordance with the Skrill Account Terms of Use (“Account”);
b)
have fully verified your Skrill Account in accordance with the Skrill’s verification requirements;
c)
not use your Account for commercial purposes;
d)
not be a service provider or a direct family member of a service provider to any of the Paysafe group companies;
e)
not reside or be located in any country that Skrill are prohibited from offering Accounts;
f)
not have your Account registered and used in any country where this Promotion and/or Prize Draw might be considered illegal and/or
prohibited;
5.2. The above mentioned are collectively referred to as the “Eligibility Criteria”. If you satisfy the Eligibility Criteria you are a “Qualifying Participant” for
the purposes of this Promotion. Skrill reserves the right to require Participants to provide evidence demonstrating that they meet any or all of the Eligibility
Criteria and may at its discretion disqualify any Participant if such evidence is not provided within a reasonable time stipulated by Skrill or if Skrill (acting
reasonably) is not satisfied that the Eligibility Criteria are met.

6. Eligible Transaction
6.1. Eligible Transactions are successful:

Send money transaction made from your Skrill Account to a Skrill Merchant in an amount no less than 20 EUR; and/or
Uploads to your Skrill Account in an amount no less than 20 EUR. Please note that, Participating Customers shall be eligible to receive only
one (1) Entry Ticket for making uploads to your Account during the Promotion Period. For the avoidance of doubt, the Entry Ticket shall be
given on the first successful upload to your Account in the stipulated minimum amount or more and any additional uploads of funds to your
Account during the Promotion Period shall not give you additional Entry Tickets.
6.2 The following transactions shall not be considered Eligible Transactions:

6.3. Skrill reserve the right to disregard any Eligible Transactions for this promotion that they, in their sole but reasonable discretion, deem an abuse of
the Promotion including but not limited to, transactions that have no commercial purpose, multiple transactions that are made to artificially increase the
volume of Eligible Transactions or transactions that are not for the personal benefit of the account holder.
7. Prize Draw
7.1 Subject to Clause 3.2. above, all Participating Customers shall automatically be included into the Prize Draw for the chance to win the Prize by entering
your unique Skrill Account identification number into a random number generator.
7.2 The Prize Draw shall take place on 28th March 2024 during which one (1) Winner (a “Winner” shall mean a Participating Customer who’s unique Skrill
Account identification number has been randomly drawn during the Prize Draw and as a result the Prize has been made available to the Winner) shall be
selected from the Prize Pool.
7.3. The Winner shall be notified by an email sent to the primary email address and a phone call from a Skrill representative registered to their Skrill Account
by 11th April and the Winner must claim their Prize by 18th April at the very latest by replying to the received email to claim the Prize and to follow any
further instructions from Us to receive your Prize.
7.4 Skrill does not accept any responsibility if you are not able to claim your Prize. If a Winner does not claim their Prize by 18th April, or if a Winner is
disqualified or unable to comply with these Promotion Terms and Conditions, Skrill reserves the right to revoke the Prize completely.
8. Payment of the Prize
8.1 The Prize shall be paid into the Winners’ Skrill Accounts only as a free issuance of electronic money in an amount equal to the respective Prize.
Alternative payment options (including but not limited to bank account transfers, P2P transactions, cash handouts and other) are generally not
acceptable and Skrill reserves the right to decline in Skrill’s sole discretion any such requests.
8.2 The Prize shall be made available as in-account credits within 60 days after the Winner has claimed their Prize in accordance with Clause 7.3. above
8.3 Skrill will make reasonable efforts to deposit the Prize into the respective Winners’ Skrill Accounts within the period as stipulated in clause 8.2.
hereinabove without further notice or request of respective Winner. However, Skrill reserves the right to extend the payment with a reasonable period
if in our sole discretion it is required to do so.
8.4 Payment of the Prize is only possible to active and non-restricted Skrill Accounts that are fully verified in accordance with Skrill’s verification
requirements and are not subject to any restrictions as stipulated in the Skrill Account Terms of Use. Skrill reserves the right to decline any payment of
the Prize including to revoke the Promotion completely regarding a Winner if in our sole discretion we suspect that an unauthorised or fraudulent use
of a Winner’s Skrill Account has occurred or that any of its security features have been compromised, or the Winner’s Skrill Account has been suspended,
or terminated, or closed. For the avoidance of doubt, if you close your Skrill Account, or if your Skrill Account has been suspended, and/or terminated
you shall not be eligible to receive the Prize.
9. Privacy and personal data
The following provisions apply to this Promotion:
a. The processing of participants data is governed by the Paysafe Group Limited Privacy Policy which can be found on Skrill’s website
(https://www.skrill.com/en/footer/privacypolicy/). Additional information may be required by Skrill to verify compliance with these Promotion Terms &
Conditions. Participants agree that certain of their personal information (first name, surname initial and country location) may be published on different
NETELLER channels including but not limited to emails, social media and online broadcast.
b. For the purposes of the Promotion participants grant Skrill and its affiliates a non-exclusive, worldwide, royalty-free, non-transferrable, irrevocable
license to copy, use and display any logo, trademark, trade name or other intellectual property (where applicable) which may be published on various
Paysafe Group marketing channels including but not limited to our websites, emails, and social media pages.
10. Confidentiality
10.1. Confidential Information means any information which is marked as “Confidential” or should be reasonably expected to be confidential having
regard tothe context of disclosure or the nature of the information; including, without prejudice to the generality of the foregoing, business plans, data,
strategies,methods, customer and client lists, technical specifications, transactional data and customer data shall be deemed confidential.
10.2. During the Promotion Period and thereafter, Skrill shall use and reproduce the participants’ Confidential Information only for purposes of this
Promotion and only to the extent necessary for such purpose and will restrict disclosure of the Confidential Information to its employees, consultants,
advisors or independent contractors with a need to know.
10.3. Notwithstanding the foregoing, it shall not be a breach of these Terms and Conditions for Skrill to disclose Confidential Information if required to do
so under law or in a judicial or governmental investigation or proceeding.
10.4. The confidentiality obligations shall not apply to information that (i) is or becomes public knowledge through no action or fault of Skrill; (ii) is known
to Skrill without restriction, prior to receipt from the Participant in relation to this Promotion, from its own independent sources as evidenced by Skrill’s
written records, and which was not acquired, directly or indirectly, from the Participant; (iii) Skrill receives from any third party reasonably known by Skrill
to have a legal right to transmit such information, and not under any obligation to keep such information confidential; or (iv) information independently
developed by Skrill’s employees or agents provided that Skrill can show that those same employees or agents had no access to the Confidential
Information received hereunder.
11. Miscellaneous
11.1. Skrill reserves the right to end this Promotion at any time in their sole discretion or to make changes to this Promotion at any time in its sole discretion
by sending written notice to the e-mail address registered to your Account or by amending these Promotion Terms and Conditions. NETELLER reserves
the right to modify, cancel, terminate or suspend the Promotion in whole or in part, at its sole discretion, if it believes the Promotion is not capable of
being conducted as specified within these Promotion Terms and Conditions or in the event of a virus, a computer bug or unauthorised human intervention
or any other cause that is beyond the reasonable control of Skrill that could corrupt or affect the administration, security, impartiality or normal course
of the Promotion.
11.2. Skrill reserves the right to remove participants from the Promotion where Skrill has reason to believe that Participants have:
a) breached or tried to breach these Promotion Terms and Conditions, the Skrill Account Terms of Use or VIP terms and conditions as applicable;
b) attempted to circumvent any security or operational procedures
11.4. All decisions by Skrill are final and binding and no further correspondence will be entered into.
11.5. Skrill are not responsible for any of the following:
a) incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with
orutilised in the Promotion;
b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware
orsoftware;
c) unauthorised human intervention in any part of the entry process or the Promotion;
d) technical or human error which may occur in the administration of the Promotion or the processing of entries;
e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Promotion
orreceipt or use or misuse of any cash prize.
11.6. Skrill will not in any circumstances be responsible or liable to compensate the participants or accept any liability for any loss, damage, personal injury
or death occurring as a result of the participant taking part in the Promotion except where it is caused by the negligence of Skrill or that of their employees.
Participant’s statutory rights are not affected.
11.7. Skrill shall not be liable for delay in performing, or failure to perform, any of its obligations under the Promotion Terms and Conditions, if such delay
or failure result from events, circumstances or causes beyond its reasonable control, such as but not limited to fire, flood, earthquake, adverse weather
conditions, strike, war (declared or undeclared), embargo, blockade, legal prohibition, governmental action, riot, insurrection, damage, destruction, flight
or other transportation delays or cancellations.
11.8. If you are resident outside of the European Economic Area, all issues and questions concerning the construction, validity, interpretation and
enforceability of the present Promotion Terms and Conditions, or the rights and obligations of the Participant and Skrill, as applicable, in connection with
this Promotion shall be governed by and construed in accordance with the laws of England, without giving effect to any choice of law or conflict of law
rules (whether of England or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than England.
11.9. If you are resident in the European Economic Area, all issues and questions concerning the construction, validity, interpretation and enforceability
of the present Promotion Terms and Conditions, or the rights and obligations of the Participant and Skrill, as applicable, in connection with this Promotion
shall be governed by and construed in accordance with the laws of Ireland, without giving effect to any choice of law or conflict of law rules (whether of
Ireland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Ireland.
11.10. If there is any discrepancy between any translated version and the original English version of these Promotion Terms and Conditions, the English
versionshall prevail.
11.11. To the extent permitted by law, Skrill, its agents or distributors will not in any circumstances be responsible or liable to compensate a Participant
or prospective Participant, or accept any liability (whether direct, indirect, special, incidental, exemplary, punitive or consequential) for or in connection
with the participation (or attempted participation) in the Promotion whether such liability arises from any claim based upon contract, warranty, tort
(including negligence), strict liability or otherwise. A Participant’s statutory rights are not affected. Nothing in these Promotion Terms and Conditions
excludes or limits in any way any liability for death or personal injury caused by Skrill’s negligence, for fraud or for any other matter where liability may
not as a matter of law be excluded or limited.
11.12. Skrill shall not be liable for delay in performing, or failure to perform, any of its obligations under these Promotion Terms and Conditions, if such
delay or failure result from events, circumstances or causes beyond its reasonable control, including but not limited to fire, flood, earthquake, adverse
weather conditions, strike, war (declared or undeclared), embargo, blockade, legal prohibition, governmental action, riot, insurrection, damage,
destruction, flight or other transportation delays or cancellations.
