Dear Courtesy Tow,
I am writing to inform you of my intent to pursue legal action against your company due to
an incident of unlawful towing involving my vehicle. However, before escalating this
matter to court, I would like to provide an opportunity for an amicable resolution.
According to California law AB 2210, various protections are in place for consumers
against illegal towing practices. For instance, a tow truck driver is required to release a
vehicle unconditionally if its owner is present while the tow truck is still on private
property. Furthermore, a towed vehicle cannot be taken to a storage lot located more
than ten miles from the point of origin. Additionally, charging excessive rates for towing
services or storage can result in the liable party being responsible for four times the
amount charged.
In my case, my car was towed, and the storage lot was located beyond the legally
allowed ten-mile radius. Moreover, I was not provided with any photograph evidencing
the alleged parking violation. As a result, I am demanding compensation totaling $7,000
for my time, pain, and suffering, as well as any excess fees associated with this incident.
To resolve this matter and avoid legal action, I request a check payable to my name at
the address listed above. Please note that this is my final attempt to reach an amicable
agreement before moving forward with a lawsuit. If I do not receive a response by May
17, 2023, I will be left with no choice but to pursue legal action. In the event of litigation, I
intend to seek full restitution as permitted by law, including additional damages, legal
costs, court fees, and accrued interest.
