Teacher Ethics & Conduct: Legal & Professional Standards

Sec. 1: A teacher is a facilitator of learning and of the development of the youth; he shall, therefore,
render the best service by providing an environment conducive to such learning and growth.
Example: Mark belongs to the (FL) fast learner class, after the second periodical examination he
overheard negative feedbacks from his classmates though it was an indirect confrontation. Apart from
his knowledge, the result of the said examination was posted on the school’s bulletin, later he found out
that he got the lowest grade. On that very day Mark decided to stop schooling. Thus, the teacher
practice ethical conduct towards student’s result.
First and foremost, the teacher is unethically violating principles of ethics in assessment states, test
results and assessment results are confidential results. Such should be known only by the student
concerned and the teacher. Results should be communicated to the students in such a way that other
students would not be in possession of information pertaining to any specific member of the class (De
Guzman-Santos, 2007).
As far as confidentiality of students’ records is concerned, the teacher violated Batas Pambansa bilang
232, Chapter II, Section 9, statement no.4 states, the right to access to his own school records, the
CONFIDENTIALTY of which the school shall maintain and preserve.
Section 3. Example: Mr. Ricky dela Cruz is one of the youngest teacher in Silab Community High School.
Due to his young age he has lots of friends and barkadas. After school hours, he is always seen with his
friends in an internet café playing Dota, in gambling dens, and in beerhouses. He also frequently seen in
discos during weekends.
Mr. Cruz is violating the Code of Ethics for Professional Teachers issued by the Board for Professional
Teachers through Resolution No. 435 series of 1997, provides in the PREAMBLE that “Teachers are duly
licensed professionals who possess dignity and reputation with high moral values as well as technical
and professional competence.”
Furthermore, the Code dictates that “Every teacher shall merit reasonable social recognition for which
purpose he shall behave with honor and dignity at all times and refrain from such activities as gambling,
smoking, drunkenness and other excesses, much less illicit relations,” and “A teacher shall maintain at all
times a dignified personality which could serve as model worthy of emulation by learners, peers, and
others.
Section 4: Every teacher shall live for and with the community and shall, therefore, study and
understand local customs and traditions in order to have sympathetic attitude, therefore, refrain from
disparaging the community. Study the following situations. A teacher shall maintain at all times a

Any violation of any provisions of this code shall be sufficient ground for the imposition against the
erring teacher of the disciplinary action consisting of revocation of his Certification of Registration and
License as a Professional Teacher, suspension from the practice of teaching profession, reprimand or

cancellation of his temporary/special permit under causes specified in Sec. Maximizing Learning
Competence.
Sec 5: It is the responsibility of the teachers to inform the community about the school’s work,
accomplishments, its needs and problems. Reporting of what the school can do, what the school has
achieved, and the future plans of the school are always integral to both the school administrative
functions and stakeholders in their participation of the so-called shared responsibility.
Since everyone in a community is a stakeholder in the local education system, every stakeholder plays a
different, significant role in supporting the education system.
For example, a stakeholder’s input and relationship with other stakeholders are important in the
planning, implementation and evaluation of, say, health promotion and education programs in schools.
Their personal perceptions and understanding can help motivate children in the school environment.

CHAPTER 2 Rights, Section 8. Rights of Parents – In addition to other rights under existing laws, all
parents who have children enrolled in a school have the following rights:
The right to organize by themselves and/or with teachers for the purpose of providing a forum for the
discussion of matters relating to the total school program, and for ensuring the full cooperation of
parents and teachers in the formulation and efficient implementation of such programs. Also, Section
10. Rights of all School Personnel – In addition to other rights provided for by law, the following rights
shall be enjoyed by all school personnel:
The right to free expression of opinion and suggestions, and to effective channels of communication with
appropriate academic and administrative bodies of the school or institution.
Sec 7. States; every teacher shall maintain harmonious and pleasant personal and official relations with
other professionals, with government officials, and with the people, individually or collectively.
Example: A story of public-school teachers: Teacher Maming’s son got sick and confined in a very
expensive hospital. Her last salary would no longer be enough to pay the hospital bills, so she decided to
owe money from her co-teacher, Mira. Months went by; teacher Maming was not yet able to pay her
borrowed money since his son was still on recovery. On her long wait, teacher Mira could no longer forgo
her debtor resulting of her scandalous act confronting teacher Maming inside her class.
So, both are facing violation against teacher’s obligations as reflected in Batas Pambansa bilang 232,
chapter 3, and section 16, statement no.4 states, a teacher shall assume the responsibility to maintain
and sustain his professional growth and advancement and maintain professionalism in his behaviour at
all times.
On the other hand, teacher Maming is also liable of violating Code of Ethics article X, section 2 states, a
teacher shall maintain a good reputation with respect to the financial matters such as in the settlement
of his debts and loans in arranging satisfactorily his private financial affairs.

Sec 8: Everyone has the right to his own beliefs with regard to religion, therefore, no one should coerce
or enforced any religiosity that will affect academic scores or performance.
The teacher can violate any provisions in the Magna Carta for Public School Teachers.
He violated these provisions if he will use his influence to coerce or to unlawfully hold the right to
religious freedom. But as long as his action aligned with the ethical standard of a teacher then he has no
violation of any provision thereof.
