ANALYSIS OF CASES OF RAPE INTRODUCTION: The offence of rape is one of the heinous crimes which is considered derogatory not only in our country but also in almost all the civilized nations. Before 1979 section 376 of Pakistan Penal Code was in vogue which was replaced with Hadood Ordinance 1979 in which where the person accused of zina bil jabr (rape) was penalized the woman was also penalized if the zina was found to be committed with consent of both. However, by the amendment introduced in 2006 through Protection of Woman Act, the element of consent was abrogated and only the offence of rape was kept as amounting to penalize the accused. This amendment give room to fake cases registered by women with the perspective of obtaining money from accused persons or there were some other issues also behind registration of such cases like property or matrimonial disputes etc. Upcoming is the analysis of 100 rape cases which have tentatively been selected to examine the motives, factors, reasons behind registration of such cases, the handling of these cases by police during investigation and submitting report for trial. Primarily, following questions have been addressed in this analysis:i. What are the motives and reasons behind rape incidents. ii. Whether recurrence of this crime is instinctual or due to other factors. iii. Whether the victim/complainant of these cases reports the incidents promptly to the police. iv. What are the relation between the victim and accused, victim and witnesses. v. What is the usual timings of these incidents at urban and rural places. vi. Whether the police, on receipt of information about such occurrences immediately registers the case. vii. Whether the medical of victim is got conducted immediately, the victim cooperates for conducting medical examination/DNA test. viii. Whether the medical officer hands over swabs etc immediately to police and the police send these to PFSA immediately. ix. Whether the accused is arrested immediately or his arrest is delayed. x. Whether the result from PFSA are received in time and challan is sent to court within prescribed time frame. 1 Besides, specific emphasis has been placed on the implication of innocent people in these occurrences by analyzing place, time, witnesses with their relation with the complainant/victim and relation of co-accused with the main culprit in order to identify frequency of these factors in identical incidents with the perspective to curtail registration of false rape cases and nomination of innocent persons in it. Furthermore, the loopholes in investigation have also been analyzed so that these may be overcome in future investigations to ensure penalization of actual culprits. In this analysis cases registered at the rural and urban police stations have been included so that a real picture of this crime may come forward. Bahawalpur district has maximum rape cases committed outside home especially in rural areas. The tendency of committed rape crime is very low in urban areas compared to rural areas. The result shows in the majority of rape cases 47 % committed in the time of 06 PM to 12 AM in the night throughout the region. In addition 24 % occurrences were committed on the day at the time of 12 PM to 06 PM in region. The result showed Bahawalpur district had been leading in rape crime 59 % time occurred at the time of 06 Pm to 12 AM in the night. On the other hand the rape crime in district Rahimyar Khan 36 % cases were committed at 2 the day. Through the cross tabulation express result majority of the rape crimes were committed in night time overall. On the other hand tendency of rape crime is very low on the day time as compared to the night. Some reason directly influence on the late registratio of FIR, in majority of case the delay of lodging FIR from victim himself involved 27 % overall. In addition the result showed that 27 % cases were registered within time. In district Rahimyar Khan maximum cases were registered within time 60 % as compared to other areas. Initially in few of the cases late lodging FIR was due to the process of reconciliation. The assumed result of the late lodging of FIR is so high in district Bahawalnagar 28%. The causes of late lodging of FIR from victim side is high 41 % in district Bahawalpur and Rahimyar Khan 28 % are more than district Bahawalnagar 21 % while the rate of late lodging of FIR on the court order was high in district Bahawalnagar 33 % as compared to the other both districts. Almost two third 61% cases committed for the rape purpose in district Rahimyar Khan was high than other districts Bahawalpur 24 % and Bahawalnagar 30%. On the other hand, the revealed results 37 % rape crime occurred for the purpose of illegal gains in district 3 Bahawalnagar and other than Bahawalpur 35 %. In some cases the rape crime occurred for evil intention in Bahawalpur district the tendency of the rape crime for evil intention was high 29 % cases but the ratio of other district was low as compared to it. Some of the other initial factors and information had come out in early enquiry of occurrences the old relationship of the male and female was very low as same to the few of cases were occurred for the civil disputes overall in three districts. The overall explored results show the tendency of rape crime occurred for rape purpose was high 38 % and 28 % for the illegal gains. The results reveal that the tendency of rape crime was high 69 % 4 during the age of 10 to 25 years and similarly one forth 29% crime occurred during the age of adulthood in region overall. In addition, the ratio of rape crime was high 74 % during the age of adolescent in district Bahawalnagar and results of other both districts was overall same 67%. In the age of adulthood, the ratio of rape crime moderately occurred 33 % in district Bahawalnagar but the ratio of other both districts was low as compared to it. The results in cross tabulation explored the marital status of victim were affected on the committing of rape crime in which the unmarried women near the age of 10 to 25 years highly victimized in the hand of accused 86% in district Bahawalpur other than both districts Bahawalnagar and Rahimyar Khan had low occurrence rate 70% and 67% respectively. One forth 32% married women victimized in district Rahimyar Khan but the other both districts had low tendency of rape crime against married women. The mentioned results in this table showed 74 % victims were unmarried near to the age of 10 to 25 year was so high in overall region in addition 26 % victims were victimized when they were married near the age of adulthood. The overall results showed that the unmarried women were highly victimized as compared to the married women. The attained results presented 53% overall cases considered on the relationship between victim and witness respectively. Similarly, in 51% cases were not found any relationship between the witness and victim. There is no much variation between the witness and victim relationship overall in region. The relationship between the victim and witnesses was so high in district Rahimyar Khan 73 % rather than both districts Bahawalpur 55% and Bahawalnagar 21%. In addition, the rate of non relative among the witness and victim were higher in district Bahawalnagar as compared to the other two districts 79%. The majority of accused were non jobian respectively in rape crime was high in district Bahawalpur 88% other than Bahawalnagar 82% and Rahimyar Khan 51%. The results showed the tendency of non jobian accused is high as compared to the jobian. The revealed results of the relationship between victim and accused all over three districts was high Bahawalnagar 85% other both districts have same results 70%. The overall result showed the tendency of non relative and non jobian accused were high as compared to relative and jobian accused in the overall region. The figure of the male main accused was high 105 that represents the overall region. In addition, only 72 in number male and female 8 co accused committed help in rape crime. The result showed Bahawalpur district had been leading in number of main accused 40 Bahawalnagar 35 and Rahimyar Khan 30 were main accused as part of 100 rape cases. In the sense of male and female co accused the frequency of district Bahawalpur was high 34, Bahawalnagar 27 and lowest in Rahimyar Khan 11. The overall results revealed main male accused was higher in number as compared to the co accused both male and female. The results showed the figure of non arrested accused were higher than the arrested accused. In the region only 35 main accused were arrested out of 105 and on 08 co accused were arrested out of 80. In addition, the number of non arrested main and co accused is 30 and 38 respectively were higher in district Bahawalpur. Overall results show 58% accused absconded due to which police failed to arrest them. In addition, 29% occurrence were doubtful that is cause of non arrest of accused and some accused were on immediate bail. The tendency of absconding of accused in district Bahawalnagar was high 61 % other than Bahawalpur 59 and Rahimyar Khan 54 % accused absconders. One forth 32 % occurrences were being doubtful in district Bahawalnagar, 34% in Rahimyar Khan and 32% in district Bahawalpur. In the majority of rape case maximum accused were being absconder and its oppose some occurrences being doubtful these are the huge cause of non arrest of accused. In addition, in the causes of non arresting accused absconder towards the police immediately bail of accused was also hindrance in arresting the accused but its ratio is less than from others. The overall results revealed that in the early ten days police were arresting the maximum accused 43% in addition, 34% accused were arrested in the gap of 10 to 20 days overall. Initial action taken by the Bahawalpur police was so high. 53% arresting the accused under early 10 days and other districts has less tendency rate of arresting accused. After that gape of 20 days of arresting the accused Rahimyar khan district had been leading 48% as compare to other both districts. There are overall results mentioned in this table indicated almost 79 % cases were registered through the undue favour or respect like “Sufarish culture” and political interference in the lodging of FIR. Trend of undue favour is seen high. 88% in both districts Bahawalpur and Rahimyar Khan but Bahawalnagar district has low undue favour 61%. The tendency of reported cases on the order of the court 33% in district Bahawalnagar but ratio of the other both districts was low as compared to it. The results disclose that in majority of occurrences maximum visits are conducted by ASIs 51% overall. In addition, only 23% SIs visited the place of occurrences and SHOs have 14%, while the SDPOs only 12% overall in region. Similarly, as seem on the districts Rahimyar Khan and Bahawalnagar has been leading 61% and 58% ASIs visiting the place of occurrences in regard to rape cases. In addition, the tendency of visit by the SI was high in district Bahawalnagar 36% as compared to other both districts. In respect of crime the police official SHOs and SDPO traditionally visit place of occurrences on the minor basis. Overall result showed 75% cases photography was not conducted and in only 25% cases photography was conducted to preserve the evidence. In respect of the revealed results only in 33% cases in district Bahawalnagar photography was conducted but other both districts have less tendency of conducting photography. The founded results represent all over 03 districts clearly show that majority of the cases 82% in district Bahawalpur and 76% in district Rahimyar Khan photography was not conducted. Overall more than one forth cases the evidence being preserved like blood, semen, cloth, leaves etc in district Bahawalnagar and Rahimyar Khan in 18% cases evidence were preserved. All results present the tendency of none availability of evidence was so high as compared to the ratio preserved evidences in overall region. Table No.14 presents the results of the initial enquiry of the occurrences whereby the police official took some steps to preserve evidence in rape crimes. The revealed results showed that in 51 % cases overall phone numbers have not been obtained by the police according to the presentation of the given results only in 60% cases phone number were taken in district Bahawalnagar. One third 63% was high in district Bahawalnagar of not getting the phone number from accused and victim. Similarly the overall results 9 express there is no any case in the region where the police official took the data of accused or victim. In addition, according to the results the tendency of getting data was very low overall 100% results revealed that there is not any case found in which the data was obtained by the police. The result showed 70% cases medical of the victim was conducted. In only 30 % medical was not conducted in respect of rape crime. The conducting of medical of victim, district Bahawalnagar was very high 100% as compared to the other districts Rahimyar Khan 67% and Bahawalpur district 45%. With regard to non conducting of medical district Bahawalpur has been leading with 55 % and Rahimyar Khan with 33%. In the light of the mentioned result showed that the tendency of conducting medical was high as compared to not conducting medical of victim of rape crime overall in region. In the situation of non conducting medical of the victim role of victim was high 57% as compared to that of police 43%. The result showed that the majority of cases delay had come from the police side in district Rahimyar Khan 55% other than district Bahawalpur 37%. On the other hand delay on victim side maximum in Bahawalpur district 63% and in Rahimyar Khan 45%. The results from all over three districts showed that in majority of cases the potency test was not conducted. Overall in 81% cases the potency test was not conducted in Bahawalpur region. On the other hand in Bahawalpur district the potency test of the accused was conducted 24% while other both districts have lower ratio of conducting potency test in rape crime. On the other hand in district Rahimyar Khan seems 88% cases was very high rate of potency test not conducted in comparison to the Bahawalpur 70% and Bahawalnagar 79%. In which explored results that the maximum cases age of accused was not got determined 64% only in 30% overall cases the age of victim and accused was got determined through the medical officer. The indicated result showed district Bahawalnagar has been leading 55% in determining age of accused and victim from medical officer on the other hand district Bahawalpur in 80% cases ages of accused and victim were not determined other than other both district Rahimyar Khan 67% and Bahawalnagar 45%. The overall mentioned results showed that in maximum cases ages of victim and accused were not determined. The results mentioned in this table emphasis on the ages of victims determined through the medical officers. One third in 75% cases ages of victim were between 10 to 20. In addition, in 17% cases ages of victim remained 21 to 30 years and in only 02% cases the ages were between 31 to 40 years. In district Bahawalpur victims of 10 to 20 years were maximum 86 % as compared to district Bahawalnagar 78% and district Rahimyar Khan 64%. On the other hand ages of victims between 21 to 30 years were high district Rahimyar Khan 18% in district Bahawalnagar 17% and lowest in district Bahawalpur 14%. The main reason for non conducting of DNA test in was non arrest of accused 100% in district Rahimyar, 93% in district Bahawalpur and 91% in district Bahawalnagar. The other reason for non conducting of DNA test was non willingness of victim which remained 9% in district Bahawalnagar and only 7% in district Bahawalpur. The overall results show that the reason non arrest of accused was very high 95% on the other non willingness of victim was lowest 5% in the region.
