Factors considered in infringement:
1. Strength
2. Degree of logo similarity
3. Proximity of products (in marketplace)
4. Quality of product, services
5. Good faith
6. Likelihood of confusion of the mind of the consumer.
Defining FBS
 “Moron in a hurry” standard (i.e., only a moron could be confused)
 “Mind share” (consumer awareness)

- Protect it or lose it
 Generic trademarks (becoming too popular)
