Introduction – Page 5 1. Introduction Det Norske Veritas (DNV) has been appointed by the UK Maritime and Coastguard Agency (MCA) as one of the Nominated Bodies (NB) authorised to undertake type approval of Marine Equipment. This delegation is provided to DNV’s British Committee under the UK Statutory Instrument (1996) No. 147. This came into effect on the 1st March 1996. The details of the scheme are provided in the Merchant Shipping Notice No. MSN 1735 (M+F) Amendments No. 4 and Amendment No.4 CORRECTION. This certification note is provided to describe the system and its operation within DNV’s Certification Services. DNV provides its own type approval of equipment. This service is described in the Certification Note No. 1.2 - Type Approval. Type Approval The world-wide experience in safeguarding quality is laid down in internationally recognised standards, such as ISO/IEC Guides for third-party certification, and the European Standards presently being developed for the EEA countries (EU and EFTA countries). These standards, together with rules and experience of Det Norske Veritas, form the basis of Det Norske Veritas’ Certification Services. 1.1 Background for DNV’s MCA type approval In accordance with its international and national responsibilities, stemming in part from the International Convention for the Safety of Life at Sea (SOLAS), the Maritime and Coastguard Agency (MCA) and its forebears have for many years undertaken the “type approval” of marine equipment, mainly of a safety or pollution prevention nature, for use on board United Kingdom ships. To gain such type approval a prototype which is representative of the build standard of the equipment is subjected to a technical appraisal of its design, examined and tested, and if found satisfactory, a type approval certificate is issued. The advantage of the type approval process is that a manufacturer is thus assured that the equipment will be accepted without detailed examination of each individual item during the ship’s routine surveys and the shipowner can purchase such equipment with similar assurance. 1.2 Equipment subject to type approval Equipment subject to type approval is listed in the annex to MSN 1735 (M+F) Amendments No. 4 and Amendment No. 4 CORRECTION and Appendix B. It should be noted that type approval of Navigation Equipment and Radio Equipment have been delegated to the UK Defence Research Agency only. For equipment not listed but which requires type approval, manufacturers are advised to contact the MCA. Note: After the EU Directive on Marine Equipment became mandatory (1999-01-01), the Conformity Assessment Procedures specified in said directive have to be followed. Type Approval Principles 2.1 Choice of manufacturer seeking type approval In recent years there has been significant development of specifications and testing requirements for many items of equipment which should ensure that equipment is manufactured to consistent and satisfactory standards. It has been decided therefore that new arrangements should be made to widen the choice of manufacturers seeking approval of their equipment with anticipated savings in costs. It should be noted however that where equipment is of a novel nature, or subject to significant design changes, or the specifications or testing requirements are not considered to be sufficiently developed or experience of their usage is limited, the MCA will undertake the necessary approval procedure. Enquiries for this type of equipment should be referred to MCA. 2.2 DNV as nominated body (NB) Procedures have been agreed between MCA and DNV. DNV “persons” (as referred to in the Merchant Shipping (Delegation of Type Approval) Regulations 1996) and hereinafter referred to as Nominated Body DET NORSKE VERITAS AS Standard for Certification - No. 2.12, October 2011 Page 6 – Sec.3. How to Obtain a Type Approval (NB) may undertake the examination, testing and certification of the equipment listed in the annex for which type approval is normally appropriate. 2.3 Scope of Service 2.3.1 Type approval applies to a wide range of systems, products and materials. Type approval may be a selfcontained, independent service or an element in the product certification process. 2.3.2 The scope is to assess systems, products and materials to conformity with standards and specifications. 2.3.3 The Type approval consists of the following four elements: Design assessment to verify that the design of a system, product or material conforms to a given standard and specifications. Type testing to verify that a system, product or material has the ability to meet specified test requirements. Initial TA Survey An initial TA survey shall be carried out in order to confirm that the manufacturer has a production line and quality control for consistent production of the products for which TA is requested. Certificate retention survey to verify that the conditions stated when the certificate was issued, are complied with at any time during the validity of the certificate. Each of these elements is described in detail in clause 4 of this Note. Type testing may be waived for certain products and materials that cannot be subjected to a realistic test. 2.4 Type approval to latest standards Equipment for new ships or for fitting on board existing ships, where required to be type approved, should be type approved to the latest standards. 3. How to Obtain a Type Approval 3.1 Application for type approval 3.1.1 The type approval should be applied for in writing to any office of DNV. Application forms can be obtained from a local DNV Station. 3.1.2 A manufacturer or person wishing to gain type approval of equipment for use on UK ships should submit an application to DNV. The application should include: — the name and address of the manufacturer and, if the application is lodged by an authorised representative, his name and address — a written declaration that the same or a similar application has not been lodged with another NB — the technical documentation and test requirements as stated in Specification Sheets for each product as given in MSA 1735 (M+F) Amendment No. 4 and Amendment No. 4 CORRESTION — the applicant is to place at the disposal of DNV sufficient specimens representative of the production envisaged. DNV may request further specimens if needed for carrying out the test programme. 3.2 Quotation 3.2.1 A quotation for type approval may be obtained on request and by submitting information on: — — — — — system/product/material to be type approved field of application (if known) standards/specifications to be applied tests already carried out location of production and testing facilities. Elements of Type Approval 4.1 Design assessment 4.1.1 The scope is to assess that the design of a system/product or material conforms to given standards and specifications. 4.1.2 The design assessment may vary considerably in extent from one product to another and is to be defined in each single instance. 4.1.3 The design assessment will normally comprise the following documentation which is to be submitted to DNV : — — — — — — — — — — — — main drawings of system/product (or other equivalent documentation) instruction manuals (if any) design calculations (if any) information regarding marking of the product by manufacturer’s type designation (or other marking) for unambiguous traceability between product and certificate of type approval. reference to design standards, specifications, etc. specification of applied materials operating characteristics test results (hereunder results from possible type tests) type testing programme (see below) proposed field of application (if known) functional description documentation of reliability by calculation and/or in service experience (if required). 4.2 Type testing 4.2.1 The scope of type testing - also called initial testing - is to verify the ability of a system/product or material to meet specified requirements by subjecting the test sample to physical, chemical, environmental or operational stresses. 4.2.2 The test sample (e.g. prototype) is to be built in conformity with the approved plans, using tooling, methods and processes comparable to those planned for subsequent production. 4.2.3 The test sample is to be examined for workmanship and for conformity with drawings and specifications prior to testing. 4.2.4 The type testing will be performed in accordance with an established test programme which the client and DNV have agreed upon prior to the commencement of the testing. 4.2.5 Type approval tests are to be conducted by a United Kingdom Accreditation Services (UKAS) laboratory, accredited laboratories or an equivalent laboratory recognised by DNV. A recognised laboratory in this context may be a laboratory that can document compliance with the relevant requirements in EN ISO/IEC 17025:2000 The laboratory at DNV’s Head Office, Høvik, Norway, is an accredited laboratory. Type Approval Certificate 4.2.6 If the test results for some reason do not comply with the requirements, DNV may require renewed testing, or supplementary tests, or it may reject the design. DNV will provide reasons for the rejection of any tests performed. 4.2.7 Upon completion of the testing according to the type testing programme, the client is to submit a copy of the test report, signed by himself and endorsed by the representative of DNV. DNV will inform the clients when more than one copy is required. 4.2.8 In consultation with the MCA, DNV may waive the requirement for any test specifically cited in a performance standard providing it is satisfied that the sample has met the criteria of a specification superior to that of the prescribed test. 5. Type Approval Certificate 5.1 Certificate 5.1.1 A certificate of type approval will be issued by DNV when the system/product/materials in question has been found to meet all specified requirements, i.e. upon acceptance of design assessment and results of type testing. 5.1.2 Where the equipment meets the provisions of the relevant applicable instruments and test and performance standards, DNV will issue a certificate of type approval to the applicant. The certificate will contain the name and address of the manufacturer, details of the equipment, technical documentation, conclusions of the examination, conditions for its validity and the necessary data for identification of the approved type. 5.1.3 The applicant must inform DNV of all modifications to the approved product which must receive additional approval where such changes may affect the conformity with the requirements or the prescribed conditions for use of the equipment. 5.2 Type approval at subsidiaries and licensees Manufacturers being licensees or true subsidiaries of certificate-holders or companies possessing a statement “Design Assessment for Type Approval” will normally have to apply for type approval, and procedure for granting the certificate will be as for initial approval. However, a simplified procedure to obtain type approval may be considered, provided conditions that will be decided case by case, are fulfilled. 5.3 Validity period 5.3.1 All new certificates of type approval will be valid for a period of up to 5 years. 5.3.2 Unless specifically required otherwise, existing type approval equipment already fitted on board ships will continue to be accepted providing it continues to operate and function satisfactorily. If such equipment needs to be replaced, then it should be replaced with equipment for which a current certificate of type approval is in force. 5.3.3 If so requested by the manufacturer and provided the requirements have not been changed, the existing MCA type approval certificate may be replaced by a DNV MCA certificate of type approval upon transfer of MCA certificates. A copy of the MCA certificate and the test reports referred to therein is to be submitted to local DNV Station for forwarding to DNV Høvik. Type Approval Certificate – Page 9 5.4 Re-submission 5.4.1 Where a submission has been rejected after completion of the type approval procedure by DNV, the manufacturer will be required to modify the equipment to take account of the reasons for non compliance before making a new submission to DNV, which is to be accompanied by a new application form. The documentation shall clearly show the original test report reference. 5.4.2 Upon receipt of the re-submission, together with the application form, DNV will re-open the approval procedure. 5.5 Renewal of type approval 5.5.1 The certificate holder should apply for renewal of the certificate at least 3 months before the period of validity expires. The intention of the renewal survey is to check that the conditions for type approval have not been altered during the validity period of the certificate, and to check that any new rules, if applicable, have been complied with. This may be done by means of a certificate retention survey as specified below, or in another appropriate manner, dependent on the changes of the product and the extent of any applicable new rules. 5.6 Certificate retention survey 5.6.1 The scope of the survey is to verify that the design of the product type, material composition and the product type designation marking and other conditions stated on the Type Approval Certificate are not altered since the certificate was issued. 5.6.2 The certificate retention survey may take place at time of renewal of the certificate of type approval, and thus constitute one possible basis for the renewal. 5.6.3 For certain systems and products, a certificate retention survey may be required for the retention of the certificate. 5.6.4 The main elements of the certificate retention survey are : — Witnessing of tests/ inspection on factory samples, selected at random from the production line (where practicable) — Review of type approval documentation — Review of possible changes in design, materials and performance — Ensure tractability between manufacturer’s product marking and certificate of type approval 5.6.5 A certificate retention survey report will be issued and submitted to the client when the product in question has been found to meet all requirements. 5.7 Retention of type approval documents 5.7.1 The manufacturer or his authorised representative is to keep with the technical documentation copies of certificates of type approval and their additions for a period of at least ten years after the last product has been manufactured. 5.7.2 The certificate of type approval and/or their additions and the annexes to the certificates will be kept at the disposal of the MCA and DNV for the period specified in paragraph 5.7.1 DET NORSKE VERITAS AS Standard for Certification - No. 2.12, October 2011 Page 10 – Sec.6. United Kingdom Accreditation Services DET NORSKE VERITAS AS Standard for Certification - No. 2.12, October 2011 Appendix A Regulations for the Type Approval Service – Page 11 Appendix A Regulations for the Type Approval Service A.1 Publication A.1.1 Publication by the certificate-holder: A certificate-holder has the right to publish that he is the holder of a certificate of type approval, issued by DNV. If the certificate-holder wishes to publish only part of a test report or other document related to type approval issued by DNV, he shall have a written agreement from DNV. The certificate-holder shall not claim product properties or functions in his publications that could mislead purchasers to believe that performances or properties of the product or its use are covered by the type approval, when in fact they are not. A.1.2 Publication by DNV All products approved by DNV are listed on the internet site: exchange.dnv.com/tari. The pages are updated once a week. A.2 Suspension, withdrawal and cancellation of certificate A.2.1 Suspension of certificate: A certificate may be suspended for a limited period for the following reasons: — if non-conformity with the requirements are found but are of such a nature that immediate withdrawal is not necessary. — in case improper use of the documents is not rectified by suitable retractions and appropriate remedial measures by the client. A suspension will be formally confirmed by DNV in writing. The MCA will also be advised. DNV shall specify conditions and requirements for the abolishment of the suspension. A.2.2 Withdrawal/ cancellation of certificate: A certificate may be withdrawn/ cancelled if: — manufacturer fails to comply with due settlements of his financial obligations — inadequate measures are taken by the manufacturer in case of suspension — there has been any other serious contravention to the requirements of the type approval service or the procedures of DNV — the manufacturer does not wish to prolong the certificate — the standard or rules are changed and the manufacturer either will not or cannot ensure conformity with the new requirements — if the submission, after finalisation of the type approval procedure, is found to be non-compliance due to the equipment being found not to meet the appropriate standard(s) the applicant will be notified, in writing, of the non compliance. A withdrawal/cancellation will be formally confirmed by DNV in writing. DNV shall specify conditions and requirements for the abolishment of the withdrawal/cancellation. A.3 Appeal A.3.1 In cases of dispute, the manufacturer has the right to appeal decisions taken to a board not directly connected to the same organisational unit who has carried out the commission. The changes apply where no detailed internationally agreed testing standard exists. Equipment listed in the amended Annex A.2. will continue to be type approved by the UK's Nominated Bodies until international standards are agreed and the products are transferred to Annex A.1 of the Marine Equipment Directive and into MSN 1734 (M+F). Introduction 1.1 The Merchant Shipping (Delegation of Type Approval) Regulations 1996 (S.I. 1996 No 147) provide for Nominated Bodies to undertake the "type approval" of marine equipment, of a safety or pollution prevention nature, for use on board United Kingdom ships. This legislation was supplemented by The Merchant Shipping (Marine Equipment) Regulations 1999 (SI 1999 No.1957) which implemented the European Council (EC) Directive 96/98/EC of 20 December 1996 on marine equipment (”the MED”). Amendment to MED Directive and to MSN 1735 (M+F) Annex 2.1 In response to changes to the testing standards developed by those organisations listed in Article 2(n) of the MED, the EC Commission has again issued an amending Directive that updates the list of equipment for which no agreed international testing standards currently exist. These updates are set out in Annex A.2 of Directive 2009/26/EC, published in the Official Journal of the European Communities (Volume 52, L 113 of 5th May 2009)¹ and are required to be transposed into UK law by 6th April 2010. 2.2 On 6 April 2010 the updates in Annex A.2 of Directive 2009/26/EC are implemented in UK law by Annex A.2 of this MSN, which replaces Annex A.2 of MSN 1735 (M + F). The previous Annex A.2 to MSN 1735 (M+F) is revoked and replaced by the new Annex A.2. of this Notice as from 6 April 2010.
