Frequently Asked Questions Rules and penalties Can I apply for an extraordinary licence (EL)? You can no longer apply for an extraordinary licence in the event of being disqualified due to demerit point offences. You now have two options: Option1: You can accept the disqualification period associated with the amount of demerit points you have accrued; or Option 2: You can elect to take the Good Behaviour Period (GBP) option (if eligible). This allows you to continue to drive for a period of 12 months subject to the following conditions: You must not commit a driving offence where the penalty involves more than one demerit point. You must not commit a driving offence that results in a court disqualification from holding or obtaining a drivers licence. What happens if I commit a driving offence where the penalty involves more than one demerit point? Should you breach the conditions of the GBP, you are subject to serve double the original disqualification period however, this period of disqualification does not commence until a Disqualification (breach) notice has been personally served on you. Until that time you may lawfully continue driving. What happens if I am disqualified from driving by a Court for an offence committed during a GBP? Any Court imposed disqualification period arising from offence(s) committed during a GBP will commence from the date of conviction. If the start date is during a GBP, the GBP will be immediately terminated. How can I find out how many demerit points I have accumulated? To find out how many demerit points you may have accumulated, you can check via our Online demerit point check or call us on 1300 720 111. How do I pay my fine? Visit the Infringements section on the W A Police website for more information about payment, nonpayment fees and contesting infringements. Page 1 of 3 How can I find out if my driver’s licence has been suspended for the non-payment of a fine or infringement? Visit the Department of the Attorney General's online licence suspension check to see if your licence is suspended due to the non-payment of any fines you have incurred. How do I get my licence document back when my demerit point suspension period has been completed? Driver and Vehicle Services can provide a replacement copy of your driver’s licence document. Please refer to Renew or replace your licence for further information on how to do this. A fee is payable. How long does it take for demerit points to expire? The demerit points associated to an infringement will expire three years from the date of the offence unless you accrue 12 or more points (4 or 8 in the case of a novice driver) within the three-year period and an Excessive Demerit Point Notice is issued. Once the Excessive Demerit Point Notice is personally served on a person the disqualification period (or GDP if eligible) will commence 28 days from after the date of service. The period of disqualification will depend on the number of demerit points accumulated within the threeyear period. If my licence is cancelled but I held an extraordinary licence will I have to do any tests to get my licence back? Where a period of disqualification has ended and you were required to comply with an Order to undertake a theory test (CTT) and practical driving assessment (PDA) prior to the grant of an EL, you will be exempt from taking a CTT and PDA. You must have held an EL that expired less than five years ago and must not have recorded any subsequent convictions (other than traffic infringements) resulting in a further disqualification period and the EL must not have been cancelled by the Courts. If you were previously authorised to drive a higher class and/or a motorcycle class of vehicle (e.g. HR & R) and did not undertake a PDA or CTT prior to the grant of an EL you would only be required to undertake a CTT and PDA in a ‘C’ class vehicle to obtain the authorisation to drive the previous class(s) back. Driver and Vehicle Services can provide a certified copy of a served Excessive Demerit Point Notice or Disqualification (Breach) Notice. You will need to attend a Driver and Vehicle Services Centre with primary identification and complete a Request for a Certified Copy of Excessive Demerit Points Notice form. A fee is payable A copy of the notice will then be posted to you. I have accumulated more than 12 demerit points but haven't received a disqualification notice. What do I do? When does a demerit point disqualification take effect after I have been issued with demerit points? The disqualification period will take effect 28 days after the Excessive Demerit Point Notice has been personally served on the person. Demerit point disqualifications are cumulative to any existing disqualification you may be serving. This means that if you have been served with a demerit point disqualification notice your disqualification period will not start at that time if you have other disqualifications (including fines suspensions) in place or incur other disqualifications prior to the demerit point disqualification period commencing.
