We spoke and here is an amended reactive line for consideration:
"T in the Park is one of Scotland's most popular and successful annual cultural events and last
year generated £15Am for the Scottish economy. Recognising the benefits this event delivers for
Scotland, a contribution of £150,000 has been made by the Scottish Government to contribute
towards the significantly increased costs of staging the event and to help its organisers in ensuring
its successful transition to the new site at Strathallan."
The £lS.4m impact figure was produced by independent analysts EKOSLtd for DF Concerts. As discussed, a formal
offer of grant has not been made yet but I expect that to take place this week.

The Scottish Ministers in exercise of their powers under section 23 of the National Heritage
(Scotland) Act 1985 hereby offer to give to DF Concerts ("the Grantee") a grant of up to £150,000
STERLING (incluslve of VAT), payable in financial year 2015-16, to boost Scotland's National
Events Strategy by assisting DF Concerts and Events to deliver key operational activities related
to the transition of the T in the Park event ("the Project") from Balado in Fife to Strathallan in
Perthshire and for no other purposes. The project is more particularty described in Part 1 of
Schedule 1 of this letter and subject to the following terms and conditions:
1. Definitions and Interpretation
1.1
In these Conditions, the words and expressions set out in Schedule 4 shall have the
meanings ascribed to them in that Schedule.
1.2
In these Conditions unless the context otherwise requires, words denoting the singular
shall include the plural and vice versa and words denoting any gender shall include all genders.
1.3 The headings in these Conditions are for convenience only and shall not be read as
forming part of the Conditions or taken into account in their interpr.etation.
1.4
Except as otherwise provided in these Conditions, any reference to a clause, paragraph,
sub-paragraph or schedule shall be a reference to a clause, paragraph, subparagraph or schedule
of these Conditions.
2. Purposes of the Grant

The Grant is made to help enable the Grantee to carry out the Project.
2.2
The Grant shall only be used for the purposes of the Project and for no other purpose
whatsoever.

2.3
No part of the Grant shall be used to fund any activity or material which is party political in
intention, use, or presentation or appears to be designed to affect support for a political party.
2.4

3. Payment of Grant
3.1
The Grant shall be paid by the Scottish Ministers to the Grantee in accordance with the
terms of Schedule 1 attached.
3.2
The Grantee shall by January 2016 submit to the Scottish Ministers a statement of
compliance with the Conditions of the Grant using the form of words provided in Schedule 3. The
statement shall be signed by the Grantee.
3.3
In the event that the amount of the Grant paid by the Scottish Ministers to the Grantee at
any point in time is found to exceed the amount of the expenses reasonably and proper1y incurred

by the Grantee in connection with the Project, the Grantee shall repay to the Scottish Ministers the
amount of such excess within 14 days of receiving a written demand for it from or on behalf of the
Scottish Ministers.
3.4
The Scottish Ministers shall not be bound to pay to the Grantee, and the Grantee shall
have no claim against the Scottish Ministers in respect of, any instalment of the Grant which
has not been claimed by the Grantee by 31 March of the applicable financial year as set out
in Schedule 1, unless otherwise agreed in writing by the Scottish Ministers.
4. Inspection and Information
4.1
Revisions to measures of success shall be subject to the written agreement of the Scottish
Ministers.
4.2
The Grantee shall, on completion of the Project, submit a report to the Scottish Ministers
summarising the performance of the Project. Such a report shall include such statistical and other
information relating to the impact of the Project as shall be required by the Scottish Ministers. It
shall also include a clear breakdown of what the Grant was used for.
4.3
The Grantee shall also provide any other information that the Scottish Ministers may
reasonably require to satisfy themselves that the Project is consistent with the Agreement. The
Grantee shall provide the Scottish Ministers with prompt access to any information they
reasonably require to ensure compliance with these Conditions.
4.4
The Grantee shall keep and maintain for a period of 5 years after the expenditure occurs,
adequate and proper records and books of account recording all receipts and expenditure of
monies paid to it by the Scottish Ministers by way of the Grant The Grantee shall afford the
Scottish Ministers, their representatives, the Auditor General for Scotland, hislher representatives
and such other persons as the Scottish Ministers may reasonably specify from time to time, such
access to those records and books of account as may be required by them at any reasonable time
in response to a written request for such access from the person seeking it. The Grantee shall
provide such reasonable assistance and explanation as the person carrying out the inspection
may from time to time require.
4.5
In the event of the Grantee becoming aware of or suspecting any irregular or fraudulent
activity that may have any impact on the Project or on the use of the Grant, or any part of it, the
Grantee shall immediately notify the Scottish Ministers of such activity and provide such other
information as the Scottish Ministers may reasonably require in relation to the impact on the
Project and the use of the Grant
5. Confidentiality and Data Protection
5.1
The Grantee will respect the confidentiality of any commercially

department, office or agency of Her Majesty's Govemment in Scotland, in right of the Scottish
Administration or the United Kingdom, and their servants or agents. When disclosing such
information to either the Scottish Parliament or the United Kingdom Parliament it is recognised
and agreed by both parties that the Scottish Ministers shall if they see fit disclose such information
but are unable to impose any restriction upon the information that it provides to Members of the
Scottish Parliament, or Members of the United Kingdom Parliament; such disclosure shall not be
treated as a breach of this agreement
5.3
The Grantee shall ensure that all requirements of the Data Protection Act 1998 are fulfilled
in relation to the Project.
5.4
To comply with section 31(3) of the Public Services Reform (Scotland) Act 2010, the
Scottish Ministers publish an annual statement of all payments over £25,000. In addition, in line
with openness and transparency, the Scottish Govemment publishes a monthly report of all
payments over £25,000. The Grantee should note that where a payment is made in excess of
£25,000 there will be disclosure

6. PubliCity

7. Intellectual Property Rights
7.1
All Intellectual Property Rights are hereby assigned to and shall vest in the Crown or its
assignees.
7.2
The Grantee shall ensure that nothing contained in any materials produced or submitted to
the Scottish Ministers by the Grantee or anyone acting on its behalf nor the reproduction of such
materials, shall constitute an infringement of any third party copyright or intellectual property right
and shall indemnify the Scottish Ministers against all actions, proceedings, claims and demands
made by reason of any such infringement.
8. Default and Recovery of Grant
8.1
The Scottish Ministers may re-assess, vary, make a deduction from, withhold, or require
immediate repayment of the Grant or any part of it in the event that:
8.1.1
The Grantee commits a Default;
8.1.2 The Scottish Ministers consider that any change or departure from the purposes for
which the Grant was awarded warrants an alteration in the amount of the Grant;
8.1.3
The Grantee fails to carry out the Project;

8.1.4
In the Scottish Ministers' opinion, the progress on the Project is not satisfactory; or
8.1.5
In the Scottish Ministers' opinion, the future of the Project is in jeopardy .

8.3
In the event that the Grantee becomes bound to pay any sum to the Scottish Ministers in
terms of clause 8.1, the Grantee shall pay the Scottish Ministers the appropriate sum within
14 days of a written demand for it being given by or on behalf of the Scottish Ministers to the
Grantee.
8.5
Notwithstanding the provisions of this clause 8, in the event that the Grantee is in breach of
any of the Conditions, the Scottish Ministers may, provided that the breach is capable of a
remedy, postpone the exercise of their rights to recover any sum from the Grantee in terms of
clause 8 for such period as they see fit, and may give written notice to the Grantee requiring it to
remedy the breach within such period as may be specified in the notice. In the event of the
Grantee failing to remedy the breach within the period specified, the Grantee shall be bound to
pay the sum to the Scottish Ministers in accordance with the foregoing provisions.
8.6
Any failure, omission or delay by the Scottish Ministers in exerCising any right or remedy to
which they are entitled by virtue of clauses 8.1 to 8.2 shall not be construed as a waiver of such
right or remedy.
8.7 There is a specific claw-back condition related to the Grant. A key condition of Grant is
that T in the Park event successfully takes place in Strathallan, Perthshire on 10-12 July 2015 and
also in 2016 and 2017. The amount of £50,000 will be clawed back by the Scottish Govemement
for each year (2015,2016 or 2017) that the event does not take place in Strathallan, Perthshire,
on its current scale, up to a maximum of £150,000.
9. ASSignation
The Grantee shall not be entitled to assign, sub-contract or otherwise transfer its rights or
obligations under the Agreement without the prior written consent of the Scottish Ministers.
10. Tennination
The Agreement may be terminated by the Scottish Ministers giving not less than 3 months' notice
in writing from the date of the notice being sent.
11. Corrupt Gifts and Payments of Commission
The Grantee shall ensure that its employees shall not breach the terms of the Bribery Act 2010 in
relation to this or any other grant. The Grantee shall ensure that adequate controls are in place to
prevent bribery.

12.1 These Conditions, except for Condition 6, shall continue to apply for a period of 5 years after
the end of the financial year in which the final instalment of the Grant was paid.
12.2 Condition 6 shall continue to apply until the end of the period referred to in that Condition.
13. Compliance with the Law
The Grantee shall ensure that in relation to the Project, they and anyone acting on their behalf
shall comply with the relevant law, for the time being in force in Scotland.

PART 1: THE PROJECT
T in the Park is one of Scotland's most popular and successful annual cultural events and
last year generated £15.4m for the Scottish economy.
In 2015 the T in the Park event will move from Salado in Fife to Strathallan in Perthshire.
Recognising the benefits this event delivers for Scotland, a contribution of £150,000 has
been made by the Scottish Government to contribute towards the significantly increased
costs of staging the event and to help its organisers in ensuring its successful transition to
the new site (in Strathallan).
The project will take place prior to the T in the Park event (on 10-12 July 2015) in Strathallan,
Perthshire.

PART 2: PAYMENT OF GRANT
1.
The total Grant of £150,000 shall be payable by the Scottish Ministers to the Grantee
upon acceptance of the receipt of a completed claim for Grant in the form set out in
Schedule 2.
2.
The total Grant shall be payable during the financial year 2015-16. The Scottish Ministers
shall not be bound to pay any instalment of the Grant which has not been claimed by the
Grantee by 31 March of the applicable financial year, unless otherwise agreed in writing by
the Scottish Ministers.
3.
On receipt of the grant claim (and any required documentation and information), the
Scottish Ministers shall determine the amount of expenditure which they consider the Grantee
shall reasonably and properly incur in connection with the Project having regard to that claim. The
determination shall be based on the information provided by the Grantee in accordance with this
Schedule. The Scottish Ministers shall use their best endeavours (but shall be under no obligation
or duty) to pay the amount determined to the Grantee within two weeks of receMng a claim and
any required documentation and information relevant to the claim.

DEFINITIONS
"Agreement" means the agreement constituted by the Scottish Ministers' invitation to apply for a
grant, the Grantee's Application, these Conditions and the Grantee's acceptance of these
Conditions;
"Conditions"
means these grant conditions;
"Default" means:
(a) Any breach of the obligations of either party under this Agreement (including, but not limited to, any breach of any undertaking or w~
(b) Any failure to perform or the negligent performance of any obligation under this Agreement;
(c) Any breach of any legislation; or
(d) Any negligence or negligent or fraudulent miss-statement or misappropriation of Grant, or
any other de~ult,
In all cases by either party, its employees, agents or representatives;
"Financial Year" means a period from 1 April in one year until 31 March in the next;
"Grant" means the grant offered by the Scottish Ministers to the Grantee as specified in the Award
Letter, as varied from time to time in accordance with these Conditions;
"Grantee" means the person, organisation or body to which the Grant will be payable as specified
in these Conditions. Where two or more persons, organisations or bodies are the Grantee,
references to the "Grantee" are to those persons, organisations or bodies collectively and their
obligations under the Agreement are undertaken jOintly and severally;
"Intellectual Property Rights" means all rights of ownership, including all copyrights and other
intellectual property rights in books, leaflets and other printed and published materials in whatever
form produced as part of the Project by or on behalf of the Grantee including all reports and any
such published materials stored in or made available by means of an information technology
system and the computer software relating thereto and all patents, trademarks, registered designs
and other rights in the nature of intellectual property;

2.3
No part of the Grant shall be used to fund any activity or material which is party political in
intention, use, or presentation or appears to be designed to affect support for a political party.
2.4
The grant is provided to assist OF Concerts Concerts and Events with operational costs
relatedto the transition of the T in the Park event ('1heProject")from Balado in Fife to Strathallan
in Perthshire and for no other purposes. A key condition of grant is that the T in the Park
event takes place in Strathallan, Perthshire in 2015, 2016 and 2017, otherwise grant clawback will take place (see 8.7). Expected outcomes of the Grant are:

To support the objectives of the National Events Strategy and enhance Scotland's
major events portfolio.
To boost the events, tourism and national economies.
To achieve the successful transition of the T in the Park event from Balado in Fife to
Strathallan in Perthshire.
2.5 The milestones against which progress in achieving the expected outcomes shall be
monitoredare:

Successful site transition from Balado in Fife to Strathallan in Perthshire
T in the Park event successfully takes place in Strathallan on 10-12 July 2015 and also in
2016 and 2017.
2.6 The eligible costs for which the Grant can be claimed are operational costs associated with
the the transition of the T in the Park event from Balado in Fife to Strathallan in Perthshire and
for no other purposes. Under no circumstances can the Grant be used to support
infrastructure costs. Eligible operational are only:

Costs for Consultants (associated to the event gaining planning consent)
3. Payment of Grant
3.1
The Grant shall be paid by the Scottish Ministers to the Grantee in accordance with the
terms of Schedule 1 attached.
3.2
The Grantee shall by January 2016 submit to the Scottish Ministers a statement of
compliance with the Conditions of the Grant using the form of words provided in Schedule 3. The
statement shall be signed by the Grantee.
3.3
In the event that the amount of the Grant paid by the Scottish Ministers to the Grantee at
any point in time is found to exceed the amount of the expenses reasonably and properly incurred
by the Grantee in connection with the Project, the Grantee shall repay to the Scottish Ministers the
amount of such excess within 14 days of receiving a written demand for it from or on behalf of the
Scottish Ministers.
3.4
The Scottish Ministers shall not be bound to pay to the Grantee, and the Grantee shall
have no claim against the Scottish Ministers in respect of, any instalment of the Grant which

has not been claimed by the Grantee by 31 March of the applicable financial year as set out
in Schedule 1, unless otherwise agreed in writing by the Scottish Ministers.
4. Inspection and Infonnation
4.1
Revisions to measures of success shall be subject to the written agreement of the Scottish
Ministers.
4.2
The Grantee shall, on completion of the Project, submit a report to the Scottish Ministers
summarising the performance of the Project. Such a report shall include such statistical and other
information relating to the impact of the Project as shall be required by the Scottish Ministers. It
shall also include a clear breakdown of what the Grant was used for.
4.3
The Grantee shall also provide any other information that the Scottish Ministers may
reasonably require to satisfy themselves that the Project is consistent with the Agreement. The
Grantee shall provide the Scottish Ministers with prompt access to any information they
reasonably require to ensure compliance with these Conditions.
4.4
The Grantee shall keep and maintain for a period of 5 years after the expenditure occurs,
adequate and proper records and books of account recording aU receipts and expenditure of
monies paid to it by the Scottish Ministers by way of the Grant. The Grantee shall afford the
Scottish Ministers, their representatives. the Auditor General for ScoUand, hislher representatives
and such other persons as the Scottish Ministers may reasonably specify from time to time, such
access to those records and books of account as may be required by them at any reasonable time
in response to a written request for such access from the person seeking it. The Grantee shall
provide such reasonable assistance and explanation as the person carrying out the inspection
may from time to time require.
4.5
In the event of the Grantee becoming aware of or suspecting any irregular or fraudulent
activity that may have any impact on the Project or on the use of the Grant, or any part of it, the
Grantee shall immediately notify the Scottish Ministers of such activity and provide such other
information as the Scottish Ministers may reasonably require in relation to the impact on the
Project and the use of the Grant.
5. Confidentiality and Data Protection
5.1
The Grantee will respect the confidentiality of any commercially sensitive information
that they have access to as a result of the Project.
5.2
Notwithstanding the above, the Grantee may disclose any information as required by law
or judicial order. All information submitted to the Scottish Ministers may need to be disclosed
and/or published by the Scottish Ministers. Without prejudice to the foregoing generality, the
Scottish Ministers may disclose information in compliance with the Freedom of Information
(Scotland) Act 2002, any other law, or, as a consequence of judicial order, or order by any court or
tribunal with the authority to order disclosure. Further, the Scottish Ministers may also disclose all
information submitted to them to the Scottish or United Kingdom Parliament or any other
department, office or agency of Her Majesty's Govemment in Scotland, in right of the Scottish
Administration or the United Kingdom, and their servants or agents. When disclosing such
information to either the Scottish Parliament or the United Kingdom Parliament it is recognised
and agreed by both parties that the Scottish Ministers shall if they see fit disclose such information
but are unable to impose any restriction upon the information that it provides to Members of the

Scottish Parliament, or Members of the United Kingdom Parliament; such disclosure shall not be
treated as a breach of this agreement
5.3
The Grantee shall ensure that all requirements of the Data Protection Act. 1998 are fulfilled
in relation to the Project.
5.4
To comply with section 31(3) of the Public Services Reform (Scotland) Act. 2010, the
Scottish Ministers publish an annual statement of all payments over £25,000. In addition, in line
with openness and transparency, the Scottish Govemment publishes a monthly report of all
payments over £25,000. The Grantee should note that where a payment is made in excess of
£25,000 there will be disclosure (in the form of the name of the payee, the date of the payment,
the subject.matter and the amount of grant) in the both the monthly report and the annual Public
Services Reform (Scotland) Act 2010 statement
.
6. Publicity
6.1 Scottish Ministers require to approve any form of acknowledgement of Scottish
Government support for the Project in the Project's publicity material prior to its first
publication.
7. Intellectual Property Righ1s
7.1
All Intellectual Property Rights are hereby assigned to and shall vest in the Crown or its
assignees.
7.2
The Grantee shall ensure that nothing contained in any materials produced or submitted to
the Scottish Ministers by the Grantee or anyone acting on its behalf nor the reproduction of such
materials, shall constitute an infringement of any third party copyright or intellectual property right
and shall indemnify the Scottish Ministers against all actions, proceedings, claims and demands
made by reason of any such infringement
8. Default and Recovery of Grant
8.1
The Scottish Ministers may re-assess, vary, make a deduction from, withhold, or require
immediate repayment of the Grant or any part of it in the event that:
8.1.1 The Grantee commits a Default;
8.1.2 The Scottish Ministers consider that any change or departure from the purposes for
which the Grant was awarded warrants an alteration in the amount of the Grant;
8.1.3 The Grantee fails to carry out the Project;
8.1.4 In the Scottish Ministers' opinion, the progress on the Project is not satisfactory; or
8.1.5 In the Scottish Ministers' opinion, the future of the Project is in jeopardy.
8.2
If, in the Scottish Ministers' opinion, the Grant or any part of it is state aid and they
consider that they are required to recover such sum in order to ensure compliance with their
obligations under EU law Scottish Ministers may require immediate repayment of the Grant

or any part of it together with interest at such rate and on such basis as may be determined
from time to time by the Commission of the European Union.
8.3
In the event that the Grantee becomes bound to pay any sum to the Scottish Ministers in
terms of clause 8.1, the Grantee shall pay the Scottish Ministers the appropriate sum within
14 days of a written demand for it being given by or on behalf of the Scottish Ministers to the
Grantee.
8.5
Notwithstanding the provisions of this clause 8, in the event that the Grantee is in breach of
any of the Conditions, the Scottish Ministers may, provided that the breach Is capable of a
remedy, postpone the exercise of their rights to recover any sum from the Grantee in terms of
clause 8 for such period as they see fit, and may give written notice to the Grantee requiring it to
remedy the breach within such period as may be specified in the notice. In the event of the
Grantee failing to remedy the breach within the period specified, the Grantee shall be bound to
pay the sum to the Scottish Ministers in accordance with the foregoing provisions.
8.6
Any failure, omission or delay by the Scottish Ministers in exercising any right or remedy to
which they are entitled by virtue of clauses 8.1 to 8.2 shall not be construed as a waiver of such
right or remedy.
8.7 There is a specific claw-back condition related to the Grant A key condition of Grant is
that T in the Park event takes place in Strathallan, Perthshire on 1()"12 July 2015 and also in 2016
and 2017. The amount of £50,000 shall be repaid by the Grantee to Scottish Ministers for each
year (2015, 2016 or 2017) that the event does not take place in Strathallan, Perthshire, on its
current scale, up to a maximum of £150,000.
9. Assignation
The Grantee shall not be entitled to assign, sub-contract or otherwise transfer its rights or
obligations under the Agreement Withoutthe prior written consent of the Scottish Ministers.
10. Tennination
The Agreement may be tenninated by the Scottish Ministers giving not less than 3 months' notice
in writing from the date of the notice being sent
11. Corrupt Gifts and Payments of Commission
The Grantee shall ensure that its employees shall not breach the terms of the Bribery Act 2010 in
relation to this or any other grant. The Grantee shall ensure that adequate controls are in place to
prevent bribery.
12. Continuation of Conditions
12.1 These Conditions, except for Condition 6, shall continue to apply for a period of 5 years after
the end of the financial year in which the final instalment of the Grant was paid.
12.2 Condition 6 shall continue to apply until the end of the period referred to in that Condition.

13. Compliance wHh the Law
The Grantee shall ensure that in relation to the Project, they and anyone acting on their behalf
shall comply with the relevant law, for the time being in force in Scotland.
If you wish to accept the offer of this Grant on the whole terms and conditions as set out in the
letter and annexed Schedules, you should sign and date both copies of the Grant Acceptance
below and retum one copy of the offer of Grant and Schedules to Willie Duff, Scottish
Government, Tourism and Major Events, 8th Floor, Ocean Point One, 94 Ocean Drive, Edinburgh,
Midlothian EH6 6JH. You should retain the second copy of the offer of Grant and Schedules for
your own records.

SCHEDULE 1
PART1:THEPROUECT
T in the Park is one of Scotland's most popular and successful annual cultural events and
last year generated £15.4m for the Scottish economy.
In 2015 the T in the Park event will move from Balado in Fife to Strathallan in Perthshire.
Recognising the benefits this event delivers for Scotland, a contribution of £150,000 has
been made by the Scottish Government to contribute towards the significantly increased
costs of staging the event and to help its organisers in ensuring its successful transition to
the new site (in Strathallan).
The project will take place prior to the T in the Park event (on 10-12 July 2015) in Strathallan,
Perthshire.
A key condition of grant is that the event must takes place there in 2015,2016
(otherwise grant claw-back will take place- see 8.7)
and 2017
The Project can only support operational costs associated with the transition of the T in the
Park event from from Balado in Fife to Strathallan in Perthshire. In no circumstances can
infrastructure costs be supported.

PART 2: PAYMENT OF GRANT
1.
The total Grant of £150,000 shall be payable by the Scottish Ministers to the Grantee
upon acceptance of the receipt of a completed claim for Grant in the form set out in
Schedule 2.
2.
The total Grant shall be payable during the financial year 2015-16. The Scottish Ministers
shall not be bound to pay any instalment of the Grant which has not been claimed by the
Grantee by 31 March of the applicable financial year, unless otherwise agreed in writing by
the Scottish Ministers.
3.
On receipt of the grant claim (and any required documentation and information), the
Scottish Ministers shall determine the amount of expenditure which they oonsider the Grantee
shall reasonably and properly incur tn connection with the Project having regard to that claim. The
determination shall be based on the information provided by the Grantee in accordance with this
Schedule. The Scottish Ministers shall use their best endeavours (but shall be under no obligation
or duty) to pay the amount determined to the Grantee within two vveeks of receiving a claim and
any required documentation and information relevant to the claim.

DEFINITIONS
"Agreement" means the agreement constituted by the Scottish Ministers' invitation to apply for a
grant, the Grantee's Application, these Conditions and the Grantee's acceptance of these
Conditions;
"Conditio,."
means these grant conditions;
"Default" means:
(a) Any breach of the obligations of either party under this Agreement (including, but not limited to, any t

"Granf means the grant offered by the Scottish Ministers to the Grantee as specified in the Award
Letter, as varied from time to 'time in accordance with these Conditions;
"Grantee" means the person, organisation or body to which the Grant will be payable as specified
in these Conditions. Where two or more persons, organisations or bodies are the Grantee,
references to the "Grantee" are to those persons, organisations or bodies collectively and their
obligations under the Agreement are undertaken jointly and severally;
"Intellectual Property Rights" means all rights of ownership, including all copyrights and other
intellectual property rights in books, leaflets and other printed and published materials in whatever
form produced as part of the Project by or on behalf of the Grantee including all reports and any
such published materials stored in or made available by means of an information technology
system and the computer software relating thereto and all patents, trademarks, registered designs
and other rights in the nature of intellectual property;
"Project' means the purpose for which the Grant has been awarded as described in the Offer of
Grant;
"Payment" means each of the payments specified in Schedule 1 hereto.

The main time issue we face is the actual 'notification'
of this award onto the EC's registration
database, which is a requirement
under the General Block Exemption Regulation, under which this award is being made. This must be done within 20 working
days of the measure coming into force (in this case the day the award was made). When we register the award on the system
there must be a weblink to the full legal terms of the award which explains the GBER Article used and how the award fits with

that Article - in other words while the proposed wording you have offered looks agreeable, it does not provide the level of
information
that would be necessary to satisfy the Commission's
transparency
requirements.
My colleague Emma McClintock had been dealing with this process and has discussed these requirements in detail with
colleagues in Malcolm's team on Wednesday of this week however unfortunately
Emma is not in the office today.

Tony and I had a discussion on this last week prior to the Glasgow holiday weekend. We agreed that of the two, Option 2
seemed closest to the mark. We agreed, however, to run this past our colleague Emma McClintock
before getting back to you.
Emma is unfortunately
out of the office until Wednesday, however she was involved in initial discussions on this issue with Ian
Sirrell and has a significant expertise on what the Commission are looking for on such web pages to satisfy their transparency
requirements.

FUNDING ASSISTANCE: T IN THE PARK - STATE AID
Support for
T in the Park have received one-off grant funding support of £150,000 from the
Scottish Government to help ensure the successful transition of this iconic music
festival from Balado, Stirling to their new temporary site at Strathallan in Perthshire.
The outcomes of the grant aid are to:•

Scotland's major events portfolio;
Boost the events, tourism and national economies;
Achieve the successful transition of the T in the Park event from Balado in Fife to
Strathallan in Perthshire.
Legal Basis
This grant award has been made under section 23 of the National Heritage
(Scotland) Act 1985.
GBER Provisions
This grant funding award is compliant with Section 11 Aid for Culture and Heritage
Conservation, Article 53 sections (2a), (2d) and (5d) of the State Aid General Block
Exemption Regulations, which state:2. The aid shall be granted for the following cultural purposes and activities:a. museums, archives, libraries, artistic and cultural centres or spaces, theatres,
opera houses, concert halls, other live performance organisations, film heritage
institutions and other similar artistic and cultural infrastructures, organisations and
institutions;
b. art or cultural events and performances, festivals, exhibitions and other similar

Further to Alan's email I agree that option B will need to be followed in terms of transparency. You can choose
where this goes on the SG website, but for the purposes of annex 2 you will notice that you need to provide me with
two web links. The first demonstrating what area of government this aid has come from - so perhaps the main
tourism section of the website, and secondly the link to the full text of the aid measure - which will have all of the

State Aid information in it. Therefore, you will need to ensure that the State Aid web link is a sub link of whatever
.main link you send me so that the EC can see the link for full transparency.

As you will see from the examples you then have to outline the article to which you have cover for in the
GBER and the provisions under that article.

Other things such as the legal basis (with hyperlinks to the act of this), incentive effect etc will also need to
be included and addressed.
Worthwhile noting that this page cannot be subsequently removed at a later date as the ECwill want it to be
accessible for anyone to look at for transparency purposes.
If you follow the structure of these examples it should be quite straight forward because although yours is an ad hoc
aid measure the content is pretty much the same. As I suggested previously, if you want myself or Alan to have a
look at the content before publishing we are happy to check this. Then if you send me your final version of the
Annex 2 I can get it notified ahead of the 30 July deadline.

Thanks for your time (and patience) earlier in talking me through what action is required to
demonstrate full compliance with State Aid regulations. As agreed, I have attached two
documents which attempt to reflect the discussion we had. Option A simply references the
relevant sections of the GBER regulations (which would be our preference, given the look and feel
is light touch); and Option B provides the full wording of these same sections within GBER (from
my perspective this looks and "feels" unwieldy but appreciate this is what might be required).
Willie in my team is investigating whether we are able to show text as a footnote on the SG site in
this way; but if we decide that option A is acceptable then our ability to adopt such an approach
becomes less important.
If your advice is that option B is the route we need to go down, then I think we will need to take a
view on whether the location on the SG website we are proposing for this text remains fit for
purpose.

Thanks - I've spoken to Helen Taylor at SNH and to Claire Smith at RSPB. I believe the deadline
they have been working to for consultation responses is next Tuesday, 21st April, but at this stage
PKC are asking SNH to hold on until the situation in terms of the ospreys' activity is clear. It
sounds as if SNH are awaiting a further update from your ornithologist I from Jennifer.
In terms of availability for a meeting, Monday afternoon looks a possibility for a meeting here in
Edinburgh and I have asked Claire Smith to hold that date. Can you manage that? A meeting on
Monday should hopefully also allow Darren Hemsley from SNH to be involved on his return from
leave.

As discussed on the phone,
I am looking to set up a meeting with Ms Hyslop and Geoff Ellis, CEO DF Concerts which
organises T in the Park, Scotland's largest and award-winning
music festival.
As you may be aware, we are moving to a new site this year at the iconic Strathallan Castle. This is a detailed
process, going through planning and extensive engagement with key partners such as Police Scotland, SEPA, RSPB,
Transport Scotland, SNH, and several others as you can imagine.
There has been a lot of media coverage about the site change and will be a lot more as we move through the
planning process.
It would be great to meet with Ms Hyslop to brief her on the plans for T in the Park 2015 and ensure she has the
latest information as the plans continue to develop and discuss how we work with the Scottish Government going
forward for this important event. We are very excited about the new site, it is a beautiful setting and is set to show
