Registra.on.WhensubmiEngyourOrderfortheAirBar,youwillberequiredtoprovide
yourname,emailaddress,shippingaddress,billingaddressandotherinforma.on.You
areresponsiblefortheaccuracyofthisinforma.onandyouwillensurethatthis
informa.oniskeptcurrent.TheCompanyhasnoresponsibilityorliabilityforinaccurate
informa.onorinforma.onthatbecomesoutdated.Youcanupdateyourinforma.onat
any.me(priortoactualshipmentoftheAirBar)bycontac.ngusathello@air.bar.

PaymentTerms.ForeachAirBarunitinyourOrder,youshallpaythesumcurrently
displayedonwww.air.bar,plusapplicablesalestaxandshippingcosts.Yourpayment
informa.on(e.g.,yourcreditcardnumberandexpira.ondate)willbesubmiTedinfull
totheCompany’sthird-partypaymentgatewayserviceprovider.Anyinaccurateor
fraudulentpaymentinforma.onwillresultinthenon-fulfillmentofyourOrder.

Cancella.onofOrder.YoumaycancelyourOrderupun.lthe.meshipmenthas
commenced.OncetheCompanyhascommencedtheshipmentprocess,yourOrder
cannotbecancelled.
4.
LimitedWarranty–Returns.TheAirBariscoveredsolelybyawarrantyagainst
manufacturingdefectsforaperiodofoneyearfromthedateofpurchase.
a. IfyoubelievethatyourAirBarhasamanufacturingdefect,youmustfirstcontact
usbyemailathello@air.bar.
b. IftheCompany’scustomerservicerepresenta.veverifiesthatthereisa
manufacturingdefectwithyourAirBar,youwillbegivenauthoriza.onand
instruc.onsonhowtoreturnthesametotheCompany.AnyAirBarsthatare
returnedwithoutauthoriza.onwillnotbeacceptedbytheCompany.
c. DamagetoanAirBarcausedbyanaccident,usernegligence,misuse,tampering
oranyothercauseshallnotbecoveredundertheCompany’slimitedwarranty
againstmanufacturingdefects.
d. Defec.veproductsthatarereturnedtotheCompanywithin30daysofpurchase
inaccordancewiththerequirementssetforthintheseTermsshallbereplaced
withanotherAirBaroryoushallbegivenarefund.
e. Defec.veproductsthatarereturnedtotheCompanya^er30daysofpurchase
butwithintheoneyearlimitedwarrantyperiodinaccordancewiththe
requirementssetforthintheseTermsmayonlybereplacedwithanotherAirBar.

TheCompany’slimitedwarrantyreturnpolicyshallonlycoverAirBarsthatare
purchaseddirectlyfromtheCompany’swebsite,andnotproductsthatare
purchasedfromresellersorfromothersources.
5.
Shipping.ShippingtocustomerslocatedwithintheUSAshallbeviaacarrierofthe
Company’schoosing,thecostofwhichshallvarybasedontheshippingpreferencethat
youchosewhenplacingyourOrder.Shipping.mesareonlyanes.mateandaresubject
tochange,andtheCompanydoesnotrepresentorwarrantthatyouwillreceivethe
AirBarbythees.mateddate.Asaresult,intheeventthatanydelayarisesandthe
es.matedshipmentdateisnotmet,theCompanyshallnotberesponsibleforany
damagesthatmayoccur,norshallitbeobligatedtoprovideanydiscounts.

PersonalUseOnly;Restric.ons.YouherebyrepresentandwarranttotheCompanythat
youareplacingyourOrderwiththeintenttoacquireandusetheAirBaronlyfor
personalpurposes(andnotacquiringthesameforre-sale),thatyoupermanentlyreside
intheUSA,andthatyoushallnotreverseengineertheAirBaroruseittocreatea
compe..veproduct.

Limita.onofLiability.TOTHEEXTENTPERMITTEDBYLAW,INNOEVENTWILLTHE
COMPANYBELIABLEFORANYCOLLATERAL,CONSEQUENTIAL,INDIRECT,PUNITIVE,
SPECIAL,EXEMPLARYORINCIDENTALDAMAGESARISINGOUTOFORRELATEDTOTHESE
TERMSORUSEOFTHEAIRBAR,EVENIFTHECOMPANYSHALLHAVEBEENADVISEDOF
SUCHPOTENTIALDAMAGES.THESELIMITATIONSWILLAPPLYWHETHERTHELIABILITY
ARISESINCONTRACT,TORT(INCLUDINGNEGLIGENCE),STRICTLIABILITY,UNDER
STATUTEOROTHERWISE.INANYANDALLCIRCUMSTANCES,THECOMPANY’SLIABILITY
SHALLBELIMITEDTOTHETOTALDOLLARAMOUNTOFYOURORDER.
8. Disclaimer.EXCEPTASEXPRESSLYSETFORTHINTHESETERMS,ANDTOTHEMAXIMUM
EXTENTPERMITTEDBYAPPLICABLELAW,THEAIRBARSHALLBEPROVIDED“ASIS”AND
“ASAVAILABLE”,WITHALLFAULTSANDWITHOUTGUARANTEEDWARRANTYOFANY
KIND,ANDTHECOMPANYHEREBYDISCLAIMSALLWARRANTIESANDCONDITIONSWITH
RESPECTTOTHEAIRBAR,EITHEREXPRESS,IMPLIEDORSTATUTORY,INCLUDING,BUT
NOTLIMITEDTO,THEIMPLIEDWARRANTIESAND/ORCONDITIONSOF
MERCHANTABILITY,SATISFACTORYQUALITY,FITNESSFORAPARTICULARPURPOSE,
ACCURACY,QUIETENJOYMENT,ANDNON-INFRINGEMENTOFTHIRDPARTYRIGHTS.

any posting on the Company’s website, including, without limitation, on any message

hate speech, highly explosive subject matter (as determined by the Company, in its sole
discretion), or any illegal subject matter or activities; (ii) violates any law or regulation
governing false or deceptive advertising, comparative advertising or trade disparagement;
(iii) contains any misrepresentation, or content that is defamatory or violates any rights of
privacy or publicity; (iv) infringes on any copyright, trademark, patent or other
proprietary right, such as providing pirated computer programs or links to them,
providing information to circumvent manufacture-installed copy-protect devices, or
providing pirated images, audio or video, or links to pirated images, audio or video files;
(v) contains any “worm”, “virus” or other device that could impair or injure any person or
entity; (vi) harasses or advocates the harassment of another person; (vii) involves the
transmission of “junk mail”, “chain letters”, or unsolicited mass mailing or “spamming”,
(viii) contains restricted or password only access pages, or hidden pages or images (those
not linked to or from another accessible page); (ix) solicits passwords or personal
identifying information from other users; or (x) engages in commercial activities,
solicitation, advertising, marketing and/or sales. The Company, in its sole discretion,
may remove any posting you make anywhere on its website.

theuseoftheAirBarshallberesolvedexclusivelybybindingarbitra.onbeforeasingle
arbitrator(the“Arbitrator”)inaccordancewiththeCommercialArbitra.onRulesofthe
AmericanArbitra.onAssocia.on(the“AAA”)thenineffectandthefurtherprocedures
setforthherein.(Forinforma.onontheAAAanditsrules,seewww.adr.org.)The
arbitra.onshallbeconductedinSanFrancisco,California.Thearbitra.onshallbe
governedbytheFederalArbitra.onAct,9U.S.C.§§2etseq.,andthelawsoftheState
ofDelawarewithoutreferencetoprinciplesofconflictsoflaws.Notwithstandingany
rulesoftheAAAtothecontrary,anyclaimsshallbeadjudicatedonanindividualbasis
only,andyouherebywaiveanyrighttobringanyclaimasarepresenta.veofa
proposedclass,onanaggregatedormassbasis,orasaprivateaTorneygeneral,orto
