Trustees,
After the May 6, 2015 Trustee Meeting, I requested complete copies of both the Concord
quote as well as the Judco quote from Gene Layne. Along with the Trustees, prior to the
meeting I had received only pages 2 & 3 of the Concord Equipment Mfg., Inc. quote (the
entire quote consists of 10 pages) and had never seen any of the Judco, Inc. quote. Upon
obtaining all information on May 11,2015 from Gene Layne and reviewing it I am finding issue
with how this bid and contract letting has been conducted. I have attached complete copies
of both Concord & Judco quotes for your reference and review. I have also prepared a list of
procedural changes that I strongly recommend to avoid potential issues with the Auditor of
State:
1.) All quotes should be sent by the bidder to both the Department Head (if desired) and the
Fiscal Office to avoid any potential for improper bid manipulation, modification, or steering.
2.) All quotes should be provided to the Trustees as well as the Assistant to the Trustees for
complete review prior to any meeting to decide on award.
3.) All quotes must be provided in their entirety, without edit, modification, or deletion.
4.) Award to Department Head recommendation should only occur after full review by the
FO, Assistant to the Trustees, and Trustees and verification of facts pertaining to the reason
for selection, especially if the lowest bid is not chosen.
I objected to the loose nature of the Concord delivery terms contained in their quote at the
Trustee meeting and recommended that we ask for a written penalty clause to be included, to
no avail. More importantly, I am disappointed to find after reviewing the Judco quote that
ALL of our specifications were met without exception at a lower cost to Russell Township and,
different than Concord, Judco provided a Predelivery inspection at OUR facility prior to paint
and through the warranty period provides pick up & return of the vehicle for repairs to our
facility. This not only negates the argument that Elyria (47 miles) is further to take the truck
than Painesville (22 miles) but it also reduces our future potential for towing costs should the
vehicle be in need of repairs, preventing it from being driven.
Although the decision to use Concord may in fact be the best choice for the Township, the
method used to obtain this decision is severely flawed and potentially violates ORC regarding
a contract of this size. Again, I strongly recommend that the Trustees alter their process and
clearly communicate it to the Department Heads to avoid this situation in the future.
