PRE-MEETING DISCUSSION
JUNE 27,2016
The City Council of the City of Mountain Brook, Alabama met in public session in the Pre-council
Room (A106) of City Hall at 6:00 p.m. on Monday, the 27th day of June, 2016. The Council President called
the meeting to order and the roll was called with the following results:
Present:
Virginia C. Smith, Council President
William S. Pritchard, Ill, Council President Pro Tempore
Jack D. Carl
Lloyd C. Shelton
Alice B. Womack
Absent:
Lawrence T. Oden, Mayor
Also present were City Attorney Whit Colvin, City Manager Sam Gaston and City Clerk Steven
Boone.

AGENDA
1.
Ordinance designating "No Use of Wireless Telecommunication Devices while operating a motor
vehicle in School Zones"-Richard Caudle of Skipper Consulting, Inc. (Appendix I). This matter
will be considered further. Questions raised include the size of the defined school zones including
whether Highlands Day School should be included or not, enforceability, and effectiveness.
2. Sain Associates contract for the design of the roundabouts project in Mountain Brook VillageAlicia ~ a i l e kof Sain Associates (Appendix 2). Council members Pritchard and Carl expressed
concern about the accuracy of the illustrations included in the proposed submittal. Both urged
Sain Associates to meet with John Evans to determine what modifications may be necessary to the
plans considering the Lane Parke developers' modifications to the Lane Park Road. The
consensus of those present was that the draft Sain agreement be sent to the Alabama Department
of Transportation for review and Sain schedule a meeting with the Lane Parke developers to
determine what modifications, if any, may be warranted.
3. Authorize Mayor or City Manager to apply for funding from the Metropolitan Planning
Organization (MPO)for engineering design to replace one bridge and rehab another in the City.
Motion 2016-085 was added to the formal meeting agenda.
4. Consultant's report on the Library roof window IeaWwater damage study (Appendix 3).
5. Review of the matters to be considered at the formal [7 p.m.] meeting.
6. Executive session
There being no further business to come before the City Council, it was moved by Council President
Smith that the City Council convene in executive session to discuss a matter involving a real estate transaction.
The motion was seconded by Council President Pro Tempore Pritchard. The City Attorney certified that the
subject of the executive session is allowed pursuant to the Open Meetings Act. Then, upon the question being
put and the roll called, the vote was recorded as follows:

Council President Smith declared that the motion carried by a vote of 5-0 and then asked that the
members of the audience be excused. She also announced that the City Council shall reconvene upon
conclusion of the executive session at approximately 7 p.m. in the Council Chamber.

I, Steven Boone, City Clerk of the City of Mountain Brook, Alabama, certify the above is a true and

AN ORDllrlANCE TO PROHIBIT THE USE OF Wt RELESS TELECOMMUNICATION DEVlCES WHILE
OPERATING A MOTOR VEHICLE IN SCHOOL ZONES B m E E N THE HOURS OF 7% A.M. AND 8:00 A.M.
AND BETWEEN THE HOURS Of 2:30 P.M. AND 3:30 P.M.
BE ITORDAINED by the City Council of the City of Mountain Brook, Alabama, as follows:
1. Provisions. It shall be unlawful for the driver of a motor vehicle in a School Zone t o operate a
wireless telecommunication device between the hours o f 7 3 0 A.M. and 8:00 A.M. and between
the hours of 2:30 P.M. and 3:30 P.M. Operating a wireless telecommunication device shall
include engaging in a call; writing, sending, or reading text-based communications; accessing,
reading, or posting to a social network site or accessing or adding any Information t o the
wireless telecommunication device. The provisions of this Sectimn shall only apply within a
school zone upon a public road or hlghway during posted hours when signs are located In a
visible manner in each direction that lndicate the use of a hand-held wireless
telecommunication device is prohibited while operating a motor vehicle,
2. "Wireless telecommunlcation device" defined. "Wireless telecommunication device" means a
cellular telephone, a text- messaging device, a personal digital assistant, a stand-alone
computer, or any other substantiallysimilar wireless device that is readily removable from the
vehicle and is used to write, send, or read text or data through manual input. A "wireless
telecommuntcation device" shall not include any device or component that is permanently
affixed to a motor vehicle. It does not include a hands-free wireless telephone, an electronic
communication device used hands-free, citizens band radios, citlzens band radio hybrids,
commercial two-way radio cammunlcations devices, two-way radlo transmitters or receivers
used by licensees of the Federal Communication Commission in the Amateur Radio Service, or
eleetronlc communication devices with a push-to-talk function.
3. Violations.
(1) Violations of this ordinance shall constitute a moving violation.
(2) The first violation of the provlslons of this ordinance shall be punishable for a fine of not
more than $XX.
(3) Each subsequent violation shall be punishable by a fine of not more than $XX.
(4) If a person is involved in a collision at the time of the violation, then the fine shall be
equal to double the amount of the standard fine imposed in this ordinance and the law
enforcement officer investigatingthe collision shall Indicate on the written report that
the person wasusing a wireless telecommunication devlce at the tlme of the coHislon.
4.
hceptfons: The provlslons of this ordinance shall not apply t o a person who uses a wireless
telecommunication device and does any of the following:
(1)Reports a trafflc collision, medical emergency, or serious road hazard.
(2) Reports a situation in which the person believes his personal safety is in jeopardy.
(3) Reports or averts the perpetration or potential perpetation of a criminal act against the
driver or another person.

(4) Operates a wireless telecommunication device while the motor vehicle is lawfully
parked.
(5) Uses a wireless telecommunication device In an official capacity as an operator of an
authorized emergency vehicle.
5. Repealer. All ordinances or parts of ordinances heretofore adopted by the City Council of the
City of Mountain Brook, Alabama that are inconsistent with the provisions of this ordinance are
hereby expressly repealed.
6. Seuerabltitv, If any part, section or subdivision of this ordinance shall be held unconstit~;tionalor
invalid for any reason, such holding shall not be construed to Invalidate or impair the remainder
of thls ordinance, which shall continue in full force and effect notwithstandingsuch holding.
7.
Effective Date. This ordinance shall become effective immediately upon adoption, publicationas
provided by law, and the installation of appropriate traffic signage indicatingthat such turns are
prohibited.

project Altached ore the estimated rnandays for your review and opproval.

Project Understanding
As part of Soin's feasibility study prepared for Ihe Clty of Birmingham, Cify of Mountain Brook, and
ALDOT, Sain prepared several alternatives fo improve the capacity and operations at the Cahaba
Road/Hwy 280/Lane Park Road/Culver Road intersection. The alternative with the most efficient
operations was Alternative 1 (concepf is attached lo this proposal), a large roundabout at the
Cohabo RoadfHwy 280ILane Park Road infersection and a mini-roundabout at Culver Road, At the
completion of the feasibility study, we deemed Alternative 1 to most adequately address the
purpose ond need of the project.
In our recenf discussions with ALDOT, we understand Alternative 1 can proceed forward as the
"preferred dternative": however there is a certain amount of risk in doing so as we discussed with you
in our meeting on February 2,201 6. The environmeniol phase of the project will begin with a kick-off
meeting with FHWA and ALDOT. FHWA is the approving agency and will determine fhe level of
environmental document for this project. Based on ALDOT's guidance, the project is being scoped
for a Categorical Exclusion environmental document. If FHWA deems an Environmental Assessment
ond additional alternative evaluations be performed, the project will be required to be re-scoped.
Sain Associates and wr subconsultants are scoplng this project based on the Alternative 1 concept
attached to this proposal. In the event the public rejects the proposed roundabout layout that result
in either changes to this concept or Mher evaluailon of ofher alternatives, additional services or rescoping of this project may be necessary. Neither ALDOT nor Sain feels these risks are great enough
to warrant a different approach to scoping this project.
Our understandingis as fdows:
The project will progress on the typical path for a Clty sponsored project with ALDOT. Reviews
will be performed by ALDOT, ollhough a sft-down 3096 review meeting will not be conducted
and is not included in this scope of work.

JUNE 27,2016
The City Council of the City of Mountain Brook, Alabama met in public session in the City Hall
Council Chamber at 7:00 p.m. on Monday, the 27th day of June, 201 6. The Council President called the
meeting to order and the roll was called with the following results:
Present:
Virginia C. Smith, Council President
William S. Pritchard, 111, Council President Pro Tempore

Lawrence T. Oden, Mayor
Also present were City Attorney Whit Colvin, City Manager Sam Gaston and City Clerk Steven
Boone.
The City Council President stated that a quorum was present and that the meeting was open for the
transaction of business

RECOGNITION OF A GUEST
Council President Smith recognized Boy Scout David Krueger in attendance from Troop 320
(Mountain Brook Presbyterian) for the Communications merit badge.
2.
UPDATE ON LANE PARKE PROJECT BY JOHN EVANS OF EVSON, INC.
John Evans of Evson, Inc.
Phase I retail includes: Western, Revelator, Amano's, Betsy Prince, Village Gunnery,
Kinnucan's, Char Bar 7, Platinum Pilates, M & S Furniture, Local Taco and Yeah Burger
April 11,201 6 the developer turned over the space to the tenants
Kinnucan's and Local Taco expect to open around the time school reconvenes, the restaurants will
likely open in September, and Western is scheduled to open October 1 1,2016
Western can retain their current location for two months after they open in the new location
Demolition and culvert work is expected to commence in January, 2017
Once the culvert is started, Regions will be released to start their phase. Regions has 210 days to
complete its building
The culvert is expected to be completed in four months
The bridge replacement at Lane Park Road will be the final improvement there. Lane Park Road
will be widened in conjunction with the culvert work
Western will be accessible from all directions during the bank construction
The culvert will be much larger than exists today which should remove a lot of property from the
100-year flood area
Once Regions has moved, the old building will be raised and Jemison Lane will be completed
The developer is in negotiations with Rite Aid to provide them with 6,200 square feet with no
drive through
The culvert should be completed by July 20 17
Jemison Lane should be completed by Christmas 2017
If Rite Aid can be relocated, their old building can be raised immediately
The Phase 2 retail will have to be 50% pre-leased before construction commences which will take
Retail Specialists about six months to complete

CONSIDERATION OF AN ORDINANCE (NO. 1954) AMENDING SECTION 30-3(a) OF THE
CITY CODE WITH RESPECT TO THE TIME AND PLACE OF HOLDING COURT
(EXHIBIT 6)
The ordinance was introduced in writing by Council President Smith who then invited questions and
comments from the audience.
There being no comments or discussion, Council President Smith called for a motion. Council
President Pro Tempore Pritchard made a motion that all rules and regulations which, unless suspended, would
prevent the immediate consideration and adoption of said ordinance be suspended, and that unanimous consent
to the immediate consideration of said ordinance is given and that the reading of the ordinance at length be
waived. The motion was seconded by Council member Womack and was carried, as follows:

BE IT ORDAINED by the City Council of the City of Mountain Brook, Alabama, that Section 303(a) of the City Code is hereby amended as follows:
1. "See. 30-3. - Time and place of holding court.
(a) The municipal court of the city shall hold court commencing at 4:00 p.m. on Wednesday of each
week, except the fifth Wednesday in each month or a week containing a holiday, in the council
chamber of city hall and at such other times as a municipal judge may continue or set a case. If
approved by a municipal judge, court may be rescheduled to address an irresolvable conflict, an
unforeseen circumstance, or inclement weather."
2. Re~ealer.All ordinances or parts of ordinances heretofore adopted by the City Council of the City of
Mountain Brook, Alabama that are inconsistent with the provisions of this ordinance are hereby expressly
repealed.
