This edition of MCCL News includes our 2010 Primary Election
Voter's Guide. Candidates for public office were polled on their
attitudes regarding right-to-life issues. The survey is an effort to
help inform citizens so they can better participate in the democratic
process by basing judgments on factual information about candidates' positions, rather than relying on hearsay or rumor. The

the 2009 state total.

shows a total of 12,388 abortions were performed in the state
in 2009, compared to 12,948 the
previous year. The 2009 total is
the lowest number on record
since 1975 and is also the lowest abortion rate (10.9 per 1,000 females age 15-44) since
1975.
The dramatic drop—560 fewer babies were killed than in 2008—demonstrates that pregnant
women are being helped and empowered to choose life by the numerous resources available to
them across the state. But more needs to be done.

Governor, state office candidates

Abortion
Many women, especially young women, feel coerced into
having an abortion due to pressure from a boyfriend, parent or other person. Often it is these women who suffer
the long-lasting psychological impacts of abortion the
most, because they did not want the abortion themselves.
According to the Elliot Institute, 64% of all abortions
involve some form of coercion.
1. Will you vote for legislation that would make it a
crime to use coercion or the threat of physical harm
to pressure someone into having an abortion?
 Yes
 No To use abortion as a method of birth control means to use
it for the same reasons as one would employ any method
of birth control, such as contraceptives or natural family
planning. People use birth control to space children, to
avoid interference with a career or education, or for a
variety of other motivations that all have one thing in
common: the desire to avoid having any child at the
current time.
There are other categories of abortions that might
be sought: (1) abortions performed to prevent death to
the mother, (2) abortions performed to prevent serious
physical health problems to the mother, (3) in cases of
rape and (4) incest, or (5) in cases in which the unborn
child has a fetal abnormality incompatible with life. For
purposes of clarity and enforceability, a law preventing
the use of abortions as a means of birth control would
define such abortions as covering abortion other than
those in the five categories described above.
2. Will you vote for legislation that would prevent the
use of abortion as a means of birth control?
 Yes
 No New non-invasive technology allows expectant parents
to identify the sex of their unborn child as early as six
weeks into pregnancy. This ability makes it easy for sexselection abortions to occur even before others are aware
of the pregnancy.
3. Will you vote for legislation to ban sex-selection
abortions?
 Yes
 No Currently the state of Minnesota neither licenses nor
inspects most abortion facilities, even though they complete thousands of surgical abortions every year. Many
other medical facilities are required to be licensed and/
or inspected by the government.
4. Will you vote for legislation that would require
abortion facilities to be licensed and inspected by
the state?
 Yes  No According to a November 2009 CNN/Opinion Research
poll, only 37% of registered voters nationwide indicated
that they were in favor of using public funding for abortions when the woman cannot afford it.
5. Will you vote against the use of government funding
for abortion other than to prevent the death of the
mother, when the pregnancy is the result of forcible
rape (reported to law enforcement agencies within
two days), or when the pregnancy of a minor is the
result of incest (with the perpetrator reported to law
enforcement agencies)?

Human cloning, also referred to as Somatic Cell Nuclear
Transfer or Transplantation (SCNT), is a process in which
genetic material from one person would be artificially
transferred into a human or animal egg cell, thereby
beginning the life of a new human individual who is vir-
tually genetically identical to the parent. MCCL believes
that human life at every stage of biological development
is deserving of respect and protection, regardless of the
circumstances under which the human life was created.
Some scientists propose creating human life through cloning (SCNT) for the purpose of destructive experiments on
those human beings, and for the purpose of scavenging
the bodies of those human beings to obtain cells, tissues
or organs. Both purposes result in the death of newly
formed human beings.

MCCL respects the right of patients and/or their proxies
to make medical decisions. Additionally, MCCL is opposed to any efforts that seek to force medical decisions
on others which are based on quality of life criteria.
The “quality of life” debate is really a debate about
values: Whose lives are worth preserving? Whose lives are
not? Minnesota law bases “cost effective health care” on
“quality of life” measures such as ability to function and
return to work (62J.03, subd. 7). This definition means that
older people and people with disabilities are in danger of
being denied life-preserving health care simply because
an insurance review agent or medical personnel doesn’t
think the patient’s life is worth saving.
Unfortunately, we have seen government attempts to
involve itself in such quality of life scenarios, including
the following situations:
•Mandated denial of nutrition and/or hydration to
patients when the patient’s wishes are unknown;
•Creation of evidence-based / best practices guidelines;
•Rationing proposals like the so-called “Oregon plan”
based on diagnosis and treatment pairings; and
•General cost-effectiveness programs which attempt
to limit expensive care.

Frustrating session sees no pro-life
advances Pro-lifers made valiant efforts; all pro-life policies remain

From a pro-life perspective, the 2010 legislative session seemed like a perfect example of spinning
one’s wheels. There were several very important issues
being considered by the Legislature, including health
care, taxpayer funded abortion, and enacting reasonable
protections related to abortion.
However, no matter how hard pro-lifers worked, they
never were able to gain the traction needed to make
substantial improvements in Minnesota’s laws. This
is certainly not for a lack of effort. In the final weeks of
session, pro-life lawmakers offered several amendments
to related bills.
Abortion industry regulation
Rep. Larry Hosch, DFL-St. Joseph, and Sen. Michelle
Fischbach, R-Paynesville, offered amendments that
would have, if enacted, put an end to the outrageous
reimbursement rates that some abortion providers
receive. Rep. Laura Brod, R- New Prague, and Sen. Pat
Pariseau, R-Farmington, offered amendments that would
have finally required abortion facilities to be inspected
by the state.
Taxpayer funded abortions
Additionally, Reps. Matt Dean, R-Dellwood, and Steve
Gottwalt, R-St. Cloud and Sen. Mike Parry, R-Waseca,
all offered amendments that would have helped to
ensure access to insurance policies that do not include
abortion coverage. And Rep. Gottwalt and Sen. Warren
Limmer, R-Maple Grove, offered amendments to prohibit
taxpayer funding for sex-selection abortions; Rep. Patti
Fritz, DFL-Faribault, offered an amendment to prohibit
saline abortions; and Rep. Marty Seifert, R-Marshall,
offered an amendment to limit taxpayer subsidies to
abortion advocates.
All pro-life policies intact
With all of this activity, pro-lifers ended the session
exactly where they began. No new pro-life policies were
put into place, though, thankfully, no existing pro-life
policies were changed either.
For the last two years, the Minnesota House of
Representatives has generally had an even split among
legislators who are pro-life and those who are not. Prolifers have been a minority in the Senate for a number
of years.
The wheels-spinning 2010 legislative session is obviously a product of these facts. Let’s hope that following
this fall’s elections, the 2011 Legislature will be known
as the Pro-Life Legislature!

U.S. House candidates respond to survey
Congressional candidates were asked the following questions. A short explanation precedes each question.
Abortion
In its 1973 rulings in Roe v. Wade and Doe v. Bolton, the
U.S. Supreme Court created a “right to abortion” that
invalidated the abortion laws of all 50 states.
(1) Do you support the reversal of the Roe v. Wade
and Doe v. Bolton decisions, so that elected
legislative bodies may once again protect unborn
children by limiting or prohibiting abortion?
There is now overwhelming scientific evidence that
abortion methods used by the fifth month (and perhaps
earlier) such as the “dilation and evacuation” (dismemberment) method, and the partial-birth abortion method,
cause excruciating pain to the unborn child.
(2) Would you support legislation to strictly limit
abortion at least from the point in development
that evidence suggests an unborn child has the
capacity to experience pain?
Human cloning is a process (technically known as “somatic cell nuclear transfer”) in which genetic material
from one person is artificially transferred into a human
or animal egg cell, thereby beginning the life of a new
human individual who has only one parent and who is
genetically nearly identical to that parent. NRLC believes
that human life at every stage of biological development
is deserving of respect and protection regardless of the
circumstances under which that human life was created.
It has been proposed to create human life through cloning for the purpose of destructive experiments on those
humans, resulting in their deaths, a process sometimes
referred to as “therapeutic cloning.” In Congress, the
Stupak-Wamp Human Cloning Prohibition Act (111th
Congress, H.R. 1050) would prohibit the use of somatic
cell nuclear transfer (cloning) to create any humans,
including human embryos.
(3) Would you support a legal prohibition on all human cloning (i.e. the creation of human embryos
by cloning), along the lines of the Stupak-Wamp
Human Cloning Prohibition Act (H.R. 1050)?
The “Hyde Amendment” prohibits federal Medicaid
money from being used to pay for abortions or for health
care plans that include abortion, except to save the life of
the mother, or in cases of rape or incest. Because the Hyde
Amendment is attached to the annual appropriations
bill for the Department of Health and Human Services,
it is currently necessary for Congress to renew it every
year. If this annual renewal was ever blocked, the federal
Medicaid program would revert to a policy of paying for
abortion on demand.
(4) Would you vote to renew the current Hyde
Amendment policy without weakening amendments?
The U.S. spends roughly $650 million annually for
birth-control programs overseas. Under President Reagan, George H.W. Bush, and George W. Bush, executive
orders collectively referred to as the “Mexico City Policy”
established that in order to be eligible for U.S. populationcontrol funds, a private overseas organization must agree
not to perform abortions (except to save the life of the
mother, or in cases of rape or incest) or to “actively promote
abortion as a method of family planning.” However, in
January 2009, President Obama overturned this pro-life
policy by executive order.
(5) Would you support legislation to reinstate the
Mexico City Policy, and would you oppose any
legislation that would prohibit a future president
from reinstating the policy by executive order?
Laws are already in effect in about half the states that
require notification or consent of at least one parent
(or authorization by a judge) before an abortion can be
performed on a minor. However, these laws are often
circumvented by minors who cross state lines in order
to evade parental notification requirements (often with
the aid of older boyfriends, abortion clinic staff, or other
adults lacking parental authority). The Child Interstate
Abortion Notification Act (CIANA) (H.R. 634 in the 111th
Congress) would require any abortionist, encountering
a minor client from another state, to notify one parent
before performing an abortion, unless presented with
authorization from a court, or in cases of life endangerment, or in cases of sexual or physical abuse or neglect
by a parent, in which case the appropriate state agency
must be notified instead of a parent. The bill would also
make it an offense to transport a minor across state lines
to evade a parental involvement requirement.
(6) Would you vote for the Child Interstate Abortion
Notification Act, and oppose weakening amendments?
Euthanasia
Some hospitals have implemented formal policies authorizing denial of lifesaving medical treatment against
the will of a patient or the patient's family if an ethics
committee thinks the patient's so-called “quality of life”
is unacceptable, even though the patient and family
disagree. The federal Patient Self-Determination Act
currently requires health care facilities receiving Medicare or Medicaid to ask patients on admission whether
they have an advance directive indicating their desire
to receive or refuse lifesaving treatment under certain
circumstances.
(7) Would you vote to prevent involuntary denial of
lifesaving medical treatment by amending the
Patient Self-Determination Act to provide that, if
failure to comply with a patient’s or surrogate’s
choice for life-saving treatment would be likely,
in reasonable medical judgment, to result in or
hasten the patient’s death, a health care provider
unwilling to respect the choice for lifesaving
treatment must allow the patient to be transferred
to a willing provider and must provide the treatment pending transfer?
The manner in which any restructuring of the American
health care or health insurance system is constructed is
a matter of central importance to the pro-life movement
because when the government rations health care in a
way that makes it illegal or impossible for Americans to

choose lifesaving medical treatment, food, and fluids, it
imposes a type of involuntary euthanasia. In the name
of controlling health care costs, in late 2009, both the
House and the Senate passed bills limiting the right of
Americans to spend their own money to obtain lifesaving
health care. These bills would have empowered government officials to exclude plans from health insurance
exchanges if offered by insurers the officials thought
raised premiums too much, thus limiting the ability of
consumers themselves to balance cost against benefit, and
pushing them into health insurance plans more likely to
ration health care.
(8) Would you vote against any bill that would prohibit or limit the right to spend one’s own money
for health care or health insurance?
It is well known that because of the impending retirement
of the baby boom generation, Medicare faces a fiscal crisis.
Broadly speaking, there are three fundamental options.
One, substantial tax increases, is widely considered improbable. Another, in which less and less money (adjusted
for health care inflation) is available for each beneficiary,
would compel rationing.
The third option is to allow older Americans who wish
to do so to add their own funds on top of the diminishing
government contribution in order to obtain health insurance that is less likely to ration medical treatment and
prescription drugs. By voluntarily putting more money
into the health care system through this means, middle

sector cost shifting, allowing more undercompensated
and uncompensated health care to be provided to those
with low incomes. In 1997 and 2003, the National Right
to Life Committee persuaded Congress to allow such an
alternative in the form of “private fee-for-service” plans.
Under current law, so long as these plans meet requirements for financial stability, and cover what original
Medicare covers, the government places no price controls
on what private fee-for-service plans can pay for health
care or prescription drugs, or on what premiums they
can charge in addition to the amount provided by the
government under Medicare. These are left for the market
to determine. However, the health care bills passed by
the House and Senate in late 2009 gave the Centers for
Medicare and Medicaid Services the authority to exclude
any or all of these plans from the choices available to
senior citizens.
(9) Would you vote against any bill that limits, or authorizes government officials to limit, the right of
older Americans who choose to do so to add their
own funds on top of the government contribution

abortions peaked at 2,327 in 1980.
Planned Parenthood’s exploitation
Even though the abortion total was the lowest in 34 years,
Planned Parenthood managed to increase its abortions last year to a record 3,996. Planned Parenthood
performed 1,600 more abortions than the next largest
provider. It now performs more than 32 percent of all abortions in the state—its highest percentage ever.
“Despite its claims to the contrary, Planned Parenthood clearly is not concerned with reducing the
number of abortions performed in Minnesota,”
Fischbach said. “The new report confirms that Planned
Parenthood's aggressive marketing of abortion to teenagers, minorities and low-income women is enabling it to
achieve its business goal of performing more abortions
every year.”
Sobering increases
Other increases in 2009: Chemical abortions using the
dangerous and sometimes lethal RU486 drug rose to 19
percent of all abortions, and taxpayer-funded abortions rose to 31.9 percent of all abortions. Both of
these were the highest percentages ever in the state.
