THIRD AMENDMENTS TO BY.IAWS
WHEREAS, the Substituted By-Laws of The Oaks, (hereinafter referred to as
"By-Laws"), were recorded February 16,7995, of record in Condominium Deed Book
3'l.,Page166, inthe Fayette County Clerk's Office; and
WHEREAS, the Amendments to By-Laws (hereinafter referred to as "First
Amendments") were recorded luly 2,1999, of record in Condominium Deed Book 40,
Page 146,inthe Fayette County Clerk'g Office; and
WHEREAS, the Second Amendments to By-Laws (hereinafter referred to as
"Second Amendments'J were recordedlanuary 27,2011, of record in Condominium
Deed Book $7,Page 105, in the Fayette County Clerk's Office; and
WHEREAS, the following Third Amendments to By-Laws (hereinafter
referred to as "Third Amendments") were approved by the required maiority at the
Annual Meeting of the Co-Owners, pursuant to notice, on December 6,2W12
ARTICLE V
Article V. H. 5. of the Bylaws shall be amended by adding the following
subsection e:

Notwithstanding any provision herein to the conkary, from and after
the date of the adoption of this Amendment by the Council of Co-Owners, a CoOwner shall not lease said unit if the then percentage of Ieased units exceeds
fourteen and nine-tenths (74.9W percent of the total number of units (hereinafter
refered to as "Rental Restriction"l.
Provided, however, the above Rental Restriction shall not apply to Co-Owners
or their heirs who have title to their unit prior to the date of the adoption of this
Rental Restriction by the Council of Co-Owners.
The Oaks Condominium Horizontal Property Regime consists of twenty-nine
(29) residential buildings (hereinafter referred to as "Building") with residential
units in each Building, to-wit:

The Co-Owners of any such Building may, upon the unanimous written
approval of such Co0wners, resfoict the number of units which may be leased in
such Buildingto twenty-five (25o4 percent, or less, of the units in such Building.
In the event of a violation of the provisions of this section by a Co-Owner, the
Co-Owner and his/he{their respective unit shall be assessed monthly penalties equal
to 150% of the regular maintenance fee assessed against such unit.
This is hereby certified to be true and accurate account of the action of the
Council of Co-Owners, Oaks Condominiums on
