How to Appeal a Watercourse and Wetland Alteration (WAWA) Permit Refusal.
If your proposed works are considered to have an unacceptable negative impact
on the best interest of the water resource, or the aquatic habitat, you will receive a
letter from the Watercourse and Wetland Alteration Program of the Department of
Environment and Local Government explaining why your proposal was not approved.
If you are not satisfied with the explanation you receive from the Department, you may
appeal to the Minister of Environment and Local Government. For your reference the

The following represents the recommended steps to follow when submitting a notice
of appeal for a WAWA permit refusal:
1. Within 15 days after being notified of the decision to refuse your WAWA permit
(or within such further time as the Minister may allow) you must serve the
Minister with a notice of appeal, which should include the following information:
a) A statement indicating that you wish to appeal the decision to refuse your
WAWA Permit
b) The “Reference” number found on your refusal letter (usually top right corner)
c) The date of your WAWA refusal letter
d) Your name, mailing address and contact phone number(s)
e) The grounds of appeal, i.e., the reason(s) why you disagree with the
refusal of your WAWA Permit, together with the relevant facts
2. After completing the above, within thirty days after being notified of the decision
to refuse your WAWA permit, you may serve the Minister with a written
submission, setting out your position in detail and annexing any supporting
documentation and other pertinent information.
3. Your notice of appeal will be assessed and a decision will be sent to you by
registered or certified mail within 60 days of your initial submission.
