Terms and Conditions Antioch College and the Office of Community Life hereby agree that the College will grant the students a license to use a residence hall room at the College according to the following terms and conditions. 1. Term This agreement ends at noon on the date identified for the appropriate academic term (usually 12 p.m. on the second day following the last day of classes for all term breaks), at which time this Agreement shall terminate unless the College renews it by action of the Office of Community Life in reassigning the student to the same room (See Appendix A). Regardless of continuing assignment to the same room, the student shall vacate the residence halls by the appropriate time as identified for the academic term. In the event of a student’s withdrawal from the College, this agreement will be automatically terminated. The College will provide adequate heat, electricity, locks, and plumbing to the student in the room/residence hall assigned. The College cannot be responsible for acts of God and other forces beyond its control or for conditions which have not been reported to the appropriate College employees. The College will not be liable for consequential damages (resulting harm) caused by any failure to meet maintenance and similar obligations. 2. Fees The student shall pay the appropriate housing fee for each term of occupancy as stated in the College catalog. Fees will be due and payable at the Student Accounts Office subject to the terms and conditions for payment as set forth in the current version of the College Catalog. The student shall have no right to a full or partial refund of room fees except as expressly set forth in College publications. 3. Damages and Damage Deposit If the student is found responsible by the Resident Life Managers for residence hall damages in excess of ordinary wear and tear, the student must pay for the costs of such damage. Charges of such damage will be billed to the student. Failure by the student to pay these charges may result in the student’s eviction or permanent exclusion from the residence halls and/or ineligibility to register for classes. A damage deposit is not currently required of students who have no record of past residence hall damage. However, if the student has been found responsible by the Resident Life Managers for residence hall damage, the College may require of the student a deposit of funds to be termed as a damage deposit. This damage deposit will be applied against charges for any further damage for which the student may be found responsible for by the Residence Life Managers. The amount of the deposit shall be proportional to the charges imposed on the student for past damage, as determined by the Resident Life Mangers. Any of these deposited funds remaining upon the student’s graduation or permanent departure from the College residence halls shall be returned to the student within one month of said departure. 4. Storing of Personal Possessions Students reassigned to the same room for the fall and spring quarter may leave their belongings in that room. Prior to the student vacating the room, a notice must be posted on the door informing the Housekeeping Staff of continued occupancy. Students who will be continuing to study or co-op on campus the following term, and have been assigned a different room, may move their belongings into that room by arrangement with the current occupant and the Resident Life Managers. A notice of continued occupancy must be placed on the door of the new room for the Housekeeping Staff, and a list of preexisting damages to the new room must be prepared (use of an official Office of Community Life form is required: Room Condition Form). The College will take all reasonable precautions to ensure the security of student property and/or belongings stored either in a student’s room or in a College-supplied storage space. These precautions will be in effect year-round. The College accepts no responsibility, beyond taking the above described precautions, for the damage, theft, or loss of money, valuables, or other personal effects of the student and is not responsible for personal belongings left in residence halls during the semester or breaks, closings or any other college recess period. This general rule also applies to storage of personal belongings in College-supplied storage spaces. 5. Limitation to Residential Use by Student The residence hall shall be used only as a living space. The student’s license to use the room may not be assigned to any other party. Temporary guests of the student shall be authorized to use the room only after getting a valid Visitor’s Pass issued by the Office of Community Life. Page 2 6. Rules of Conduct The student agrees to abide by the terms and conditions contained in all College publications related to policy, procedure, and student conduct as amended from time to time. Such policies and publications currently include (but are not limited to) the following: 1. Honor Code 2. The Horace Man Fellows Rights and Responsibilities 3. Civil Liberties Code 4. Alcohol and Drug Policy 5. Academic Honesty Policy 6. Smoking Policy 7. Firearms and Dangerous Ordinance Policy 8. Sexual Offense Prevention Policy (SOPP) 9. Racial Discrimination Prevention Policy (RDPP) 10. Harassment Policy 11. Residence Hall Special Designations 12. Antioch College Catalog 13. Student Handbook The student understands and agrees that it is their responsibility to familiarize themselves with the contents of these publications, and that ignorance of any published rule or policy shall not be an excuse or defense for violation of that rule or policy. The student will conform to the “NO PETS” policy and to the designation of the residence hall as it pertains to noise levels and alcohol tolerance. Engaging in any type of illegal activity in campus buildings, and/or elsewhere on the campus grounds and in any college activity is strictly prohibited. 7. Expectations of Mutual Respect The student shall refrain from repeated acts or practices which unreasonably disturb the other occupants of the residence hall. This general obligation of mutual respect applies to all members of the Antioch community and in addition to the more specific prohibitions contained in the college publications referenced above. College representatives have the right to inspect student rooms at any time for the proper operations of the hall, for reasons of health and safety, and when necessary in cooperation with local, state, and federal law enforcement officials. Whenever possible or practical the College will give the student a 24-hour notice of room inspection. 8. Termination upon recommendation from the appropriate judicial bodies or failure to comply with the terms of the Residence Occupancy Contract as determined by the Office of Community Life. Prior to termination of this agreement the College will provide the student with an opportunity to present the student’s side of the relevant events and circumstances at a hearing. The student will receive advance written notice of the time and place of the hearing. The specific notice and hearing procedures to be followed prior to termination will depend on the type of the alleged student misconduct at issue, and will be determined by reference to the appropriate College publication. In a situation which may warrant termination of this Residence Occupancy Contract but which would not otherwise require a notice and hearing under a specific college publication, the student will be given at least 48 hours’ advance notice of an informal hearing before the Office of Community Life, at which hearing the student may present his or her side of the relevant events. The Dean of Community Life will issue a decision which may be appealed in writing within two business days to the College President, whose decision will be final. appendices Appendix A Commencing and ending at NOON as officially published in the College’s Academic Calendar. This agreement covers all academic terms, commencing and ending on the published dates when Residence Halls OPEN and CLOSE. Students will be required to sign the ROC (Residence Occupancy Contract) before receiving keys at the beginning of each term and by this signature abide by all Office of Community Life Residence Policies and Standards including (but not limited to) the Antioch College Residence Occupancy Contract. All unauthorized person(s) inhabiting the room, including former College students and students whose housing contracts have expired, been terminated or have not yet commenced are trespassers under Ohio law (ORC, Section 2911.21) and shall be ejected along with their personal belongings. The assessment of fines for unauthorized occupancy will be determined by the Dean of Community Life and may result in the loss of housing privileges. Appendix B Antioch College reserves the right to deny on-campus housing to anyone 30 years of age or older. Children are not permitted to live or reside temporarily in any Campus Housing due to safety reasons. Note: All or part of this agreement is subject to change without notification.
