Eaton Industries Pty Ltd Pro-Rata Warranty Terms and Conditions Applicable Country: Australia Applicable product series: E- Series NV, 5110, Ellipse Max, 5115 Period of Coverage: In addition to the standard product warranty, Eaton Industries further warrants the aforementioned applicable UPS product will have a service life from date of purchase when used in accordance with the storage, handling, installation, operation & maintenance procedures prescribed in the “Operating Conditions” section of this warranty, and in the applicable product documentation. “Service life” means the UPS’s ability to deliver at least 80% of its original rated back up time. Outlined below are the prescribed full service lives of each applicable product E-Series NV, 5110, Ellipse Max – 5 years 5115 – 10 years Warranty Policy: This Pro-Rated Warranty is given by Eaton Industries Pty Ltd. This warranty is additional to any rights and remedies that you may have under the Australian Consumer Law and other laws. If Eaton Industries determines that the UPS has not provided the warranted service life in accordance with the definition of “service life” above, Eaton Industries will provide a pro-rated credit to be applied against the purchase of a new replacement identical or equivalent Eaton Industries UPS product. The User will be offered a credit against the List Price of equivalent equipment at the time of return to Eaton Industries in proportion to the percentage of the warranted service life remaining at the time of return to Eaton Industries. In calculating the available credit the remaining warranted service life will be rounded up or down to the nearest whole year. The user is responsible to pay the balance of the list price of identical or equivalent equipment at the time of replacement. Copyright 2012 Eaton Industries Pty Ltd Pro-Rata Warranty – Terms and Conditions (30/04/2012) 1 Correct Installation Guidelines: • The UPS must be plugged into properly grounded & wired outlets using no extension cords, adaptors, other ground wires, or other electrical connections. • The installation of the UPS complies with all applicable electrical & safety codes described by the AS/NZ Standards. • The UPS must be used & stored under normal operating conditions and in accordance with all labels & instructions. • The UPS must not be damaged by accident (other than AC power line transient), misuse, or abuse. Coverage Exclusion: • A failure to provide the warranted service life due to damage associated with flood, fire, liquid spills, earthquakes, war, insurrection, vandalism, theft, erosion, and/or abuse is not covered by this warranty. • A failure to provide the warranted service life due to abuse, misuse, incorrect installation, alteration, modification, tampering or negligence is not covered by this warranty. Claims Procedure: • Any claim under the Pro-Rata Warranty must be made within 10 days of the date of the alleged damage to the connected equipment. • Call Customer Service on 1300 303 059 for a Return Authorisation (RA) number and your claims information package. • Return the UPS, the original purchase receipt and your completed claims information package within 30 days, freight prepaid to: Eaton Industries, 10 Kent Road, Mascot, NSW, 2020. You will be responsible for the costs of making a claim under this warranty. • IMPORTANT. Clearly mark the RA number you were given on the box AND product you are returning. • A Pro-Rata credit is only applicable on the purchase of a new replacement identical or equivalent Eaton Industries UPS product. Statutory rights Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
