PURCHASE OF LASERS AND RELATED MAINTENANCE
GENERAL INFORMATION
This procedure is issued to address State of Texas registrations requirements for the suppliers of lasers and
maintenance/repair of lasers.
AUDIENCE
Applicable to all Procurement Staff and designated Satellite Buyers
GUIDELINES
1.
In accordance with the Texas Administrative Code Section, Rule 289.301, all suppliers that will perform work on or
perform demonstrations in order to sell Class 3b or Class 4 lasers must be registered with State. Therefore, the
following clause shall be included in all procurement solicitations for Class 3b or Class 4 lasers and/or
maintenance/repair of Class 3b or Class 4 lasers:
“In accordance with the Texas Administrative Code Section, Rule 289.301, all suppliers that perform work on or
perform demonstrations in order to sell Class 3b or Class 4 lasers for equipment in this solicitation must be
registered with State of Texas. In order to be considered for this solicitation please provide, in your response, the
State of Texas registration number and its expiration date for anyone who will be demonstrating, installing or
providing maintenance for this equipment.”

The Buyer will be responsible for obtaining the State of Texas registration number and its expiration date on
procurements for Class 3b or Class 4 lasers as required by Texas Administrative Code Section, Rule 289.301 that did
not go through a solicitation process (i.e., sole-source that was not bid).

At the time of award or the issuance of a Purchase Order and/or Contract/Agreement for the demonstration,
installation or maintenance & repair of a Class 3b or Class 4 lasers, the Buyer shall provide the following
information, via e-mail, to UTMB’s Radiation Safety Officer (Luz Cheng):

The requirements in Sections 2 and 3 above shall also apply to Class 3b or Class 4 lasers that are trial or evaluation
products (ref. Logistics/Acquisition Procedure 2.80; Trail, Sample & Evaluation Products)
EXCEPTIONS
There will be no exceptions unless by formal addendum to this procedure or other formal written exception by the Purchasing
Agent.
