Assignment – Practice and Procedure I understand that Pleading Precedents 6th Edition – Azize, El Khouri & Finnane are is not available online from the University of Sydney Library, nor is Bullen & Leake & Jacobs Pleading Precedents. There is one edition, about the 13th edition, of Bullen & Leake at the library and also a number of copies of Azize available at the library. These are hard copies. It is not to be expected that there are precedents exactly on the assignment problem. Precedents give an idea of how a matter may be pleaded and some words from one precedent and some words from another precedent may be adapted for the purposes of the matter that you are pleading. I now make available, on the LEC website, some precedents from Azize, El Khouri & Finnane which should give you an idea of how matters are generally pleaded. It is emphasised that these are general precedents to be utilised to gain an understanding of how pleadings work. They are not necessarily directly relevant to the assignment question. Material dealing with general principles of pleading and particulars includes: – Commentary UCPR Parts 14 and 15 NSW Civil Procedure Handbook 2014 (prescribed text) Chapter 8 Principles of Civil Procedure in New South Wales – Boniface (prescribed text) Chapter 11 Civil Procedure – Colbran et at Chapter 6 Australian Civil Procedure – Bernard Cairns Robert Gowenlock
