Compliance With Japanese Laws Form All students applying for participation in the Japan 2015 trip must answer the following questions, provide details as requested, certify the correctness of the information provided, and commit to obey Japanese Law. You must read the conditions in the last paragraph of this document and sign and date the document. This document may request information of you that is not normally asked of people in the United States and which may restrict or inhibit your rights in the United States. However, since these are questions that affect your ability to comply with Japanese Law and participation in the Japan 2015 trip, you are requested to provide the answers. Any information that you provide will be kept confidential within the University. Failure to fully and truthfully respond to any and all questions and issues contained in this document will disqualify you from participating in the Japan 2015 trip sponsored by Montana State UniversityBillings. If you have questions, please seek answers before you fill out and sign this document. The Immigration Control and Refugee Recognition Act (Cabinet Order No. 319 of 1951 as Amended through Law No. 43 of 2006) is the Japanese Law that governs the conditions under which, among other things, foreign visitors can visit Japan. Japan distinguishes between visa permits to stay in Japan and “Landing” permits to enter Japan. The latter governs who they allow to enter Japan regardless of the type of visa arrangement that may have been made. All students who apply to participate in the Japan 2015 Trip from Montana State University-Billings must, as a condition of acceptance for participation in the trip, certify that they are not subject to any of the conditions in Japanese law that would prohibit their entry into Japan. The following is a list of 11 questions that will assist the University in determining if entry conditions from the Immigration Control and Refugee Recognition Act may apply to you For EACH condition, circle the appropriate YES or NO answer to each question as it applies to you. Have you ever been convicted of a violation of any law or regulation in any country (including the USA) where you were sentenced to imprisonment for 1 year or more? 4. Have you ever been convicted of a violation of any law or regulation in any country (including the USA) relating to the control of any drugs, narcotics, marijuana, opium, stimulants or psychotropic substances and been sentenced to a penalty? 5. Have you ever been convicted of a violation of any law or regulation of Japan or of any other country or have been deported from Japan in accordance with the provisions of the Immigration Control and Refugee Recognition Act or expelled from any other country in accordance with the provisions of any law or regulation of that country for killing, injuring, assaulting or threatening a person, or damaging or destroying a building or other things in relation to the process or results of an international competition or a competition of an equivalent scale or an international conference (hereinafter referred to as “international competition”) or with the intent of preventing the smooth operation thereof, and is likely to kill, injure, assault or threaten a person, or damage or destroy a building or other things in relation to the process or results of an international competition held in Japan or with the intent of preventing the smooth operation thereof, at the venue of the international competition or within the area of the municipality where the venue is to be located? 6. Have you ever engaged in prostitution, or procured prostitutes for other people, or solicited a prostitute, or furnished a place for prostitution, or engaged in any business directly connected to prostitution? 7. Have you ever trafficked in people or instigated or aided another to do so? 8. Have you ever been deported from Japan? 9. Have you ever been convicted of any crime under the laws of Japan? 10. Do you advocate the overthrow of the Government of Japan by means of force or violence or have you knowingly assisted in any way an organization that advocates the overthrow of the Government of Japan by means of force or violence. 11. Are you a member of a political party or organization that encourages acts of violence or the assault, killing, or injuring of any government or local public officials in any country, or which encourages illegal damage or destruction of public buildings or facilities, or which encourages acts of dispute such as stopping or preventing normal maintenance or operation of security equipment of a plant or place of work? Japanese Law Governing Permission to Land Questionnaire Page 3 If you answered YES to any of the foregoing 11 questions, you must attach a separate sheet of paper and explain in detail (including dates, places, and times) for each affected question the circumstances that caused you to answer YES. Japanese law allows for certain mitigating circumstances if you answered YES to some of these questions. This is why it is important to explain the circumstances that cause you to answer YES. Items Prohibited or Restricted for Importation into Japan There are additional conditions and provision in the Immigration Laws of Japan that allow denial of landing in Japan to people who possess any illegal items. Further, mere possession of these items could cause you to be detained by the Japanese Authorities. If you are detained, you may be subject to prosecution in Japan, or denial of landing in Japan with immediate deportation back to the United States at your own expense. Possession of Air guns and/or swords or any other weapon is subject to strict legal regulation. Any ingredients that could be used in biological or chemical weapons Illegal drugs and drug paraphernalia Pornography Anything that violates someone’s legal intellectual property rights. Anything directly associated with trafficking in endangered species of animals or plants. Generally speaking, it is not wise to bring any live or unprocessed animal or plant materials into Japan. The following over-the-counter medications are prohibited in Japan (they contain narcotic or stimulant ingredients in excess of the Japanese standard): a. Tylenol Cold medications b. Nyquil c.
