People credited with this unit standard are able to conduct a preliminary NZTA investigation in relation to alleged non-compliance with road transport legislation by a transport service operator or driver, and conduct and complete an NZTA investigation of alleged non-compliance with road transport legislation by a transport service operator or driver. Any legislation or other requirement superseding any of the above will apply for the purpose of assessment. 3 Definitions Organisational requirements refer to instructions to staff on policy and procedures which are documented, available in the workplace, and consistent with applicable legislation and any other applicable compliance requirements. Transport service driver, for the purpose of this unit standard, is as defined in the Land Transport Act 1998. Transport service operator, for the purpose of this unit standard, is as defined in the Land Transport Act 1998. Elements and performance criteria Element 1 Conduct a preliminary NZTA investigation in relation to alleged non-compliance with road transport legislation by a transport service operator or driver. Performance criteria 1.1 Information is confirmed as genuine and is assessed against legislative requirements to confirm likely non-compliance. 1.2 Importance and/or urgency of the matter is assessed in terms of risk and is prioritised, in accordance with organisational requirements. 1.3 Recording of alleged non-compliance is in accordance with organisational requirements. 1.4 Investigation planning and recording is in accordance with organisational requirements. Element 2 Conduct an NZTA investigation of alleged non-compliance with road transport legislation by a transport service operator or driver. Performance criteria 2.1 Evidentiary elements of the alleged non-compliance are identified. 2.2 Security and preservation of potential evidence are managed in accordance with organisational requirements. New Zealand Qualifications Authority 2016 20338 version 2 Page 3 of 3 2.3 Evidence is gathered, preserved, and stored in accordance with organisational requirements. 2.4 Details of party or parties involved in the alleged non-compliance are recorded in accordance with organisational requirements. Range alleged non-compliant party; may include but is not limited to – witnesses. 2.5 Likely defences to alleged non-compliance are anticipated and evidence to counter these is recorded, in accordance with organisational requirements. 2.6 The alleged non-compliance is recorded in accordance with organisational requirements. Element 3 Complete an NZTA investigation of alleged non-compliance with road transport legislation by a transport service operator or driver. Performance criteria 3.1 If non-compliance has not occurred, or no action is to be taken, documentation records reasons and justification, and is completed, in accordance with organisational requirements. 3.2 If non-compliance is confirmed, action recommended is appropriate, timely, and within delegated powers, and is in accordance with organisational requirements. Please note Providers must be accredited by NZQA, or an inter-institutional body with delegated authority for quality assurance, before they can report credits from assessment against unit standards or deliver courses of study leading to that assessment. Industry Training Organisations must be accredited by NZQA before they can register credits from assessment against unit standards. Accredited providers and Industry Training Organisations assessing against unit standards must engage with the moderation system that applies to those standards. Accreditation requirements and an outline of the moderation system that applies to this standard are outlined in the Accreditation and Moderation Action Plan (AMAP). The AMAP also includes useful information about special requirements for organisations wishing to develop education and training programmes, such as minimum qualifications for tutors and assessors, and special resource requirements.
