These requirements include but are not limited to – company employment contracts, company human resource policy and procedures, and legislative requirements. 2 Legislative requirements in this unit standard include but are not limited to compliance with the Health and Safety in Employment Act 1992, Employment Relations Act 2000, Human Rights Act 1993, and subsequent amendments. Outcomes and evidence requirements Outcome 1 Explain the employment contract process as it relates to the New Zealand dairy industry. Evidence requirements 3.1 Company policies and procedures in relation to termination of employment are explained in accordance with organisational requirements. Range 3.2 The basis for fairness and ‘good cause’ are explained in relation to discipline and termination in accordance with organisational requirements. Range 3.3 explanation includes but is not limited to legal basis for termination and company policy guidelines on treatment of termination of employment ‘good cause’ includes but is not limited to – misrepresentation, redundancy, poor performance, misconduct. Steps required for procedural fairness in a discipline situation are identified in accordance with organisational requirements. Range steps include but are not limited to – presentation of allegation, representation, opportunity to reply, investigation, due consideration. Outcome 4 Explain the personal grievance process as it relates to the New Zealand dairy industry. Evidence requirements 4.1 The legal basis of the personal grievance process is explained in accordance with organisational requirements. Range 4.2 legal basis includes – statute, contract, common law, company policy. The performance grievance process is explained in accordance with organisational requirements. Range explanation includes but is not limited to – performance grievance process steps, employer/employee rights, prohibition of strike action.
