Peralta Community College District Board Policy 6.85 Policy 6.85 Independent Contractors/Consultant Applicable laws and statutes, including the provisions of the Internal Revenue Code and the Government Code as it relates to the definition of Independent Contractors and Consultants, shall be followed for the use of consultants. All consultants shall be hired on the basis of demonstrated competence and professional qualifications. Individuals who meet the legal qualifications shall be paid as independent contractors. The following are additional guidelines. 1. Consultants may be employed to advise on administrative matters.. 2. Requests for employment of consultants at the college level must be approved by the President of the college and submitted to the designated District Office administrator. 3. Requests for the employment of contractors/consultants must be approved by the Board of Trustees in advance. When emergency exceptions are necessary, they must be approved by the Chancellor and later ratified by the Board of Trustees. 4. Each college is responsible for limiting the cost of employing consultants to budget availability.
