TERMS OF REFERENCE For one Senior Short Term Expert (STE) to familiarize CSOs representatives with legal and fiscal framework relevant to the third sector in Albania Background of the assignment The general objectives of Technical Assistance for Civil Society Organizations – TACSO Project are to strengthen the overall capacities and accountability of Civil Society Organizations (CSOs) within the IPA beneficiaries, to guarantee the quality of services of CSOs and create a sustainable role for the CSOs in the democratic process. The main purposes of the project are to: Increase and improve the capacity and actions of CSOs and to Improve the democratic role of CSOs. An important activity under this heading is addressing policy level issues which aim at strengthening the CSOs’ role to the democratization process and EU integration of IPA countries and territories. Therefore, the main purpose of this assignment is to contribute to the TACSO project component: Training and Capacity Building for CSOs by assisting in enabling a better environment for CSOs in Albania. Specific objectives of the trainings are: To familiarize Albanian and foreign CSOs operating in Albania with legal and fiscal requirements and obligations. Identify and discuss with CSOs representatives the problems, shortcomings and contradictions in existing legal and fiscal framework that impede the normal performance of CSOs in Albania. Prepare the module of the consultative meetings on legal and fiscal operating environment for CSOs in Albania together with supportive materials (handouts, case-studies, etc) that will be used during the events. Prepare, in coordination with the TACSO Albania Resident Advisor, a detailed list of questions to be covered regarding the legal and fiscal CSOs obligations towards the Albanian Government. Conduct a one-day consultative meeting in 8 different regions of Albania, in close collaboration with TACSO Albania Office, in the above mentioned topics and, if appropriate, plan for the follow-up activities. Prepare a report one week after the completion of consultative meeting s highlighting the entire process, results achieved, participants’ satisfaction with the expert and his/her methodology, main conclusions and recommendations for future activities, etc. Activities to be carried out: Determining in conjunction with the RA the most problematic issues regarding the legal and fiscal framework, together with delivery methods for a successful participatory approach. Deliver consultative sessions with CSOs and government representatives in eight districts of Albania according to the schedule agreed by TACSO Albania Resident Advisor. . Draft standard evaluation documentation for each of the training sessions. Prepare an activity report as stated under Scope of Assignment Location of assignment. Profile of the STE: University degree in economic sciences, advanced degree is an asset. At least 10 years working experience with civil society organizations in Albania. At least 5 years experience with CSOs or relevant organizations, with a specific focus on taxations and fiscal issues. Excellent facilitation and communication skills Fluent in English, any local language is an asset Applicants must be independent and free from any conflict of interest. Note that civil servants and other staff of a beneficiary public administration may not be recruited as STE unless to prior written approval has been obtained from Contracting Authority. Monitoring and evaluation of the STE: The activity will be monitored by the Resident Advisor of Albania.
