McFarland, Superintendent Norfolk County Agricultural High School 400 Main Street Walpole, MA 02081 Re: Mid-cycle Report Dear Superintendent McFarland: Enclosed is the Department of Elementary and Secondary Education's Mid-cycle Report based on the Mid-cycle Review conducted in your district in June 2010. In this Mid-cycle Review the Department monitored selected special education criteria to determine your district’s compliance with special education laws and regulations. The review consisted of information gathered from one or more of the following activities: staff interviews, review of student records, examination of documentation, and/or classroom observation. The Department found one or more of the criteria monitored in your district to be “Partially Implemented” or “Not Implemented.” In all instances where noncompliance has been found, the Department has prescribed corrective action for the district. This corrective action must be implemented as soon as possible, but in no case later than a year from the date of this report. You will find these requirements for corrective action included in the enclosed report, along with requirements for submitting progress reports using the enclosed form. Please provide the Department with your written assurance that all of the required corrective action will be implemented by your district within the timelines specified in the report. You must submit your statement of assurance to Darlene Lynch, Director, Program Quality Assurance Services, by December 20, 2010. Your staff's cooperation throughout this Mid-cycle Review is appreciated. If you have questions about this letter or the enclosed report, please do not hesitate to contact Joan Brinckerhoff at (781) 338-3715. SE 13 Progress reports PI Documentation, student records and staff interviews Special education liaisons provide progress reports to the administrator of special education one week after report cards are issued. Some student records indicated a lack of progress and other progress reports are written broadly, not specifically to the IEP goal. The district must provide staff members who write progress reports (liaisons and related service personnel) with training on writing progress reports specific to the IEP goal. In addition, the performance criteria on Present Level of Performance (PLEP) A and B are blank. The age related considerations on Present Level of Performance B are blank for all students. The Present Level The district must train Team Chairpersons to fully complete the IEP forms. Specifically, this training needs to focus on measurable goals and Present Level of Performance (PLEP) A and B pages. Criterion SE 18B Determination of placement; provision of IEP to parent Criterion Implemented Criterion Partially Implemented (PI) or Not Implemented (NI) Method(s) of Investigation Basis of Determination about Criterion If Partially Implemented or Not Implemented: (a) Required Corrective Action and Timelines for Implementation PI Documentation, student records and staff interviews The district does not secure consent to placement changes initially made for freshmen students. Some students have a partial inclusion placement in middle school and are placed in full inclusion when they enter Norfolk County Agricultural High School. The administrator of special education states that she or a designee attends transition meetings at the sending district, yet the IEP consented to by the parents is not fully implemented for incoming freshmen. The district is responsible for implementing the consented to IEPs for incoming students. The district must conduct an analysis and determine the root cause of the continued non-compliance related to ensuring that when incoming students are scheduled, the individual schedules conform with the current, consented to IEP. The district then must plan and implement actions that will address the underlying cause of the continued non-compliance in this area. Additionally, the district must develop and implement an internal oversight and tracking system to ensure that all IEPS for incoming students are fully implemented. Further, the district must conduct a post-analysis administrative review of student records to ensure that the district is maintaining compliance with the implementation of IEPs for all incoming students. *Please note when conducting Norfolk County Agricultural High School Coordinated Program Review Mid-cycle Report December 1, 2010 Page 11 of 20 (b) Progress Report Due Date(s) and Required Elements Submit a narrative description that identifies the root cause of the continued noncompliance and provides a detailed description of the corrective action steps taken. Please be sure to include the timeline of the actions taken by the district, indicate the staff member(s) responsible for the implementation by name and role and if applicable, the staff members who were involved in the overall corrective action process. Please Criterion Criterion Implemented Criterion Partially Implemented (PI) or Not Implemented (NI) Method(s) of Investigation Basis of Determination about Criterion If Partially Implemented or Not Implemented: (a) Required Corrective Action and Timelines for Implementation internal monitoring the district must maintain the following documentation and make it available to the Department upon request a) List of student names and grade level for the records reviewed; b) Date of the review; c) Name of person(s) who conducted the review, their role(s) and signature(s). Each IEP reviewed that contained pull out services on the C grid had an appropriate nonparticipation justification statement. Documentation, student records and staff interviews The district does not secure parental consent for the changes in placement for freshmen students when there is a placement change from partial or sub-separate placement in middle school to full inclusion in high school. The last one was held in March 2009. The district must provide a workshop on parent and student rights to the Parent Advisory Council annually, as required. Please provide the schedule or calendar of PAC related meetings and trainings for the 2010-2011 school year to the Department by February 28, 2011. SE 34 Continuum of alternative services and placements PI Documentation and staff interviews The district does not offer a continuum of alternative services and programs that meet the needs of incoming students. Specifically, for freshman students, the district is not providing the special education services, related services or placement as indicated and consented to on the student’s current IEP. The district’s practice is to implement some services and place the students in available programming placements at the beginning of the school year, then at a later point in the school year they convene an IEP Team meeting The district must evaluate its existing programs and services, identify the gaps and develop a plan to close those gaps in the continuum of alternative services and placements. The continuum must assure that all students identified as having a specific disability receive appropriate supports and services as described in the IEP. Submit a narrative description of the results of the district's internal evaluation of its existing programs and services, including a description of any proposed expansion of the range of programs and related service options available to meet needs of The district must conduct an administrative review of student records of incoming freshmen for the fall of 2011 to ensure that a range of programs and services are available to meet those needs. Criterion Criterion Implemented Criterion Partially Implemented (PI) or Not Implemented (NI) technology; specialized materials and equipment SE 40 Instructional grouping requirements SE 43 Behavioral interventions PI Method(s) of Investigation Basis of Determination about Criterion and staff interviews supplementary materials that are used to support student learning. Recently three staff members were trained in Kurtzweil. Documentation and staff interviews The grouping that was cited in the CPR is no longer in effect and all groups are within the required student to teacher ratio. Documentation, student records and staff interviews Records demonstrated that the district does not consistently conduct functional behavioral assessments (FBAs) as needed and that the staff members responsible for conducting these assessments are not familiar with the FBA process. Interviews indicated that the guidance counselors have been designated to conduct functional behavioral assessments; however at the time of this review those individuals were not knowledgeable on how to complete a functional behavioral assessment. If Partially Implemented or Not Implemented: (a) Required Corrective Action and Timelines for Implementation The district must provide training to guidance counselors and other staff members designated to conduct functional behavioral assessments, on how to conduct functional behavioral assessments. Further, the district must conduct internal monitoring of student records post-training for compliance with the implementation of functional behavioral assessments. *Please note when conducting internal monitoring the district must maintain the following Norfolk County Agricultural High School Coordinated Program Review Mid-cycle Report December 1, 2010 Page 17 of 20 (b) Progress Report Due Date(s) and Required Elements Please provide evidence of training (agenda and sign-in sheets with name, role and signature) on functional behavioral assessments by February 28, 2011.
