Onsite observations and interviews indicated the following issues in Benjamin Franklin
Classical Charter Public School's special education instructional spaces: 1) related services
are provided simultaneously in the basement's open cafeteria, the cafeteria hallway, in
cubicles located in the cafeteria, or in a small, shared space across from the cafeteria,
thus creating auditory, visual, and privacy concerns; 2) the cubicles are poorly lit and too
small for the number of students receiving services; 3) students in grades 5-8 who
require services are often placed in lower grade level classrooms with chairs and desks
too small, which may be stigmatizing to these students; and 4) students receive special
education services in the second floor computer lab while other students enter and leave
to print materials or access technology, again creating auditory, visual, and privacy
concerns.
Description of Corrective Action:
The BFCCPS administration met to discuss the findings of the CPR with regard to special
education instructional service delivery facilities. Cited were the use of small study rooms
on the lower level as well as a shared OT/Sp/l room on the lower level. Included too were
Classrooms that were inadequate for special education service delivery for students in
grades 5-8
.

August 16, 2013: Classroom on third floor cleared of all computers
August 27, 2013: Classroom on the third floor is furnished with student tables. Grades 38 special education students begin using this room for direct instructional service delivery
as of August 27, 2013.
September 4, 2013 to January 6, 2014: Explore ways to divide room into instructional
sections with minimal auditory and visual interruptions. Continue to explore space within
BFCCPS, in the hope of identifying additional service delivery space (in addition to the
third floor classroom). Explore a way to either remove the printer from that third floor
classroom or to block the view (and noise) to it when students are working in that room.
January 8, 2014 Order materials needed to divide room into instructional sections with
less auditory and visual interruptions.
February 25, 2014: Materials arrive. Installation of dividers etc. for the third floor
classroom.
February 28, 2014- May 23, 2014: Continue to explore and identify additional
instructional service delivery space that is not on the lower level.
May 23, 2014: Identify additional instructional service delivery space other than the third
floor classroom. This could include the space used for PE to be considered for OT use.
June 1, 2014-June 13, 2014: Head of School/Director of Student Services will work with
special education teachers and related service providers on their schedules of service
delivery for the 2014-2015 school year, taking into consideration identified instructional
service delivery space.

August 1, 2014 SE#55 compliance addressed. Students will no longer be serviced in the
lower level study corral areas. Speech and language and Occupational therapy will
arrange schedules so that they will not be servicing in the same room at the same time
(in the lower level) and if they are, a divider will be used between the two.
Of note is that the BFCCPS Board of Trustees is committed to actively pursuing a
construction plan for a new facility. The goal is to have a new facility by August 2015 for
the opening of the school year 2015-2016. The plans for this facility will include separate
and distinct service areas for all support staff including special education. Currently we
continue to rent a facility from the Roman Catholic Archdiocese of Boston that we have
been in since BFCCPS was chartered in 1995.
Description of Internal Monitoring Procedures:
Internal monitoring will be ongoing by Administration, including the Director of Student
Services. The monitoring will be vigilant as to scheduling at the end of a school year (for
the next school year) and at the beginning of the school year. Scheduling will consider the
instructional service delivery space that is acceptable. Instructional space will be looked at
carefully for compliance. Special education staff will be monitored carefully to ensure
compliance. All staff at BFCCPS will be made aware of the consideration not to have
special education instructional service delivery occur in the lower level of the school.
Special ed Parent Advisory Council will be kept informed of progress.

Please submit to ESE on or before November 15, 2013 a written assurance from the
charter school leader that the third floor classroom is now designated for the use of
provision of services for students of special education with privacy, auditory and visual
concerns addressed for these students regarding the technology printer location to ensure
compliance. Please submit to ESE on or before March 14, 2014 evidence of installation of
dividers for the third floor classroom along with a narrative of continuing progress toward
service delivery in compliance with the findings of this criterion. Evidence may include but
not be limited to invoices, photos uploaded of the classroom and schedules of services.
On or before August 4, 2014, an onsite visit with ESE will be conducted to observe
compliance and a review of projected service delivery schedules will also be completed. A
floor map must be provided to ESE to mark service delivery locations. *School districts
and charter schools must demonstrate effective resolution of noncompliance identified by
the Department as soon as possible but in no case later than one year from the issuance
of the Department's Final Program Review Report.

Department CPR Findings:
Document review and staff interviews revealed that staff members are not trained
annually or within one month of employment on physical restraint regulations and
procedures. In addition, identified resource personnel do not have current in-depth
physical restraint training certification, and some staff members could not identify a
resource person.
Description of Corrective Action:
The BFCCPS administration met to identify the root cause which was that BFCCPS staffs
need to be aware of physical restraint, what it is and when to use it and be presented
with this during the first month of employment. BFCCPS October 1, staff meeting was
used to present the DESE power point, to hand out a hard copy of 603CMR46 Specific
physical restraint trained staff members need to be identified. To this end, BFCCPS will
send a staff member to train to be the trainer at QBS-Safety Care in Southborough, MA
who will then come back to BFCCPS and train staff.

any new staff members to ensure compliance on or before November 15, 2013. By March
