The tariff language in section
Attachment J. III.C.1 outlines the process for a customer to request a
waiver from the Safe Harbor Limits. It specifically states “The
affected Transmission Customer may request a waiver regarding the
costs in excess of the Safe Harbor Cost Limit within 15 days of such
notice form the Transmission Provider.”
Reason for Revision
The difficulty is determining when a customer is considered to have
been provided “notice.” Companies are concerned that they must
submit the request at the FIRST notice which is often a very early
stage of the study and based upon results which are unlikely to
represent the final study outcome.

A customer may submit a waiver request, pursuant to Attachment J Section III.C.1, at any time
after the posting of the first iteration of the aggregate study, but not later than 15 days after being
notified that the aggregate study is final. The request should be submitted to _________ and
provide all documentation necessary for SPP to evaluate the request.
