It specifically states “The affected Transmission Customer may request a waiver regarding the costs in excess of the Safe Harbor Cost Limit within 15 days of such notice form the Transmission Provider.” Reason for Revision The difficulty is determining when a customer is considered to have been provided “notice.” Companies are concerned that they must submit the request at the FIRST notice which is often a very early stage of the study and based upon results which are unlikely to represent the final study outcome.
