to obtain either bachelor’s or
associate degrees.

State PST Choice
E l e c t i o n cam paigns are seldom clean.
U nfortunately, the pending representation election for
the right to represent the 45,000 workers in the statew ide
P rofessional-Scientific-T echnical Bargaining U nit is shaping
up as one o f innuendo and distortion.
PST has often been a prize to be sought. Its members
are, generally speaking, the best educated and the highest
paid of the sta te ’s civil servants. They include people with
prestige titles like doctor, engineer, accountant, exam iner,
researcher, nurse, investigatijr, analyst, etc.
Because PSTers are often more vocal "knd critical of
their union, outsiders som etim es m istakenly believe they will
be easy pickings for a challenge.
N otw ithstanding this, PST em ployees have three tim es,
since the Bargaining U nits cam e into existence in 1969, voted
to work w ithin the Civil Service Employees Association. In
1969 they turned down Council 50 of the American Federa­
tion of State, County and M unicipal Employees, in 1972 they
refuted the Service Employees International Union and in
1975 they rejected the Public Employees Federation.
It is this sam e Public Employees Federation, a name
given to a joint venture of the Service Employees Interna­
tional Union and the New York State U nited Teachers, that
again is challenging the Civil Service Employees Association
for the right to bargain for PST employees.
To begin with, PEF is merely a nam e. It has no m em ­
bers, no sta ff, no officers—not even a checking account.
More im portant, it has no record. If PST em ployees should
choose to become members of PEF, th ey will be starting from
scratch. Obviously, m em bers’ problems will have to be set
aside while an organizatiofial structure is hastily put to­
gether. Since it has nothing to defend, it is sim ple for PEF
to attack w ith whatever m eans its organizers hope m ight
confuse PST em ployees. It has n o th in g to lose.
It is always possible to find som e m alcontent to com platn about som ething. In this country, Nazis, Ku Klux
K lanners, Communists and other extrem ists all have the
right to free speech, but n othing says th a t we have to be­
lieve them or even listen. PEF’s organizers, too, have the
right to propagandize through innuendo and distortion and
to use the nam es of those people who are m alcontents. It's
not nice; it’s not clean, but if the people decide the cam ­
paign is one of “outright lies,” as the CSEA’s PST coordinator
has charged, the tactic will surely fail.
The CSEA, on the other hand, h as to stand on its record
—a record built up in large part through the years by the
contributions of its PST members. H alf of the union’s six
regional presidents (who serve also as statew ide vice-presidents) are from the PST Unit, as is the chairm an of the
u nion’s State Division. In addition, h a lf of the regional first
vice-presidents are PST.
PST employees have gone through a lot in the past year
—just like everyone else who works for a living, whether in
the state, its local subdivisions or in the private sector.
Since it has been an em otional tim e, it may be easy to
be taken in by the innuendos and distortions th a t are being
bantered about in this cam paign.
There is little more than a m onth before ballots will
be m ailed for PST em ployees to m ake their choice. That
should be tim e for PST employees to think about the realities
of the choice being faced.

The Governor was also con­
vinced th a t Cuomo needed addi­
tional time to become better
known in the City to give him
a fiffhting chance in the prim ary
against form er Mayor Abraham
D. Beame and form er Rep. Bella
Abzug. who then appeared to
be th e Democratic prim ary fro n t
runners.
This is another year. Since the
Governor is up for re-election,
his political needs are different.
He would like to have a June
p rim a ry to p u t an end to fu r­
th e r speculation about the pos­
sibility of his facing a prim ary
for th e Democratic nomination.
Senator Jerem iah Bloom, Brook­
lyn, has already announced th a t
he would enter such a primary,
and it appears th a t others may
be waiting in th e wings.
A June prim ary would make it
more difficult for any prospec­
tive opponent to establish his
reputation In the state—^particu­
larly during the intervening
m onths through June—since the
Governor will dom inate the me­
dia in his official actions while
the Legislature is in session.
The selection of the prim ary
date is of even greater critical
concern to Republicans. Senate
Majority Leader W arren M. An­
derson, an undeclared candidate
for the Republican nom ination
for Governor, wo;Ud prefer a
September prim ary. As Senate
M ajority Leader, he will be tied
up from now through June in Al­
bany w ith his legislative duties
and responsibilities.
On the other hand. Assembly
Minority Leader Ferry B. D uryea, Jr. (R-Suffolk), who has
already declared his candidacy,
is less concerned with legisla­
tive responsibilities. The Demo­
crats dominate the Assembly (88
Democrats to 62 Republicans)
and, consequently, are in a posi­
tion to pass any bills they wish.
This circumstance gives Duryea—who pilots his own plane
—an opportunity to criss-cross
the State and campaign for the
nomination in th e Intervening
m onths, while Anderson is bog­
ged down in Albany.
Vote May TUt
The Assembly Democrats, with
substantial support from Repub­
licans, who back Duryea, have
already passed a bill calling foj*
a June primary. So far AndersoCi
has managed to keep a lid on
the bill In the Seriate. However,
th ere are several Senators who
are avowed Duryea supporters.
If they vote with m inority Demo­
cratic Senators, It could tilt the
vole against Anderson.
While Duryea and Anderson
have thus far engaged in a
friendly rivalry, the fate of the
bill setting the prim ary date may
precipitate an open break be­
tween them .

An Article 78 proceeding was recently brought to re­
view a determ ination of the N assau County Police Commis­
sioner, who had dism issed the petitioner, a county police
officer, after a hearing on specific N assau County Police D e­
partm ent rules and regulations.
The Supreme Court, Appellate Division, Second D epart­
ment., held th at the evidence in support o f Specification No.
7, “failure to promptly notify the, Police D epartm ent of a
change of status,” was entirely inconclusive and therefore
in su fficien t to support the determ ination sustaining the
charge. However, the petitioner was still dism issed, con­
firm ing the determ ination of the comm issioner.
The court reasoned th at substantial evidence was pre­
sented to support a more serious charge, “conduct unbe­
com ing an officer.” The court also held th a t the petitioner
was not denied a fair hearing by the adm ission, over objec­
tion, of legally incom petent evidence. Since the penalty of
dism issal was based on the charge of m isconduct, w hich was
upheld, the court found it unnecessary to rem it the m atter
for reconsideration of the penalty. In addition, th e punish­
m ent o f dism issal, although harsh, was not “shockftig to
on e’s sense of fairness” and therefore should be u p ^ ld .

THE 'SUFFOLK County Public Em ploym ent R elations
Board, in an April 21, 1976, decision, dism issed a petitioner’s
application to have the Civil Service Employees Association
decertified as the bargaining agent for park rangers in
Suffolk County. Subsequently, the D epartm ent of Park
R angers Benevolent A ssociation initiated a ^iroceedlng pur­
suant to CPLR Article 78 to review the determ ination of
the PERB.
The Supreme Court, Appellate Division, Second D epart­
m ent, held th a t there was substantial evidence on the record
th a t supported the hearing officer’s fin d in g th a t the a f­
fected em ployees were adequately represented by the CSEA
and had the opportunity to participate in collective nego­
tiations. Therefore^ the court concluded th a t the determ ina­
tion under review should be confirm ed. D epartm ent of Suf­

RECENTLY THE New York State Court o f Appeals a f­
firm ed the Appellate Division, Second D epartm ent, decision
925, w hich held it was an improper practice for Nassau Coun­
ty to refuse to bargain w ith the CSEA concerning the sup­
plying of hand tools for police m echanics.
T he case arose when the CSEA filed an unfair labor
practice alleging th a t the County violated Section 209-1 (a)
and (d) o f Civil Service Law. The CSEA argued th a t the
C ounty unilaterally altered term s and conditions of em ­
ploym ent by Instituting a policy th a t required newly hired
auto m echanics em ployed by its Police D epartm ent to fur­
n ish their own hand tools and to sign a statem en t to that

the basis of-race, sex or color, as
stated on federal applications.
The applications also request,
however, th a t the applicant fu r­
nish inform ation on race, sex
and color—with a sm all-print ex­
planation th a t the questionnaire
is voluntary.
Such a questionnaire is des­
tructive for test takers because
statistics based on th e question­
naires are used as ethnic or sex
preference by some groups to
gain access into civil service for
the people of their choice.
An example is coming up in
Ju n e when m any federal agen­
cies will be encouraged to set
aside up to 20 percent of th eir
vacancies for women and m inori­
ties, who will be exem pt from

“How m uch will I get when I
retire” is the big question these
days.
We provided some Information
a few weeks ago w ith extracts
from the official chart. However,
some retirees have protested
th a t although they have been
paid a t the maximum rate for
all th eir working lives, they still
were unable to attain the m aximums cited in the chart, because
deductions over the years were
less th an the yearly earnings
cited. Some people actually do
get maximums. They are people
who worked only for the last
few years but are disabled and
th u s eligible to retire with a
higher (more current) base.

Some people find they are
bored stiff. Others find they

Their friends are all business

kind of work they did. They
w ant to do something but don’t

do. They find being with their
families all of the time n o t n ea r­
ly as m uch fun as when the to ­
getherness was only part-tim e.
Most solutions suggested are
trite — develop hobbles,' develop
friends outside your career, plan
to structure at least p art of your
time after you retire w ith speci­
fic projects.

not a term or condition of em ­
ployment, b u t a qualification for
employment and. as such, was a
m atter w ithin the County’s m an­
agerial prerogative.
Subsequently, the CSEA sought
review of the PERB’s determ ina­
tion under Article 7 of the CPLR.
T he Supreme Court, Appellate
Division, 54 AD 2d 925, held th a t
the PERB’s determ ination was
arbitrary and capricious as a
m atter of law. The court sus­
tained the charge filed by the
CSEA, and rem itted the m atter
to the PERB for entry of an
appropriate order directing the
County to negotiate in “good
faith ,” the subject rule and
policy unilaterally promulgated
by th e County. This decision was
th en affirm ed by the Court of

A recently Im plem ented on e-year probationary period,
expected to include intensive training, should result in an
improvemeift in the quality o f care offered at th e sta te ’s
’M ental H ygiene centers and in a decrease in assaults against
staff.
Such im provem ent depends on th e new people being
trained. If they are assigned Im m ediately to ward service,
w ith no correlative training because o f s ta ff shortages, th en
the extension o f the probation period to one year w ill have
been a wasted innovation.
Even if th e one-year probationary period is accom plished
by training and does produce exem plary workers, there is
still another problem: Most directors and m any workers
adm it th a t som e em ployees in th e M ental Hygfiene in stitu ­
tions, a m inority certainly, are either incom petent or em o­
tionally unsulted for ward service work. T hese people will
still be in th e sta te system . Because they interrupt the e ffe c ­
tive functioning o f th e hospital and detract from the th era­
peutic atm osphere, their presence contributes to th e level

M anhattan Psychiatric Center director Gabriel Koz said
th at working w ithin th e state system m akes it more d iffi­
cult to m otivate the group of employees working a t th a t
hospital than If it were a privately run institution.
"It’s very difficult for m anagers to m anage in the state
system ,” he said. "It’s alm ost impossible to get rid of bad
people on any level.”
He said there are workers, as well as m anagers, who are
incom petent, but th a t "the w eight is on me to show th a t
these people are incom petent, and th a t can take a year.
“The civil service system allows for prima donnas; it
allows for defiance; it allows for passive aggressiveness,"
Dr. Koz said.

“Obviously there’s a great d ifference betw een th e pri­
vate sector and th e sta te,” he said. "There l3 no way for
us to m ove out an undesirable em ployee w ithout going
through a proper disciplinary procedure.”
Lawrence Kolb, former Com m issioner o f M ental Hygiene,
said th a t disposition o f cases Involving questionable em ploy­
ees should be resolved by the directors rather than by going
to arbitration.
"The m echanism s for rem oving unsuitable workers are
there, but it ’s n o t easy. And it shouldn’t be,” assistan t com ­
m issioner John L agatt said.
"I don’t think it should be easy to rem ove a public em ­
ployee from his public job . . . I subscribe very strongly to
th e concept th at, in disciplinary m atters, th e burden of
proof is on th e employer,” Mr. L agatt said.
"We fall down In perhaps n o t preparing our proof e f­
fectively; There are those few directors who say th is guy is
no good, and th a t’s enough. It isn ’t enough. You say h e ’s no
good; show m e.”
Mr. Lagatt ifold th a t he was "saddened by the union’s
blind attitu d e” in d efending all cases. He indicated that
there are unions th a t first screen w hich cases will be de­
fended.
Roger Heath, director o f U tica and Marcy Psychiatric
Centers, m ade the point th at, "It’s no more in the union’s
best interest to have em ployees who abuse p atients th an it
is in m anagem ent’s . . . If som e way or another we can ’t
deliver decent services to people using the system in w hich
we work, w hich includes CSEA members, som eone’s going
to find out another way o f doing It better.”
Mr. H eath com plained th a t even w ell-docum ented pa­
tien t abuse cases do not alw ays result In discharge o f the
em ployee. He estim ated th a t problem s such as assaults
against sta ff could be reduced by as m uch as 50 percent,
if the disciplinary process worked effectively.
Part o f the b u ilt-in inadequacy o f the disciplinary sys­
tem , he felt, was th at arbitrators are prone to compromise
because o f th e way in w hich th ey are selected for a case.
Either side m ay reject them . To be picked regularly they
m ust dem onstrate a balanced record w hich favors neither
m anagem ent nor labor, he said.
Alvin M esnikoff, New York City regional director, also
com plained about the arbitration procedure as one which
"compromised the issues.” He approached the problem of
inept s ta ff by saying, "This isn ’t a job for everyone. It’s
really not an issue about being discrim inatory or prejudicial
toward people. We need to select out those people who tem ­
peram entally can handle th is kind of th in g.”
Mr. Heath, who began as a ward atten d an t 30 years ago
and worked his way up to th e directorship, suggested, based
on his long and varied experience, that; another problem
in w eeding out the problem worker is determ ining who he is.
Although sta ff, according to Mr. H eath, knows who the
bad workers are, there are basically two ways the nam e of
a questionable employee will reach m anagem ent, he said:
first, If another em ployee has a grudge against him; or
w hen a new em ployee, who has n ot yet learned the ropes,
passes the inform ation on.
Once m anagem ent is alerted about an em ployee who is
alleged to have abused a p atient, it would, in som e cases,
be better if the union "lost a few ,” Mr. H eath said.
"It’s ju st a se lf-in flicted wound If we have a system
th a t forces m anagem ent and the union to Include among
their em ployees or members people who obviously are not
fitted for the kind o f work th e y ’re in.”
. Mr. H eath said th a t if he and Roger Piersall, for ex­
am ple, th e CSEA U tica P sychiatric C enter Local president,
were to Independently establish lists co n ta in in g th e nam es
o f those em ployees w ho should n o t be w orking on th e wards,
th e lists would have 18 nam es in com mon.
F inding those people, “w ould-elim inate more th a n h a lf
our problems, Just by d oin g som eth in g sim ple like that:
h avin g th e ability to get rid o f deadwood,” Mr. H eath said.
“We have an apparently inept fem ale em ployee, who. on
three occasions has*m anaged to m iss her chair w hen sitting.
T h a t’s good for 18 m onths o f compensation.*'
“Y ou’ve got to have understanding, support, goodwill
betw een union and m anagem ent on this— a m utual trust
th a t w hat you’re doing m akes sense for everybody,” Mr.
H eath said.
Dr» M esnikoff also called for cooperation betw een union
and m a n a g m e n t, saying: “T he strength o f the union in
representing its em ployees— w hich is understandable, after
all th a t’s w hat it’s there fot*—has n ot been well balanced
against th e m anagem ent o f th e facility and the interests o f
th e p a tien t.”
He said th a t if m anagem ent is to have greater discre­
tion in dealing w ith unsatisfactory em ployees, th en m anage­
m ent m ust be trusted to be fair.
Former Comm issioner Kolb said th a t a r e c e n t . study
showed th a t there has been a change in the view o f the ar­
bitrators, who are more w illing to “detach from th e service,”
unsuitable em ployees.
“We think th a t th e present tendency to bring all the
cases o f alleged assault (ag ain st p atien ts) to arbitration,
thus reducing the authority o f th e directors o f th e in stitu ­
tion, is indeed one w hich allow s the continuance of som e
few people who would better be detached from th e service.”
Robert Guild, CSEA collective bargaining specialist, felt
th at, as stated in th e CSEA contract, it is th e u nion’s respon­
sibility to defend all its m embers, and th a t w ithin th a t pur­
view' there is-no room for com prom ise.
A sim ilar view was expressed by W illiam Blom, CSEA
director o f research. An exception, he thought, m ight be a
clear-cut case Involving an extrem e crim inal action, such
as th e taking o f a life.
The attitude th a t a union autom atically defends all
members accused by m anagem ent o f incom petence or m is­
conduct apparently is shared by m ost labor organizations.
Mike Grace, who heads public relations for the AFL-CIO
public em ployees division in W ashington, D.C., said th a t
union routinely defends all members.

by its national public relations director, Alan Bigs, who did
not feel th a t greater discretion in discharging allegedly inept
em ployees should be extended to m anagem ent: “G overn­
m ent is always looking for greater prerogatives,” he said.
“T h a t’s why w e’ve got unions.”
Jam es Featherstonhaugh, attorney for the CSEA, said
th a t all m embers charged are defended, as a m atter of
course, because it is too difficu lt to m ake an Independent
determ ination of guilt or innocence. If an em ployee who felt
entitled to representation did not receive it, he could sue.
Mr. Featherstonhaugh acknowledged th at the actions
of certain em ployees could be a contributing factor to the
problem of assaults against sta ff, along w ith such other
influences as understaffing. But he was reluctant to abro­
gate any authority to defend em ployees, because he felt
th a t m anagem ent could not always be trusted to be fair;
th at in some cases, m anagem ent would cave in to the de­
m ands o f pressure groups and decide an em ployee’s fate
based on the needs of those groups, rather than on w hat
w as fair for the worker and best for the institution.
There is a m inority o f workers who are unsuited for
ward service work and should not be em ployed in the M ental
Hygiene centers. P erm itting m anagem ent greater authority
in discharging such people would risk the dangers th a t such
power m ight be m isused or not handled w ith skill and
courage.
T hat risk m ust be evaluated while keeping in m ind this
fact: Those who ultim ately su ffer m ost from retain in g such
workers in the sta te system are fellow workers and patients,
who m ust interact daily in an atm osphere, w hich can quickly
deteriorate w hen influenced by poor quality em ployees.
As stated by Dr. M esnikoff, such a process would de­
pend on workers trusting th a t xnanagem ent w ould operate
fairly. B oth Dr. Barton, director o f R ochester P s y c h ia M
Center, and Dr. Koz, director o f M anhattan P sychiatric
Center, said there are m anagers who should n o t be in th e
system .
D espite th e risk, factors contributing to th e problem
o f assaults a ga in st s ta ff should be considered as a package
for review by both th e union and th e state. T he union m ight
review th e possibUlty o f gran tin g m anagem ent m ore pre­
rogative in th e discharging o f incom petent em ployees, or
at least reassessing th e requirem ent th a t all workers be
defended. T he sta te could exam ine th e possibility, o f greatly
expanding its training an d education { ^ g r a m s , and in ­
creasing th e sta ff.
As Mr. H ealth, director o f th e U tica and Marcy P sy ch ia t­
ric Centers, said, “To in sist th a t every perm anent em ployee
be retained in sp ite of th eir problems . . . is n o t in th e best
Interest o f th e sta te, m anagem ent, th e union or th e clien ts.”
The other part o f th is m atter is rewarding those em ­
ployees who excel. If m anagem ent were to be granted greater
prerogative in discharging th e incom petent, th en tied to
th at, along w ith increased training and sta ffin g , should
be greater advancem ent opportunities for th e qualified,
highly experienced career worker.

Many directors have said th a t th ey would prefer to
prom ote from th e ranks an em ployee w ith dem onstrated
ability and experience, rather th an bring from th e outside
som eone who m ay have spent six years in college, but who
has no idea o f w hat life is like in a developm ental or psy­
chiatric center.
O ften, a problem w ith m aking such a prom otion is th a t
th e jum p from a grade 13, in th e career ladder, requires
college education, a prerequisite th a t h as stopped m any
otherwise qualified people. The m ost logical, although prob­
ably m ost expensive way to rem edy th is problem, would be
the establishm ent o f w ell-funded educational programs in
the D epartm ent of M ental Hygiene.
A nother possible solution would be to ch an ge th e rules.
Deputy director o f the D epartm ent of Civil Service Robert
Quinn said th a t “m inim um qualifications is a subject w hich
can be worked out betw een the D epartm ent o f M ental Hy­
giene and Civil Service.”
He said th a t ways could be explored for possibly settin g
up three alternative sets of qualifications, such as: four
years of college; two years college plus certain experience,
or no college but certain experience.
“For an individual who com es In as a therapy aide, who
works an d learns and does well, we don’t have a system
o f increasing their chances o f prom otion once th ey reach
grade 9,” said SyracCise D evelopm ental Center deputy direc­
tor Chuck Soper. “Also where does th e grade 13 go w hen
he has reached his m axim um level?” he asked.
A related problem th a t results from th e way the system
is set up involves em ployees for whom a transfer from ward
service to another section o f the hospital m ay be th e best
move.
Because the salaries for ward service work are higher
than those for support services,, such an em ployee would have
to take a cut in pay to transfer to the cen ter’s laundry, for
exam ple, although both he and m anagem ent m ight agree
th at such a move was desirable.
There seem s to be no easy solution to th is problem. In ­
creasing salaries for work in other sections o f th e centers
—to m ake them com m ensurate w ith ward service salaries
—would apparently require increasing salaries for all work­
ers at th a t level throughout the civil service system .
Salaries at other levels m ight th en have to be adjusted
upward to m ain tain th e proper increm ental steps. It does
n ot sound like a plan th a t would receive a sym p ath etic re­
view from the State.
Some factors th a t Influence assaults again st sta ff are
clinical, and will be discussed In the n ext Installm ent. Others,
w hich relate to the Civil Service System and how it is m an ­
aged, include understaffing; not enough m en on th e wards,
low morale; inadequate training; incom petent m anagers
and workers and bureaucratic com plications th a t thw art
prom otion according to ability.
Because th ese problems prevent the psychiatric and d e­
velopm ental centers from operating m ost effectively, it Is

Moody’s Investor Service, which has given New York City low
investm ent ratings several times, has done th e sam e thing to Erie

nounced it will lay off 3,500 woricers. Miffed county officials say the
ratings should improve rath er th a n drop since the county has im ­
proved its financial situation. County officials also say th e layoffs
should not affect the county finances.

Editor, The Leader:
I enjoyed your article on the makeup of regions, etc., and
I felt it w«s very timely in acquainting our many newly ac■quired members with some good solid background inform ation
o n our union’s structure. We, also, tend to forget th a t not
everyone gets the structure explained when they become in ­
volved in CSEA.
It was interesting th a t you noted the fact th at Local 999
(Capital Area Retirees) was the largest in membership of Re­
gion IV chapters.
A study of our latest membership report vividly points
out th a t the retiree membership a t one ten th our standard
d u es'stru c tu re now numbers almost 10 percent of our rolls.
This pressure group w ithin CSEA has become increasingly
more vocal and demanding of attention.
Obviously, the m atter of how and in w hat m anner CSEA
as a public employee union will be reacting is of interest to
all our membership. The topic of our retirees’ role in our
organization is <becoming more and more an area of heated
debate a t various meetings. Perhaps, yoiu: readers’ reaction to
where the CSEA should be standing policy-wise in this m atter
of retiree vis-a-vis still publicly employed members would
be worth exploring.

I wish to reply to the letter of Joseph E. McDermott, Re­
gion IV presidetit, CSEA, in the Leader of Jan, 27, 1978.
The leter refers to our retiree membership and character­
izes us as a pressure group who only pay 10 percent of the
working members’ dues
Most of our retiree problems are financial and health. We
are dependent on our pensions to exist. The cost of living
since April 1969 has gone up conservatively 60 percent. How
m any raises has the working membership received since April
1969, as well as all other strata of the population? The last
supplemental increase we got was up to April 1969.
I get letters from my membership indicating they and
their families have cancer, strokes, h ea rt conditions as well
as other physical ailments.
How much does dental and medical w re cost?.W e do not
have a dental plan and medicare only covers 80 percent of
costs. The balance of medical costs can bankrupt us.
The life expectancy of a m an today is 69 years and for
a woman 76 years. The average pensioner who retired since
1969 is about 70 years of age. How much longer do we have
to live? Time is of the essence.
Our program calls for a perm anent cost-of-living in ­
crease, a supplemental increase from April ’69 through 1971,
a minimum retirem ent of $4,100 after 25 years and coverage
under a dental plan among other points.
Do you feel th a t this is an unrealistic program adopted
by the statewide retiree committee? I t is not needed in these
inflationary times?

You call us a pressure group and emphasize our 10 per­
cent dues. Is CSEA only interested in our dues?
The October 1977 convention approved almost u nani­
mously giving retirees the right to vote in CSEA elections and
to hold office, subject to the approval of the April Convention.
It was dem onstrated th a t the retirees built the CSEA.
The working members today are the retirees of tomorrow.
It is about time th at retirees exert pressure both on our
officers and the state government. We have been quiet too
long and our cause is a ju st one.

duced K enneth Cadleux, C hair­
m an of CSEA’s Constitution and
By-Laws Committee. Mr. Cadleux
said he had been given the im ­
pression th a t the retirees were
upset with him and his com­
m ittee. He said th a t as standing
committee chairman, he does n o t
have a committee vote except in
case of a tie. T he m ajority view
of his committee has been in
opposition to lifting the restric­
tions attached to retiree mem­
bership which did not reflect
his own views. He reminded the
retirees present th a t it was orig­
inally the request of th e retiree
committee th a t for th e reduced
dues advantage, retirees willingly
forfeited th e right to ru n for
state or regional office and to
vote In such elections.
Mr. Cadleux acknowledged
th a t time and clrcmnstances
have changed and he felt th a t

BUFFALO — Alexander T.
Burke, Sr., 74, a pioneer in
the Erie Local of the Civil
Service Employees Associa­
tion, died Jan. 24 in a Buffalo
hospital.
Mr. Burke was president of
the CSEA Erie Local from 1959
to 1965 and lobbied for CSEAbacked bills in Albany during his
tenure as Local president.
He was employed by th e Buf­
falo Sewer Authority until his
retirem ent. In 1974 as chief con­
struction inspector, and helped
organize a CSEA u n it ’of the
Erie Local a t the BSA.
Mr. Burke, an active Democrat,
ran unsuccessfully for th e State
Senate in the 1950s. He was a
member of the Holy Name So­
ciety of St. Bernard’ Church and
helped organize Boy Scout Troop
75 a t Transfiguration Church.
He was a Buffalo native and
served In the Coast G uard In
the 1920s.
Surviving are a son, Alexander
Jr.; a daughter, Delores Gladkl;
sU grandchildren, and three
great-grandchildren.

One of our m ost highly regarded officers. Capital Region
IV president Joseph McDermott, had a letter to the editor in
the Jan. 27, 1978, issue of the Civil Service Leader w hich
has brought an unexpected batch of m ail to the retirees’
office at the CSEA headquarters.
Mr. M cDermott’s letter m akes the point th a t CSEA’s
retiree organization "has become more vocal and dem anding
of a tten tion .” We hope th a t he is right, since it is still “the
squeaky wheel th a t gets the grease.”
Working people everywhere are becom ing more retire­
m ent conscious, even years before they approach retirem ent
age. And working members of the Civil Service Employees
Association are no exception. R ank-and-file members are
beginning to realize th a t w hen they enter retirem ent, they
stand to gain from w hatever improved benefits today’s re­
tirees are able to pick up.
Other unions, both public and private, are learning the
value of taking good care of their retirees. U ntil recent years,
CSEA has moved slowly in th a t direction, seem ingly im ­
pressed by the fact th a t retirees pay only 10 percent of
regular CSEA dues, forgetting th a t m ost retirees had paid
full dues for m any years, long before there was an agency
shop law.
Members not yet retired know th a t tim e flies and th a t
sooner than they think they also will be retirees. By th a t
tim e I think th at members like our friend, Joe M cDermott,
will be am ong our m ost "vocal” cham pions for retirees’
benefits.
As for other unions, AFSCME has begun organizing
retired public em ployees and has opened another office for
th at purpose in Florida. "Gray power” is no longer the wave
of the future; it is here. The tim e has come w hen elected
governm ent officials count the strength of a union’s retiree
members as a political factor to be considered.
In the private sector, large industries like General Elec­
tric Company continue to grant their retirees cost-of-livin g
increases, responding to pressures from the union, GE locals,
and GE retiree clubs. E ffective last October, those who re­
tired on or before Jan. 1,1975, received a 10 percent increase;
those who retired on or before July 1, 1975, received 8.23
percent; before Jan. 1, 1976,. 6.5 percent; June 1, 1976, 5
percent, and Jan. 1, 1977, about 3 percent.
CSEA need n ot be apprehensive about the growth of its
retiree branch but should nurture th a t growth. R etirees are
not bound by the restrictive and punitive m easures o f the
Taylor Law and, w ith a little encouragem ent, can become
more helpful to the union in m eeting future crises.
The little encouragem ent sought by the retirees simply
m eans a little more acceptance. Retired members who pay
full dues already enjoy the right to vote and run for office.
So, the issue is m onetary, n o t age and not whether they are
working or retired. Those who oppose retirees gaining the
right to vote in A ssociation elections are actually saying,
“Pay full dues and you can have it. If you can no longer
afford it, that is too bad.”
The pressure is being applied again to have Comptroller
Arthur Levitt bail New York City out of Its financial mess
by use of some of the R etirem ent System ’s $9-billion pension
fund. We are confident th at Mr. Levitt will n ot yield and
we support him all- the way.
The Comptroller has outlined his goals for 1978 legisla­
tion for the supplem entation of retiree pensions. Some of
them are identical to* CSEA retirees com m ittee legislative
goals for this year, such as extending the c o s t-o f-liv in g
supplem ent beyond the present cu t-o ff date of March 31,
1969, to irlclude retirees through 1976 on a graduated scale,
m aking the supplem entation perm anent, removing the re­
quirem ent that the retiree be age 62 before June 1, 1972,
and a number of other improved retirem ent benefits which
will be explained here in a future column.

ALBANY—Some key Issues including changes
in convention practices,, legislative priorities and
successful grievances were discussed at the re­
cent Civil Service Employees Association Capital
Region rv m eeting held Jan. 16 a t the Italian-A m erican
Community Center in Albany.
As p art of a cam paign to increase the effectiveness of
the Region by learning where problems lie, regional
president Joseph McDermott opened the meeting with
the distribution of questionnaires to be filled o u t by
delegates.
The questions dealt with Local practices concern­
ing constitutions, the powers of the Board of Directors,
appointments, types of committees and th e relation­
ships between the Locals and the field representatives.
Mr. McDermott announced th a t a t future meetings the
results of questionnaires would be discussed and new
ones would be distributed.
Continuing his report. Mr. McDermott introduced the
officers of the new Court Local and the H ealth Research
Ixistitute Local. He announced new co m m itt^ appoint­
ments and briefly reiterated the CSEA’s reactions to

CSEA executive vice-president llio m a s McDonough
reported th a t one of the CSEA’s top legislative priorities
for 1978, the am endm ent of the Taylor Law, is one
"which won’t cost th e State of New York five cents.”
He continued th a t the CSEA is seeking a reduction In
the strike penalties, which Include the loss of two days’
pay for every day of the strike, the loss of seniority,
probation and heavy fines.
Mr. McDonough announced a change in the form at
of statewide conventions to a two-day spring co n v ^ tio n
and a five-day fall convention. This year’s spring con­
vention will be held in Albany on April 3 and 4.

Mr. McDonough commented on the practice of some
Locals on negotiating contracts w ithout the aid and
presence of professional CSEA personnel and w am ed
th a t a single word could affect the interpretation of
the contract.
He said th a t statewide president William McGowan
had secured $50,000 from the CSEA Board for the
purpose of challenging other unions. " It is about tim e
th a t the CSEA takes this kind of action in th e labor
world,” Mr. McDonough said.
Mr. McDonough told the delegates th a t proxies a t
statewide Board of Directors mefetings would have all
the rights of Board representatives, except voting and
the privilege to m ake motions. These changes, he stated,
aref in keeping with laws governing non-profit organi­
zations.
Regionali first vice-president Jack Dougherty w arned
th a t the CSEA should "work together and stop fighting
among ourselves.” He declared th a t personality conflicts
and internal politics could prove detrim ental to the;
union and leave it ripe for challenges by rival imions.
The question of w hether or not member discounts
should be given to Agency Shop members was answered
by several officers. All said th a t they should not.
Richard Doucette, of th e Public Service Local, re­
ceived a round of applause for his remark, "Agency
Shop people have reasons and principles for not Joining
the union and the union should have, in turn, reasons
and principles for not allowing them benefits reserved
for members.” Tim othy Mclnerney, regional second
vice-president, rem inded officers th a t the Locals should
also take into account th a t they have not as yet re­
ceived revenue from Agency Shop fimds.
The issue of Mr. McGowan calling for copies of all
Local constitutions was brought up and those concern­
ed were informed th a t th e reason for the check stemmed
from the discovery th a t m any Locals were functioning
when, in fact, they were not chartered. They were fu r­
th er assured th a t Mr. M cDerm ott would request th a t the
CSEA acknowledge th e receipt o f the individual copies.
Other delegates who were concerned about the state’s
Civil Service reform measures were told th a t th e CSEA
was keeping abreast of th e new developments and would
oppose any reforms th a t It felt were n ot legitimate.
Anthony “Duke” Caruso, president of the Tryon School
Local, spoke for m any officers in expressing concern
th a t the regional field representatives were overworked
and th a t the staff as weU as th e elected officials wouW
be better served by the addition of more representatives.
Mr. McDermott replied th a t a 25;page documentation
detailing the need for more jstaff *^had been submitted
to headquarters by Mr. Corcoran and himself. He stated
further th at it appeared th a t th e measiire would result
in one extra worker immediately, and one toward the
end of the year.
Several delegates requested th a t a le tte r of commen­
dation be sent to B arbara Falzano, regional re s e a rc h
analyst, and Daniel Campbell, regional public r e la tio n s
director, for the excellent Job they did con:ipillng the
booklet “Compendium of Agreements Between th e CSEA
and the State of New York.”
