(Leader photo* br T ^ K ^ l u ) Facf-Finder To Sfudy Thruway Impasse Issues ALBANY—An impasse has been declared by the Civil Service Employees Assn. in negotiations affecting over 2,000 toll, maintenance and clerical employees of the State Thruway Authority, and the Public Relations Board (PERB) has appointed a fact-finder to enter the negotiations dispute between CSEA and the Thruway Authority. Albany Law School Professor R a l p h S e m e r a d h a s been n a m e d by P E R B to serve as a f a c t - f i n d er, a n d Prof. S e m e r a d h a s said he expects to m e e t with representatives of b o t h sides quickly. T h e CJSEA-represented T h r u w a y employees h a v e twice rejected o f f e r s f r o m t h e A u t h o r i t y for a new c o n t r a c t to replace t h e last c o n t r a c t which expired J u n e 30. CSEA declared t h e impasse d u r i n g t h e first negotiating session between t h e two sides a f t e r the second c o n t r a c t rejection. T h e u n i o n said t h e A u t h o r i t y was unwilling to negotiate f u r ther on economic issues, including salaries, a $6,500 m i n i m u m hiring rate, a n d s h i f t pay d i f f e r entials. Th^ reodmmendAtions, Mr. Clark notfcfl, were made after months of meetings and deliberations by the committee, which traveled all met the arta/te I f ^ summer in efforts to learn f i t ^ hand what the problems and politics are in the vurioiu regions of the statewide OSEIA organization. "The committee has worked very hard to take into consideration local feelings in making these statewide recommendations," Mr. Clark said. He pointed out that in addition to consultatitos wMb r««httwL poUtloftl action committees, the staltewlde comjnittee had held a series of open meetings at which rankand-file members wn-e afforded an oin>ortunity to voice their opinions on endorsements. This is only the second time that CSEA's statewide organization has taken the plunge into political endorsements. After years of political neutnality at all levels, the statewide organization made its inftial endorsements for legislative candidates two years ago. At that time, the committee chairmanship was held by liiomas H. McDonough, who is' currently executive vice-president of the Employees Association. At the time of OSEA's first foray into political endorsements, only 94 legislators weire singled out for the stamp of ipprpvml. With the earlier experience under its belt, CSEA has been able to mote than double the nund>er of endorsements made this year. In 1972, 0 8 ^ endorsed 37 candidates for.! the Senaite, of which 20 emerged as winners. For the Assembly, 50 out of 07 endorsed candidates won. Altogether. it meant about 75 percent of the OSEA-endorsed candidates went on to victory. In accordance with the contractual agreement the union filed e third-step grievance to which no response was received. Subsequently a hearing was held on the grievance a t which Mr. Greenidge was the hearing officer though he, himself, h a d preferred the charges. • J o h n Griffin was suspended on July 3. placed on mandatory vacation Aug. 1 a n d reinstated to work on Sept. 4. In effect Mr. Griffin suffered a two-month suspension without any charges filed against him. • Mattie Blue was summoned to a hearing Oct. 9 before the personnel officer and immediately suspended for 60 days. No charges were filed against Ms. Blue nor was the CSEA executive director of the union notified of the suspension within the required 24 hours. Green Haven i f^'BtORNimilM'lli- Representatives of the CivU Servi* employees Assn. and the State Correctional Services Bteparfment met Oct. 15 to discuss the future of 18 employees in shops being phased out at the Green Haven Correctional Facility here. Green Haven Is in the process of shutting down its industrial shops, where 18 CSEA members work. Two shops have already closed, a n d two more will be phased out within six to 10 months, according to Correctional Services Department officials. The prison's garment shop will be transferred to Clinton Correctional Facility, and the Department wants to transfer a pieneral foreman and two foremen to Clinton along with the shop. CSEA Team The CSEA team a t the meeting consisted of Green Haven chapter president Angelo Senisi and two of his foremen; field representative John Deyo; Jack Weisz, Correctional Services Departmental representative to CSEA's Board of Directors, and CSEA regional public relations associate Geni Abrams. The Department was represented by Allen F. Mills. Director of Correctional Services; Howard Kelso, of the Department's division of employee relations, and Tom Adams, the prison's superintendent of industries. In response to CSEA questioning, Mr. Mills repeatedly said he has no schedule for t h e phasing out of the industrial shops now operating at Green Haven, or for their replacement by new shops. Shops planned for Green Haven include a n optical lab. plant engineering shop, auto mechanics shop and an upholstery and hospital equipment repair shop. Mr. Weisz. Mr. Senisi and Mr. Deyo demanded to know "who is going where and when they are going there." They insisted t h a t employees in the industrial shop are intelligent and mechanically able men who could easily be retrained to teach in the new shops, a n d who may very well already be qualified to teach in them, because of previous experience or training. To Start Screening The state officials promised to s t a r t "a screening program" a t Green Haven to see how many of the employees have qualifications to work in the incoming shops, but refused to say when the screening would begin. He also promised to obtain a list of civil service qualifications required for Jobs in the new shops, and to send a copy of t h e m to Mr. Deyo. Names of streets have been changed, posters distributed, meetings held . . , the whole bit. I t seems t o this writer, however, t h a t some b a r n door closing while the horse still h a n g s out there would be a good idea. In the n a m e of t h e economy (certainly not in the n a m e of common sense at any rate!) t h e top people in the Fire Departm e n t are trying to do a top r a t e Job with a force which simply cannot handle t h e Job. I am referring now to t h e Fire Marshals. At t h e present time we have a staff of 63 Marshals. Of t h a t number, a t least a few are in radio cars and available for duty around the clock. Others are on special assignments, stalceouts, etc. T h e r e are over eight million people in t h e City of New York of whom especially of late, it would seem t h a t quite a percentage. especially in the ghetto areas, are seemingly bent upon reducing t h e City of New York t o ashes. Bronx causing serious i n j u r y to eight firefighters a n d lesser injuries t o a score or more of their buddies could most probably have been prevented if t h e r e were sufficient Marshals on t h e staff to do a proper stakeout because, many fires h a d taken place in t h a t building, all t h e work of a n arsonist and, under normal circumstances t h e building would have been staked out on the n i g h t t h e fire was set. Instead, the arsonist h a d free reign and t h e final fire was the one which broke the camel's back—so to speak—resulting in 32 firefighters being burled a s the interior of t h e building collapsed inito t h e cellar. How m a n y more such incidence will take place before the budget boys get s m a r t to t h e m selves? Of course, as long as Commissioner O'Hagan'e policy of "dollars before lives is permitted to continue. I auppoae t h e situation a s outUned above will also continue. T h e Fire Marshals estimate t h a t a fores no fewer t h a n 250 Marshals would be needed to provide minimal protection for a city with the population t h e size of New York. Urvin ln€reas€ In N 10.4% MinoHfy MANHATTAN — The City last week released the results of an ethnic survey of City workers which showed a 10.4 percent increase in minority city employees in 1974, as compared with 1973. T h e survey, conducted by t h e D e p a r t m e n t of Personnel, covered some 162,757 city employees, including 52,958 minority employees. I t showed t h a t there were 41,287 black employees working for t h e City in 1974, u p 8 percent f r o m 1973, a n d 10,458 Spanish - s u m a m e d employees working for the City in 1974, u p 22 percent f r o m 1973. I t also showed t h a t female representation has increased approximately 6.2 percent in 1974. T h e r e were 45,970 female e m ployees working for t h e City in 1974, as compared with 39,692 in 1973. Female representation in t h e Office Administrative job category. in which t h e m a j o r i t y e a r n between $16,000 a n d $25,000 an- nually, also showed a 9.3 percent increase, f r o m 542 workers in 1973. to 648 workers in 1974. T h e survey was m a n d a t e d by the Federal Equal Employment Opportunity Commission, and categorizes t h e work force by sex a n d six different e t h n i c groups. They a r e white, black, S p a n i s h s u r n a m e d, Asian-American. American Indian, a n d other. It was composed primarily of agencies u n d e r t h e Jurisdiction of the Mayor, a n d includes all City employees except those in the O f f - T r a c k Betting and Health a n d Hospitals Corporations, t h e Board of Education, t h e Board of Higher Education, the Office of Probation, t h e City Council, and t h e Traixsit. He started working in the Bronx. T h e n suddenly he showed u p in his old base of operations around Atlantic Avenue in Broolclyn a n d one fire a f t e r a n o t h e r in t h a t area, all with his trade m a r k , indicated his presence there. As one Marslxal said, it was a s though he was j u s t screaming to get bagged. T h e boss was asked for permission to stake him out a n d the permission was granted but with t h e warning t h a t t h e Bureau couldn't a f f o r d a n y long stake o u t . . . a few days a n d the troops would have to forget it! Well, they went to work around the clock. T h i s guy was a slippery eel a n d wiggled out of every trap. T h e stakeout went on for ten days a n d they were within p e r h a p s days or h o u r s of collaring t h e guy when t h e Chief, for money reasons, ordered t h e m to call a halt. They would have to a t t e n d t o other m a t t e r s . . . the budget couldn't stand t h e gaff. T o this day t h a t arsonist is loose a n d doing a seemingly fine Job in Bronx a n d Brownsville. T h e r e Is simply not enough money to permit long t e r m stakeouts on birds such afi t h a t one. Dr. Wenzl is prepared to take the lead in two major programs. One is to prevent public officials from making the public employees the principal victim in government efforts to fight inflation by cutting worker's salaries by reducing personnel and by taking awiay fringe benefits. The other is to reopen wage and salary negotiations to make up "for the unforeseen erosion in the purchasing power of the dollar" during the first two years of the present .threeyear contract. The road ahead will be a difficult one. President Ford's first step in the fight against inflation was his recommendation to delay for three months a 5.5 percent salary increase for Federal employees recommended by both the Federal Office of Budget and Management and by the Federal Civil Service Commission. By a bipartisan vote, the Senate rejected the President's recommendation. Ironically, the President sought to delay this 5.5 percent increase at a time when the Cost of Living Index showed an 11.5 percent increase in living costs. Various members have protested the practice of "Continuous Recruitment Examinations." Examinations for the same title m a y be given every few m o n t h s . The Individual who passes t h e e x a m ination m u s t be reached f o r a p p o i n t m e n t before his eligibility terminates, which Is one year. An Individual with a low mark m a y never be reached since those Individuals taking a later examination a n d receiving a higher m a r k would be Interfiled ahead of those Individuals taking the earlier examination. We registered a vigorous protest. We proposed t h a t everyone on t h e early Usts be appointed before the agency goes to later lists. We also proposed t h a t an employee on any list should not be required to take a n examination for the same position unless h e wished to improve his mark. His eligibility would last for four years and In addition only his highest m a r k should be used. At first they wouldn't consider it, b u t later said they will review the feasibility. We criticized t h e system of caixvasslng a list. We pointed out t h a t declinations are obtained u n d e r duress. T h e y felt this was difficult to prove, b u t m e m bers should m a k e this known to CSEA. Recently they did find a n agency guilty of this a c t a n d h a d them re-canvass a list. They also agreed It was improper to take a person off a list for a specific area simply because t h a t person refuses a job in a specific unit In t h a t area. They will also follow up on complaints t h a t emjployees on lists are n o t given adequate consideration because the agency h a s someone else in mind who is not even reachable. Another request we made was t h a t candidates taking stenographic exams should not have to repeat t h a t p a r t of the exam they passed. They will give us an answer a t a subsequent meeting. Your Resolutions Committee has m e t on two occasions primarily for t h e p u r pose of ascertaining Its role which h a s Increasingly changed over t h e years as a result of the adoption of t h e Taylor Law by the New York S t a t e Legislature. Prior to our initial meeting, we f o r warded a communication t o CSEA's chapter presidents and incorporated a n article in t h e Civil Service Leader requesting our chapters to forward to us resolutions representative of the con, cerns of our chapter's members for t h e express purpose of advising CSEA's Negotiating T e a m in t h e S t a t e Division of our State Division's members' desires and also advising o u r Legislative a n d Political Action Committee on m a t t e r s received t h a t appear to be of a legislative n a t u r e . As a result of this solicitation, numerous resolutions were received by us on the subjects of salary, health insurance, agency shop a n d m a t t e r s t h a t would require the submission of bills in t h e New York S t a t e Legislature during t h e forthcoming session. Appropriately, all resolutions forwarded to your Resolutions Committee f r o m our chapters were, in turn, directed to a variety of our standing committees whose reports n o t only on these resolutions, but other subject m a t t e r s will be delivered to you in the course of t h i s convention. As previously mentioned in this report, t h e role of this committee h a s undergone considerable change If for no other reason t h a n the f a c t t h a t the vast m a j o r i t y of resolutions reviewed by your committee are clearly negotiable r a t h e r t h a n legislative and must be liandled through the collective bargaining process. In the respect t h a t resolutions are submitted to a standing committee for action. It would be Inappropriate for us to deliver to you specific action on any resolutions as our standing committees intend to report out to you a t this convention their particular position on related resolutions.
