EL PASO COUNTY COMMUNITY COLLEGE DISTRICT BOARD POLICY 3.32.01 TEACHER RETIREMENT SYSTEM Any employee of the District who is employed for one-half or more of the standard work load on a regular basis is eligible and required by law to participate in the Teacher Retirement System. Part-time (less than one-half the standard work load), irregular, seasonal or temporary employment for a definite period of less than 4 ½ months during a school year is not eligible unless such employment occurs in a school year in which the employee has rendered a creditable year (4 ½ months) of service during the school year under TRS. Each eligible employee is a member of the retirement system as a condition of employment on the first day of eligible employment except: A. A person who executed and filed a waiver of membership in 1937 or 1949. B. A person who is eligible and elects to participate in the Optional Retirement Program. C. A person who is solely employed by a public institution of higher education which requires as a condition of employment that the person be enrolled as a student in that institution. D. A person who has retired under the retirement system and has not been reinstated to membership pursuant to the teacher retirement laws. Texas Government Code Ann.
