The Foreign Corrupt Practices Act
(“FCPA”) presents real and significant
challenges for companies with
international operations. As
government regulators increase the
amount of resources dedicated to FCPA
enforcement, it is not surprising that
executives have consistently identified
anti-bribery/anti-corruption compliance
as an issue “keeping them up at
night.” For these companies, having an
effective anti-corruption compliance
program in place is critical both to
minimize the risk of enforcement actions
and to mitigate the potential
consequences should bribery issues
arise.
This presentation will provide an
overview of the FCPA, an analysis of
current FCPA enforcement activity, and
a discussion of FCPA compliance “best
practices.” The presentation will also
highlight emerging issues and trends
and a perceived shift in the Department
of Justice’s and the Securities &
Exchange Commission’s enforcement
strategies for 2016.
