RFP No. 15-01 Food Services Food Service Center/Café & Gourmet Coffee/Grab & Go Addendum No. 1 This Addendum No. 1 sets forth modifications to portions of the bid and contract documents for the above-referenced work described as: RFP15-01 Food Services/Café & Gourmet Cofee/Grab & Go I. Requests for Information: Questions and Responses 1. Q: Is it possible to get a comprehensive copy of the current drink and food menu for the kiosk(s)? A: No, this is not possible at this time. 2. Q: Can we use our own licensed contractors for onsite kiosk repair retrofitting? A: Yes, provided they are licensed in the State of California for the category of work proposed to be performed, meet minimum insurance requirements and name the District as an additional insured, and provided that written plans are submitted to and approved by the District prior to the commencement of repair, remodeling, and/or retrofitting. 3. Q: Is there any kiosk equipment still owned by the college if so can we have a list of equipment including stats? A. The only equipment either owned by the College or by Pepsi Inc. and on long-term loan to the college that is provided under this pending agreement for services are the refrigerators currently present. We are not able to provide statistics such as age or volume at this time. 4. Q: Are there restrictions regarding the sale of coffee in the cafeteria? C:\Users\GaSteven\AppData\Local\Temp\Addendum 1 RFP15-01 011515.doc Page 1 of 3 A: Yes, only brewed coffee and bottled coffee beverages may be vended in the cafeteria. No individually prepared espresso coffee drinks may be vended in the cafeteria. 5. Q: Are there restrictions regarding the sale of food items at the coffee kiosks? A: There are no such restrictions except for those imposed by the health department about not preparing food in a vending area that is not permitted for food preparation. 6. Q: Are there restrictions regarding the sale of food and beverages at the bookstore? A: No, except that all vendors are required to abide by the provisions of the District’s Exclusive Pour Rights Agreement with Pepsi Beverage Company. See section II below. 7. Q: Is power available in the soffit located above the cafeteria service line? A: No. 8. Q: Re: Section 1 Minimum Qualifications—require proof of capital ranging from 100k-150K in accounts receivable: If a contractor does not have the exact minimum requirements, are there alternative options to show proof of income? Such as assets, real estate or current business ownership? A: The District will determine upon review what is a qualified proposal, and will take into consideration the fulfilment of minimum requirements by alternative means. The RFP Committee will review and evaluate a District determined qualified proposal that presents such alternative options. Please note, however, that the Committee may score such a proposal with a lower score in this section. 9. Q: In regards to the RFP/commission fee and structure that is currently in place with the current vendor, what is the current fee and will it change in accordance with the proposed service at Cabrillo College? A: The current vendor contract mandates a $35,000 annual commission, plus a $5,000 annual equipment use payment, plus 50% of net profits. In “Section #8: Fee Proposal” of “IV. Additional Specifications #28 (continued from Page 19 of 51 of the RFP): Contractor agrees to abide by the following provision of the District’s Exclusive Pour Agreement with Pepsi Beverage Company: “Permitted Exceptions. The only permitted exceptions to Pepsi’s 100% exclusive Beverage rights at the Facilities are the following: Specialty kiosks may sell freshly prepared coffee drinks and freshly prepared fruit smoothies. Ten percent (10%) of the shelf space allocated for Beverages in the bookstore and Café only may be used by Customer for the sale of Beverage products in categories not available from Pepsi, e.g. milk, sparking water, packaged smoothies and organic juice products. Such products may not be stored or sold from Pepsi’s Equipment.” III. Additional Relevant Information Bidder/Proposer should be aware that for at least five years there has been a discussion in the District “Bookstore Committee” and/or in the “Bookstore & Auxiliary Services Committee” to open a Starbucks Café in the Cabrillo Bookstore. The current Cabrillo College Bookstore vendor, “Barnes & Noble College Booksellers, LLC,” has a relationship with Starbucks nationally, and has explored with the District and the Committee two possible Starbucks Café options. The significant remodeling funds that would be required to create the necessary physical conditions for a Cabrillo Bookstore Starbucks Café would come from the District’s Bookstore Fund balance. There are no current or immediate plans for such an expenditure. In addition, such an expenditure would be authorized by the “Bookstore & Auxiliary Services Committee” following discussion at committee meetings, which current vendors as well as any member of the public are welcome to attend and participate. If the dream of a bookstore coffee café is every realized, it is also possible that a current vendor could propose to expand operations into the bookstore space, provided the current bookstore vendor is in agreement. District officials are aware of the impact that such a café could have on then existing “Gourmet Coffee/Grab & Go” vendor. If such a bookstore café were to be realized, that would provide a re-opener on the commission/fee structure clause of the District’s then in effect agreement with the “Gourmet Coffee/Grab & Go” vendor.
