le>h tk,xh A Back to Top 15 Transport Department Notification Shimla-2, the 31st December,2004 No. TPT-F(9)1/2001- Whereas the draft amendment scheme titled as “Himachal Pradesh passenger, Ex-gratia Scheme, 2004” were published in the Rajpatra, Himachal Pradesh (Extraordinary) on the 6th November,2004 vide notification of even number, dated8th October,2004 in pursuance of the provisions of Section 21 of the Himachal Pradesh Motor Vehicles Taxation Act, 1972 (Act No. 4 of 1973), for inviting objections and suggestions from persons likely to be affected thereby as required under Section 21 of the Himachal Pradesh Motor Vehicles Taxation Act, 1972 (Act No.4 of 1973), within a period of 30 days from the date of publication; 2. scheme. And whereas no objection has been received from general public on the said draft 3. Now, therefore, in exercise of the powers conferred by section 21 of the Himachal Pradesh Motor Vehicles Taxation Act, 1972, the Governor of Himachal Pradesh is pleased to make the following scheme, namely:1. Short title:- (I) This Scheme shall be called the Himachal Pradesh Passenger Ex-Gratia Grant Scheme,2004. (II) This scheme will come into force from the date of its final publication in the official Gazette (Rajpatra). 2. Definitions:- (I) In this Scheme, unless the context otherwise requires:(a) “Act” means the Himachal Pradesh Motor vehicles Taxation Act, 1972 (Act No. 4 of 1973) (b) “accident” means an unforeseen mishap resulting in ‘disability’ or “death” of any passenger, while boarding or alighting or loading or unloading of luggage, during the course of journey in a stage carriage bus or ‘contract’ carriage bus; (c)”contract carriage bus” means a motor vehicle which carriers a passenger or passengers for hire or reward and is engaged under a contract; (d) “death” for the purpose of this scheme means a death of a passenger as a direct consequence of an accident which occurs during the course of journey, in a stage carriage bus or contract carriage bus or any death which occurs as a direct consequence of such accident; Back to Top 16 (e) “dependent” means any of the relative, namely the wife, husband, parents and children or any other legal heirs of the deceased or disabled passenger; (f) “disability” means percentage of loss of earning capacity on account of an accident of a passenger, as certified by the Medical Board constituted by the State Government under the Chairmanship of Chief Medical Officer of the district concerned; (g) “ex-gratia grant” means the amount payable in case of disability or death of a passenger during course of journey consequent upon an accident in a stage carriage bus/contract carriage bus to him or his dependents, as the case may be; (h) “form” means the form appended to this Scheme; (i) “fund” means the fund established under sub-section(1) of section 3-B of the Act; (j) “passenger” mean a person travelling in a stage carriage or contract carriage bus but shall not include the driver, conductor or an employee of the owner while on duty or a porter; (k) “Schedule” means the schedule appended to this scheme; (l) “Stage carriage bus” means a motor vehicle constructed or adapted to carry more than six passenger, excluding the driver for hire or reward at separate fares paid by or for individual passenger, either for the whole journey or for stage of the journey; and (2) All other words and expressions used herein but not defined shall have the same meaning as assigned to them in the Motor Vehicles Act, 1988 or the Himachal Pradesh Motor Vehicles Taxation Act, 1972. (3) Risk cover:- (1) The Government shall pay ex-gratia grant as may be determined by the Government keeping in view the death or percentage of loss of earning capacity due to disability as laid down in the Schedule, out of fund to the dependents of a passenger on death or the passenger disabled as a consequence direct or indirect of an accident occurring during the course of journey in stage carriage bus or contract carriage bus having valid permit as required under the Motor Vehicles Act,1988 and are subject to levy of special road tax under the Act, or passenger tax and surcharge as the case may be notwithstanding whether such tax or surcharge has been paid or not by the owner at the time of occurrence of the accident: Provided that the payment of ex-gratia grant shall be made only in those accident cases which occur within the territory of State of Himachal Pradesh. Back to Top 17 (2) The ex-gratia grant payable under clause 6 shall be in addition to the amount of compensation payable under sections 140 and 166 of the Motor Vehicles Act, 1988 and relief granted by the District Administration. 4. Intimation of accident:- (1) The Sub- Divisional Officer (civil) of the area where the accident occurs and the owner of the stage carriage bus or contract carriage bus shall send a report in writing of the accident to the Deputy Commissioner concerned immediately on or after the occurrence of the accident which shall contain the following details:(i) name of the owner of the bus, name of the driver, name of the conductor, registration of the bus, route on which the bus was plying and date, time and place of accident. (ii) The particulars of the passengers involved in the accident indicating name, approximate age and addresses of the passengers in respect of death and disability separately. (iii) The Deputy Commissioner or any officer authorized by the Government on receipt of the intimation about the accident shall make all efforts to complete the investigation or enquiry with regard to the identity of the passengers involved in the accident and also of the dependents or next of kin of those who died in the accident, so as to make the payment of exgratia grant as specified in the Schedule as early as possible. 5. Application for payment of ex-gratia grant;- (1) The application for payment of ex-gratia under this scheme shall be made on the form appended to this scheme, by the dependent(s) of the deceased or by the disabled passenger, as the case may be, and the same shall be submitted to the Sub-Divisional Officer (civil) of the area within whose jurisdiction the accident occurred. (2) The form shall be accompanied by the following documents:(a) Certificate from the owner or the authorized representative of the owner of the bus or certificate issued by the Sub-Divisional Officer (Civil)concerned to the effect that the deceased or the disabled person was a bonafide passenger of the stage carriage bus or contract carriage bus. (b) Certificate of the Medical officer regarding death or disability. (c) Certificate of dependents issued by the competent authority in the case of death. (3) No application for payment of ex-gratia grant shall be entertained unless it is made within one year from the date of the accident: Provided that the Government may consider any application for grant of ex-gratia grant in exceptional cases on merit which is made after the expiry of period of one year if there are good and sufficient reasons for not filing the application within one year. Settlement and payment of ex-gratia grant:- (1) On receipt of the application on the form, alongwith essential documents, under clause (5) , the Sub-Divisional Officer (Civil) shall process the application after making such enquiry as he deems necessary to ascertain the genuineness of the claim and forward his recommendation, to the Deputy Commissioner concerned within whose jurisdiction the accident occurred, within 15 days from the date of receipt of application. (2) The Deputy Commissioner on receipt of the recommendations from the SubDivisional Office (civil), shall after satisfying and ensuring that all essential requirements have been adhered to, sanction the ex-gratia grant as per schedule. (3) On receipt of the sanction of payment of the ex-gratia grant from the Deputy Commissioner, the concerned Sub-Divisional Officer (Civil) shall endeavour to disburse the same to the applicant, either directly or through any other authority having jurisdiction over the area where the applicant is residing at the time of sanction of grant. (4) Every Deputy Commissioner concerned who has made sanction of the ex-gratia grant, shall send monthly information of disbursement of ex-gratia grant to the Commissioner for compilation of expenditure. 7. Payment of ex-gratia grant:- (1) In case of death of a passenger who is of the age of 12 years and above, as on the date of accident, the amount of ex-gratia grant shall be such as may be determined by the Government from time to time. (2) In case of death of or disability to passenger of stage carriage bus or contract carriage bus in an accident who is below the age of 12 years and above, as on the date of accident, the exgratia grant shall be reduced to 50 percent of the limit prescribed in sub- clause(1). 8. Exclusion:- (1) The Government shall be liable for any such liability for compensation under the Motor Vehicles Act, 1988 or rules made there under or under the Indian Fatal Accidents Act, 1855, or any other Law for time being in force. 9. Indemnity of the Government:- (1) Every eligible passenger or his dependents as the case may be, who is entitled for exgratia grant as per provisions of this Scheme and in whose favour payment of ex-gratia grant has been sanctioned under sub-clause 1 or 2 of clause 7 of this Scheme shall at all time indemnity Back to Top 19 and save and keep harmless the Government from all and every loss suits or proceedings in case the payment of ex-gratia grant is later on questioned/ challenged. 10. Repeal and Saving:- (1) The Himachal Pradesh Passenger Insurance Scheme as notified vide Notification No. TPT-6-27/76, dated 19-11-1977, and published in the Himachal Pradesh Rajpatra (Extraordinary), dated 19-11-1977 (page 1109-1113) is hereby repealed. (2) Notwithstanding such repeal anything done or any action taken under the aforesaid Scheme shall be deemed to have been done or taken under this Scheme as if this Scheme had commenced on the day when the repealed Scheme came in force.
