CALPINE CORPORATION VISITOR AGREEMENT
I, __ BRUCE MAYER _______, representing __ CHABOT COLLEGE _____________
(company or organization), in consideration of being permitted by Calpine Corporation
(“Calpine”) to enter the premises of
Russell City Energy Center (“Calpine Facility”) agree as follows:
1.
I agree to comply with all applicable rules. I will listen carefully to all information and instructions provided by plant personnel and I will promptly comply with all instructions of plant personnel. I will not engage in any activity inconsistent with the purpose of my visit.
2.
I will not use tobacco products except in designated areas while in the Calpine
Facility, and I will not bring or possess any weapons of any kind inside the facility or the surrounding area.
3.
I will not take photographs or make drawings or representations of the Calpine
Facility or anything located inside the Calpine Facility or on its premises unless explicitly authorized in writing by Calpine to do so.
4.
I will not remove from the Calpine Facility any documents or property of any kind belonging to the Calpine Facility or any other party, unless explicitly authorized in writing by Calpine to do so. I will assume unless otherwise instructed by an authorized Calpine representative that any information, whether written or observed, that I obtain while visiting the Calpine Facility is confidential and proprietary in nature, and I will not disclose such information to any other person unless explicitly authorized in writing by Calpine to do so.
5.
I will not touch or operate any equipment within the Calpine Facility.
6.
I understand that there are health and safety risks associated with visiting any power plant, including the Calpine Facility.
7.
I acknowledge that I have been provided specific information in the form of a video presentation and/or written materials regarding safety hazards at this site and I have been given an opportunity to ask Calpine staff questions to ensure that I understand such information.
8.
I further understand that chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm are present at this Calpine
Facility.

I voluntarily, on behalf of myself, my heirs, assigns and personal representative, release, indemnify and hold harmless Calpine, including its affiliates, shareholders, equity holders, officers, employees, agents, representatives and independent contractors, from any and all liability, and waive the right to bring any claim or legal action whatsoever arising from my visit to the Calpine Facility, except with respect to personal injury or damages resulting from Calpine’s gross negligence or willful misconduct.
10.
If any part of this release agreement is found to be unenforceable or invalid, that portion shall be severed, and the remainder will remain in full effect.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND THE WORDS
AND LANGUAGE IN THIS AGREEMENT. I HAVE BEEN ADVISED OF
THE POTENTIAL DANGERS THAT I MAY ENCOUNTER WHEN I VISIT
THIS CALPINE FACILITY. I AM AWARE THAT THIS IS A RELEASE OF
LIABILITY, ASSUMPTION OF RISK AND A COVENANT BETWEEN ME
AND CALPINE CORPORATION, AND I SIGN IT OF MY OWN FREE
WILL.
