(1+6) COPY NO. 110 1dth March,. 19U6* CABINET CIVIL AVIATION BILL Memorandum by the Parliamentary Secretary to the Ministry of Civil Aviation In the absence abroad of my Minister I submit (appended to This Bill was this Paper) the draft Civil Aviation Bill. referred to in the Legislative Programme as the Air Transport Bill. 2. The proposals in the Bill were submitted to the Lord President's Committee in L.P. (1+6) 1k and received the general approval of that Committee on 25th January (L. P. (1+6) 3rd Meeting Minute 2 ) . 3. I ask for permission to introduce the Bill in the House of Commons during the present month or the first week of A p r i l / The Legislation Committee will consider the Bill on Tuesday, 19th March. If the Bill is approved I also ask to be allowed to make any amendments of a minor or drafting nature which may­ be found desirable after it has been approved and before its introduction. Scope of the Bill 1+. The Bill has two main purposes, the first to reserve scheduled air services to three statutory corporations, and the second to authorise the Minister of Civil Aviation to acquire aerodromes for use, primarily, by these statutory corporations and in particular cases by foreign air lines also. Certain supplementary provisions relating to matters connected with air transport services and the use of aerodromes have been included in the Bill. Summary of the provisions of the Bill Part. I - Air Services 5. The three statutory corporations to which scheduled services are to be entrusted are:­ (i) The existing British Overseas Airways Corporation, established under the British Overseas Airways Act, 1939. This corporation will operate services within the British Commonwealth and Empire and to the Par East. Its maximum capital is to be fifty million pounds. (ii) A new corporation, to be called the British European Airways Corporation. It will operate services in Europe including the internal services of the British Isles. Its maximum capital is to be twenty million pounds. 72 (iii) Another new corporation, to be called the British South American Airways Corporation. This will operate services between the United Kingdom and South America. Its maximum capital is to be ten million pounds. 6. The continuity of the British Overseas Airways Corporation is not to be interrupted and accordingly the Act of 1 9 3 9 is not being repealed, although certain of its provisions are cancelled The ,two now corporations are to be or modified by the Bill. modelled upon that corporation. 7. Part I of the Bill is based upon the Act of 1 9 3 9 , the chief alteration being the reservation (by Clause 22) of scheduled air services for the three corporations. Other important modifications are ( i ) the wider powers of control given to the Minister in Clause 3 , ( i i ) the provision in Clause 1 3 that each corporation should set up joint consultative machinery for settling terms and conditions of employment, and (iii) the provision in Clause 1 9 that the Minister may require the thr corporations to establish for their employees joint pension schemes and other benefit schemes, to which members of the existing 3 . 0 . A. C. schemes will be allowed to transfer. 8. Provision is made for Exchequer grants up to 1 9 5 6 , the maximum aggregate figures being, for all corporations, ten million pounds for the period to 19U7 and also for the year ending 3 1 s t March 19U8, million pounds for each year thereafter. 3 1 s t March the 3 1 s t March and eight 9. The spheres of operation of the corporations are not defined in the Bill. They may overlap in certain areas and it is intended that the allocation of routes and services shall be made by the Minister. 10. Foreign operators will be allowed to run scheduled air services to the United Kingdom in accordance with the terms of inte r-gevernme ntal agreements. 11. The functions of the corporations are to provide scheduled air services and to do all other forms of aerial work, including work on charter terms. . 12. A general power is given to each corporation to do whatever is necessary for facilitating the discharge of its functions. In view, however, of the need, for giving some indication of the principal powers included in the general -power, twenty-one of those powers have been specified in Clause 2 ( 2 ) of the Bill. The exercise of these powers will be subject to the Minister's control - see paragraph 1 7 below. 13. In accordance with polic. announced in the White Paper on British Air Services (Cmd. 6 7 1 2 ) , aerial charter work is not reserved in the Bill to the statutory corporations. Independent operators are at liberty to compete with the corporations in that field, provided that they maintain terms and conditions of employment in accordance with a formula recommended by the Ministry of Labour and National Service. Clause 38 is based on that formula. 1h. Much care has had to be given to defining the border line between scheduled air services, which are reserved to the corporations, and charter work, in which the corporations will compete with other operators. The chief task has been to ensure that an independent ,opera tor will not be able to run a regular service under the guise of charter work. 73 15* Clause 2 2 of the Bill attempts to solve the problem by imposing two conditions on journeys by aircraft for hire or reward. The conditions ore, firstly, that no person other than the corporations shall *be allowed to make advance announcements concerning the time of departure or the destination of his aircraft and, secondly, that no person or group of persons shall be allowed to contract for the hire :.f less than the whole capacity of an aircraft which is not operated by the corporations. Power to obtain information for the purpose of enforcing those conditions is provided for in Clause 2 3 . 1 6. The Minister, to whom clauses 2 2 and 2 3 have been telegraphed, has asked for his position to be reserved until he has had an opportunity of studying them on his return on the 1 9 t h March. 17. The Minister is given general powers of control over the activities of the corporations. Clause 3 (l) enables him to limit the powers of the corporations by an order which will not be laiel before Parliament, but will be published in accordance with the appropriate procedure proposed in the Statutory Instruments Bill. Clause 3 ( 2 ) enables him to give directions, without formal instrument, to any of the corporations after consultation with the chairman of the corporation. Clause 3 ( 2 ) is modelled on the corresponding provision in the Bank of England Act. The members of the British Overseas Airways Corporations (other than the Chairman, who is abroad) have been consulted about Clause 3 and have accepted its provisions, although they felt that the Minister's powers of control were too wide. Fart II - Land 18. This part of the Bill is designed to give to the Minister power to acquire all the aerodromes necessary for use by the statutory corporations and such other land, away from aerodromes, as may be required for radio installations for air navigation purposes. '19. Provision is also made (Clauses 2 7 and 2 9 ) for powers to acquire rights over land in the vicinity of those aerodromes and to restrict the use of such land so far \u is necessary to ensure the safety of aircraft approaching or leaving and also, in the case of radio installations,, to ensure absence of local interference with the transmissions frora such instalI ations. 20. Clause 28 of the Bill gives to the Minister of Transport powers to stop up or divert and to reprovide highways which cross, or are made dangerous by the use of, aerodromes vested in the minister of Civil ^viation. i understand tii^t he hao agreed to exercise these powers, provided that the cost is .borne on the Ministry of Civil Aviation vote. 21, He-housing of tenants evicted from houses on land acquired for aerodromes is dealt with in Clause 3 2 , which requires the Minister of Civil Aviation to provide or arrange for housing accommodation if he thinks such action desirable. I understand that the Minister of Health has no power to ensure that such persons will be re-housed and that he does not object to the provisions of Clause 3 2 . 74 22. .X...-.r.st point cut to the Cabinet the extremely w i d e nature of the powers conferred by clauses 27 t o 2 9 , and also by Clause 30 (which relates to the removal of burial grounds) clause 31 (which gives a power of entry for the p u r p ; s o o f survey) ana clause 3 2 . Some or all of these powers will be required/ not only i n connection with Heathrow aerodrome, but a l s o in connection with other State aerodromes. The issue to be decided, therefore, is -whether these powers should be taken generally in a public bill, or acquired piecemeal by a­ series of bills relating to particular aerodromes. I seek the approval o f the Cabinet for the principle that they should be taken generally, once for all. 23. I am advised that the powers contained in Part II of- t h e Bill will be sufficient for the purpose of acquiring and developing t h e London Airport at Heathrow and "that if they are granted by Parliament the Heathrow (Acquisition of Land) Bill, listed in the Legislative P r o g r a m m e , will not b e necessary. On the assumption that the Civil Aviation Bill goes forward in its ore sent general form it is proposed t o drop the Heathrow Bill, 2U. Where land is compulsorily acquired for the purposes of Part II of the Bill the procedure closely resembles t h a t laid down i n the Distribution of Industry Act, 1 9 h 5 , and the Acquisition of Land (Authorisation Procedure) Bill. In t h e case of land of statutory undertakers, local authorities and t h e National Trust, compulsory acquisition will b e b y order subject to special Parliamentary procedure. 25. Compensation for the compulsory purchase of land will be assessed in accordance with the relevant provisions of the Acquisition of Land (Assessment of Compensation) Act 1 9 1 9 , t h e Town and Country Planning Act 1 9hh and t h e Requisitioned Land and War Works Act 19h5o Part III - Miscellaneous 26. In Part III, I most direct special attention to Clause 3 6 , under which the Minister is to be given power t o impose restrictions on flying from aerodromes in the vicinity of State aerodromes. The Air Navigation A c t , 1 9 2 0 gives the Minister a power to license aerodromes, and refusal of such a licence would hot. attract compensation. But this power is conferred solely for the purposes of the Paris Convention, and I do n u t think it could properly be used for the purpose of protecting a State aerodrome, I have therefore thought it right to s e e k a new power for this purpose and to provide that aerodrome owners whose interests are injured by the exercise o f the power should receive compensation, except where the aerodrome w a s established after the pas sin;-: of the Bill and without the Minister's consent, 27. The establishment of an Air Transport Advhsory Council is provided for in Clause 3 5 . This Council will not itself fix fares and freight rates but will make recommendations t o the Minister on these and other matters relating to air transport. The Minister will decide whether effect is to be given t o the Council's recommenetations. The provisions of the Bill cover England, and W a l e s , 28 Scotland and Northern Ireland, and will be extended to the Channel Islands and the Isle of Man by Orders in Council. The Channel Island representatives pressed, o n constitutional 75 grounds, for this course t. bo token, although they affirmed their willingness to be brought within the reservation of scheduled air services and other provisions of the Bill; and the Manx representatives took the same line-. A Special Point on the Bill 29. Clause h (1) requires the three corporations to use aircraft, airframes and aero-engines designed and manufactured within His Majesty's Dominions unless the Minister waives that requirement. The President of the Board of Trade "feels that the enactment into law of such a provision would be very unfortunate at the present time, since it would be regarded abroad as foreshadowing a policy of extreme pro tec tie-n for British manufactures and 1 0 0 per cent. preference to Empire manufacture by nationalised enterprises at a time when we are about to embark on an international Conference on Trade and Employment on the basis of the United States proposals with which His Majesty's Government have declared themselves to be 'in full agreement on all important points'". He asks for the substitution of a sub-clause requiring the corporations to obtain the Minister's assent to their acquisition of aircraft and components generally; it would then be open to the Minister to give a general permit to the corporation to acquire aircraft manufactured in the Empire,, while his specific approval would still have to be obtained for foreign acquisitions. 30. It is laid down in the White Paper "British Air Services", (Cmd. 6712) paragraph 27, that "it will be the general policy of His Majesty's Government to require the Corporations tc use British aircraft types". The industry will certainly expect this policy to be translated into law. 31. I propose that "United Kingdom" be substituted for "His Majesty's Dominions" in Clause h ( 1 ) . This should go some way towards meeting the President of the Board Trade, but apart from this modification 1 feel bound to press for the Clause as it stands. I. T. Reserve funds. 16.—(1) E a c h of t h e three corporations shall establish a reserve fund, a n d shall, at such t i m e s as t h e Minister, w i t h t h e approval of t h e Treasury, m a y direct, carry t o t h e credit of t h a t fund o u t of their r e v e n u e s such s u m s as h e m a y so direct. 2 0 (2) T h e reserve fund of e a c h of t h e three corporations shall b e m a n a g e d i n s u c h m a n n e r a n d applied for s u c h purposes as t h e Minister, w i t h t h e approval of t h e Treasury, m a y direct. 25 Application of r e v e n u e s . 17.—(1) A n y excess of t h e revenues of a n y of t h e three cor­ porations for a n y financial year over their e x p e n d i t u r e a n d provisions properly chargeable t o r e v e n u e a c c o u n t for t h a t year, including i n s u c h provisions (without prejudice t o t h e generality of t h a t expression) s u m s credited under t h e last preceding section 3 t o t h e reserve fund of t h e corporation, shall b e applied b y t h e corporation i n s u c h manner a s t h e Minister, w i t h t h e a p p r o v a l of t h e Treasury a n d after c o n s u l t a t i o n w i t h t h e c h a i r m a n of t h e corporation, m a y direct. 0 (2) A n y direction given under t h e preceding s u b s e c t i o n m a y 35 require t h e w h o l e or a n y part of a n y such e x c e s s a s aforesaid t o b e paid i n t o t h e E x c h e q u e r . Staff, wages, pensions, etc. Employment of staff, a n d terms and c o n d i t i o n s of employment. 18.—(1) S u b j e c t t o t h e provisions of this A c t , e a c h of t h e three corporations m a y appoint such officers, a g e n t s a n d servants, 40 on such terms a s t o remuneration a n d otherwise, as t h e corporation m a y determine. ; ^5 10 15 20 (2) I t shall b e t h e d u t y of e a c h of t h e three c o r p o r a t i o n s t o e n t e r i n t o c o n s u l t a t i o n w i t h organisations appearing t o t h e m t o b e r e p r e s e n t a t i v e of persons in their e m p l o y m e n t or of a n y class of t h o s e persons w i t h a v i e w t o t h e conclusion of a g r e e m e n t s providing for— (a) t h e e s t a b l i s h m e n t a n d m a i n t e n a n c e of j o i n t m a c h i n e r y for— (i) t h e s e t t l e m e n t b y n e g o t i a t i o n of q u e s t i o n s a s t o t h e t e r m s a n d c o n d i t i o n s of e m p l o y m e n t of persons e m p l o y e d b y t h e corporation, a n d of o t h e r q u e s t i o n s arising b e t w e e n t h e corporation a n d s u c h persons i n c o n n e c t i o n w i t h t h e e m p l o y m e n t of s u c h p e r s o n s ; and (ii) t h e reference of a n y s u c h q u e s t i o n t o arbitra­ t i o n w h e r e n e g o t i a t i o n s for t h e s e t t l e m e n t of t h e q u e s t i o n h a v e failed a n d t h e parties c o n c e r n e d agree t h a t t h e q u e s t i o n s h o u l d be so referred ; a n d (b) t h e discussion of m a t t e r s affecting t h e s a f e t y , h e a l t h a n d welfare of persons e m p l o y e d b y t h e corporation, a n d of o t h e r m a t t e r s of m u t u a l interest t o t h e corporation a n d s u c h persons. (3) W h e r e a n y of t h e t h r e e corporations c o n c l u d e s u c h a n a g r e e m e n t as is m e n t i o n e d i n t h e last preceding s u b s e c t i o n , or a n y v a r i a t i o n is m a d e i n s u c h an agreement, t h e corporation 25 c o n c e r n e d shall f o r t h w i t h t r a n s m i t particulars of t h e a g r e e m e n t or t h e v a r i a t i o n t o t h e Minister a n d t h e Minister of L a b o u r a n d N a t i o n a l Service. Staff, wages, pensions, etc. 1 8 . — ( 1 ) Subject t o t h e provisions of t h i s Act, each of t h e EMPLOYMENT TERMS^AND^ t h r e e c o r p o r a t i o n s m a y a p p o i n t such officers, a g e n t s a n d s e r v a n t s , 4 0 h t e r m s as t o r e m u n e r a t i o n a n d otherwise, as t h e c o r p o r a t i o n CONDITIONS of EMPLOYMENT, m a y d e t e r m i n e . o n s u c ; (2) I t shall b e t h e d u t y of each of t h e t h r e e c o r p o r a t i o n s to enter into consultation w i t h organisations appearing t o t h e m t o be P a r t I. representative of persons in t h e i r e m p l o y m e n t or of a n y class of —cont. those persons w i t h a view t o t h e conclusion of a g r e e m e n t s "^5 providing for— (a) the e s t a b l i s h m e n t a n d m a i n t e n a n c e of j o i n t m a c h i n e r y for— (i) t h e s e t t l e m e n t b y negotiation of questions as t o t h e t e r m s a n d conditions of e m p l o y m e n t of persons 10 e m p l o y e d b y t h e corporation, a n d of o t h e r questions arising b e t w e e n t h e corporation a n d s u c h p e r s o n s in connection w i t h t h e e m p l o y m e n t of such persons ; and (ii) t h e reference of a n y such question t o a r b i t r a ­ 15 t i o n where negotiations for t h e s e t t l e m e n t ol t h e q u e s t i o n h a v e failed a n d t h e parties concerned agree t h a t t h e question should b e so referred ; a n d (b) t h e discussion of m a t t e r s affecting t h e safety, h e a l t h a n d welfare of persons employed b y t h e corporation, a n d of 20 other m a t t e r s of m u t u a l i n t e r e s t t o t h e c o r p o r a t i o n a n d such persons. (3) W h e r e a n y of t h e t h r e e corporations conclude such a n agreement a s is m e n t i o n e d in t h e last preceding subsection, or a n y v a r i a t i o n is m a d e in such a n a g r e e m e n t , t h e corporation 5 concerned shall forthwith t r a n s m i t p a r t i c u l a r s of t h e a g r e e m e n t or t h e v a r i a t i o n to t h e Minister a n d t h e Minister of L a b o u r a n d N a t i o n a l Service. 2 30 35 40 45 19.—(1) T h e Minister m a y b y regulations provide for t h e Pensions, etc. establishment a n d m a i n t e n a n c e ol one or more j o i n t pension schemes for t h e p u r p o s e of providing pensions a n d o t h e r similar benefits in respect of t h e service of persons employed b y a n y of the t h r e e corporations ; a n d t h e Minister m a y b y such regulations in p a r t i c u l a r p r o v i d e for securing benefits in t h e case of injury or d e a t h . (2) N o p e r s o n shall be a m e m b e r of a n y fund or scheme established before t h e d a t e of t h e passing of t h i s Act u n d e r section forty of t h e British Overseas Airways A c t , 1939, unless h e w a s a m e m b e r of t h a t fund or scheme i m m e d i a t e l y before that date. (3) R e g u l a t i o n s m a d e u n d e r t h i s section m a y m a k e such provision as t h e Minister t h i n k s necessary for enabling a n y person who is a m e m b e r of a n y such fund or scheme as aforesaid, or w h o is for t h e t i m e being p a r t i c i p a t i n g in a n y s u c h scheme as is m e n t i o n e d in t h e S i x t h Schedule t o t h e said A c t of 1939, t o w i t h d r a w from t h a t fund or scheme in consideration of being a d m i t t e d , u p o n s u c h t e r m s as m a y be p r o v i d e d for b y t h e regulations, t o a n y scheme established u n d e r subsection (1) of this section. A . D . 1946. PARTI — c o n t ' (4) N o fund or scheme shall be established u n d e r t h e said section ^ r t y after t h e passing of t h i s A c t . Accounts, ACCOUNTS A N D AUDIT. reports and jj information. 20.—(1) E a c h of t h e t h r e e c o r p o r a t i o n s shall k e e p p r o p e r a c c o u n t s a n d proper records in relation t h e r e t o , a n d shall p r e p a r e in respect of each financial y e a r a s t a t e m e n t of a c c o u n t s in s u c h form a s t h e Minister m a y , w i t h t h e a p p r o v a l of t h e T r e a s u r y , 1 0 direct. (2) T h e s t a t e m e n t of a c c o u n t s p r e p a r e d in respect of a n y financial y e a r b y a n y of t h e t h r e e c o r p o r a t i o n s shall c o n t a i n such p a r t i c u l a r s w i t h r e s p e c t t o a n y u n d e r t a k i n g w h i c h a t a n y t i m e d u r i n g t h a t y e a r w a s a n associate of t h e c o r p o r a t i o n a s t h e 15 Minister m a y direct. (3) T h e a c c o u n t s of e a c h of t h e t h r e e c o r p o r a t i o n s shall b e a u d i t e d b y a u d i t o r s a p p o i n t e d a n n u a l l y b y t h e Minister. (4) As soon as t h e a c c o u n t s of a n y of t h e t h r e e c o r p o r a t i o n s for a n y financial y e a r h a v e b e e n a u d i t e d , t h e c o r p o r a t i o n shall 20 send t o t h e Minister a c o p y of t h e s t a t e m e n t of a c c o u n t s p r e p a r e d b y t h e m for t h a t y e a r i n accordance w i t h t h i s section, t o g e t h e r w i t h a copy of a n y r e p o r t m a d e b y t h e a u d i t o r s o n t h a t s t a t e m e n t or on t h e accounts of t h e corporation. (5) T h e Minister shall l a y a c o p y of e v e r y such s t a t e m e n t a n d 25 r e p o r t before each H o u s e of P a r l i a m e n t . 21.—(1) E a c h of t h e t h r e e c o r p o r a t i o n s shall, a s soon a s Annual report and periodical possible after t h e e n d of each financial year, m a k e t o t h e Minister p t dealing generally w i t h t h e o p e r a t i o n s of t h e c o r p o r a t i o n returns. d u r i n g t h a t year a n d c o n t a i n i n g such i n f o r m a t i o n w i t h r e s p e c t 30 t o t h e proceedings a n d policy of t h e c o r p o r a t i o n as c a n b e m a d e p u b l i c w i t h o u t d e t r i m e n t t o t h e i n t e r e s t s of t h e u n d e r t a k i n g of t h e corporation. a r e 0 r (2) T h e Minister shall l a y a copy of every such r e p o r t before each H o u s e of P a r l i a m e n t . 35 (3) E a c h of t h e t h r e e c o r p o r a t i o n s shall, in r e s p e c t of each p l a n n i n g period, a s defined for t h e p u r p o s e s of t h i s section, a n d a t such t i m e before t h e b e g i n n i n g of t h a t p e r i o d as t h e Minister m a y direct, s u b m i t t o t h e Minister— (a) a p r o g r a m m e of t h e a i r t r a n s p o r t services w h i c h t h e 40 corporation propose t o p r o v i d e d u r i n g t h a t p e r i o d a n d of t h e o t h e r activities in which t h e corporation propose t o engage d u r i n g t h a t period ; a n d A.D. 1946. ifART (b) a n e s t i m a t e of t h e receipts during t h a t period, a n d of £\ t h e e x p e n d i t u r e , w h e t h e r on r e v e n u e a c c o u n t or o n 5 c a p i t a l a c c o u n t , t o be incurred b y t h e m d u r i n g t h a t period. ( 4 ) I n respect of t h e financial y e a r beginning w i t h t h e first d a y of April, n i n e t e e n h u n d r e d a n d forty-seven, a n d each s u b s e ­ q u e n t financial year, each of the t h r e e c o r p o r a t i o n s shall, a t such 1 0 t i m e before t h e b e g i n n i n g of t h e y e a r as t h e Minister m a y direct, s u b m i t t o t h e Minister a n e s t i m a t e of t h e e x p e n d i t u r e t o b e incurred b y t h e c o r p o r a t i o n on c a p i t a l a c c o u n t d u r i n g t h e y e a r . (5) W i t h o u t prejudice t o t h e i r d u t i e s u n d e r t h e p r e c e d i n g provisions of this Act, each of t h e t h r e e c o r p o r a t i o n s shall 1 5 provide t h e Minister— 2 0 (a) w i t h such information relating t o t h e u n d e r t a k i n g of t h e c o r p o r a t i o n a n d t o t h e u n d e r t a k i n g of a n y associate of t h e c o r p o r a t i o n (including information relating t o a n y activities p r o p o s e d t o b e u n d e r t a k e n b y t h e c o r p o r a t i o n or a n y s u c h associate) a s t h e Minister m a y i r o m t i m e t o t i m e require ; a n d (b) w i t h such financial a n d statistical r e t u r n s relating t o a n y such u n d e r t a k i n g as aforesaid as t h e Minister m a y from t i m e t o t i m e require. 25 (6) F o r t h e p u r p o s e of p r o v i d i n g t h e Minister w i t h a n y information w h i c h h e m a y r e q u i r e in a c c o r d a n c e w i t h t h e provisions of t h e last preceding subsection, e a c h of t h e t h r e e c o r p o r a t i o n s shall p e r m i t a n y p e r s o n a u t h o r i s e d b y t h e Minister in t h a t behalf t o inspect a n d m a k e copies of t h e a c c o u n t s , b o o k s , 3 0 d o c u m e n t s or p a p e r s of t h e c o r p o r a t i o n , a n d shall afford s u c h e x p l a n a t i o n thereof as t h a t p e r s o n or t h e Minister m a y r e a s o n a b l y require. I n this subsection t h e expression " facilities for t r a n s p o r t " m e a n s facilities for t r a v e l as a passenger a n d facilities for t h e carriage of goods, a n d t h e expression " goods " does n o t include 35 a n y articles r e q u i r e d o n l y for t h e personal use of t h e crew of t h e aircraft on t h e j o u r n e y , or a n y articles forming p a r t of t h e e q u i p ­ m e n t or stores of t h e aircraft. (4) N o t h i n g in t h i s section shall restrict t h e r i g h t of a n y person— 40 (a) t o c a r r y passengers for t h e sole p u r p o s e of giving i n s t r u c t i o n in flying a n d t h e duties of a i r c r e w s ; or (b) t o c a r r y passengers or goods for t h e sole p u r p o s e of p r o v i d i n g a n air a m b u l a n c e or rescue service. (5) N o t h i n g in t h i s section shall restrict t h e r i g h t of a n y p e r s o n t o c a r r y passengers u p o n a n y j o u r n e y which, w i t h o u t i n t e r m e d i a t e stops, begins a n d ends a t t h e same place. (6) Subsection (3) of t h e said section fifteen is h e r e b y r e p e a l e d . 27.—(1) T h e Minister m a y , if h e is satisfied t h a t i t is e x p e d i e n t p e r of so to do in o r d e r t o secure t h e safe a n d efficient use for civil Minister to 15 a v i a t i o n p u r p o s e s of a n y l a n d which is vested in h i m or w h i c h he acquire rights proposes t o a c q u i r e , or in order t o secure t h e provision ot a n y ­ services r e q u i r e d in relation t o a n y such land, or in o r d e r t o secure t h a t civil aircraft m a y be n a v i g a t e d w i t h safety a n d efficiency, b y order p r o v i d e for t h e creation in his favour, or for 20 t h e v e s t i n g in h i m , of e a s e m e n t s c ver land, or of r i g h t s t o i n s t a l a n d m a i n t a i n s t r u c t u r e s , w o r k s a n d a p p a r a t u s on, u n d e r , over or across a n y l a n d . If a n y p e r s o n c o n t r a v e n e s t h e preceding provisions of this subsection, h e shall b e liable, on s u m m a r y conviction, to imprison­ m e n t for a t e r m n o t exceeding t h r e e m o n t h s or t o a fine n o t exceeding five h u n d r e d p o u n d s or t o b o t h such i m p r i s o n m e n t a n d 40 such fine ; a n d e v e r y person w h o wilfully o b s t r u c t s a n y person in t h e exercise of a n y p o w e r of e n t r y conferred b y s u c h a n o r d e r as aforesaid shall b e liable, on s u m m a r y conviction, t o a fine n o t exceeding one h u n d r e d p o u n d s . (4) A n y person whose l a n d is injuriously affected b y a n o r d e r 45 m a d e u n d e r t h i s section shall b e entitled t o recover c o m p e n s a t i o n from t h e Minister i n respect of t h e injurious affection ; a n d , l a n d A . D . 1 9 4 6 . —PART I I . subject t o t h e provisions of this Act, t h e provisions or t h e Acquisition of L a n d (Assessment of Compensation) Act, 1919, shall h a v e effect for t h e purpose of assessing s u c h c o m p e n s a t i o n I* COIlt. I accordingly. (5) A n y s u c h o r d e r shall be subject t o special p a r l i a m e n t a r y 5 procedure. (4) A n y such order shall be subject t o special procedure. parliamentary 20 A c o p y of t h e notice required to b e given in relation t o a n y such o r d e r b y t h e Minister of T r a n s p o r t u n d e r p a r a g r a p h 1 of t h e F i r s t Schedule t o t h e S t a t u t o r y Orders (Special Procedure) A c t , 1945, shall be served u p o n every local a u t h o r i t y which, in its c a p a c i t y as a h i g h w a y a u t h o r i t y , would b e affected b y t h e 25 provisions of the order, a n d u p o n a n y person whose a p p a r a t u s , or whose rights in relation t o a p p a r a t u s , would b e so affected ; a n d t h e provisions of p a r a g r a p h s 2 t o 4 of t h a t Schedule shall h a v e effect accordingly. (5) T h e powers of t h e Minister of T r a n s p o r t u n d e r subsection (1) 30 of t h i s section shall include p o w e r t o m a k e a n order a u t h o r i s i n g t h e stopping u p or diversion of a n y h i g h w a y which is t e m p o r a r i l y s t o p p e d u p or d i v e r t e d u n d e r a n y o t h e r e n a c t m e n t , a n d t o m a k e a n o r d e r p r o v i d i n g for t h e e x t i n g u i s h m e n t of a n y p u b l i c right of w a y t h e exercise of which is for t h e t i m e b e i n g p r o h i b i t e d or 3 5 r e s t r i c t e d u n d e r a n y o t h e r e n a c t m e n t . (6) T h e Minister of T r a n s p o r t m a y b e a u t h o r i s e d , b y a com­ p u l s o r y p u r c h a s e order m a d e b y h i m , t o p u r c h a s e l a n d com­ pulsorily for t h e p u r p o s e of p r o v i d i n g or i m p r o v i n g a n y h i g h w a y w h i c h is t o b e p r o v i d e d or i m p r o v e d in p u r s u a n c e of an order 40 u n d e r subsection (1) of this section ; a n d a n y such c o m p u l s o r y p u r c h a s e order shall b e m a d e in a c c o r d a n c e w i t h t h e T h i r d Schedule t o this Act, a n d t h e provisions of t h a t Schedule shall h a v e effect w i t h respect t o s u c h orders accordingly, with t h e s u b s t i t u t i o n of references t o the Minister of T r a n s p o r t for 45 references t o t h e Minister. PART I I . —cont. Power of Minister to impose restrictions on land in the interests of civil aviation. 29.—(1) T h e Minister m a y , if h e is satisfied t h a t it is necessary so t o do in order t o secure t h e safe a n d efficient use for civil a v i a t i o n purposes of a n y land, s t r u c t u r e s , w o r k s or a p p a r a t u s v e s t e d in h i m , or w h i c h he proposes t o acquire, b y o r d e r p r o v i d e — (a) for r e q u i r i n g t h e t o t a l or p a r t i a l demolition of buildings Q or s t r u c t u r e s within s u c h a r e a s as m a y b e so specified ; (b) for restricting t h e height of trees w i t h i n s u c h a r e a s as m a y b e so specified ; (c) for restricting t h e installation of cables, m a i n s , pipes, wires or similar a p p a r a t u s w i t h i n such a r e a s as m a y be 10 so specified ; (d) for extinguishing, a t t h e e x p i r a t i o n of s u c h period as m a y be d e t e r m i n e d b y o r u n d e r t h e order, a n y subsisting right of installing or m a i n t a i n i n g a n y s u c h a p p a r a t u s as aforesaid u p o n , across, u n d e r or over a n y such l a n d 15 as m a y b e so d e t e r m i n e d ; (e) for requiring t h a t , before t h e e x p i r a t i o n of such period as m a y b e so determined, a n y such a p p a r a t u s shall b e r e m o v e d from a n y s u c h l a n d as m a y b e so d e t e r m i n e d . (2) A n y such order m a y c o n t a i n s u c h consequential, incidental 20 a n d s u p p l e m e n t a l provisions as a p p e a r t o t h e Minister t o b e necessary or e x p e d i e n t for t h e purposes of t h e order, including, in p a r t i c u l a r , provisions for e m p o w e r i n g a n y p e r s o n a u t h o r i s e d in t h a t behalf b y t h e Minister, t o r e m o v e , p u l l d o w n , cut down, or alter so as t o b r i n g i n t o conformity w i t h t h e r e q u i r e m e n t s of 25 t h e order, a n y building, s t r u c t u r e , tree or a p p a r a t u s w h i c h con­ t r a v e n e s those r e q u i r e m e n t s . (3) A n y person whose l a n d or a p p a r a t u s , or w h o s e right t o m a i n t a i n or instal a p p a r a t u s , is injuriously affected b y a n order m a d e u n d e r this section shall be e n t i t l e d t o recover c o m p e n s a t i o n 30 from t h e Minister in respect of t h e injurious affection ; a n d , subject t o t h e provisions of this A c t , a n y q u e s t i o n of d i s p u t e d c o m p e n s a t i o n u n d e r this subsection shall b e d e t e r m i n e d in t h e s a m e m a n n e r as c o m p e n s a t i o n on t h e acquisition of l a n d falls t o b e d e t e r m i n e d u n d e r t h e Acquisition of L a n d (Assessment of 35 Compensation) A c t , 1919, a n d sections one, t h r e e , five a n d six of t h a t Act shall, with a n y necessary modifications, h a v e effect accordingly. (4) A n y such order shall b e subject t o special p a r l i a m e n t a r y procedure. 40 A c o p y of t h e notice required t o b e given in relation t o a n y such order b y t h e Minister u n d e r p a r a g r a p h 1 of t h e F i r s t Schedule to t h e S t a t u t o r y Orders (Special P r o c e d u r e ) Act, 1945, shall b e served u p o n e v e r y owner, lessee a n d occupier (except t e n a n t s for a m o n t h or a less period t h a n a m o n t h ) of a n y l a n d 45 t o which t h e proposed order relates a n d u p o n a n y o t h e r person whose rights would, in t h e opinion of t h e Minister, b e affected A.D. 1 9 4 6 . b y t h e order, a n d t h e provisions of p a r a g r a p h s 2 t o 4 of t h a t Schedule shall h a v e effect accordingly. ^IL^;/ ' 1 (5) T h e powers of t h e Minister u n d e r this section shall n o t 5 prejudice his power t o acquire l a n d for t h e p u r p o s e of securing t h e o b s e r v a n c e of a n y r e q u i r e m e n t or restriction w h i c h m i g h t h a v e been i m p o s e d i n relation t o t h e l a n d b y a n o r d e r u n d e r this section. 30.—(1) Section t w e n t y - e i g h t of t h e T o w n a n d C o u n t r y Supple­ 10 P l a n n i n g Act, 1944 (which relates t o consecrated l a n d a n d b u r i a l "^ grounds) shall h a v e effect in relation t o a n y l a n d acquired b y ^ n ^ t e r a i t h e Minister as if t h e Minister h a d acquired t h a t l a n d u n d e r relation to P a r t I of t h a t A c t : land. P r o v i d e d t h a t t h e power of m a k i n g regulations for t h e purposes 15 of t h a t section as applied b y this section shall b e exercisable b y t h e Minister, a n d accordingly t h e references in subsection (3) of t h a t section t o " t h e Minister " shall b e c o n s t r u e d as references t o t h e Minister of Civil A v i a t i o n . (2) A n y regulations m a d e b y t h e Minister b y v i r t u e of t h e 20 last preceding subsection shall b e subject t o a n n u l m e n t in p u r ­ suance of a resolution of either H o u s e of P a r l i a m e n t . A n y expenses i n c u r r e d b y t h e Minister or t h e Minister of T r a n s p o r t in consequence of t h e passing of t h i s P a r t of this Act, a n d a n y a d d i t i o n a l s u m s which, in consequence of t h e passing 10 of this P a r t of t h i s Act, fall t o b e defrayed out of m o n e y s p r o v i d e d b y P a r l i a m e n t u n d e r t h e F o u r t h Schedule t o t h e Town a n d C o u n t r y P l a n n i n g Act, 1944, shall be defrayed o u t of m o n e y s provided b y Parliament. e x p' PART I I I . 15 GENERAL, MISCELLANEOUS AND SUPPLEMENTAL PROVISIONS. Air Transport Advisory Council. 35.—(1) H i s Majesty m a y b y Order in Council provide for Air Transport t h e constitution of a n Air T r a n s p o r t Advisory Council consisting ­ of such n u m b e r of m e m b e r s a p p o i n t e d b y t h e Minister as m a y 20 be d e t e r m i n e d in accordance w i t h t h e Order, a n d for securing t h a t tin- m e m b e r s of t h e Council so c o n s t i t u t e d h a v e such quali­ fications as H i s Majesty t h i n k s necessary for t h e performance of t h e duties i m p o s e d on t h e Council b y this section. C o u n c u (2) I t shall b e t h e d u t y of t h e Air T r a n s p o r t Advisory Council— 25 30 35 40 (a) t o consider a n y question relating t o facilities for t r a n s p o r t b y air in a n y p a r t of t h e world, or relating t o t h e charges for s u c h facilities, which m a y be referred t o t h e Council b y t h e Minister ; (b) subject t o a n y conditions or exceptions for which provision m a y b e m a d e b y a n O r d e r m a d e u n d e r t h i s section, t o receive a n d consider r e p r e s e n t a t i o n s from a n y q u a r t e r w i t h respect t o a n y such facilities a n d charges as afore­ said a n d t o afford t o persons interested t h e o p p o r t u n i t y of b e i n g h e a r d in connection w i t h such r e p r e s e n t a t i o n s ; and (c) w h e n t h e Council h a v e considered a n y question referred t o t h e m b y t h e Minister, or h a v e considered a n y such r e p r e s e n t a t i o n s as aforesaid, t o r e p o r t t o t h e Minister u p o n t h e i r conclusions, a n d t o m a k e such r e c o m m e n d a ­ t i o n s t o t h e Minister in connection w i t h those conclusions as they think expedient: 93 PART III. —cont. (5) T h e Minister shall provide t h e Council w i t h s u c h i n f o r m a t i o n a n d o t h e r assistance as h e t h i n k s e x p e d i e n t for t h e p u r p o s e of assisting t h e Council t o discharge t h e i r functions. 20 (6) T h e Council shall m a k e a n a n n u a l r e p o r t t o t h e Minister of t h e i r proceedings, a n d t h e Minister shall l a y t h e r e p o r t before each H o u s e of P a r l i a m e n t t o g e t h e r w i t h a s t a t e m e n t of a n y action w h i c h h a s been t a k e n b y him in consequence of a n y r e c o m m e n d a t i o n s s u b m i t t e d t o h i m b y t h e Council d u r i n g t h e 25 period t o w h i c h t h e r e p o r t relates. Aerodromes. Power of Minister to prohibit or restrict use of civil aerodromes. 3 6 . — ( 1 ) T h e Minister m a y b y order p r o h i b i t or restrict t h e use of a n y civil a e r o d r o m e t o such e x t e n t as h e t h i n k s e x p e d i e n t for t h e p u r p o s e of securing t h a t aircraft m a y l a n d a n d d e p a r t 30 w i t h safety from a n y a e r o d r o m e v e s t e d in h i m . (2) A n y p e r s o n whose r i g h t s in relation t o a n a e r o d r o m e a r e injuriously affected b y a n o r d e r m a d e u n d e r t h i s section shall b e entitled t o recover c o m p e n s a t i o n from t h e Minister in respect of t h e injurious affection ; a n d a n y question of d i s p u t e d c o m p e n - 35 sation u n d e r t h i s subsection shall be d e t e r m i n e d in t h e s a m e m a n n e r as c o m p e n s a t i o n o n t h e acquisition of l a n d falls t o b e d e t e r m i n e d u n d e r t h e Acquisition of L a n d (Assessment of Compensation) A c t , 1919, a n d sections one, t h r e e , five a n d six of t h a t A c t shall, w i t h a n y necessary modifications, h a v e effect 40 accordingly : 05 P r o v i d e d t h a t where a n y a e r o d r o m e or any p a r t of an aerodrome was first p r o v i d e d after t h e passing of this Act, no c o m p e n s a t i o n shall be p a y a b l e u n d e r t h i s subsection in respect of t h a t a e r o d r o m e or in respect of t h a t p a r t thereof, as t h e case m a y b e , unless it w a s p r o v i d e d w i t h t h e consent of t h e Minister. A.D. 1946 PART I I I . —conl. (4) A n y p e r s o n w h o c o n t r a v e n e s t h e provisions of a n y such order shall b e liable in respect of e a c h offence— 1 0 15 (a) on s u m m a r y conviction t o a fine not exceeding one h u n d r e d p o u n d s or to i m p r i s o n m e n t for a t e r m n o t exceeding t h r e e m o n t h s or t o b o t h such fine a n d to such imprisonment ; and (b) on conviction o n i n d i c t m e n t , to a fine not exceeding one t h o u s a n d p o u n d s or to i m p r i s o n m e n t for a period n o t exceeding t w o y e a r s or t o b o t h such fine a n d such imprisonment. (5) I n this section t h e expression " civil a e r o d r o m e " m e a n s a n y a r e a of l a n d or w a t e r designed, equipped or set a p a r t for affording facilities for t h e l a n d i n g a n d d e p a r t u r e of civil aircraft. 37.—(1) W i t h o u t p r e j u d i c e to t h e i r general duties u n d e r a n y Sanitary 20 A c t of P a r l i a m e n t or otherwise, it shall be t h e d u t y of t h e Minister g ^ ? ^ of H e a l t h a n d t h e Minister of Civil Aviation t o m a k e a r r a n g e m e n t s ,iromes for securing satisfactory s a n i t a r y control services a t a e r o d r o m e s for t h e t i m e being v e s t e d in t h e Minister of Civil A v i a t i o n . a t aero (2) A local a u t h o r i t y m a y , a n d shall if t h e Minister of H e a l t h 25 so requires, u n d e r t a k e duties in connection w i t h t h e execution of a n y s u c h a r r a n g e m e n t s as aforesaid upon s u c h t e r m s as m a y b e agreed u p o n b e t w e e n t h e Minister of H e a l t h a n d t h e a u t h o r i t y , or, in default of a g r e e m e n t , as t h e Minister of H e a l t h m a y deter­ mine. (3) Section one h u n d r e d a n d forty-three of t h e P u b l i c H e a l t h Act, 1936, (which e m p o w e r s t h e Minister of H e a l t h t o m a k e regulations w i t h a v i e w t o t h e t r e a t m e n t of certain diseases a n d for p r e v e n t i n g the s p r e a d of such diseases) shall h a v e effect in relation t o a e r o d r o m e s for t h e t i m e being v e s t e d in t h e Minister 35 of Civil Aviation s u b j e c t t o t h e following modifications, t h a t is to say— 30 40 (a) in subsection (3) thereof, after t h e words " for t h e i r enforcement a n d execution " there shall be inserted t h e w o r d s " b y officers designated for t h a t p u r p o s e b y t h e Minister or t h e Minister of Civil Aviation, a n d " ; P a r t I I I . —cont. (b) in subsection (4), after t h e word " a u t h o r i t y " t h e r e shall b e inserted t h e w o r d s " officers so d e s i g n a t e d as aforesaid " ; a n d t h e provisions of t h e said A c t of 1936 shall h a v e effect 1 accordingly. 5 (4) A n y expenses of t h e Minister of H e a l t h a n d t h e Minister of Civil A v i a t i o n in executing t h e provisions of this section shall b e defrayed o u t of m o n e y s p r o v i d e d b y P a r l i a m e n t . (5) I n this section t h e expression " local a u t h o r i t y " m e a n s a n y local a u t h o r i t y for t h e p u r p o s e s of t h e P u b l i c H e a l t h Act, 1936, 10 a n d includes a c o u n t y council a n d a p o r t h e a l t h a u t h o r i t y . Miscellaneous Terms and conditions of employment of persons employed in air transport undertakings provisions. 38.—(i) T h e provisions of t h i s section shall h a v e effect for t h e p u r p o s e of securing t h a t t h e t e r m s a n d conditions of e m p l o y m e n t f p e m p l o y e d b y a n y i n d e p e n d e n t u n d e r t a k i n g c o n s t i t u t e d 15 for t h e p u r p o s e of p r o v i d i n g air t r a n s p o r t services or of c a r r y i n g o u t o t h e r forms of aerial w o r k shall, except in so far as t h e y comply— 0 e r s o n s (a) w i t h a n y r e q u i r e m e n t s i m p o s e d b y or u n d e r a n y e n a c t m e n t for t h e r e g u l a t i o n of s u c h t e r m s a n d conditions ; or 20 (b) w i t h t h e r e q u i r e m e n t s of a n a g r e e m e n t m a d e between t h e u n d e r t a k i n g a n d organisations r e p r e s e n t a t i v e of t h e p e r s o n s e m p l o y e d ; or (c) w i t h a n y decision of a t r i b u n a l h a v i n g a u t h o r i t y to settle t h o s e t e r m s or conditions ; 25 n o t be less favourable t h a n t h e least favourable of t h e t e r m s a n d conditions settled, for persons engaged in c o m p a r a b l e work, in p u r s u a n c e of t h e provisions of this A c t providing for t h e regula­ tion of t h e t e r m s a n d conditions of emplo3'ment of persons e m p l o y e d b y t h e t h r e e corporations. 30 (2) If a n y d i s p u t e arises a s t o w h a t t e r m s a n d conditions o u g h t t o b e observed for t h e p u r p o s e specified in t h e preceding subsection, t h e d i s p u t e m a y , if n o t otherwise disposed of, be referred b y t h e Minister t o t h e I n d u s t r i a l Court for s e t t l e m e n t . (3) W h e r e a n y a w a r d h a s b e e n m a d e b y t h e I n d u s t r i a l Court 35 u p o n a d i s p u t e referred t o t h a t Court u n d e r this section, t h e n , as from t h e d a t e of t h e a w a r d or from such o t h e r d a t e as the Court m a y direct, it shall be a n implied t e r m of t h e c o n t r a c t b e t w e e n t h e employer a n d workers t o w h o m t h e a w a r d applies t h a t t h e t e r m s a n d conditions of e m p l o y m e n t t o b e observed u n d e r t h e c o n t r a c t shall, until varied in accordance w i t h t h e provisions of t h i s section, be in accordance with t h e a w a r d . N o direction given b y t h e C o u r t for t h e purposes of t h e ^1 5 preceding provisions of this section shall h a v e t h e effect of m a k i n g a n y a w a r d retrospective t o a d a t e earlier t h a n t h e d a t e on which t h e d i s p u t e to w h i c h t h e a w a r d relates first arose. (4) Section t w e n t y - s e v e n of t h e Air N a v i g a t i o n Act, 1936, is h e r e b y repealed ; b u t a n y a w a r d m a d e u n d e r t h a t section a n d in 10 force i m m e d i a t e l y before t h e c o m m e n c e m e n t of t h i s Act shall be d e e m e d t o h a v e been m a d e on a reference u n d e r this section, a n d m a y be enforced or varied accordingly. (5) I n this section t h e expression " i n d e p e n d e n t u n d e r t a k i n g " m e a n s a n y u n d e r t a k i n g o t h e r t h a n t h e t h r e e corporations. 39.-—(1) T h e Minister m a y b y regulations p r o v i d e for requiring Recording and such persons a s m a y be specified in t h e regulations t o k e e p registration births and records a n d m a k e r e t u r n s to h i m — deaths on (a) of b i r t h s a n d d e a t h s occurring in a n y p a r t of t h e world ­ in a n y aircraft registered in Great B r i t a i n a n d N o r t h e r n 20 Ireland ; a n d 15 o f a i r c r a f t (b) of the d e a t h , outside t h e U n i t e d K i n g d o m , of a n y person who, b e i n g a traveller on such a n aircraft, is killed on t h e j o u r n e y in consequence of a n a c c i d e n t ; a n d for t h e keeping in his D e p a r t m e n t of a record of a n y r e t u r n s 25 m a d e t o h i m in accordance w i t h a n y such r e q u i r e m e n t a s aforesaid. A n y person w h o fails t o c o m p l y w i t h a n y such r e q u i r e m e n t shall be liable on s u m m a r y conviction t o a fine n o t exceeding twenty pounds. (2) W h e r e a n y s u c h regulations provide for t h e keeping of 30 records in t h e D e p a r t m e n t of t h e Minister in accordance w i t h t h e preceding subsection, t h e y shall also provide for t h e t r a n s m i s s i o n of certified copies of those records t o t h e R e g i s t r a r General of B i r t h s , D e a t h s a n d Marriages in E n g l a n d , t h e R e g i s t r a r General of B i r t h s , D e a t h s a n d Marriages in Scotland, or t h e R e g i s t r a r 35 General for N o r t h e r n Ireland, as t h e case m a y r e q u i r e . (3) T h e R e g i s t r a r General t o w h o m a n y such certified copies a r e sent shall cause t h e m t o be filed a n d preserved in a book t o b e k e p t b y h i m for t h e purpose, a n d t o be called t h e Air Register B o o k of B i r t h s a n d D e a t h s . PART I I I . —cont. (6) T h e e n a c t m e n t s relating to t h e registration of b i r t h s a n d 15 d e a t h s in E n g l a n d , Scotland a n d N o r t h e r n I r e l a n d shall h a v e effect as if t h e Air Register Book of B i r t h s a n d D e a t h s were a certified copy t r a n s m i t t e d to t h e R e g i s t r a r General in a c c o r d a n c e w i t h those e n a c t m e n t s . (7) T h e Minister m a y b y regulations p r o v i d e — (a) for t h e keeping in his D e p a r t m e n t of a record of p e r s o n s w i t h respect to w h o m t h e r e are reasonable g r o u n d s for believing t h a t t h e y are missing in consequence of a n accident in a n aircraft registered in G r e a t B r i t a i n or Northern Ireland ; O Q 2 5 (b) for t h e rectification of a n y s u c h record ; a n d (c) for t h e transmission of information as to t h e m a t t e r s for t h e t i m e being entered on t h e record to t h e R e g i s t r a r General of B i r t h s , D e a t h s a n d Marriages in E n g l a n d , t h e R e g i s t r a r General of B i r t h s , D e a t h s a n d Marriages o in S c o t l a n d or t h e R e g i s t r a r General for N o r t h e r n Ireland, as t h e case m a y require. Power to appoint special constables. 40.—(1) A n y two justices of. t h e peace m a y a p p o i n t such persons as m a y be n o m i n a t e d for t h e purpose b y t h e Minister— (a) t o b e special constables on, a n d within five miles of, a n y premises for t h e t i m e being vested in t h e Minister or u n d e r his c o n t r o l ; a n d (6) to b e special constables for t h e p u r p o s e of performing, outside t h e places a n d limits aforesaid, such d u t i e s as t h e Minister m a y from t i m e to t i m e require to b e performed in connection with accidents to aircraft. (2) E v e r y person so a p p o i n t e d shall be sworn in b y t h e justices duly t o e x e c u t e t h e office of a constable in t h e premises a n d w i t h i n t h e limits a n d for t h e purposes aforesaid, a n d w h e n so sworn in 0 shall, i n those premises a n d w i t h i n t h o s e l i m i t s a n d for those p u r p o s e s , h a v e t h e powers a n d privileges a n d b e liable t o t h e d u t i e s a n d responsibilities of a constable. A.D. 1946. PART I I I . —cont. (3) Special constables a p p o i n t e d u n d e r t h i s section shall b e 5 u n d e r t h e exclusive control of t h e Minister, a n d t h e Minister shall h a v e p o w e r t o s u s p e n d or t e r m i n a t e t h e a p p o i n t m e n t of a n y such special constable. 4 1 . Registration of certain orders in the register of local land charges. 44.—(1) As soon as m a y be after a n y of t h e following orders, t h a t is to say—(a) a n order u n d e r section t w e n t y - s e v e n of this A c t ; (b) a n order u n d e r section t w e n t y - n i n e of this Act w h i c h restricts t h e h e i g h t of trees or t h e installation of a p p a r a t u s ; or (c) a n order u n d e r section thirty-five of t h i s Act ; m 5 x: becomes o p e r a t i v e , it shall b e registered in t h e prescribed m a n n e r in t h e register of local l a n d charges b y t h e p r o p e r officer of t h e local a u t h o r i t y in t h e a r e a of which t h e l a n d t o which t h e order 1 0 relates, or a n y p a r t of t h a t land, is s i t u a t e d . (3) T h e p o w e r conferred b y subsection (6) of section fifteen of 20 t h e L a n d Charges Act, 1925, t o m a k e rules for giving effect t o t h e provisions of t h a t section shall b e exercisable for giving effect t o t h e provisions of t h i s section, a n d in this section t h e expression " prescribed " m e a n s prescribed b y rules m a d e in t h e exercise of t h a t power. 25 Variation and 4 5 . G - F I R S T SCHEDULE S U P P L E M E N T A R Y PROVISIONS AS TO T H E T H R E E CORPORATIONS. 5 Tenure and Vacation of Office. 1. Subject as hereinafter provided, a member of the corporation shall hold and vacate office as such in accordance with the terms of t h e instrument appointing him to be a member : IO 15 Provided t h a t — (a) where a member becomes or ceases to be chairman or deputy chairman of the corporation, the Minister may vary the terms of the instrument appointing him to be a member of the corporation, so far as they relate to the date on which he is to vacate office as such ; and (b) a member of the corporation m a y at any time, b y notice in writing under his hand addressed to the Minister, resign his membership. 3. Subject as hereinafter provided, the chairman of the corporation a n d the deputy chairman of the corporation shall hold and vacate 2 0 office in accordance with the instruments respectively appointing them: Provided that the chairman or deputy chairman m a y at any time, b y a notice in writing under his hand addressed to the Minister, resign his office as such. 25 3 0 35 4. If the chairman or deputy chairman of the corporation ceases to be a member of the corporation, he shall cease to be chairman or deputy chairman, as the case m a y be. 5. A person shall be disqualified for being a member of the corporation if and so long as he is a member of the Commons House of Parliament. 6. If the Minister is satisfied that a member of the corporation— (a) has been absent from meetings of the corporation for a period longer t h a n three consecutive months without the permission of the corporation ; or (b) has become bankrupt or made an arrangement with his creditors; or 1946. 1ST SCH. —cant. (c) is incapacitated by physical or mental illness ; or (d) is otherwise unable or unfit to discharge the functions of a member ; the Minister m a y declare his office as a member of the corporation to be vacant and shall notify the fact in such manner as the Minister thinks fit ; and thereupon the office shall become vacant. ^ 7. A member of the corporation who ceases t o be a member shall be eligible for re-appointment unless he is disqualified for membership. 8. The validity of any proceeding of the corporation shall not be affected by any vacancy amongst the members thereof, or by any defect 1 0 in the appointment of a member thereof, or by the fact that any member thereof is disqualified from being a member of the cotporation. Remuneration. 9. The corporation shall pay to each member thereof, in respect of his office as such, such remuneration as m a y be determined b y the 5 Minister with the consent of the Treasury, and shall pay to the chairman and deputy chairman thereof, in respect of his office as such, such remuneration (in addition to any remuneration to which he m a y be entitled in respect of his office as a member) as m a y be so determined. 20 I 10. If any member of the corporation is employed about the affairs of the corporation otherwise than as a member thereof, the corporation m a y pay to that member such remuneration (in addition to a n y remuneration to which he m a y be entitled in respect of his office as a member) as the corporation may determine. 25 Meetings and proceedings. 11. The quorum of the corporation and the arrangements relating to meetings thereof shall, subject t o any regulations made by the Minister, be such as the corporation may determine. The common seal. 3 0 12. The corporation shall have a common seal, and the fixing of the seal shall be authenticated b y the signatures of— [a) the chairman of the corporation, or some other member thereof authorised either generally or specially by the corporation to act in his stead for t h a t purpose ; and 35 (b) some other person authorised by the corporation, either generally or specially, to act for t h a t purpose. Instruments of the corporation. 13. Any contract or instrument which, if entered into or executed by a person not being a body corporate, would not be required to be 40 under seal, m a y be entered into or executed on behalf of the corporation by a n y person generally or specially authorised by them for t h a t purpose. 9& io GEO. A compulsory purchase order shall incorporate, subject to the 25 modifications set out in Part IV of this Schedule, and to any necessary adaptations, the Lands Clauses Acts, section seventy-seven of the Railways Clauses Consolidation Act, 1845, and sections seventy-eight to eighty-five of that Act (as originally enacted and not as amended for certain purposes by section fifteen of the Mines (Working Facilities 30 and Support) Act, 1923), and shall describe b y reference to a map the land to which it relates, and subject as aforesaid shall be in such form as the Minister may determine. c o n t 3 R D SCH. —cont. 2.—(i) Where the Minister proposes to make a compulsory purchase order with respect to any land he shall prepare a draft of the order, and shall— (a) publish in one or more newspapers circulating in the district r in which the land is situated a notice stating t h a t he proposes "5 to make a compulsory purchase order and describing the land and naming a place where a copy of the draft of the order and of the map referred to therein may be seen at all reasonable hours ; (6) serve on every owner, lessee and occupier (except tenants for 10 a month or a less period than a month) of any of the land a notice stating t h a t the Minister proposes t o make a com­ pulsory purchase order, and the effect thereof, and specifying the time within which, and the manner in which, objections t o the proposal may be made. *5 (2) Where under this paragraph any notice is required to be served on an owner of land, and the land is ecclesiastical property, a like notice shall be served on the Ecclesiastical Commissioners. (3) In this paragraph the expression " ecclesiastical p r o p e r t y " means land belonging to any ecclesiastical benefice, or being or forming 20 part of a church subject to the jurisdiction of the bishop of any diocese or t h e site of such a church, or being or forming part of a burial ground subject to sucH jurisdiction. 3.—(1) If no objection is duly made by any persons upon whom notices are required to be served or by any local authority in whose 25 area the land to which the draft of the order relates is situated, or if all objections so made are withdrawn, the Minister may, if he thinks fit, make an order either in accordance with the draft or with any modification thereof except, unless all persons interested consent, a modification extending the order to any land not designated by the 30 draft. (2) I n any other case the Minister shall, before making an order, cause a public local inquiry to be held, and shall consider any objection not withdrawn and the report of the person who held the inquiry and may then make an order as aforesaid: ^5 Provided t h a t the Minister may require any person who has made an objection to state in writing the grounds thereof, and m a y make an order without causing a public local inquiry t o be held if he is satisfied t h a t every objection duly made relates exclusively t o matters which can be dealt with b y the arbitrator by whom the compensation has 40 to be assessed. (3) Subsections (2) and (3) of section two hundred and ninety of t h e Local Government Act, 1933 (which relate t o the giving of evidence at local inquiries) shall apply to local inquiries held in pursuance of this paragraph as they apply to the local inquiries 45 mentioned in subsection (1) of the said section two hundred and ninety. PART II. " A.D. 1946. Validity and Operation of Compulsory Purchase Orders. JRD g 4. Immediately after a compulsory purchase order has been made, 5 the Minister shall publish in one or more newspapers circulating in the district in which the land is situated a notice stating that the order has been made, and naming a place where a copy of the order and the map referred to therein m a y be seen at all reasonable hours, and shah serve a like notice on every person who, having duly given 10 notice of his objection to the making of the order, appeared at the public local inquiry in support of his objection. — 5.—(1) If any person aggrieved by a compulsory purchase order desires to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of this Act or ! ^ that any requirement of this Act has not been complied with in relation to the order, he may, within six weeks from the time when notice of the making of the order is first published, make an application to the High Court, and 011 any such application the Court— (a) m a y by interim order suspend the operation of the order or any provision contained therein, either generally or in so far as it affects any property of the applicant, until the final determination of the proceedings ; and (b) if satisfied that the order or any provision contained therein is not within the powers of this Act, or that the interests of the applicant have been substantially prejudiced by any 5 requirement of this Act not having been complied with, may quash an order or any provision contained therein, either generally or in so far as it affects any property of the applicant. O Q 2 3 0 (2) Except by leave of the Court of Appeal, no appeal shall lie to the House of Lords from a decision of the Court of Appeal under the last foregoing sub-paragraph. 6. Subject to the provisions of the last foregoing paragraph, a compulsory purchase order shall not, either before or after it has been made, be questioned in any legal proceedings whatsoever, and shall 35 become operative on the expiration of six weeks from the date on which notice of the making of the order is published in accordance with the provisions of this Part of this Schedule. 7. The preceding provisions of this Part of this Schedule shall not apply to an order which is confirmed by an Act of Parliament under section six of the Statutory Orders (Special Procedure) Act, 1945, 4 but except as aforesaid shall have effect in relation to a compulsory purchase order to which t h a t Act applies as if, in sub-paragraph (1) of paragraph 5, for the reference to the time when notice of the making of the order is first published there were substituted a reference to the time when the order becomes operative under the Statutory 45 Orders (Special Procedure) Act, 1945, and as if, in paragraph 6, the words from " and shall become operative " to the end were omitted. 8. Any power conferred by this Act to make a compulsory purchase order in relation to any land shall be exercisable notwithstanding any other enactment providing that the land shall be inalienable. 0 C H c o n i ­ A . (2) Except b y leave of the Court of Appeal, no appeal shall lie to the House of Lords from a decision of the Court of Appeal under the last foregoing sub-paragraph. 6. Subject to the provisions of the last foregoing paragraph, a compulsory purchase order shall not, either before or after it has been made, be questioned in any legal proceedings whatsoever, and shall 35 become operative on the expiration of six weeks from the date on which notice of the making of the order is published in accordance with the provisions of this Part of this Schedule. 7. The preceding provisions of this Part of this Schedule shall not apply to an order which is confirmed by an Act of Parliament under section six of the Statutory Orders (Special Procedure) Act, 1945, 4 but except as aforesaid shall have effect in relation to a compulsory purchase order t o which that Act applies as if, in sub-paragraph (1) of paragraph 5, for the reference to the time when notice of the making of the order is first published there were substituted a reference to the time when the order becomes operative under the Statutory 45 Orders (Special Procedure) Act, 1945, and as if, in paragraph 6, the words from " and shall become operative " to the end were omitted. 0 8. Any power conferred b y this Act to make a compulsory purchase order in relation to any land shall be exercisable notwithstanding any other enactment providing that the land shall be inalienable. 93 F SCH. c o n t 5.—(1) If any person aggrieved by a compulsory purchase order desires to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of this Act or xg that any requirement of this Act has not been complied with in relation to the order, he may, within six weeks from the time when notice of the making of the order is first published, make an application to the High Court, and on any such application the Court— 2 R D ­ A.D. 1946. 3RD SCH. —cont. Restrictions on Compulsory Purchase of Certain Lands. g.—(1) In so far as a compulsorj' purchase order authorises the purchase of any land forming part of a common, open space or fuel or field garden allotment, the order shall be subject to special parlia­ mentary procedure unless the Minister of Agriculture and Fisheries (in the case of a common or of a fuel or field garden allotment) or the Minister of Town and Country Planning (in the case of an open space not being a common or such an allotment) is satisfied that there has been or will be given in exchange for such land other land, not being less in area and being equally advantageous to the persons, if any, entitled to rights of common or other rights, and to the public, and that the land given in exchange has been or will be vested in the persons in w h o m the land purchased was vested, and subject to the like rights, trusts and incidents as attach to the land purchased, and, being so satisfied, certifies accordingly. ^ 10 15 (2) Where it is proposed to give a certificate under this paragraph, the Minister having jurisdiction to give the certificate shall give public notice of his intention so t o do, a n d — (a) after affording an opportunity to all persons interested t o 20 make representations and objections in relation thereto, and (6) after causing a local inquiry t o be held in any case where it appears t o him to be expedient so t o do, having regard t o any representations or objections made, the said Minister may, after considering any representations and 25 objections made and, after an inquiry has been held, the report of the person who held the inquiry, give the certificate. (3) A compulsory purchase order m a y provide for vesting land given in exchange as mentioned in sub-paragraph (1) of this paragraph, in the persons, and subject to the rights, trusts and incidents therein 30 mentioned, and for discharging the land purchased from all rights, trusts and incidents, to which it was previously subject. (4) As soon as m a y be after the giving of a certificate under this paragraph, the Minister of Civil Aviation shall publish in one or more local newspapers circulating in the locality in which the land comprised 35 in the order is situated a notice in the prescribed form stating that the certificate has been given. 10. A compulsory purchase order, in so far as it authorises the purchase of land being, or being the site of, an ancient monument or other object of archaeological interest, shall be subject to special 40 parliamentary procedure. 11. A compulsory purchase order, in so far as it authorises the purchase of land belonging to the National Trust which is held b y the Trust inalienably, shall be subject to special parliamentary procedure. 45 12. A compulsory purchase order shall, in so far as it authorises the compulsory purchase of land which is the property of a local authority, or land which is the property of statutory undertakers and has been acquired by the undertakers for the purpose of their under­ taking, be subject t o special parliamentary procedure. 50 o, & i o G E O . 6 . Civil Aviation. 39 13. In this Part of this Schedule, the following expressions have A.D. 1946. the meanings hereby assigned to them respectively, that is to s a y — " ancient monument " has the same meaning as in the Ancient ^ ' Monuments Acts, 1913 and 1931; " common " includes any land subject to be enclosed under the Enclosure Acts, 1845 t o 1882, and any town or village green; " fuel or field garden allotment " means any allotment set out as a fuel allotment or a field garden allotment, under an Enclosure Act ; " held inalienably " in relation to land belonging to the National Trust, means that the land is inalienable under section twenty-one of the National Trust Act, 1907, or section eight of the National Trust Act, 1939 ; " local authority " means the council of a county, county borough, metropolitan borough or county district, the common council of the City of London, and any other local authority within the meaning of the Local Loans Act, 1875, and includes any drainage board and any joint board or joint committee if all the constituent authorities are such local authorities as aforesaid ; " National Trust " means the National Trust for Places of Historic Interest or Natural Beauty, incorporated b y the said Act of 1907 ; " open space " means a n y land laid out as a public garden or used for the purpose of public recreation, or land being a disused burial ground. 3 R D H c ^5 10 15 20 25 PART I V . Modifications of Lands Clauses Acts and Acquisition of Land (Assessment of Compensation) Act, 1919, for purposes of this Act. 30 The Lands Clauses Acts. 14. In construing the Lands Clauses Acts as incorporated w i t h a compulsory purchase order,— (a) this Act, together with the compulsory purchase order in question, shall be deemed to be the special A c t ; 35 (b) references t o the promoters of the undertaking shall be construed as references to the Minister ; (c) references to the execution of the works shall be construed as references to any erection or carrying out b y the Minister of buildings or works authorised b y this Act. I 5 - The following sections of the Lands Clauses Consolidation Act, s & 9 Viet., 1845, shall be excepted from incorporation with a compulsory purchase c. 18. order, that is to say,— (a) sections one hundred and twenty-seven to one hundred and thirty-two (which relate to the sale of superfluous land) ; (b) section one hundred and thirty-three (which relates to 45 promoters making good deficiencies in land tax and rates) ; (c) sections one hundred and fifty and one hundred and fifty-one (which relate t o access to the special Act). 16.—(1) Where the Minister has served notice to treat on every 50 owner of any land, he m a y at any time thereafter serve a notice on. 40 9 3 F 2 A.D. 1946. every owner and occupier of any of the land, describing the land t o — w h i c h the notice relates and stating his intention to enter on that land 3RD SCH. take possession thereof at the expiration of such period (not ' ''' being less than fourteen days) from the date on which the notice is served as m a y be therein specified. 5'Q (2) At the expiration of the period specified in such a notice (or, where t w o or more such notices are required, and the periods specified in the several notices do not expire at the same time, at the expiration of the last of those periods to expire), or at any time thereafter, the Minister may enter on and take possession of the land without previous 10 consent or compliance with sections eighty-four to ninety of the Lands Clauses Consolidation Act, 1845, but subject to the payment of the like compensation for the land of which possession is taken, and interest on the compensation agreed or awarded, as he would have been required to pay if those provisions had been complied with *5 0 1 - 17. The following provisions shall have effect in substitution for the provisions of section ninety-two of the Lands Clauses Consolidation Act, 1845, that is to say, no person shall be required t o sell a part only of any house, if he is willing and able to sell the whole of the house, building, manufactory, park or garden, unless the arbitrator 20 determines that, in the case of a house, building or manufactory, such part as is proposed to be taken can be taken without material detriment to the house, building or manufactory, or, in the case of a park or garden, that such part as aforesaid can be taken without seriously affecting the amenity or convenience of the house, and, if he so 25 determines, he shall award compensation in respect of any loss due t o the severance of the part so proposed to be taken, in addition to the value of that part, and thereupon the party interested shall be required t o sell to the Minister that part of the house, building, manufactory, park or garden. 30 18. Where glebe land or other land belonging to an ecclesiastical benefice is purchased compulsorily, or compensation falls to be paid for damage sustained b y the owner of such land b y reason of severance or injury affecting the land, sums agreed upon or awarded for the purchase, severance or injury shall not be paid as directed by the 35 Lands Clauses Acts, but shall be paid to the Ecclesiastical Com­ missioners to be applied for the purposes for which the proceeds of a sale by agreement of the land would be applicable under any enactment or Measure authorising such a sale. 19.—(1) Any notice required to be served by the Minister may, not- 40 withstanding anything in section nineteen of the Lands Clauses Consolidation Act, 1845, be served on any person either b y delivering it t o him, or b y leaving it at his proper address, or by post, so however that the notice shall not be duly served b y post unless it is sent by registered letter. 45 (2) A n y such notice required or authorised to be served upon an incorporated company or body shall be duly served if it is served on the secretary or clerk of the company or body. (3) For the purposes of this paragraph and of section twenty-six of the Interpretation Act, 1889, the proper address of any person 5 upon whom any such notice as aforesaid is to be served shall, in the 0 case of the secretary or clerk of a n y incorporated company or body, A . D . 1946. be that of the registered or principal office of the company or body, SCH. and in any other case be the last known address of the person to be 3 — o' ­ served: Provided that where the person to be served has furnished an address for service, his proper address for t h e purposes aforesaid shall be the address furnished. r d c ^6 (4) If it is not practicable after reasonable enquiry t o ascertain the name or address of an owner, lessee or occupier of land on whom any 10 such notice as aforesaid is to be served, the notice m a y be served b y addressing it to him b y t h e description of " owner ", " lessee " or " occupier " of the land (describing it) t o which it relates, and b y delivering it t o some person on the premises or, if there is no person on the premises to whom it can be delivered, by affixing it, or a copy ! 5 of it, t o some conspicuous part of the premises. Acquisition of Land (Assessment of Compensation) Act, 1919. 20. Where compensation falls to be assessed under t h e Acquisition of Land (Assessment of Compensation) Act, 1919, the arbitrator shall not take into account any interest in land, or any enhancement of 20 the value of any interest in land b y reason of any building erected, work done or improvement or alteration made, whether on the land purchased or on any other land with which the claimant is, or was at the time of the erection, doing or making of the building, work, improvement or alteration, directly or indirectly concerned, if the 25 arbitrator is satisfied that the creation of the interest, the erection of the building, the doing of the work, or the making of the improvement or alteration, as the case m a y be, was not reasonably necessary and was undertaken with a view to obtaining compensation or increased compensation. 30 FOURTH SCHEDULE. ADJUSTMENTS OF THE FUNCTIONS OF STATUTORY UNDERTAKERS. PART I. 1. Where it appears to the Minister and the appropriate Minister, upon a representation made by t h e person carrying on a statutory 35 undertaking, that in order to facilitate a n y adjustment of the carrying on of the undertaking necessitated by any order made or proposed to be made under Part II of this Act, it is expedient that the powers and duties of the said person in relation to t h e carrying on of the undertaking should be extended or modified, the Minister and the 40 appropriate Minister may b y order provide for such extension or modi­ fication of the said powers and duties as appears t o them to be requisite for facilitating the adjustment. 2. Without prejudice t o the generality of the provisions of the preceding paragraph, an order under this Part of this Schedule m a y 45 provide— (a) for empowering the person carrying on the undertaking t o acquire, whether compulsorily or by agreement, any land nt A.D. 1946. 4TH SCH, " - C 0 K ^ specified, in t h e order and to erect or construct any buildings or works so specified ; j p p i y i g j relation 'to t h e acquisition of such land and the construction of such works enactments relating to the acquisition of land and the construction of works (including s£") the Acquisition of Land (Assessment of Compensation) Act, o r a n n 1919); and for such incidental and supplemental matters as appear t o the Minister and t h e appropriate Minister t o be expedient for the purposes 0 of t h e order. X 3 . A s soon as m a y be after the making of a representation under this Part of this Schedule, the person carrying o n the undertaking shall publish, in such form and manner as m a y be directed b y the Minister and the appropriate Minister, a notice giving such particulars as m a y be so directed of the matters to which the representation 15 relates and specifying the time within which, and the manner in which, objections to the making of an order on the representation m a y be made, and shall also, if it is so directed b y t h e Minister and t h e appropriate Minister, serve a like notice on such persons, or persons of such classes, as m a y be so directed. 20 4 . If any objection is duly made to the making of an order on a n y such representation as aforesaid, the provisions of t h e First Schedule t o t h e Town and Country Planning Act, 1944, shall have effect as if t h e order were an order under section twenty-six of that Act. 5. A n order under this Part of this Schedule shall be subject to 25 special parliamentary procedure. PART I I . 6. Where on a representation in t h a t behalf made b y the person carrying on a statutory undertaking t h e appropriate Minister is satisfied' that the making of a n y order under the said Part II of this Act has 30 rendered impracticable t h e fulfilment of a n y obligation of the said person incurred in connection with t h e carrying on of the undertaking, t h e appropriate Minister m a y b y order direct that t h e said person shall be relieved of t h e fulfilment of the obligation either absolutely or to such extent as m a y be specified in t h e order. 35 t " 7 . A s soon as m a y be after the making of a representation t o the appropriate Minister under t h e preceding paragraph, the person carrying on the undertaking in question shall, as m a y be directed b y t h e appropriate Minister, either publish, in such manner as m a y be so directed, a notice giving such particulars as m a y be so directed of 4 the matters t o which t h e representation relates and specifying the time within which, and the manner in which, objections t o the making of an order on t h e representation m a y be made, or serve such a notice on such persons, or persons of such classes, as m a y be so directed, or both publish and serve such notices. 45 0 8. The provisions of the First Schedule t o the Town and Country Planning Act, 1944, shall have effect in relation t o the making of an order under this Part of this Schedule if a n y objection thereto is duly made, as if t h e order were an order under section twenty-seven of that 93 Act, and subject t o those provisions in a case in which they have effect, the appropriate Minister may, if he thinks fit, make an order. A.D. 1 9 4 6 . 4TH SCH. 9 . If any objection t o the making of an order under this Part w of this Schedule is made and is not withdrawn before the making of l 5 the order, the order shall be subject to special parliamentary procedure. PART III. 10. In this Schedule the expression " the appropriate Minister " means— [a) in relation t o a railway, light railway, tramway, road transport. 10 water transport, canal, inland navigation, dock, harbour, 'pier or lighthouse undertaking, the Minister of Transport; ib) in relation to an undertaking for the supply of electricity, gas or hydraulic power, the Minister of Fuel and P o w e r ; and (c) in relation to an undertaking for the supply of water, the *5 Minister of Health. —cont.
