CHAPTER 70 - CONDEMNATION
72.31 - Condemnation Report.
Send five copies of the condemnation report to the Regional Forester. Distribution will be:
1.
Chief - original and two copies.
2.
Office of General Counsel - one copy.
3.
Regional Forester - one copy.
If a preliminary review is requested, only two copies are needed.
72.32 - Deposit with Declaration of Taking.
Upon notification by the Chief that the Secretary of Agriculture has executed the Declaration of
Taking, the Regional Right-of-Way Program Manager will request the Forest to process a check
payable to the appropriate Clerk of the U.S. District Court. The Forest will deliver the check to
the Regional Right-of-Way Program Manager for transmittal to the U.S. Attorney through the
Office of General Counsel. The transmittal to the Office of General Counsel will include:
1.
Copy of executed Declaration of Taking.
2.
Copy of letter from Secretary of Agriculture to Attorney General.
3.
Check in the amount of estimated just compensation.
4.
Fifty-five copies of Schedules A and B.
72.33 - Schedules A and B.
In addition to the Schedule A and B copies in the condemnation reports, 55 copies of each must
be submitted to the Regional Forester for distribution to the Chief and U.S. Attorney.
