MINUTES WEST VIRGINIA BOARD OF EDUCATION Eastern Greenbrier Middle School 330 Knight Drive Ronceverte, West Virginia August 13, 2014 I. Call to Order Following the welcome, Pledge of Allegiance and introductions, President Gayle C. Manchin called the meeting of the West Virginia Board of Education (WVBE) to order at 10:04 a.m. on August 13, 2014, in the Music Room at Eastern Greenbrier Middle School, 330 Knight Drive, Ronceverte, West Virginia. The following members were present: President Manchin, Vice President Michael I. Green, Secretary Tina H. Combs, Thomas W. Campbell, Robert W. Dunlevy, Lloyd G. Jackson II, L. Wade Linger Jr., and William M. White, and ex officio Charles K. Heinlein, State Superintendent of Schools. Members absent were ex officios Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education. II. Welcome and Introductions President Manchin introduced Ms. Sallie Dalton, Superintendent of Greenbrier County Schools, who welcomed the Board, requested Greenbrier County staff in attendance to introduce themselves to the assembly, and provided an overview of education programs and statistics available to Greenbrier County students. III. Recognitions The Board recognized Greenbrier East High School, a 2014 National HOSA Outstanding Chapter award winner, with a number of students placing in other events at the HOSA Conference; and, Mr. Douglas S. Lambert, Superintendent of Pendleton County Schools, as the 2014 West Virginia Association of School Administrators' Superintendent of the Year. IV. Greenbrier University Superintendent Dalton introduced Mr. Jeff Bryant (distributed information), Principal of Greenbrier East High School, assisted by Ms. Rebecca Legg, counselor, Greenbrier East High School, and Ms. Holly Jo Burns, Ms. Kathy Carry, and Ms. Beth Fallon, The Greenbrier, provided Information regarding the partnership between The Greenbrier and Greenbrier County high schools to build capacity for the employment of students through career and employment opportunities through experiential learning. Assisting Youth in Making Positive Life Decisions Dr. White introduced Mr. Thomas Gerdy (distributed information), Project Founder for Outreach Effort, who provided information regarding efforts to proactively assist youth in making positive life decisions through sharing examples of lessons learned by incarcerated individuals. (Copy appended to Official Minutes, Attachment U.) VI. Approval of Agenda President Manchin called for a motion to approve the agenda. Mr. Dunlevy moved that the agenda be approved. Mr. Jackson requested that Consent Agenda item C. 1. WVDE Personnel Matters be removed from the Consent Agenda and taken up with the Board's personnel matters. Mr. Dunlevy agreed to the adjustment. Mr. Linger seconded the motion, with the requested agenda adjustment, and upon the call for the question the motion was carried unanimously. VII. Educator Preparation Program Review Board Recommendation for West Virginia Wesleyan College, Granting of Continuing Approval Status of Advanced Level Educator Preparation Program - (Action) Dr. Monica Beane, Executive Director, WVDE Office of Professional Preparation, addressed the Board regarding the Educator Preparation Program Review Board's recommendation for West Virginia Wesleyan College. In April of 2013, an on-site focused accreditation visit of the educator preparation program at the advanced level at West Virginia Wesleyan College (WVWC) was conducted jointly by an accreditation team from the National Council for Accreditation of Teacher Education (NCATE) and by a West Virginia Board of Education State Review Team. NCATE Board of Examiners (BOE) found Standard 4 (Diversity) not to be met. An appeal was filed and parties were notified on or about August 11, 2014, that the appeal was denied; WVWC's accreditation status was rescinded retroactive to December 2013 affecting both recent graduates and potential program enrollees. The Educator Preparation Program Review Board (EPPRB) has reviewed the BOE Report from the NCATE and disagreed with the findings in the BOE Report and found that all standards identified in Policy 5100, including the Diversity Standard, were in fact met. Granting continuing approval status to WVWC's Advanced Level program will allow the institution to continue preparing teacher candidates to serve West Virginia students in their service area. These candidates will be prepared to fill critical shortage areas. Mr. Linger moved that the Advanced Level Program offered at West Virginia Wesleyan College be granted continuing approval status until the completion of the required upcoming full visit that will be conducted by the Council for the Accreditation of Educator Preparation (CAEP). Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment V.) -3VIII. WVBE Finance Committee - FY16 Legislative Improvement Packages Mr. Campbell (distributed information) presented FY16 legislative improvement pages for the Board's consideration and indicated that the committee met prior to today's meeting and would meet again to discuss the improvement packages and prioritize the recommendations for the Board's consideration at the Board's September meeting. Transforming the School Principalship: A Framework of Promising Practices and Bold Actions Mr. Jackson led discussion regarding Transforming the School Principalship: A Framework of Promising Practices and Bold Actions and the recommendations found in the document. Mr. Jackson moved that the recommendations portion of Transforming the School Principalship: A Framework of Promising Practices and Bold Actions be placed on the WVDE/WVBE's website, along with a link to the research, for comment, that affected organizations/groups be notified that the recommendations are available for comment, and the comments be provided to the Board at the September meeting. WVBE Coordinator of Board Agencies Report Mr. Jason L. Butcher, WVBE Coordinator of Board Agencies, provided a report regarding his work with WVBE agencies and specifically visits to institutional education programs and options being pursued to assist in the provision of services to youthful offenders. XI. RESA Liaison Report Dr. Robin Lewis, Executive Director of RESA 1, and Mr. David Warvel, Executive Director of RESA 4, provided a brief report regarding RESA initiatives. Mr. Warvel extended his thanks to the WVBE and WVDE for the support provided to new RESA Executive Directors. XII. Capacity Building for Priority Schools and Intervention Counties Ms. Michele Blatt, Assistant State Superintendent, Division of Educator Quality and System Support, provided information regarding support services provided to schools and RESAs. Mr. Ted Mattern, System Support Liaison, Office of the State Superintendent, provided information regarding support services provided to the intervention counties. Call to Order President Manchin called the meeting back to order at 12:57 p.m. XV. Consent Agenda Dr. White moved that the Consent Agenda, as previously amended, be approved. Approved minutes of July 9, 2014 (Attachment C) Approved Final Education Performance Audit Reports for Fall River Elementary School, Iaeger Elementary School, Southside K-8 School, Welch Elementary School and Mount View High School, McDowell County (Attachment D) Approved one first time request for a waiver of WVBE policy (Attachment F) Notification, per W. Va. Code §18A-4-7a(l)(3), Transfer of Person Employed in a Professional Position after the Twentieth Day Prior to the Beginning of the Instructional Term, from Jefferson County Schools (Attachment G) Approved Policy 2419, Regulations for the Education of Students with Exceptionalities (Attachment H, Parts 1 and 2) Approved Policy 2422.2, Driver Education Regulations (Attachment I) Approved Policy 4321.1, Standards for School Nutrition (Attachment J) Approved Marshall University's revision to its Language Program to include a Japanese Program (Attachment K). Office of Education Performance Audits (OEPA) Director’s Information Dr. Gus Penix, Director, OEPA, provided brief remarks regarding OEPA initiatives, trainings, audits, and the electronic school monitoring report. XVII. Progress Report of the Fayette County School District Dr. Penix reported that an announced review (five days in advance) of the Fayette County School District was conducted June 13, 2014. The purpose of the audit was to ascertain the degree of compliance and progress in addressing the noncompliance regarding policy development from the OEPA's 2007, 2009, and 2010 reports. The Team found that the Fayette County Policy Manual was current and also posted on the county's website. -5- Upon the recommendation of Dr. Penix, Mr. Linger moved that partial control be returned to the Fayette County Board of Education in Policies; all other areas of intervention remain in place; and the Nonapproval status of the Fayette County School District be continued. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment L.) Dr. Serena Starcher-Martin, Superintendent of Fayette County Schools, addressed the Board regarding the Board's action. XVIII. Waiver Request - Policy 4336, West Virginia School Bus Transportation Policy and Procedures Manual Superintendent Heinlein introduced Mr. Terry George, Superintendent of Randolph County Schools, who presented a waiver request of Policy 4336 for the Board's consideration. The request is to accommodate the bus routes that will need to be lengthened to accommodate Harman School students and transportation to other Randolph County Schools. Mr. Campbell moved that Randolph County Schools' request for a waiver of Policy 4336, at section 22, be approved for a period of one year. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment M.) XIX. Memorandum of Agreement (MOA) and Contract for Leasing between the West Virginia Schools for the Deaf and the Blind (WVSDB) and Eastern West Virginia Community and Technical College (EWVCTC) Ms. Mary Catherine Funk, WVBE Attorney, presented the MOA and contract for leasing between the WVSDB and EWVCTC for the Board's consideration. The MOA between WVSDB and EWVCTC, and its associated Contract for Leasing, provides the rules and responsibilities of each institution as they collaborate to share resources in the provision of online instruction to Residential Care Specialists pursuing their required coursework. Due to a question regarding student security, action regarding this item was postponed until later in the agenda. (Copy appended to Official Minutes, Attachment Mc.) XX. Approval of Local Board of Education Policies for Dual Credit Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, presented 15 local board of education policies for dual credit for the Board's consideration. Policy 2510, at section 5.4.f.1.C., states “County boards of education shall adopt policies that allow students to earn credit for completion of college courses and other advanced courses outside the school setting. If these courses, including dual credit courses, are used to meet graduation requirements, the county policy must be reviewed by the WVDE and approved by the WVBE.” Fifteen (15) counties have submitted local policies and required documents for dual credit courses. The policies and course documents have been reviewed by WVDE staff to ensure alignment with -6appropriate Next Generation content standards. Following discussion regarding policy language, action regarding this item was deferred to the September meeting. XXI. Policy 2512, Transformative System of Support for Early Literacy Mr. Clayton Burch, Interim Associate Superintendent, Division of Teaching and Learning, presented Policy 2512 for the Board's consideration. The proposed repeal and replacement of Policy 2512 is required due to action taken during the 2014 legislative session. House Bill 4618 amended and reenacted W. Va. §18-2E-10 relating to establishing transformative system of support for early literacy; making legislative findings; requiring state board rule; minimum provisions of rule; eliminating critical skills instructional support programs for third and eighth graders; and modifying critical skills program framework to apply only to early literacy program. The revised WVBE Policy 2512 lays the framework for the newly established Transformative System of Support for Early Literacy, a key component in West Virginia's Campaign for Grade Level Reading. Mr. Jackson moved that Policy 2512 be placed on public comment for a period of 30 days. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. Policy 5100, Approval of Educational Personnel Preparation Programs Dr. Monica Beane, Executive Director, WVDE Office of Professional Preparation, presented Policy 5100 for the Board's consideration. Policy 5100 has been revised to address the governor's challenge to increase the quality and rigor in teacher preparation in West Virginia by requiring all West Virginia educator preparation programs to become nationally accredited by the Council for Accreditation of Educator Preparation (CAEP). Changes were made to clarify the process for transitioning into the CAEP Standards; to revise and clarify the program review process for accreditation and the program approval process at the state level. Also addressed are criteria for increasing the rigor in program admission, matriculation and completion; to update terminology to reflect the CAEP language and the new intent of the policy. Mr. Jackson moved that the suggested revisions to Policy 5100 be placed on public comment for a period of 30 days. Mr. Dunlevy seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment O.) XXIII. Policy 5202, Minimum Requirements for the Licensure of Professional/Paraprofessional Personnel and Advance Salary Classifications Dr. Beane presented Policy 5202 for the Board's consideration. Policy 5202 has been revised to clarify language that ensures the intent of the policy. Minor revisions are being recommended to align the numbering and referencing of other sections of policy. In order to -7allow counties the flexibility in technology training, the renewal requirement for professional certificates no longer includes a required technology course. Additionally, changes were made to Appendix A to align with the proposed changes in Policy 5100. Finally, Appendix C was amended to clearly identify the NOCTI Exam Exemptions and Requirements for Career and Technical Education. Mr. Jackson moved that the suggested revisions to Policy 5202 be placed on public comment for a period of 30 days. Appointments to WVBE Statutory Units/Liaisons/ Presidential Committees 2014-2015 President Manchin, assisted by Ms. Donna Hoylman Peduto (distributed appointments chart), WVBE Director of Operations, presented appointments to WVBE Statutory Units/Liaisons/Presidential Committees 2014-2015 for the Board's consideration. Members were requested to notify President Manchin and Ms. Peduto if they are available to fill future vacancies. By consensus the appointments were approved. (Copy appended to Official Minutes, Attachment X.) XXV. WVBE Personnel Matters and Update regarding Current Litigation in Jorea M. Marple v. West Virginia Board of Education President Manchin requested a motion to move into executive session. Mr. Linger moved, in accordance with W. Va. Code §6-9A-4 [matters involving attorney-client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)] and/or §6-9A-4(b)(2)(A) [personnel exception], that the Board enter into executive session. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. The Board moved into executive session at 2:35 p.m. XXVI. Return from Executive Session Dr. White moved that the Board return from executive session. Mr. Green seconded the motion and upon the call for the question the motion was carried unanimously. The Board returned from executive session at 4:25 p.m. President Manchin announced that no action was taken or decisions were made during executive session. XXVII. Recess President Manchin recessed the meeting at 4:26 p.m. and announced that the meeting would reconvene on August 14 at 9:00 a.m. in the same location. -8XXVIII. Memorandum of Agreement (MOA) and Contract for Leasing between the West Virginia Schools for the Deaf and the Blind (WVSDB) and Eastern West Virginia Community and Technical College (EWVCTC) (Continued) Ms. Funk provided clarification regarding the WVSDB student security concerns with regard to classes held on the WVSDB campus by EWVCTC. Dr. White moved that the MOA and associated Contract for Leasing between WVSDB and EWVCTC be approved. WVBE Personnel Matters President Manchin requested a motion regarding the Board's personnel attachment. Mrs. Combs requested that the employment of Shannon Johnson, Personnel Coordinator, RESA 8, be removed from Attachment Q and that the amended attachment be approved. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. No discussion occurred regarding Attachment E. Superintendent's Report Superintendent Heinlein provided a report regarding the statewide summative assessment testing window and data issues. (Copy appended to Official Minutes, Attachment Y.) XXXII. Update - WVBE Response to Governor's Education Agenda Ms. Donna Hoylman Peduto (distributed information), WVBE Director of Operations, members of the Board, and WVDE staff, provided an update (PowerPoint presentation attached) regarding progress toward accomplishing the Governor's education agenda including the key provisions of the Governor's request of the WVBE; Commission on School District Governance and Administration (Mr. Campbell); Project 24 (Mr. Green); require every career center to add at -9least one career pathway to meet SREB requirements for Preparation for Tomorrow; use RESAs more efficiently for cooperative purchasing and local professional development delivery; teacher certification/teacher preparation and educator evaluation; professional development; leadership capacity development (President Manchin); early literacy to support reading on grade level by end of third grade (President Manchin); accountability and accreditation/West Virginia school grading model; and, WVBE Re-imagining Instructional Time Committee. Items for Future Consideration President Manchin, assisted by Ms. Peduto (distributed information), reviewed the Board's goals showing verbiage changes to make the goals current and updating status of initiatives; action regarding the goals will be taken at the September meeting. President Manchin requested that members notify her, Ms. Peduto and the Board's secretary if they wish to attend the National Association of State Boards of Education annual conference. Dr. White stated that strategic priority number four should remain but eventually be removed. Dates within the document will be made current. Mr. Jackson suggested that strategic priority number six be amended to show support for competitive teacher compensation. It was the consensus of the Board that the goals be updated as stated. Future Meetings President Manchin requested that members consider reformatting the agenda and provide comments to Ms. Peduto for consideration at the September meeting. Dr. White issued concern regarding the Consent Agenda. President Manchin addressed the Board regarding future meeting dates that were approved at the January 2014 meeting noting that the November dates are a week earlier than normal and several dates occur on Thursday and Friday as opposed to Wednesday and Thursday. President Manchin asked members to consider a county visit for the November meeting during the second Wednesday and Thursday with a possible visit to Logan County. Another option offered was to look at holding one day meetings on Thursday. Superintendent Heinlein will investigate and provide information regarding the feasibility of enlarging the Board Room. Ms. Peduto indicated that Dr. Martirano has requested a meeting with the Board on September 22 or October 3 in Charleston and requested that members advise her of their availability. President Manchin requested members advise the Board's secretary as soon as possible if they wish to be registered for NASBE's annual conference. The next regular meeting of the WVBE will be held September 10, 2014, in Charleston, West Virginia. The meeting will continue on September 11, 2014, if the agenda is not completed on September 10, 2014. Dr. White will be attending a Data Quality Campaign student data privacy summit for policymakers in early September and noted that Mr. David M. Fryson, Esq., West Virginia University Vice President for Diversity, Equity and Inclusion, has been appointed by Dr. Gordon Gee, President of West Virginia University, to assist in the reform of Kanawha County's West - 10 Side to help support public schools, children's organizations and other community services.
