Inside, you will find campus crime statistics for the last three years as well as safety related policies and procedures. Information is prepared in accordance with the Crime Awareness and Campus Security Act enacted by Congress in 1990. The act was amended a number of times, and renamed the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act. The Clery Act, as it is commonly called, requires all institutions of higher education give timely warnings of crimes that represent a threat to the safety of students or employees, and to make public their campus security policies. It also requires that crime data is collected, reported and disseminated to the campus community, and submitted to the U.S. Department of Education. The act is intended to provide accurate, complete & timely information about safety on campus so you may make informed decisions. Kirkwood Community College’s Campus Security is responsible for gathering and publishing information required by the Clery Act. In addition to the above, law enforcement agencies with jurisdiction over property owned or controlled by Kirkwood, provide information about crimes and are included in the annual crime stats. EMERGENCY RESPONSE MEMBER OF THREAT ASSESSMENT TEAM SAFETYAND PRESENTATIONS SAFETY SECURITY PRESENTATIONS BLUE LIGHT EMERGENCY PHONES LOCATED THROUGHOUT CAMPUS Kirkwood Alert ROLE OF CAMPUS SECURITY Campus Security Officers patrol the main campus, respond to emergencies and other calls for service on all campuses, conduct traffic checks, walk through campus buildings, staff special events, and facilitate a variety of safety and security presentations. Campus Security Officers may ask persons for identification to determine whether individuals have legitimate business at the college. Campus Security Officers have the authority to investigate offenses involving rule violations and to make a referral to the appropriate area of the college. Campus Security officers do not possess arrest powers and do not carry firearms. Criminal incidents are referred to the law enforcement who have jurisdiction on campus. Campus Security maintains a highly professional working relationship with law enforcement. All crime victims and witnesses are strongly encouraged to immediately report the crime to Campus Security and other appropriate law enforcement. FIREARMS/WEAPONS Weapons of any kind, whether carried openly or concealed, are not allowed on campus. This is regardless of the individual having a weapon permit issued by Iowa or any other state. Exemptions: This policy does not apply to law enforcement personnel who are carrying weapons in performance of their duties. The definition of what is considered a weapon, along with more information on Kirkwood’s Weapons Policy is available at www.kirkwood.edu/security Kirkwood’s emergency notification system is Kirkwood Alert. In an emergency, where time is critical, Kirkwood will provide emergency alerts, notifications and updates to email accounts, cell phone, and desktops. Kirkwood Alert is your connection to real time emergency information, updates, and instructions on where to go, what to do or not do, who to contact, and other important critical emergency information. Escorts 02 Most academic buildings are locked in the evening and remain locked during the overnight hours. They are generally unlocked before 7 a.m., Monday through Friday. The majority of buildings are not accessible on the weekends or on college holidays. Exceptions to regular hours may be arranged by completing a School Dude or contacting the Campus Security office at 319-389-1774. After hours access to buildings or offices may be gained by contacting Campus Security. It is a good idea to walk in pairs whenever possible, particularly when walking on campus during hours of darkness. Campus Security escorts on main campus may be obtained by calling 319-389-1774. Kirkwood Community College | Campus Security REPORTING CRIMES AND EMERGENCIES Anyone on any Kirkwood campus who witnesses or is the victim of a crime or any criminal activity should contact Campus Security by dialing 319-389-1774. For an Emergency or to report a crime in progress, dial 911. Be prepared to provide: • location: be as specific as possible. • type of crime being committed. • if an ambulance or other emergency vehicles are needed. • any descriptions you can provide. Stay on the line until help arrives or the dispatcher tells you to hang up. Campus Security Officers will respond, take action if appropriate, investigate, and file a report. Incidents may also be reported to the respective law enforcement agency. Assistance in contacting these agencies is available through Campus Security. All crimes reported to Dean of Students, or other Kirkwood staff, must also be reported to Campus Security. Daily Log Campus Security maintains a daily log, which is available for public view during normal business hours, Monday through Friday. The log is located at the Campus Security office on the north side of the main campus. All release of information is subject to federal and state restrictions. Campus Safety Alerts (Timely Warnings) In the event a situation arises, either on or off campus, that in the judgement of Campus Security, the Director of Emergency Services & Campus Security, the Associate Vice President of Facilities, or other administrative officials or if advised by law enforcement, constitutes an ongoing immediate or continuing threat to the campus community, a “timely warning” will be issued. “Timely warnings” are issued through a variety of sources including but not limited to the emergency notification system Kirkwood Alert (email, text, desktop notification), email, social media, Kirkwood website, etc. Check www.kirkwood. edu/security for more information. Sex Offender Registry Iowa law requires a person who has been convicted of a sex offense to register with the sheriff in the county in which he/she resides, and if the person attends or works for an institution of higher education, register with the sheriff in the county in which the institution is located. To obtain information regarding sex offenders, contact the local sheriff’s office or check the Iowa Sex Offender Registry at www.iowasexoffender.com. For additional assistance, contact Campus Security. SILENT WITNESS If you have information or are the victim of a crime and do not want to pursue action within Kirkwood or the criminal justice system, you may still want to consider making a confidential report. To complete a “Silent Witness” report, go to www. kirkwood.edu/security. The purpose of a confidential report is to comply with your wish to keep the matter confidential while taking steps to ensure the future safety of yourself and others. With such information, Kirkwood can keep an accurate record of the number of incidents involving students, determine where there is a pattern of crime with regard to a particular location, method, or assailant, and alert the campus community to potential danger. CRIME REPORTING AREAS The Campus Security Act defines three areas where crime must be reported by an institution: Campus What most people think of as the main part or core of the college. Owned or controlled by the college and located within the confines of the main campus. Non-campus Building or Property Owned or controlled by the college, used for educational purposes, and frequently used by students. Public Property Within the campus or immediately adjacent to the campus. Private properties adjacent to campus, including apartment complexes are not owned or controlled by the college, and are not required to be reported in the crime statistics. All Other Locations Investigative and administration services. 03 Kirkwood Community College | Campus Security EMERGENCY RESPONSE The Kirkwood Emergency Response Plan includes information about emergencies, emergency response teams, Kirkwood’s operating parameters; incident priorities and performance expectations; shelter-in-place and evacuation guidelines; and local contingency and continuity planning requirements. Kirkwood Community College is committed to providing its students, faculty, staff, partners and visitors a safe and healthy environment. This is a proactive collaborative, coordinated, objective, and thoughtful approach to the prevention, identification, assessment, intervention, and management of situations that pose, or may reasonably pose, a threat to the well-being and safety of the campus community. Red Emergency Quick Reference guides are located throughout Kirkwood and are intended as a quick reference guide for students, faculty, and staff through emergency situations such as fire, tornado, bomb threat, evacuation, medical emergencies, lockdown or shelter in place and many others. Emergency response and evacuation plans are tested in a variety of ways throughout the year. This includes but is not limited to announced and unannounced drills, and testing of the emergency notification system. For more information on Kirkwood’s Emergency Response Plan, go to www.kirkwood.edu/security, or to the Emergency Procedures tab on KIN. 04 Kirkwood Community College | Campus Security THREAT ASSESSMENT TEAM Kirkwood Community College has established a Threat Assessment Team to ensure we provide the safest possible environment for our students, faculty, staff, and other community members. This team includes individuals from a variety of disciplines. The Threat Assessment Team will be working in conjunction with student, faculty, and staff as well as many other resources within the Kirkwood community. The responsibility of the team includes responding to reported concerns and developing assessment and prevention programming. The Threat Assessment Team serves as a point of contact for students, faculty, staff, and other members of the community who are aware of, or are experiencing threatening or potentially threatening behavior. The team will gather factual information, review, and investigate individual concerns brought to the attention of the team, and will facilitate a timely and reasonable response. Definition of Sexual Harassment Faculty, staff and students at Kirkwood Community College have a right to be free from sexual harassment by supervisors,staff and teachers. Kirkwood does not condone actions and words that a reasonable person would regard as sexually harassing or coercive. Sexual harassment encompasses any sexual attention that is unwanted, and is defined as unwelcome advances, requests for sexual or other verbal or physical conduct of a sexual nature when: •Submission is made an expressed or implied term or condition of employment or status in a class, program or activity. •Submission to or rejection of the behavior is used to make an employment or educational decision (such as hiring, promotion or grading a course). •The conduct has the purpose or effect of unreasonably interfering with a person’s work or educational performance, or creates an intimidating, hostile or offensive environment for work or learning. Sexual harassment may take many forms. For example: •Physical assault. •Direct or implied threats that submission to sexual advances will be a condition of employment, work status, promotion or grades. •Direct propositions or comments of a sexual nature. •Comments of a sexual nature. •Sexually explicit statements, questions, jokes or anecdotes. •Unnecessary touching, patting, hugging or brushing against a person’s body. •Remarks of a sexual nature about a person’s clothing or body, about sexual activity or about previous sexual experience. •Students, faculty and staff need to be concerned not only with the intent of their actions of this kind, but also the effects. While sexual harassment involves repeated, unwanted sexual attention, persons involved in isolated or inadvertent incidents demonstrate insensitivity toward others. This type of behavior will also be considered intentional violations of this policy. • unnecessary touching, patting, hugging or brushing against a person’s body; • remarks of a sexual nature about a person’s clothing or body, about sexual activity or about previous sexual experience. 06 Kirkwood Community College | Campus Security REDUCE YOUR RISK Be cautious and prepared. Learn the locations of the emergency call boxes in main campus parking lots (www.kirkwood.edu/ maincampus).The phones allow one-button emergency voice connection to 911 and Campus Security. For other locations, know where the closest phone is. • Avoid walking alone, particularly after dark. • Travel well-lighted, regular walkways and avoid shortcuts. • Make use of the main campus escort service, 319389-1774. • Stay alert to your surroundings. Be aware of what is going on around you. • Hold off on phone calls. Though it might make you feel safer, it actually distracts your attention. Don’t Leave Property Unattended Anywhere! If you’re leaving for a minute, take your things with you. • Don’t leave notes on your door saying you aren’t home. • • Use a lock when storing valuables. Housing Tips When looking into rental properties, there are a few very basic safety features you should consider before signing a lease. 1. Doors should be made of metal or solid wood. Good deadbolt locks and peepholes are also a must. 2. Make sure the management changes locks or permits the tenant to change them when moving in. • Report suspicious activity to Campus Security. 3. Sliding glass doors should be secured with pins or a bar type locking device. Lock Up 4. Ground floor apartment windows should be secured with pins latches. • Keep your apartment doors and windows locked even when you’re home. Lock your door when you leave, even if it’s “just for a minute.” • Don’t hide the key to your apartment or loan it out. • Close your curtains or blinds after dark. • Keep car doors locked and windows up, when parked & when you’re driving. 5. Hallways & stairs should be well lit. 6. Bushes and shrubbery should be cut back below window height to reduce the risk of attackers hiding in them. 7. Is there on-site security? 8. Find out if there have been burglaries in the complex. Keep Yourself Safe 9. Ask how extra keys are secured and who has access to them. • 10.Ensure parking areas are well lit at night Make it tough for someone to take you by suprise - don’t wear eadbuds when walking, running, or studying alone. • Head toward crowds, lights, and buildings if you’re being followed. • Don’t walk alone, especially after dark. Stay on well populated, well-lit paths. • Don’t engage an unknown caller in conversation or give away personal details. 11.Installation of a simple alarm system might be a good option for additional security at a relatively low expense. Keep in mind looks can be deceiving. Just because a complex is new does not mean it is safe. Look closely at the apartments you are considering. If they don’t have the majority of the safety features listed above you should probably keep looking. When it comes to your safety you should not compromise. 07 Kirkwood Community College | Campus Security STUDENT CONDUCT CODE Kirkwood Community College is an academic community built on the principles of mutual respect, integrity, and honesty. The College strives to provide a community wherein individuals have the right to express their opinions and ideas, to assemble peacefully, and to associate freely in a manner that does not interfere with the rights of others and is in the confines of intellectual honesty. In order to thrive as an educational institution, the college has adopted this Student Conduct Code (“Student Code”) to promote and preserve its educational mission for the benefit of all who are invited to be a part of the community. It is in the best interest of the College and all those who are students or who may desire to become students at the College that the disciplinary procedure be defined. This document prescribes procedures to be followed in disciplinary cases in order that cases may be handled in a timely manner while serving the interests of the college community and safeguarding the rights of all students. Administrative responsibility for the establishment and enforcement of policies governing non-academic student conduct and disciplinary action has been delegated by the Kirkwood Community College President to the Vice President for Student Services. The Vice President has, in turn, delegated considerable authority for the establishment of rules and handling of violations to the Dean of Students and other bodies as designated in this policy. All Iowa state laws and local statutes regarding the use, purchase, possession, distribution, or dispensation of alcohol must be observed. Food and nonalcoholic beverages must also be made available at events in which alcoholic beverages are served. Alcohol is prohibited at any event in which the majority of participants are under the age of 21; where alcoholic beverages are the focal point of the event, or which contributes to alcohol overindulgence or abuse. Drug Policy The unlawful use, possession, distribution, or dispensation of any narcotic (including prescription medications), dangerous drug or controlled substance is strictly prohibited on campus or at any college-sponsored activity. Sanctions There are substantial penalties for drug and alcohol violations. Individuals are subject to federal, state and local laws, as well as college policies. Both state and federal laws prohibit distribution or manufacture of controlled substances or counterfeit controlled substances. Penalties can result in imprisonment and fines depending on the severity of the crime. State and local ordinances regulate alcohol. Underage possession of alcohol, driving while intoxicated, public intoxication, public consumption, serving underage intoxicated individuals, open containers and large private parties are all affected by these laws. Check with the local police department for more information. The college may also impose sanctions against students and employees who violate this policy. The procedures for administering sanctions are described below under, “Procedures.” Procedures Students who violate this policy may be referred for an educational/treatment program and may be subject to disciplinary action in accordance with the policies and procedures outlined in the Student Conduct Code. The Dean of Students or designee will determine if the student is responsible for violating this policy and will impose appropriate sanctions. Sanctions may include warning, probation, suspension, expulsion, and other discretionary sanctions, including educational or treatment programs. Hazards of Drug Use and Available Services Illicit drug use may result in: - physical or psychological dependency; - a craving or inability to stop using drugs; - adverse effects on body systems; - injury due to motor vehicle crashes, assaults or other unintended acts; - disruption of personal relationships and work habits; - ineligibility for some types of employment. Delivery means include, but are not limited to, College 101 classes, inservice training, online training, guest speakers, intranet, and other programs. These programs are coordinated thru the Dean of Students office, Human Resources, and Campus Security. Campus Security also offers education and information programs to Kirkwood students, faculty, and staff upon request, often provided through a partnership with local law enforcement agencies such as the Cedar Rapids Police Department. Information is also available through Student Life and Campus Health. Kirkwood is making a good faith effort to comply with the requirements of the Violence Against Women Act (VAWA), and is in the process of revising and expanding educational programs/training in this area for students, faculty, and staff. Preservation of Evidence It is important that a victim of sexual assault not bathe, douche, smoke, change clothing, or clean the bed/linen/area where they were assaulted if the offense occurred within the past 96 hours so evidence may be preserved that may assist in proving the alleged criminal offense occurred/is occurring or may be helpful in obtaining a protection order. If victims do not opt for forensic evidence collection, health care providers can still treat injuries and take steps to address concerns of pregnancy or sexually transmitted disease. Victims of sexual assault, domestic violence, stalking, and dating violence are encouraged to also preserve evidence by saving text messages, instant messages, social networking pages, other communications, and to keep pictures, logs, or other copies of documents, that may useful to the Kirkwood hearing board, investigators, or police. Campus Sexual Assault Victim Bill of Rights You have the right to: •Reasonable changes to academic and living conditions •Referrals to counseling assistance & in notifying law enforcement •Same opportunity as accused to have others present at disciplinary hearing •Notified of outcome of hearing, sanctions and terms of sanctions in place •Speak (or choose not to speak) to anyone regarding the outcome •Name and identifying information kept confidential (FERPA) Bystander Intervention Bystanders play a critical role in the prevention of sexual and relationship violence. They are not directly involved but can choose to do something - to intervene or to speak up. Kirkwood wants to promote a culture of accountability where bystanders are actively engaged in the prevention of violence without causing further harm. We may not always know what to do even if we want to help. Below is a list (1) of some ways to be an active bystander. If you or someone else is in immediate danger, dial 911.This could be when a person is yelling at or being physically abusive towards another and it is not safe for you to interrupt. 1. Watch out for your friends and fellow students/employees. If you see someone who looks like they could be in trouble or need help, ask if they are ok. 2. Confront people who seclude, hit on, try to make out with, or have sex with people who are incapacitated. 3. Speak up when someone discusses plans to take sexual advantage of another person. 4. Believe someone who discloses sexual assault, abusive behavior, or experience with stalking. 5. Refer people to on or off campus resources listed in this document for support in health, counseling, or with legal assistance. 6. Indirect intervention works as well. Get creative – spill a drink, strike up a conversation or ask if one or both parties wants to get some food, and/or involve friends in a solution that fits the situation. ________________________________________________________________________________________________________________________ 1 Bystander intervention strategies adapted from Stanford University’s Office of Sexual Assault & Relationship Abuse 11 Kirkwood Community College | Campus Security SEXUAL MISCONDUCT Kirkwood Community College prohibits sexual misconduct in any form, including sexual assault, sexual harassment, and other forms of nonconsensual sexual conduct, all of which can be forms of sexual discrimination. The College will respond promptly and equitably to all reports of sexual misconduct, and will take appropriate action to prevent sexual misconduct through education of students, faculty, and staff. The College will adhere to all federal, state, and local requirements for prevention, intervention, and crime reporting related to sexual misconduct. Kirkwood Community College is committed to creating and maintaining a community where students who participate in College programs and activities can work and learn together in an atmosphere free from sexual misconduct. The Policy is designed to assist victims in easily recognizing the different forms of sexual misconduct and how to comfortably seek assistance. It also informs all students of their expectations under the Policy. The Policy This Policy prohibits sexual misconduct in any form, including sexual assault, sexual harassment, sexual exploitation, stalking, domestic violence, dating violence, and retaliation, all as defined in Section II. The College will respond to reports of sexual misconduct in accordance with This Policy. Reporting to Law Enforcement Because sexual misconduct may constitute both a violation of college policy and criminal activity, the college strongly encourages, but does not require, students to report concerns of sexual misconduct to law enforcement as soon as possible after the incident. A student may proceed under this Policy whether or not he or she elects to report to law enforcement as well. 1. For emergencies, contact 9-1-1. 2. D. Amnesty for Complainants and Participants in Investigations Time Frames for Reporting and Response VI. Process for Responding to Reports of Sexual Misconduct A. Initial Steps 1. Initial Meeting with the Complainant Upon receipt of any report of sexual misconduct, the Dean of Students or designee will first schedule a meeting with the reporter (referred to as “Complainant” for ease of reference, although a report does not necessarily have to result in a formal complaint) in order to provide the Complainant a general understanding of this Policy and to identify forms of support or immediate interventions available to the Complainant. The intake meeting may also involve a discussion of any accommodations that may be appropriate concerning the Complainant’s academic, employment, or housing arrangements. At the initial intake meeting with the Complainant, the Dean or designee will seek to determine how the Complainant wishes to proceed. The Complainant may opt for: (1) formal resolution (see section B, below); (2) informal resolution (see section C, below); or (3) not proceeding. If the Complainant would like assistance throughout any College investigation or adjudication process, the Dean of Students Office will make a student services staff member available to the Complainant. This staff member is not an “advocate” as that term is used below (see Article VII, A, Confidential Advocacy and Support), nor is that staff person a representative who will speak on behalf of the Complainant in any investigatory or adjudication process. Rather, the staff member serves as a point of contact to answer questions and explain processes, to make sure the Complainant’s expressed needs are being addressed, and to join the Complainant in meetings if requested. (The Dean also will provide the same resource to students accused of sexual misconduct.) 2. Notification of the Title IX Coordinator The Dean of Students or designee will notify the Title IX Coordinator and the deputy Title IX coordinator(s) of the report (even if the report does not proceed). This is to keep the Title IX Coordinator apprised of any potential patterns of misconduct and/or the need for further training or other prevention measures. B. Formal Resolution A Complainant may elect to pursue a formal resolution, which involves a hearing before the Sexual Misconduct Board. Such a hearing is also referred to as “formal resolution,” and is described more specifically in this section. 1. Investigation When the Complainant indicates a desire to pursue formal resolution, the Dean of Students will meet with the Complainant and prepare a written complaint. The Dean will consult with the Title IX coordi- nator and the deputy Title IX coordinators in appointing a person(s) to serve as investigator(s) of the com- plaint. The investigator(s) may be a College administrator or someone retained by the College, such as an attorney, mental health professional, or another person trained to conduct investigations of sexual miscon- duct. The investigators serve as neutral fact-finders, who during the course of the investigation, typically conduct interviews with the Complainant, the accused student(s) and each third-party witness; visit and take photographs at each relevant site; and where applicable, coordinate with law enforcement agencies to collect and preserve relevant evidence. 13 Kirkwood Community College | Campus Security 2. Investigative Report After conducting the investigation, the investigator(s) will complete an investigative report that includes, among other things: • Summaries of interviews with the complainant, the accused student and each third-party witness; photographs of relevant sites and related logs; electronic and forensic evidence; and a detailed written analysis of the events in question. • A recommendation on whether or not there should be a hearing, based on factors including whether there is a substantial dispute in the facts, the availability of witnesses and evidence, etc. The Title IX coordinator will make the ultimate decision on whether a hearing will be held. The investigative report will be distributed, concurrently, to both of the parties and to the Dean of Students and Title IX Coordinator. If a hearing is held, the Sexual Misconduct Board will also be provided with a copy of the report. 3. Determining Whether to Hold a Hearing If the Title IX Coordinator decides, upon consideration of the investigator’s recommendation, to hold a hearing, notice of that determination will be delivered, concurrently, to the Dean, the Complainant, and the accused student(s). A student whose request for a hearing is denied by the Title IX Coordinator may appeal that decision to the President or designee, whose decision will be final. 4. Complainant Changes Election to Informal Resolution or Accused Student Elects to Accept Responsibility. After reviewing the investigative report, the Complainant may decide to elect Informal Resolution instead of formal resolution, by making such a request to the Dean of Students prior to the hearing date. At any point prior to the hearing, the accused student may elect to admit responsibility for the alleged sexual misconduct. In such cases, the Dean of Students or designee will propose a resolution to the complaint and a sanction. If both the Complainant and the accused student agree to the proposed sanction, the complaint is resolved without a hearing and without any further rights of appeal by either party. If either the complain ant or the accused student objects to the proposed sanction, a hearing before the Board will be convened for the sole purpose of determining a sanction, and in these cases, the decision of the Board may be appealed pursuant to paragraph 13, “Appeals,” below. For purposes of this sanction hearing, all of the other provisions of this Policy relating to the imposition of a sanction for Sexual Misconduct will apply. 5. Advisors The Complainant and the Accused Student may have an advisor present to assist them during the pre hearing, hearing, and appeal stages of the complaint process. The advisor may be an attorney chosen at the student’s expense. However, advisors are not permitted to speak or to participate directly in the process, including at any hearing before a Sexual Misconduct Board. Students should select as an advisor a person whose schedule allows attendance at the scheduled date and time for the hearing because delays will not normally be allowed due to the scheduling conflicts of an advisor. 6. Notice of Hearing and Pre-Hearing Meetings. If a hearing is scheduled, the Dean of Students will provide written notice to both parties pursuant to Article IV. A. 4 of the Student Conduct Code. In addition, the Dean of Students or designee will schedule separate meetings with the Complainant and the accused student to review the hearing procedures and the complaint of sexual misconduct. 7. Hearing Procedures Unless otherwise stated in this Policy, the pre-hearing and hearing procedures will follow the rules and procedures described in Article IV, of the Student Conduct Code. 14 Kirkwood Community College | Campus Security 8. Conduct of the Hearing Formal rules of process, procedure, and/or technical rules of evidence, such as are applied in criminal or civil court, are not used in these proceedings. During the hearing, the parties will be expected not to repeat undisputed details or non-material circumstances that would merely duplicate information con tained in the investigative report or in other written materials. Only the Board Chair and Board members may question the parties and other witnesses directly. The parties may pose written questions to the Chair to be asked of the other party or other witnesses consistent with Article IV, A, 10, i, of the Student Con duct Code. All procedural questions, including the decision to accept evidence and/or statements, will be made by the Chair, in his or her sole discretion. • In cases of sexual assault, measures may be taken to avoid contact during the hearing between the complainant and the alleged perpetrator (e.g., videoconferencing). 9. Standard of Proof The determination of whether or not a violation of this Policy occurred will be made on the basis of whether it is more likely than not that the accused student violated this Policy. This standard is more formally referred to as the “preponderance of evidence” standard. In making its deter- mination, the Board will carefully consider all of the evidence presented and follow the proce- dures stated in this Policy and the applicable sections of the Student Conduct Code in order to ensure as fair a hearing as possible for all parties. 10. Sanction The Board is required to consider the suspension or expulsion (permanent suspension) of any student found responsible for sexual assault; however, the Board may impose any sanction that it finds to be fair and proportionate to the violation and in accordance with Article IV, B, of the Student Conduct Code. Immediate Actions (Interim Measures) The Dean of Students Office and Campus Security may take immediate interim actions to protect the safety of the college community, to enable students with complaints and witnesses to continue studies, and to ensure the integrity of an investigation. These actions may include interim suspension of the accused student or no-contact notices between the individuals involved. The Dean of Students Office and Campus Security may also take additional actions, as appropriate, including but not limited to: • Modifying class or work schedules, or housing arrangements • Addressing other academic concerns (e.g., absences, assignments, grades, leaves of absence, withdrawal) •Safety planning •Education/training 15 Kirkwood Community College | Campus Security VII. Resources and Services for Students There are campus and community services available to students regardless of whether or not a student chooses to report a violation of this Policy to the College or local law enforcement. The College strongly encourages students to seek assistance to care for themselves emotionally and physically through confidential crisis intervention, health care, and counseling. As students tend to their health, they should keep in mind that medical examinations are time-sensitive, and are critical in preserving evidence of sexual assault so that options can be considered at a later time. Reporting Requirements The College can take action only if the College is made aware of the behavior. Therefore, if a College employee becomes aware of a complaint or other violation of this Policy, the employee must bring the information to the Title IX Coordinator or a Deputy Title IX Coordinator so that concerns are heard and services can be offered to the affected students. IX. Prevention, Training, and Policy Communication The College is committed to education, communication and training in order to prevent sexual misconduct and to assure an appropriate response when incidents occur. The College will provide information on the following to students, faculty and staff: • Preventing sexual misconduct • Procedures for responding to incidents of sexual misconduct • Resources available to students in cases of sexual misconduct • Pertinent contents of relevant policy and law The College will maintain the above information on a website and will provide information about this Policy to all new students through orientation and to all registered students annually. This Policy is also available for distribution in printed form from the Dean of Students Office, Campus Security, and Human Resources and other College personnel involved in prevention and/or response activities. The College will provide training on the above information to all College personnel involved in providing any part of the college’s response to reports of alleged sexual misconduct. All Sexual Misconduct Board members will receive annual training in their responsibilities. This training may include expertise drawn from campus and community resources, profes- sional organizations, and other experts on the topic of sexual misconduct. 18 Kirkwood Community College | Campus Security DEFINITIONS Aggravated assault An unlawful attack by one person upon another for the purpose of inflicting severe or aggravated bodily injury. This type of assault usually is accompanied by the use of a weapon or by means likely to produce death or great bodily harm. Arrest Persons processed by arrest, citation or summons. Burglary The unlawful entry of a structure to commit a felony or a theft. Dating Violence Violence committed by a person who is or has been in a social relationship of a romantic or intimate nature with the victim. The existence of such a relationship shall be determined based on a consideration of: a. The length of the relationship. b. The type of relationship. c. The frequency of interaction between the persons involved in the relationship. Destruction/Damage/Vandalism of Property To willfully or maliciously destroy, damage, deface, or otherwise injure real or personal property without the consent of the owner or the person having custody or control of it. Domestic Violence: An assault, under any of the following circumstances: a. The assault is between family or household members, who resided together at the time of the assault; b. The assault is between separated spouses or persons divorced from each other and not residing together at the time of the assault. c. The assault is between persons who are parents of the same minor child, regardless of whether they have been married or have lived together at any time. d. The assault is between persons who have been family or household members residing together within the past year and are not residing together at the time of the assault. Drug abuse violations The violation of laws prohibiting the production, distribution and/or use of certain controlled substances and the equipment or devices utilized in their preparation and/or use. The unlawful cultivation, manufacture, distribution, sale, purchase, use, possession, transportation or importation of any controlled drug or narcotic substance. Arrests for violations of state and local laws, specifically those relating to the unlawful possession, sale, use, growing, manufacturing and making of narcotic drugs. Hate Crime A crime that manifests evidence that the victim was intentionally selected because of the perpetrator’s bias. The applicable categories of bias are: race, gender, religion, sexual orientation, ethnicity/national origin and disability. Intimidation To unlawfully place another person in reasonable fear of bodily harm through the use of threatening words and/ or other conduct, but without displaying a weapon or subjecting the victim to actual physical attack. Larceny-Theft The unlawful taking, carrying, leading, or riding away of property from the possession or constructive possession of another. Liquor law violations The violation of state or local laws or ordinances prohibiting the manufacture, sale, purchase, transportation, possession, or use of alcoholic beverages, not including driving under the influence and drunkenness. Motor vehicle theft The theft or attempted theft of a motor vehicle. Murder/Non-negligent manslaughter The willful (non-negligent) killing of one human being by another. Negligent manslaughter The killing of another person through gross negligence. Property damage The estimated value of the loss of the structure and contents, in terms of the cost of replacement in like kind and quantity. Referred for disciplinary action The referral of any person to any official who initiates a disciplinary action of which a record is kept and which may result in the imposition of a sanction. . 19 Kirkwood Community College | Campus Security DEFINITIONS (continued) Property Damage The estimated value of the loss of the structure and contents, in terms of the cost of replacement in like kind and quantity Robbery The taking of or attempting to take anything of value from the care, custody, or control of a person or persons by force or threat of force or violence and/or by putting the victim in fear. Sex offenses - forcible Any sexual act directed against another person, forcibly and/ or against that person’s will; or not forcibly or against the person’s will where the victim is incapable of giving consent. A. Rape - The carnal knowledge of a person, forcibly and/ or against that person’s will; or not forcibly or against the person’s will where the victim is incapable of giving consent because of his/her temporary or permanent mental or physical incapacity (or because of his/her youth). B. Fondling - The touching of the private body parts of another person for the purpose of sexual gratification, forcibly and/or against that person’s will; or, not forcibly or against the person’s will where the victim is incapable of giving consent because of his/her youth or because of his/her temporary or permanent mental incapacity. Sex offenses - non-forcible Unlawful, non-forcible sexual intercourse. A. Incest - Non-forcible sexual intercourse between persons who are related to each other within the degrees wherein marriage is prohibited by law. B. Statutory Rape - Non-forcible sexual intercourse with a person who is under the statutory age of consent. Simple Assault An unlawful physical attack by one person upon another where neither the offender displays a weapon, nor the victim suffers obvious severe or aggravated bodily injury involving apparent broken bones, loss of teeth, possible internal injury, severe laceration, or loss of consciousness. 20 Stalking a. Purposefully engaging in a course of conduct directed at a specific person (“target”) that would cause a reasonable person to fear bodily injury to, or the death of, the target or a member of the target’s immediate family; b. When the person (“stalker”) knows or should know that the target will be placed in reasonable fear of bodily injury to, or the death of, the target or a member of the target’s immediate family by the course of conduct; and c.The stalker’s course of conduct induces fear in the target of bodily injury to, or the death of, the target or a member of the target’s immediate family. Unfounded A reported crime investigated by law enforcement authorities and found to be false or baseless. Only sworn or commissioned law enforcment may unfound a crime. Weapons: carrying, possessing, etc. The violation of laws or ordinances prohibiting the manufacture, sale, purchase, transportation, possession, concealment, or use of firearms, cutting instruments, explosives, incendiary devices or other deadly weapons. This classification encompasses weapons offenses that are regulatory in nature.
